  8. My objective here is to not brag but rather build credibility. I do not consider myself a lawyer however, being in business for the last three years and being a legal studies student I understand corporate law.

  15. @Shawn Bradbury Please help me, and the community better understand what the problem is here, because quite frankly you are being misleading.

  19. I am very close to Josh Jacobs (founder of SantosRP) so I understand the arrangements of the deal.
  20. From what I have read from your announcement, you claim that a trademark opposition is putting you between a rock and a hard place.

  22. * As a background to those who are unfamiliar with intellectual property law, under US law, all creators automatically reserve the general rights of ownership to their creation.
  23. A trademark simply allows the creator to hold more exclusive rights, i.e. the ability to display "All Rights Reserved".

  27. You claim due to the opposition, you must raise $40K to restart SantosRP under a new name (legal fees, etc.) since you cannot fund it out of pocket any longer.
  28. However, an opposition does not mean you have to close the doors. It simply means in the event you lose, you do not hold exclusive rights to the name, but your project can continue.

  30. * The grounds for the opposition were based on "confusion" which is well received within the community as trademark bullying. Large companies due it to small ones.

  32. An average trademark costs around $400... just give up and take the loss. Remove the application and move on - because in no way do you need to own a trademark to continue this project.
  33. Finally, I checked all your records and you have not listed one attorney. This is probably why you are getting bullied and over reacting.

  38. Each state has a department entitled "Department of State". One of their jobs is to keep track of businesses within the state. Everything from their name, to their entity types, and their IRS filings.

  40. It is visible countless places that the business address for JAC Systems is in New Hampshire. However, what I found was the following:
  41. a. JAC Systems LLC is not even registered with the Department of State within NH. There is new Articles of Incorporation or even a Fictitious Name License.
  42. b. The original company that you purchased from Josh that was founded in Massachusetts still hasn't even been amended to account for the new location or new owners.
  43. c. During my search I did find a recent registration of JAC Systems LLC in Pennsylvania and even if that is your filing, you are still practicing an illegal business since everything is linked to what I believe is your house in NH.

  48. I love Santos and I even have some great memories with you yourself @Shawn Bradbury,
  49. But after my research, I am left to believe that you are simply raising $40K in an attempt to cut your losses from your original investment.
  50. Similar to how someone would burn down the office of their failing business just to collect the insurance money.

  52. If I am correct, what you are doing is illegal and I respectfully ask you to stop and come clean to the community.
  53. When you raise money for a business, you must report all income to the IRS. Considering you do not even have a legit entity to report to the IRS under, you are collecting money that will most likely go unreported and into your pocket - which are both felonies under US law.
