  6. Section 1: Purpose and Scope
  7.  
  8. (a) The Creek Orleans Firearm Safety and Regulation Act of 2014 is enacted to promote public safety, reduce gun violence, and ensure the well-being of the residents and visitors of Creek Orleans.
  9.  
  10. (b) This act aims to establish comprehensive regulations governing the possession, sale, and use of firearms within the jurisdiction of Creek Orleans.

  12. Section 2: Definitions
  13.  
  14. (a) "Firearm" shall refer to any portable weapon that expels projectiles through an explosive or other form of combustion.
  15.  
  16. (b) "City" shall refer to Creek Orleans, Louisiana.
  17.  
  18. (c) "Resident" shall refer to an individual who maintains a primary residence within the boundaries of Creek Orleans.
  19.  
  20. (d) "Assault Weapon" shall refer to any semi-automatic firearm with the capacity to accept detachable magazines and possessing certain features as specified in the Creek Orleans Firearm Prohibited Category List.
  21.  
  22. (e) "High-Capacity Magazine" shall refer to any detachable magazine capable of holding more than a specified number of rounds of ammunition, as outlined in the Creek Orleans Magazine Capacity Restriction List.

  24. (f) "Short-Barreled Rifle" shall refer to a rifle with a barrel length less than a specified minimum length as established in the Creek Orleans Short-Barreled Rifle Prohibition.

  26. (g) "Bump Stock" shall refer to any device, attachment, or accessory designed to increase the rate of fire of a semi-automatic firearm.

  28. (h) "Auto Sears" shall refer to any device, part, or component designed to convert a semi-automatic firearm into a fully automatic firearm.

  30. Section 3: Prohibited Firearm Categories
  31.  
  32. (a) Prohibition of Assault Weapons: The possession, sale, transfer, or distribution of assault weapons, as defined in accordance with the Creek Orleans Firearm Prohibited Category List, is strictly prohibited within the city limits.
  33.  
  34. (b) Restrictions on High-Capacity Magazines: The possession, sale, transfer, or distribution of high-capacity magazines capable of holding more than a specified number of rounds of ammunition is prohibited within the city.
  35.  
  36. (c) Ban on Bump Stocks and Auto Sears: The possession, sale, transfer, or distribution of bump stocks, auto sears, or any device designed to convert a firearm into an automatic weapon is prohibited within the city.

  38. (d) Short-Barreled Rifle Prohibition: The possession, sale, transfer, or distribution of short-barreled rifles, as defined by the Creek Orleans Short-Barreled Rifle Prohibition, is prohibited within the city.

  40. Section 4: Firearm Acquisition and Transfers
  41.  
  42. (a) Mandatory Waiting Period: All firearm sales and transfers, regardless of whether conducted by licensed dealers or private individuals, shall be subject to a mandatory waiting period of a specified number of days from the date of purchase or transfer application.

  44. (b) Background Checks: All prospective firearm purchasers, including private transfers, are required to undergo a thorough background check through the Creek Orleans Firearm Background Check System, operated by the Creek Orleans Department of Public Safety.

  46. (c) Prohibition on Straw Purchases: It shall be unlawful for any person to purchase a firearm on behalf of another person who is prohibited from purchasing or possessing a firearm.

  48. Section 5: Firearm Dealer Regulations
  49.  
  50. (a) Firearm Dealer Licensing: Any individual or entity engaged in the business of selling firearms within the city must hold a valid Creek Orleans Firearm Dealer License issued by the Creek Orleans Department of Public Safety.

  52. (b) Record Keeping: Licensed firearm dealers are obligated to maintain accurate and up-to-date records of firearm sales and transfers, and such records shall be made available for inspection by authorized law enforcement agencies upon request.

  54. Section 6: Firearm Registration
  55.  
  56. (a) Firearm Registration Requirement: Every resident who possesses a firearm within the city must register each firearm with the Creek Orleans Firearm Registration System within a specified timeframe from the date of acquisition.

  58. (b) Registration Transfer: In the event of a firearm transfer or sale, the seller must notify the Creek Orleans Department of Public Safety of the transfer within a specified timeframe.

  60. Section 7: Exceptions
  61.  
  62. (a) Law Enforcement and Military Personnel: The provisions of this act shall not apply to active duty law enforcement officers and military personnel while performing official duties.
  63.  
  64. (b) Antique Firearms: Firearms classified as antiques in accordance with federal law are exempt from the regulations set forth in this act.
  65.  
  66. Section 8: Enforcement and Penalties
  67.  
  68. (a) Violations of this act shall result in penalties as outlined in Creek Orleans municipal ordinances and state law.
  69.  
  70. (b) The Creek Orleans Department of Public Safety is authorized to enforce this act and may conduct inspections of firearm dealers and registrants to ensure compliance.
  71.  
  72. (c) Reporting Stolen Firearms: Firearm owners are required to report stolen firearms to law enforcement within a specified timeframe upon discovery of the theft.
  73.  
  74. Section 9: Public Awareness and Education
  75.  
  76. (a) The Creek Orleans Department of Public Safety shall implement public education programs to inform residents of the provisions of this act, responsible firearm ownership, and safety practices.
  77.  
  78. Section 10: Severability
  79.  
  80. If any provision of this act is deemed invalid or unconstitutional, such determination shall not affect the validity of the remaining provisions.

  83. This document has been duly reviewed, passed, and approved by the Creek Orleans City Council on October 9th 2014. It is hereby established as the Creek Orleans Firearm Safety and Regulation Act of 2014, designed to promote public safety, regulate firearm possession, and ensure the well-being of all residents and visitors within the jurisdiction of Creek Orleans.
