  12. ## 1. Acceptance of these terms

  14. By adding catbot7 to a Discord server, or by using any of its commands or features, you agree to these Terms of Use ("Terms") and to our [Privacy Policy](./PRIVACY_POLICY.md). If you do not agree, do not use the Bot.

  16. These Terms are between you and sneezeparty, the operator of catbot7. catbot7 is an independent project and is **not** affiliated with, endorsed by, or sponsored by Discord Inc.

  18. Your use of the Bot is also subject to the [Discord Terms of Service](https://discord.com/terms) and [Discord Community Guidelines](https://discord.com/guidelines). If anything in these Terms conflicts with Discord's terms, Discord's terms control your use of the Discord platform.

  20. ## 2. Eligibility and age requirements

  22. You must be at least **13 years old** (or the minimum age required to use Discord in your country, if higher) to use the Bot. By using the Bot you represent that you meet this requirement. If we learn that someone under the minimum age is using the Bot, we may remove their data and block their access. See the Privacy Policy for more on children's data.

  24. ## 3. The service

  26. catbot7 is a game bot for Discord. Players catch cats that appear in configured channels and build collections that are tracked **per server**. The Bot includes game systems such as a battlepass with seasons, achievements, a simulated in-game stock market, casino-style minigames, jobs/heists, an in-game currency ("coins"), packs, prisms, and optional purchasable cosmetic and supporter perks.

  28. The Bot is provided for entertainment only. Features, balance, drop rates, prices, seasons, and any other aspect of the game may be added, changed, reset, or removed at any time without notice.

  30. ## 4. Server administrators
  31.  
  32. If you add the Bot to a server or configure it (for example by setting up spawn channels or changing settings), you represent that you have authority to do so for that server. Server settings, channel configuration, and game activity affect everyone in that server. You are responsible for how the Bot is used in servers you administer, including informing your members that the Bot is in use.

  34. ## 5. Acceptable use

  36. You agree not to:

  38. - Use bots, scripts, macros, automation, or any third-party tool to interact with the Bot or to gain an unfair advantage (auto-catching, multi-accounting to farm rewards, etc.).
  39. - Exploit bugs, glitches, or unintended behavior instead of reporting them. We may reverse gains and remove items or currency obtained this way.
  40. - Attempt to disrupt, overload, attack, reverse-engineer the hosted service, or gain unauthorized access to the Bot, its database, its admin interface, or its infrastructure.
  41. - Harass other users, or use the Bot to transmit unlawful, infringing, or abusive content (for example through custom profile text, images, or other user-supplied fields).
  42. - Resell, trade for real money, or otherwise commercialize in-game items, currency, accounts, or access, except through the official purchase methods described in Section 7.
  43. - Use the Bot in violation of any applicable law or of Discord's terms.

  45. We may suspend or terminate your access, reset progress, or remove data for any violation of these Terms, at our discretion.

  47. ## 6. Virtual items and currency
  48.  
  49. The Bot includes virtual goods, including in-game currency ("coins"), cats, packs, prisms, cosmetics, battlepass levels, and similar items (collectively, "Virtual Items").

  51. - **No real-world value.** Virtual Items have no monetary value, are not your property, and are not redeemable for real money or anything of value outside the Bot. You receive a limited, personal, non-transferable, revocable license to use Virtual Items within the game.
  52. - **No ownership.** We retain all rights to Virtual Items. We may modify, manage, remove, reset, or eliminate Virtual Items at any time, including during seasonal resets, balance changes, or anti-abuse actions, without any obligation to compensate you.
  53. - **Season resets.** Certain progress (such as coins, battlepass, and other season-scoped systems) is wiped at the start of each season by design. Other progress (such as caught cats and certain cosmetics) persists. The specifics may change over time.
  54. - **In-game gambling.** Casino-style minigames use only Virtual Items with no real-world value. They are not gambling for money and offer no opportunity to win real-world money or prizes.

