  23. Terms & Conditions
  24. Please read carefully before using this service. By logging onto Movielink's SolutionIP network, you are deemed to have read and agreed to all of the terms and conditions of this Agreement, as outlined below.

  26. 1. Definitions
  27. This service is provided by Movielink Pty Ltd (Hereinafter known as Movielink) using an Internet Access Systems known as SolutionIP provided by Solutioninc Ltd. (Hereinafter known as Solutioninc).
  28. The service is provided to hotel and conference guests as well as casual users (Hereinafter referred to as you, user or users) visiting or staying at this property.
  29. Laptops, game consoles, computers, mobile phones and other devices with a network interface (Wired and/or wireless), are hereinafter referred to as "device" or "devices".

  31. 2. Compatibility and System Requirements
  32. Movielink uses Solutioninc's SolutionIP network to provide standards based Internet access. Any operating system like Windows, Apple OS, Linux, Android and BSD will work. The system works with any recent Web browser like Firefox, Internet Explorer 9 or later and Safari as well as their derivatives. No special software is required. For wired connections, an Ethernet port is required. For Wireless service, a built-in wireless device or external wireless device is required. DHCP (Automatically obtain IP and DNS settings) must be set so that the device can automatically obtain the correct settings.

  34. It is the users responsibility to ensure that the device has the necessary software to gain access to the Internet and that it is set up correctly. SolutionInc, the Hotel, Movielink or any of its subsidiaries are not responsible for and cannot guarantee that you will be able to use the Service with your device. Movielink will not be liable for any loss of Service based on best advice, or due to any changes to the Service which would render your device obsolete or incompatible.

  36. 3. Sessions, Fees, Charges and Payment
  37. Session duration will start from the time of purchase. For example, if a user purchases a '1 Hour session' at 1pm, the session will end at 2pm, regardless of actual usage. A '24 Hour session' purchased at 11 am, will expire at 11 am the next day, regardless of actual usage. This applies on a per device basis.

  39. If an Access Code has been purchased, the session starts at the time of entering the code and accessing the Internet. The session will expire after the purchased duration has elapsed. This applies on a per device basis.

  41. No unused time can be accumulated for later use.

  43. Where multiple devices are supported for the one price, each device is timed independently which means that if a 1 hour purchase is made, (Wired or Wireless) through an Access Code or Room/Name Authentication, the 1 hour counts from the time of purchase or entering an Access Code for that specific device (Each device gets 1 hour).

  45. For technical and security reasons, multiple devices are NOT supported when using a Credit Card to purchase access. Credit Card purchases allow one device only.

  47. Should there be a requirement to connect more than one device to wired, it is the responsibility of the user to provide any hubs or switches to facilitate this.

You agree to pay any fees and charges, including applicable taxes, incurred in connection with the provision of Internet access, in accordance with the rates, terms, and payment procedures established by Movielink, its subsidiaries and the Hotel. The rates and terms may be amended by Movielink, its subsidiaries or the Hotel at any time, but will always be available to the user before registration.

  51. For access purchased in a guest room, or other designated room, Movielink will provide details of the charges on your room folio or your corporate account for the current stay or billing cycle. Billing cycles are based on your previously established credit terms with Movielink and/or the Hotel.

  53. 4. Limited Free Access
  54. Some properties provide limited free Wireless access in public areas. If available, you will be presented with a log-on screen with up to 3 buttons, one button (Access Code) is used if you have purchased an Access Code and wish to use it, the second button (Use Credit Card) is used (If available) to pay for the Internet access with a Credit Card and the third button (Limited Free Access) is used to access the Limited Free Access service.
  55. Limited Free Access is for a set time and a set amount of data, counted in Megabytes. Once the time or amount of data has been exceeded (Whichever comes first), the log-on screen will re-appear with only the Access Code button and the Use Credit Card button (If available). Your next Limited Free Access will be available 24 hours later. The time and data allocated is displayed on the registration page as xxmin/xxMB where xx is a number. Example: 20min/20MB
  56. To continue using the Internet you will need to purchase an Access Code at reception to regain access. Alternatively you may use a Credit Card to purchase (If available).

  58. 5. Security
  59. This service employs firewall technology to prevent low level attacks from outside. It does not employ any high level filtering or virus scanning. Users are expected to keep their devices up to date with the latest virus scanners and security patches. The firewall does not protect against malicious software, Trojans, worms or virus attacks that result from content or files that you may down-load. These may install a back-door on your device.

  61. As an additional security measure, all outgoing Email traffic will automatically be re-directed via an external mail gateway operated by Movielink. If you use outgoing SMTP Authentication in your Email client, please disable this while using this system. Failure to do so will result in an error and the Email will not be sent.

  63. In the event that SMTP Authentication can not be disabled, use your ISP's Webmail system to access and send Email. Your ISP's Webmail system can be accessed from any Web Browser.

