  28. a**The Kochs are on a whole different level. Therea**s no one else who
  29. has spent this much money. The sheer dimension of it is what sets them
  30. apart. They have a pattern of lawbreaking, political manipulation, and
  31. obfuscation. Ia**ve been in Washington since Watergate, and Ia**ve never
  32. seen anything like it. They are the Standard Oil of our times.a**

  36. The Koch Brothers, Charles Koch (left) and David Koch (right), own and
  37. operate Koch Industries, the largest private company in the United
  38. States. Their combined net worth is over $40 billion. Below is a record
  39. documenting their environmental violations, funding of climate change
  40. deniers, political influence, and financial backing of the Tea Party.
  41.
  42. ENVIRONMENTAL VIOLATIONS & POLLUTION
  43.
  44. * In 2000, the Clinton administration leveled a 97-count indictment
  45. against Koch Industries for covering up the discharge of 91 tons of
  46. benzene, a carcinogen, from its refinery in Corpus Christi, Texas.
  47. The company was liable for $350 million in fines; 4 Koch employees
  48. faced up to 35 years in prison. a**The Koch Petroleum Group
  49. eventually pleaded guilty to one criminal charge of covering up
  50. environmental violations, including the falsification of documents,
  51. and paid a twenty-million-dollar finea** (Jane Mayer, a**Covert
  52. Operationsa**, The New Yorker, August 30, 2010).
  53. * The federal government sued Koch in 1995 over a reported 300 oil
  54. spills at pipelines owned by the company, which dumped an estimated
  55. 3 million gallons of oil into lakes and streams in 6 states. In
  56. 2000, Koch settled the case and agreed to pay $30 million in civil
  57. penalties.
  58. * a**In 1999, a jury found Koch Industries guilty of negligence and
  59. malice in the deaths of two Texas teen-agers in an explosion that
  60. resulted from a leaky underground butane pipelinea** (Mayer). See
  61. the National Transportation Safety Boarda**s report on the accident.
  62. * A jury found Koch Industries guilty in 1999 of stealing millions of
  63. gallons of oil from public and Indian lands through fraudulent
  64. mismeasuring. This concluded a 20-year long legal battle between
  65. Charles and David Koch and their estranged brother, Bill Koch, who
  66. revealed the scheme and spearheaded the lawsuit. See the 60 Minutes
  67. story about the case.
  68. * The University of Massachusetts at Amhersta**s Political Economy
  69. Research Institute released a study this year that named Koch
  70. Industries one of the top ten air polluters in the United States.
  71.
  72. CLIMATE CHANGE DENIAL
  73.
  74. * a**Since 1997, the Koch foundations have contributed over $48
  75. million in grants to climate opposition groups. More than half that
  76. total, almost $25 million, was given since 2005a*^3 (Greenpeace,
  77. a**Koch Industries Secretly Funding the Climate Denial Machinea**,
  78. March 2010).
  79. * Opposition groups included the Mercatus Center (received over $9
  80. million), which suggested in 2001 that global warming would be
  81. a**beneficial, occurring at night, in the winter, and at the
  82. poles,a** and Americans for Prosperity (received over $5 million),
  83. which organized a national a**Hot Air Toura** to build opposition to
  84. clean energy legislation (Greenpeace).
  85. * In January, Koch Industries sent out an internal newsletter article
  86. casting doubt on the climate change consensus.
  87.
  88. TEA PARTY FUNDING
  89.
  90. * Earlier this year, Americans for Prosperity, an organization David
  91. Koch started in 2004, held a summit, a**which served, in part, as a
  92. training session for Tea Party activists in Texasa** (Mayer).
  93. * In a speech at the summit, Peggy Venable, the organizer of the event
  94. a**explained that the role of Americans for Prosperity was to help
  95. a**educatea** Tea Party activists on policy details, and to give
  96. them a**next-step traininga** after their rallies, so that their
  97. political energy could be channeled a**more effectively.a** And she
  98. noted that Americans for Prosperity had provided Tea Party activists
  99. with lists of elected officials to targeta** (Mayer). Venable a**has
  100. worked for Koch-funded political groups since 1994a*^3 (Mayer).
  101. * a**Americans for Prosperity has worked closely with the Tea Party
  102. since the movementa**s inception. In the weeks before the first Tax
  103. Day protests, in April, 2009, Americans for Prosperity hosted a Web
  104. site offering supporters a**Tea Party Talking Points.a** The Arizona
  105. branch urged people to send tea bags to Obama; the Missouri branch
  106. urged members to sign up for a**Taxpayer Tea Party Registrationa**
  107. and provided directions to nine protests. The group continues to
  108. stoke the rebellion. The North Carolina branch recently launched a
  109. a**Tea Party Findera** Web site, advertised as a**a hub for all the
  110. Tea Parties in North Carolinaa**a** (Mayer).
  111. * Two of the three Koch family foundations, the Claude R. Lamb
  112. Foundation (Charles Koch is a Director) and the David H. Koch
  113. Foundation (David Koch is the President/Director), have given
  114. Americans for Prosperity over $5 million since 2005.
  115. * FreedomWorks, another Tea-Party-supporting organization, has
  116. received over $12 million in grants from the three Koch family
  117. foundations. See their a**Tea Party HQa** website. FreedomWorks
  118. Chairman Dick Armey recently authored a book dubbed a a**Tea Party
  119. Manifestoa**.
  120.
  121. POLITICAL INFLUENCE
  122.
  123. * a**Public tax records show that between 1998 and 2008 the Charles G.
  124. Koch Charitable Foundation spent more than forty-eight million
  125. dollarsa** on politics. a**The Claude R. Lambe Charitable
  126. Foundation, which is controlled by Charles Koch and his wife, along
  127. with two company employees and an accountant, spent more than
  128. twenty-eight million. The David H. Koch Charitable Foundation spent
  129. more than a hundred and twenty milliona** (Mayer).
  130. * a**Koch Industries spent a total of $37.9 on oil and gas lobbying
  131. from January 2006 to December 2009a** (Greenpeace). During the same
  132. period, that figure was exceeded only by ExxonMobil and Chevron.
  133. * a**From the beginning of the 2006 election cycle, Kocha**s PAC spent
  134. more on contributions to federal candidates and committees than any
  135. other oil-and-gas sector based PAC. For that period, Koch Industries
  136. and its executives spent $3.55 milliona*|a** (Greenpeace).
  137. * In 1997, the Senate a**began looking into what a minority report
  138. called a**an audacious plan to pour millions of dollars in
  139. contributions into Republican campaigns nationwide without
  140. disclosing the amount or source,a** in order to evade
  141. campaign-finance lawsa** (Mayer).
  142. * In 2004, non-partisan watchdog group Citizens for Responsibility and
  143. Ethics in Washington (CREW) accused Citizens for a Sound Economy, an
  144. organization founded by David Koch in 1984 and financed by his
  145. foundation, of illegally working to get Ralph Nader on Oregon
  146. presidential ballot (Bob Williams and Kevin Bogardus, a**Kocha**s
  147. Low Profile Belies Political Powera**, July 15, 2004).
  148. * a**Americans for Prosperitya*| has announced that it will spend an
  149. additional forty-five million dollars before the midterm elections,
  150. in November. Although the group is legally prohibited from directly
  151. endorsing candidates, it nonetheless plans to target some fifty
  152. House races and half a dozen Senate races, staging rallies,
  153. organizing door-to-door canvassing, and running ads aimed at
  154. a**educating voters about where candidates standa**a** (Mayer).