  56. ## 7. Purchases and payments
  57.  
  58. Optional purchases (for example "supporter" status or cosmetic items) are sold and processed **through Discord's monetization system** within the Discord client. This means:

  60. - **Discord handles payment.** All checkout, billing, and payment processing is performed by Discord and its payment processors. We do **not** collect or have access to your payment card number, billing address, or other payment details. Your purchase is also governed by Discord's [Terms of Service](https://discord.com/terms) and Discord's [Premium / Purchases policies](https://support.discord.com/).
  61. - **Delivery.** When Discord notifies the Bot that you hold a purchase ("entitlement"), the Bot grants the associated supporter status or cosmetic. Entitlement state is reconciled with Discord, including after downtime, so a purchase made while the Bot is offline still applies.
  62. - **Nature of the purchase.** A purchase grants a license to use Virtual Items or features as described in Section 6. It is not a purchase of property and confers no ownership.
  63. - **Refunds.** Refunds are handled according to Discord's purchase and refund policies, since Discord is the seller of record for the transaction. We do not separately process payments and generally cannot independently issue refunds for Discord-processed purchases. [OPTIONAL: state your own goodwill stance here, e.g. "We will assist with refund requests where reasonable, but cannot guarantee a refund."]
  64. - **Changes and discontinuation.** Prices, availability, and the contents of any purchasable item may change. We may discontinue purchases entirely, including by disabling the store. Discontinuing future sales does not entitle you to a refund for past purchases.

  66. ## 8. User-provided content

  68. Some features let you provide content, such as custom profile text, an emoji, a color, or a custom image URL. You are solely responsible for content you provide and represent that you have the right to use it and that it does not violate these Terms, Discord's terms, or any law or third-party right. We may remove or refuse to display any user-provided content at our discretion, and we may revoke the ability to set custom content for users who abuse it.

  70. ## 9. Open-source license

  72. catbot7 is based on Cat Bot and is distributed under the **GNU Affero General Public License v3.0 (AGPL-3.0)**, except for the `catpg.py` component, which is licensed under the MIT License. The source code is available at https://github.com/sneezeparty/. The upstream project is [milenakos/cat-bot](https://github.com/milenakos/cat-bot).

  74. These Terms of Use govern your use of the hosted instance of the Bot that we operate. They do **not** alter your rights under the AGPL-3.0 with respect to the software's source code. In case of any conflict between these Terms and the AGPL-3.0 as applied to the source code, the AGPL-3.0 controls for the source code itself.

  76. ## 10. Service availability and changes

  78. The Bot is provided on an "as available" basis. We do not guarantee uptime, availability, data retention, or that the Bot will be free of errors or interruptions. We may modify, suspend, reset, or discontinue the Bot or any feature, in whole or in part, at any time and without liability.

  80. ## 11. Disclaimer of warranties

THE BOT AND ALL VIRTUAL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA OR PROGRESS WILL BE PRESERVED.

  84. This disclaimer is consistent with the warranty disclaimer in the AGPL-3.0 under which the underlying software is licensed.

  86. ## 12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, sneezeparty AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, VIRTUAL ITEMS, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE BOT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  90. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE BOT WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR PURCHASES THROUGH THE BOT IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $20.

  92. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

  94. ## 13. Indemnification

  96. You agree to indemnify and hold harmless sneezeparty and its contributors from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Bot, your user-provided content, or your violation of these Terms or of any law or third-party right.

  98. ## 14. Termination

  100. You may stop using the Bot at any time, and a server administrator may remove the Bot from a server at any time. We may suspend or terminate your access to the Bot at any time, with or without notice, including for violations of these Terms. Sections that by their nature should survive termination (including Sections 6, 11, 12, 13, and 15) will survive.

  102. ## 15. Governing law and disputes

  104. These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that the courts located in the State of California, United States will have jurisdiction over any dispute arising out of these Terms, subject to any mandatory consumer-protection rights you have in your place of residence.

  106. ## 16. Changes to these Terms

  108. We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where practical, announce material changes (for example in the support server). Your continued use of the Bot after changes take effect constitutes acceptance of the updated Terms.