  65. 6. Liabilities
  66. Under no circumstances shall SolutionInc, the Hotel, Movielink or any of its subsidiaries, be liable to users of this service for any indirect or consequential damages, including, but not limited to, damages resulting from loss of use, lost profits, lost revenue, or damages to third parties as a result of use of the SolutionIP network and/or the Internet link associated with it.

  68. Outages on the Internet are beyond the control of Movielink and the Internet Service Provider. Such outages may be, but not limited to, the inability to send Email to certain destinations, failure to reach or access certain networks or servers, failure of certain protocols to function and other network related failures that may render the service unusable for specific tasks.

  70. 7. Fair Use Policy
  71. The Fair Use Policy has been implemented so the Hotel can deliver a broadband service that is reliable to all their guests. We monitor the performance of our network and may restrict the amount of bandwidth available to very heavy users during busy periods to ensure that the majority of guests have a good experience.

  73. 8. Content and Conduct Violations
  74. Movielink may terminate your access and block your device for any of the following reasons:

  76. wilfully disrupting network service on the SolutionIP network or anywhere else,
  77. gaining unlawful access to any site, network or host (device),
  78. posting any unlawful content or,
  79. conducting yourself inappropriately on the Internet
  80. downloading and/or using Torrents to illegally download Copyright Protected content
  81. facilitating the illegal downloading and/or distribution of Copyright Protected material
  82. Inappropriate Internet conduct includes but is not limited to:
  83.  
  84. sending unsolicited "junk" mailings or unsolicited bulk mailings,
  85. posting commercial messages to Usenet news groups,
  86. cross posting to more than 10 Usenet news groups,
  87. posting messages which are off topic for the Usenet news group to which they are addressed,
  88. posing as another user in on-line communications,
  89. sending chain letters or
  90. continuing to use your device after being made aware of the device being compromised.
  91. 8.1 Peer to Peer File Sharing
  92. Installation or use of peer to peer file sharing software such as BitTorrent, uTorrent, Vuze, eMule etc is not permitted on the Movielink network. Exceptions for legitimate research or educational use must be approved by the Internet helpdesk, and only where no alternative technology is appropriate.

  94. 9. Content
  95. Users are advised that Australia has legislation governing the viewing, distribution, down-loading and storing of material of an explicit nature. The user of this Service is solely responsible for their on-line conduct and material down-loaded, stored or distributed. It is strongly advised that children be supervised when using this service.

  97. The Australian Government is also tightening the Copyright Protection regulations in a bid to reduce On-line Piracy. Movielink and/or its subsidiaries may, in addition to terminating your Internet access, hand over logs and other information as required by Law.

  99. The Internet is a very public forum, and some material posted may be offensive to some people. Neither Movielink, any of its subsidiaries or the Hotel impose any filtering of the Internet access, except for content that may be blocked as a result of directions by The Australian Federal Government through Legislation. Neither Movielink, any of its subsidiaries or the Hotel assume any liability for any claims resulting from access to products, services or content available on the Internet.

  101. Movielink may pass log files, and other information pertaining to the usage of this service, to Law Enforcement Agencies, if requested by such Agencies.

  103. 10. Privacy and Personal information
  104. Neither Movielink or its subsidiaries will collect any private data flowing through the the system. Any data stored on the system for the purpose of managing a users account and session, will be kept in accordance with provisions of The Privacy Act with amendments from 2001 and March 2014. None of this data will be made available to any 3rd party and is treated as highly confidential.

  106. 11. Governing Law
  107. This Agreement is governed by Australian Law and local Legislation in the State of Victoria. Where any specific provisions in these Terms & Conditions conflict with applicable Laws, the applicable Law will prevail. All other provisions in these Term & Conditions will remain in effect.

  109. 12. Waiver
  110. Failure by Movielink to exercise any of its rights shall not be a waiver or forfeiture of any such rights.

  112. 13. No Warranty
  113. Movielink and/or its agents make no warranties of any kind for the Service, the operation of the SolutionIP network, the reliability of transmissions over common carriers, the capacity of common carriers, the security of messages, data or files, or the delivery of messages, data or files. Movielink MAKES NO EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WHATSOEVER (INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO THE SERVICE, ANY MERCHANDISE PROVIDED OR ANY INFORMATION ON THE INTERNET. ALL SUCH WARRANTIES OR REPRESENTATIONS ARE EXPRESSLY EXCLUDED.

  115. 14. Indemnification
  116. YOU INDEMNIFY Movielink, its subsidiaries and the Hotel, AND HOLD THESE HARMLESS FROM ANY LOSS, CLAIM OR DAMAGE ARISING OUT OF YOUR USE OF YOUR GUEST/MEETING ROOM AND SolutionIP NETWORK.
