- The real concern for all of us is that when total school funding is
- reduced, will pupils with special educational needs and disabilities be top
- priority for most Heads? Experiences suggests that they will not be.

- example, can I use an online screening assessment or would I need an expert
- to assess a child as needing additional time? I am thinking in particular
- about children with slower processing speeds. (I have, by the way,
- completed the OU Difficulties with Literacy course so could maybe declare
- myself an expert).
- Any advise would be much appreciated.

- A multi-million pound package ensuring thousands of children with special educational needs and disability (SEND) have the same opportunities as any other child has been announced today (29 January 2016).
- Children and Families Minister Edward Timpson said the ?80 million would help transform the life chances of children across the country and ensure every child, regardless of the challenges they face, can ?dream big? and fulfil their potential.
- As part of its mission to extend opportunity to all, the government has already introduced the biggest reforms to the SEND support system in a generation by placing children and their families at the heart of the system.
- Today?s announcement will increase funding for councils<https://www.gov.uk/government/publications/send-reform-funding-for-local-authorities-2016-to-2017> and support charities who work with some of the most vulnerable young people in the country. Alongside this, the government is continuing transition funding in 2017 to 2018 to help implement the reforms introduced in 2014, building on the progress so far.

- A special school I worked with did appoint a SpLT but although she was
- employed fulltime, in reality she actually worked 4 days in the school and I
- day at the NHS clinic each week to allow her to complete the supervision etc

- A good question Becky. It would be helpful if you share any collated
- responses with members.
- In addition to an individual school appointing an SLT (more common in the
- special school sector, but not unknown in mainstream primary and secondary
- schools), interesting models are emerging where school cluster groups
- employ an SLT.
- Some SLTs decided the writing was on the wall a few years ago, when NHS
- service cuts were particularly deep, and moved into private practice
- (maintaining appropriate registration) and setting up contract directly
- with schools.
- One concern I have come across recently is that NHS providers of SLT have
- decided to withdraw provision because it is being made by 'others' - an
- interesting, if unintended consequences of policy. Of course, the legality
- of such behaviour is questionable to say the least, and a matter to be
- raised with the relevant Clinical Commission Group (CCG) in an area.
- I do wonder if there is a case for re-professionalising SLT with a view to
- training for the education sector. Any thoughts?
- There is an obvious parallel with EPs (education) and clinical
- psychologists (health). It might also be possible to 'do away' with
- confusing legislation (Is SLT provision a health or educational need, or
- both? It may seem clear to some folk, but in practice we simply muddle

- What do people use to assess working memory in Ks1 - 2. Would you agree that working memory is a combination of both phonological memory ( dealing with spoken and written material) combined with Visuo -spatial memory ( memory for visual images).
- Is the phonological memory in the Ctopp combined with the visual assessment in the WRAML sufficient evidence to show poor working memory?

- Very worrying indeed! Any money which had been coming our way has now been withdrawn, you now have to prove you've spent ?6000 on a pupil, before you can apply for any extra funding. This whole process is so ridiculously burdensome that it's not even attempted.
- I don't know what is happening in Education... teachers are now being laid off, therefore others are overburdened and of course the pupils with special needs are at the end of the line. !

- What do people use to assess working memory in Ks1 - 2. Would you agree that working memory is a combination of both phonological memory ( dealing with spoken and written material) combined with Visuo -spatial memory ( memory for visual images).
- Is the phonological memory in the Ctopp combined with the visual assessment in the WRAML sufficient evidence to show poor working memory?

- A special school I worked with did appoint a SpLT but although she was employed fulltime, in reality she actually worked 4 days in the school and I day at the NHS clinic each week to allow her to complete the supervision etc to retain her registration. Carol

- One of the main reasons not to look to NHS is cost and job description. Ours has been with us for three years and it wholly employed by the school.
- The CPD and mentoring needs to be integral and that costs. But is a good investment.

- I've used them in special schools with kids on the autistic spectrum and it helped no end, now I'm looking at using it to help support in mainstream for a year 2 pupil with PD and processing difficulties. who would be your focus for the use of Clicker? just to be nosey! [😉]

- I worked previously in a Special School that employed a SALT full time, she was on NHS contract but the school paid the wages. We also used the same model for OTs too and it helped no end!

- As noted in a posting last week, the DfE is continuing to fund the
- Independent Supporters Programme through 2016 to 2017. The budget for this
- Council for Disabled Children facilitated scheme is ?15 million.
- The SEND Code of Practice (2.20) provides the following remit for programme:
- Families may receive help from and independent supporter, provided by
- private voluntary and community sector organisations, who is independent of
- the local authority. Independent supporters will be recruited locally and
- receive accredited training, inclusing legal training, to help any family
- going through an EHC needs assessment and the process of developing an EHC
- plan.Local authorities should work with organisations that are providing
- independent supporters to ensure there are arrangements agreed locally to
- offer help form an independent supporter to as many families as possible
- who require it.
- Does anyone have experience of working with independent supporters?
- The programme is being evaluated by the National Development Team for

- Dear all,
- I have had a letter from a parent of a child in Year 10 who has had a
- meeting with an independent supporter. The support worker has recommended
- that I write a letter to help them apply for an EHCP. The child has
- hypermobility and Irlen's.
- I feel uncertain about this as I thought that the school would need to make
- an application and use supporting evidence from external agencies. What
- information would be needed from school?
- The school has made reasonable adjustments for access arrangements and have
- recent standardised scores.

