- **Servicemember Workplace Assignment Program Act**
- *Whereas, Those serving in the United States Armed Forces who are disabled can find difficulty adjusting to life outside of the army.*
- *Whereas, The United States Military shall find suitable employment positions for them in the United States Government.*
- Be it enacted by the Senate and House of Representatives of the United States of America:
- **SECTION 1: SHORT TITLE.**
- This Act may be cited as the “SWAP Act”
- **SEC. 2: DEFINITIONS.**
- (a) . A “non-combative role” is a career in the United States Government which is not involved in active combat.
- (b). “Disabled” refers to a condition in which an individual is either not capable of or has degraded performance of tasks related to movement, senses, or activities.
- (c). Commander refers to a “Commanding Officer.”
- (d). “Division” refers to each echelon of approximately 17,000 to 21,000 of which two or more Divisions typically comprise a Corps, or equivalent echelon within each Branch of the United States Military.
- (e). “Medical Director” refers to any medical professional qualified as a Medical Doctor or Physician Assistant.
- **SEC. 3: WORK PLACEMENT.**
- (a). Servicemembers who are disabled from combat and are enrolled in this program will have a transfer application filed for them into a non-combative role.
- (1). The United States Government will have three months to find a non-combative role for the Servicemember.
- (i). A three month severance package shall be granted to Servicemembers who cannot be transferred due to any circumstance.
- (b). Servicemembers are automatically enrolled to the Servicemember Workplace Program.
- (2). Servicemembers may disenroll at any time.
- (3). Servicemembers who are not enrolled, or have previously disenrolled, may enroll at any time.
- **SEC. 4: OVERSIGHT AND ENFORCEMENT.**
- (a). The Servicemember Workplace Program shall be overseen by their Disabled Armed Forces Member Reassignment Advisory Board.
- (1). Each Division shall create a Board to relocate Servicemembers in accordance with this Act.
- (i). At minimum, each Board shall contain a permanent liaison, who shall appoint additional members as necessary, and one assigned Medical Director.
- (ii). Each Commander may delegate the creation of any Board(s) to subordinate units, at or above Battalion level, under their command.
- (2). Each Board shall be responsible for processing requests of the Servicemember Workplace Program.
- (3). The Board along with an appropriately assigned Medical Director shall investigate those applying to determine qualification of disability.
- **SEC. 5: SEVERABILITY.**
- (a). The provisions of this act are severable, and if any part of this is found invalid or unconstitutional, all others shall remain active.
- **SEC. 6: ENACTMENT.**
- (a). This Act shall take effect 90 days after its enactment.
