  85. of which sometimes happens when

  87. prosecutors have a full caseload

  89. she wasn't aware of for instance that

  91. the FBI was the group that started this
  92. 1:56
  93. whole process and this happens a lot

  95. with prosecutors who don't necessarily

  97. put their case

  99. aren't able to know all the facts of all

  101. the things that occur but I clearly

  103. pointed out that officer Comstock

  105. received a call or it made a phone call

  107. at 1:45 a.m. back to Special Agent Chris

  109. Whitaker in South Carolina
  110. 2:18
  111. he's the JTTF expert I believe in South
  112. 2:21
  113. Carolina this is directly related to the
  114. 2:23
  115. port situation now I don't know when his
  116. 2:25
  117. initial phone call was but the state
  118. 2:28
  119. admitted that there was several calls
  120. 2:30
  121. out to the barbecue place that I went to
  122. 2:32
  123. earlier in the evening where I was with
  124. 2:34
  125. the first contact I was meeting with he
  126. 2:35
  127. was also a police officer next police
  128. 2:37
  129. officer so I the state was not aware
  130. 2:40
  131. that I was in Zanesville to do this
  132. 2:43
  133. reporting that we find so important
  134. 2:45
  135. about our national security the state
  136. 2:47
  137. wasn't aware that the two people that I
  138. 2:48
  139. was meeting the person at the beginning
  140. 2:50
  141. of the night where I was initially
  142. 2:51
  143. pinged
  144. 2:52
  145. where the FBI was paying me and
  146. 2:53
  147. following me and putting out suspicious
  148. 2:55
  149. activity reports they had not realized
  150. 2:58
  151. that I was meeting them I came here to
  152. 3:01
  153. Zanesville to meet them to get that
  154. 3:02
  155. information to provide to national
  156. 3:04
  157. security to homeland security they were
  158. 3:06
  159. not aware that at the second meeting
  160. 3:08
  161. that I was having that night waiting for
  162. 3:10
  163. that person to meet me was also related
  164. 3:13
  165. to national security so those are two
  166. 3:14
  167. key things that the state wasn't
  168. 3:16
  169. apprised of before the meeting I believe
  170. 3:18
  171. at that point that changed the tenor of
  172. 3:20
  173. the meeting I think this is and I can
  174. 3:23
  175. understand what the caseloads and so
  176. 3:25
  177. forth not being able to know all the
  178. 3:26
  179. facts of all the cases I felt that the
  180. 3:29
  181. Emily tar bear was
  182. 3:32

  185. trial i that's the feeling I got she

  187. said she was gonna check with the other
  188. 3:38
  189. officers to get the facts of the case

  195. causes that come later in the evening so

  197. we didn't get an I I mentioned we didn't

  199. get the discovery we asked for we asked

  201. for the discovery of the phone calls

  203. between Special Agent Chris Whitaker in
  204. 3:54
  205. South Carolina and also between mr.
  206. 3:57
  207. Comstock here was the duty officer at
  208. 3:58
  209. that night we didn't get that we didn't
  210. 4:01
  211. provide that I asked about the body
  212. 4:03
  213. cameras there is no body cameras in the
  214. 4:05
  215. city of Zanesville so I would suggest at
  216. 4:07
  217. this point maybe that would be a good
  218. 4:08
  219. idea just for every for justice in bulk
  220. 4:11
  221. for both sides George what agencies

  223. Whitaker is special agent of well it

  225. says here FBI agent and mr. Comstock

  227. testimony but didn't we see a letter

  229. separate or some documentation that

  235. I think frequently in Department of

  237. Homeland Security services they people

  239. move back and forth between these

  241. agencies on task forces the whole idea

  243. of the general terrorism task force is

  245. that exactly that to create a cross

  247. fertilisation amongst all the agencies

  249. to provide the best security they can to

  251. the people United States we certainly

  253. want to encourage that what we don't

  255. want to encourage is starting to
  256. 4:47
  257. single out people who have the best
  258. 4:50
  259. interests of the country in in mind and
  260. 4:52
  261. then turn the tables on them and then
  262. 4:55
  263. attack them that is what we want does

  265. that create a loophole for just that to
  266. 4:59
  267. happen by having this sort of if you had

  269. a loophole let's say you had a

  271. diplomatic loophole which we do in this

  273. country and it's a shipping loophole and

  275. anyone with a diplomatic passport can

  277. now start shipping things into this

  279. country without proper search without
  280. 5:12
  281. proper checking without proper testing

  283. so that creates a loophole for bringing

  285. in all sorts of things mainly depleted

  287. uranium weapons which we had done some

  289. exploration in this case but white

  291. phosphorus weapons poisonous gas

  293. anything that could be used in a

  295. terrorist incident and that needs to be

  303. radiation testing to do the testing they

  333. police state where it's sort of a

  335. top-down through regional centers to

  339. top-down capability and this is the next

  341. step is a enemies list

  343. it's a winner's list and an enemies list

  345. and then the enemies people on the

  347. terrorism watch list and I've been boy

  353. the people who are most concerned about

  355. national security shouldn't be the

  357. targets of that watch list we should be

  367. are not a threat as a matter of fact

  391. male subject inside stated so this is

  395. we cleared that up for the prosecution I

  399. saying rush to judgment to quote a mark

  751. the way I want to compliment the FBI on

  753. the famous family secrets case where

  755. they busted the Mafia ring in Cleveland

  761. Teamsters ring a long time ago and so I

  765. institutions at all this is just a