- A friend of mine has just "won" a permanent placement for her son at a very expensive permanent boarding school for a child who has been treated by Great Ormond Street for the last ten years.
- It has actually cost the family a great deal of money to provide independent assessments for almost every aspect of his life going to appeal.
- However, the judge ruled at the tribunal that cost should never be a factor when deciding what is the right provision for a child. There is a sentence in this child's statement that refers to this (and I suspect is in every child's statement in this authority) which is now apparently illegal with the new legislation.
- One of the local authorities defences was that funding what was considered to be needed by all the independent practitioners consulted was that this was an inappropriate use of public funding and was extravagant provision.
- I think that our children need to be protected from this approach and I would be advising any person with a child with very real problems that need specific interventions to start now collecting evidence of their needs - from everywhere.
- A school already trying to justify their approach by using the terms "?best endeavours?, and ?where possible?" is more or less saying - this will not happen because we can't afford it. That argument at this tribunal was not permitted because it is putting money before the demonstrated needs of the child.
- I would be telling them not to accept this - and to be collecting evidence from all areas of their child's life - and I would want it documented about what exactly was the provision already made in the past - how it worked - and what was planned for the future.
- I wonder just how well the new legislation is really understood by all involved in its implementation.
- And when things do not go well go straight for independent advice from a solicitor specialising in educational matters.

What was really dreadful was having to find independent medical advice for the authority who refused to accept Great Ormond Streets reports without them being verified by an independent person! And think in terms of around ?1000 per report too - get the best!

- Special Needs Tribunals now have a new Head. A Judge who used to be the head of IPSEA. She has a profoundly handicapped child. Would that more people involved in SEN provision knew exactly what it was like to have a child with special needs!

- We went to a tribunal with my grandson - about 10 years ago.
- He had very ordinary "dyslexic" problems. He is a clever boy but can't prove it on paper without additional help of some kind - reader scribe extra time etc.
- We represented ourselves - no outsiders apart from an outside EP report which the school choose to ignore and said we thought our "goose was a swan"!
- County had a barrister - called the school's senco and advisory staff.
- Unfortunately for them they did not know their stuff.
- We won - but school were given time to prove that they could actually do the right things if they wanted to - or we should go back if we were unhappy aboput provision or progress.
- We did not go back. The upper school were great.
- It pays to fight.

- Ruth - tribunals ask really pertinent question and want proper answers. We took my grandson. He had half an hour alone with the three members of the tribunal with his mother away in the background. He was well able to talk through his problems at the age of 9/10 He was his own best witness.

- I'm following this with interest as am just supporting a family to go to tribunal. Thank goodness for the advice on IPSEA website! It's shocking what some LEAs are doing to put people off getting their child's needs met, but they are all losing so much funding from the government. When will SEND ever be funded enough?

- If the parent makes a direct application to the council for an EHCP, then the council will get in touch with you for information.
- If you don't think the child needs an EHCP then don't write a letter.

- Raises a few questions
- So there would be those parents who wouldn't notice the cost, those who
- could just about about manage it through sacrifice and those who would never
- be in the league of hiring the best solicitor. Is this advocating a three
- tier appeal system?
- Reasonable adjustment has to be the key. If a local school, with support
- from the LEA can meet 90% of a child's needs for another 6k (say) isn't this
- reasonable adjusment (and prudent use of OUR money - we are the ones who
- pay, after all). Can it be reasonable to expect US to pay 40, 50, 60k to have
- 95% of their needs met elsewhere?
- I'm not being an advocate of the LEAs who can make things very difficult,
- but they have less and less of our money to spend on increasing expensive
- out-of-county placements. For the most extreme cases 250k plus per year is
- not unusual.
- And where does inclusion sit with this current discussion?
- In answer to your question, Mary, Stick to what you know, have the
- information to support this, don't let the 'other side' wind you up, answer the
- questions, be honest if you don't know. And take a cushion. They can be such
- long, drawn out, bum numbing experiences.

- not permitted because it is putting money before the demonstrated needs of
- the child.
- I would be telling them not to accept this - and to be collecting evidence
- from all areas of their child's life - and I would want it documented
- about what exactly was the provision already made in the past - how it worked -
- and what was planned for the future.
- I wonder just how well the new legislation is really understood by all
- involved in its implementation.
- And when things do not go well go straight for independent advice from a
- solicitor specialising in educational matters.

- It has cost this family something like ?30,000 to go to appeal - and they
- used the best. What was really dreadful was having to find independent
- medical advice for the authority who refused to accept Great Ormond Streets
- reports without them being verified by an independent person! And think in
- terms of around ?1000 per report too - get the best!
- And as always - it comes down to money!
- Special Needs Tribunals now have a new Head. A Judge who used to be the
- head of IPSEA. She has a profoundly handicapped child. Would that more
- people involved in SEN provision knew exactly what it was like to have a child
- with special needs!

- I?m to be called as a witness for a Tribunal hearing. The child is a Year6
- boy with dyspraxia, hypermobility and numeracy difficulties. There really
- isn?t any dispute about his needs, nor about whether we are meeting them at
- his (independent) primary school. Parents want an EHC plan to ensure that
- his needs are fully met when he goes on to (state) secondary school. The LA
- are saying that his needs will be met by the School, whereas the School is
- saying things like ?best endeavours?, and ?where possible?. Parents feel
- that their child was sinking once before in his previous primary school
- and they are very much afraid that, without the EHC Plan, this will happen
- again.
- Does anyone have any advice at all to offer in this situation, either
- about tactics or the likelihood of success or the tribunal process itself?
- Parents are trying to make contact with IPSEA, and the LA has employed
- lawyers.
