  1. There are two documents that you should have whenever you're traveling by private vehicle. I'll get to those in a minute.
  2.
  3. First thing to know is that as soon as you're pulled over you should immediately begin filming the encounter on as many devices as possible, preferably streaming it directly to a remote storage device.
  4. NEVER surrender your license, hold it up to the glass, but do NOT give it to them by surrendering your license you give them a reason to hold you (checking for warrants etc.).
  5. Roll the window down only enough to hear the police officer through and pass the documents through, perhaps a quarter inch or so.
  6. Answer no questions and make no statements. The only questions you should ask are “Am I being detained?”, “Am I under arrest?”, “Am I free to go?”, “What crime do you suspect me of?” and “I need my lawyer.”
  7.
  8. First document is the wallet card sized paper, it should be passed through to the officer INSTEAD of your license, registration and proof of insurance. It should say this on it:
  9.
  10. “I hereby invoke and refuse to waive all of the following
  11. rights and privileges afforded to me by the United States
  12. Constitution. I invoke and refuse to waive my 5th
  13. Amendment right to Remain Silent. I invoke and refuse to
  14. waive my 6th Amendment right to an attorney of my choice.
  15. I invoke and refuse to waive my 4th Amendment right to
  16. be free from unreasonable searches and seizures. If I am
  17. not presently under arrest, or under investigatory
  18. detention, please allow me to leave.”
  19. <OVER>
  20.
  21. “Officer, I Assert My Fifth Amendment Rights As Stated On
  22. This Card”Pursuant to the law, as established by the
  23. United States Supreme Court, my lawyer has advised me not
  24. to talk to anyone and not to answer questions about any
  25. pending criminal case or any other civil, administrative,
  26. judicial, investigatory or adjudicatory matter. Following
  27. his advice, I do not wish to talk to anyone about any
  28. criminal, civil, administrative, judicial, investigatory
  29. or adjudicatory matter, without my lawyer present. I
  30. waive no legal rights, nor give any consents, nor submit
  31. to any tests or other procedures, without my lawyer
  32. present. I ask that no one question or talk to me,
  33. without my lawyer here to advise me."
  34.
  35. About the time he stops reading the card you should then pass the officer this printed on a letter-sized piece of paper:
  36.
  37. I am Traveling in my Private Automobile by Constitutional Right, these Cases recognized by the Supreme Court verify
  38. my right to Travel in my Private Automobile.
  39.
  40. Americans' "freedom to travel throughout the United States has long been recognized as a basic right under the Constitution," according to multiple cases including Williams v Fears, 179 US 270, 274; 21 S Ct 128; 45 L Ed 186 (1900); Twining v New Jersey, 211 US 78, 97; 29 S Ct 14; 53 L Ed 97 (1908), as listed in the case of United States v Guest, 383 US 745; 86 S Ct 1170; 16 L Ed 2d 239 (1968), a case involving criminally prosecuting people for obstructing the right (obstruction is a federal crime pursuant to federal criminal law 18 USC 241).
  41.
  42. The Motor Vehicle code clearly states, “licensing is for commercial drivers, not private citizens”.
  43.
  44. "The right to travel is part of the Liberty of which the citizen cannot be deprived without due process of law under the Fifth Amendment." Kent v. Dulles 357 U.S. 116, 125. Reaffirmed in Zemel v. Rusk 33 US 1.
  45.
  46. "Undoubtedly the right of locomotion, the right to remove from one place to another according to inclination, is an attribute of personal liberty, and the right, ordinarily, of free transit from or through the territory of any State is a right secured by the l4th Amendment and by other provisions of the Constitution." - Schactman v Dulles, 96 App D.C. 287, 293.
  47.
  48. "Even the legislature has no power to deny to a citizen the right to travel upon the highway and transport his property in the ordinary course of his business or pleasure, though this right may be regulated in accordance with the public interest and convenience. -Chicago Motor Coach v Chicago, 169 NE 22 ("Regulated" here means stop lights, signs, etc. NOT a privilege that requires permission)
  49.
  50. "The right of the citizen to travel upon the public highways and to transport his property thereon, either by carriage or by automobile, is not a mere privilege which a city may prohibit or permit at will, but a common right which he has under the right to life, liberty, and the pursuit of happiness."- Thompson v Smith, 154 SE 579.
  51.
  52. "The right to make use of an automobile as a vehicle of travel along the highways of the state, is no longer an open question. The owners thereof have the same rights in the roads and streets as the drivers of horses or those riding a bicycle or traveling in some vehicle." House v. Cramer, 1 12 N. W. 3; 134 Iowa 374 (1907).
  53.
  54. Public roads belong to the people, since we pay for them every time we purchase gasoline we are charged a tax on the gasoline which pays for all public roads, therefore exercising one’s liberty upon them is a natural right. The right to travel, or to locomotion, is upheld in the constitution, and actually predate the constitution
  55.
  56. No one is bound to obey an unconstitutional law and no courts are bound to enforce it." Bonnett v. Vallier, 116 N.W. 885, 136 Wis. 193 (1908); NORTON v. SHELBY COUNTY, 118 U.S. 425 (1886)
  57.
  58. "The State cannot diminish rights of the people." Hertado v. California, 110 U.S. 516
  59. <OVER>
  60. "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof;...shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or laws of any State to the Contrary notwithstanding. The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution..." Article VI of the U.S. Constitution
  61.
  62. "The claim and exercise of a constitutional right cannot be converted into a crime." - Miller v. U.S., 230 F 2d 486, 489
  63.
  64. "For a crime to exist, there must be an injured party. There can be no sanction or penalty imposed upon one because of this exercise of Constitutional rights."- Sherar v. Cullen, 481 F. 945
  65.
  66. “There is no question that there is NO injured party involved here, and a citation/ticket issued by a police officer, or jail/incarceration for any cause including no valid driver’s license, registration or insurance, and save for criminal activities involving an injured party, is a penalty or sanction, and is indeed "converting a Right into a crime."
  67.
  68. "The use of the highway for the purpose of travel and transportation is not a mere privilege, but a common and fundamental right which the public and individuals cannot be rightfully deprived." Chicago Motor Coach v. Chicago, 337 IIL200,169 NE 22, 66 ALR 834. Ligare v. Chicago 139 III. 46, 28 NE 934. Booney v. dark, 214 SW 607; 25 A M JUR (I'1) Highways, Sec. 163"
