CSGOSHOP Ltd. Terms of Use

1. Terms

CSGOShop Ltd. (“CSGOShop,” “we,” or “us”) provides an online service to facilitate the purchase and sale of certain online goods. The capabilities described above and any associated capabilities are referred to herein as the “Services.” CSGOShop is a trademark of CSGOShop Ltd.

These terms of service (“Terms”) set forth the terms and conditions that apply to your use of the services, including the web pages available at www.csgoshop.com and our applications, widgets, ads, and commerce services.

Please read the following Terms carefully before using the Services or the Site. The Site available at www.csgoshop.com is operated by CSGOShop Ltd., a Canadian corporation. The web page www.csgoshop.com and all linked pages together form the “Site”. These Terms apply to any use of the Site and/or Services.
2. Changes to this Agreement

We may revise these Terms from time to time and the most current version will always be posted to our website. If a revision is, in our sole discretion, material we will notify you and confirm your acceptance of the new terms. By continuing to access or use the Site and Services, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, please stop using the Site and/or Services.
3. General Use

The Site and Services are designed for use by only those individuals who are at least 13 years of age. If you are not 18 years of age or older, you are not authorized to use the Site and Services without the permission and supervision of your parent or legal guardian. If you are under the age of 18, you warrant that you have the express permission of your parent or legal guardian to use the Site and the Services. If you are a parent or legal guardian and have authorised a minor to use the Site and Services, you agree that you are responsible for the online conduct of the minor, and for the consequences of any misuse of the Site and/or Services by the minor

You are solely responsible for your interactions with other users of the Site and Services. We reserve the right, but are under no obligation, to monitor disputes between you and other users. You agree that you are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of this Site and/or Services and all charges related thereto. We shall not be liable for any damages to your or any user’s equipment, or for any data charges resulting from the use of this Site.
4. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on CSGOShop's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on CSGOShop's web site; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by CSGOShop at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
5. Rules for Purchases

With respect to any purchase made on or through the Site and/or Services, you agree that: (i) you will not use an invalid or unauthorised credit or debit card or other payment method; (ii) you are solely responsible for identifying and selecting the product you wish to purchase; and (iii) your payment will be charged to the credit or debit card or other payment method you use through authorized payment partners.

CSGOShop reserves the right to reject, in its full discretion, any and all orders or purchases made on the Site.

You understand you will be responsible for paying all fees and applicable taxes associated with using the Services. You will be responsible for paying any duty, taxes, or brokerage fees applicable to the purchases that you make using the Services (“Taxes”).
6. CSGO’s Fees

CSGOShop may charge a fee of 5% for each item purchased using the Site or increase the price of such item by a maximum of 5% to account for CSGOShop’s operational costs. CSGOShop reserves the right to change its fees policy and structure at any time and from time to time. Any such changes will become effective only after CSGOShop has given you fourteen days’ notice by posting such changes to the web site. However, CSGOShop may choose to temporarily change its fees policy and the fees for services, such changes are effective when CSGOShop posts the temporary promotional event to the web site.
7. Identity/Know Your Customer

You authorise us, directly or indirectly, to make any inquiries we consider necessary to validate your identity. You must, at our request (1) provide further information to us, which may include your date of birth and other information that will allow us to reasonably identify you; (2) take steps to confirm ownership of your email address or financial instruments; and (3) verify your information against third party databases or through other sources. You must also, at our request, provide copies of identification documents (such as your driver’s license). We reserve the right to close, suspend, or limit access to your account, the web site or the services provided therein in the event we are unable to obtain or verify to our satisfaction the information which we request under this section
8. Consignment Services

Users may request that a product be placed for sale on the Site (a “Consigned Product”) for a price specified by the User. In its sole discretion, CSGOShop may indicate on the Site that the Consigned Product is for sale. Upon receipt of the purchase price for such Consigned Product by CSGOShop, CSGOShop will retain 10% (5% sale and 5% withdraw) of such purchase price and will remit the balance of the same to the User who requested that such Consigned Product be advertised for sale on the Site. By requesting that the Consigned Product be listed for sale on the Site, the User represents and warrants to CSGOShop that it is the sole legal and beneficial owner of such Consigned Product and that the sale by the User of the Consigned Product does not violate applicable law.
9. Accurate Information; Registration and Passwords; URLs

In consideration of your use of the Site, you agree to: (a) provide accurate information as prompted on the Site; and (b) maintain and update such information to keep it accurate. If you provide any information that is inaccurate, or CSGOShop has reasonable grounds to suspect that such information is inaccurate, CSGOShop may suspend or terminate your use of the Site and/or decline to permit your continued use of the Site and future access to the Site.

To access certain parts of the Site, you may be required to open an online account with CSGOShop, in which case you will have to create a username and to provide registration information, including a valid e-mail address, name, phone number, and address.
You may not use as a username the name of another person or entity that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

You are responsible for maintaining the confidentiality of your password and are solely responsible for all activities resulting from the use of your password and conducted through your CSGOShop account.

If you are a business, government, or non-profit entity, the person whose e-mail address is associated with the account at the time of registration must have the authority to bind you to this Agreement.

If you are under 18 years old then you must obtain the permission of your parent or legal guardian prior to registering an account. Your parent or legal guardian will then be responsible for your online conduct, and the consequences of any misuse of the Site.

You must immediately notify CSGOShop upon becoming aware of any unauthorized access or any other security breach to the Site or the Services and do everything possible to mitigate the unauthorized access or security breach (including preserving any evidence and notifying appropriate authorities). You are solely responsible for securing your password. CSGOShop will not be liable for any loss or damage arising from unauthorised access of your account resulting from the failure to secure your password.
10. Prohibited Uses

As a condition to using the Site and/or Services, you promise not to use the Site and/or Services for any purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably foreseen to have been intended by CSGOShop. By way of example, and not as a limitation, you agree not to use the Site and/or Services:

    In any way that is false, inaccurate or misleading;
    In any way that is fraudulent or otherwise involves the sale of illegal or stolen goods;
    to collect and use product listings, descriptions or images;
    to abuse, harass, threaten, impersonate or intimidate any person;
    to post or transmit, or cause to be posted or transmitted, any content that is libellous, defamatory, obscene, pornographic, abusive, offensive, profane, violent or that infringes any copyright or other right of any person;
    for any purpose (including posting or viewing content) that is not permitted under the laws of the jurisdiction in which you use the Services;
    to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any user;
    to reverse engineer, decompile or disassemble the site, or to convert into human readable form any of the contents of this site not intended to be so read, including but not limited to using or directly viewing the underlying code for the site except as interpreted and displayed in a web browser;
    to create or transmit unwanted ‘spam’ to any person or any URL;
    to violate or attempt to violate the security of the Site and/or Services;
    to post copyrighted content which doesn’t belong to you, with the exception of blog content, in which case you may post such content with explicit mention of the author’s name and a link to the source of the content;
    with the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes or might impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;
    to promote or sell content of the Site;
    to sell any products or services other than those which can reasonably be described as related to personal support products or services;
    to advertise or perform any commercial, religious, political or non-commercial solicitation, including, but not limited to, the solicitation of users of this Site to become users of other on- or offline services directly or indirectly competitive or potentially competitive with CSGOShop;
    to interfere with or attempt to interfere with the proper working of the Site and/or Services;
    to sell or otherwise transfer your profile;
    to attempt to restrict another user from using or enjoying the Site and/or Services or to encourage or facilitate violations of these Terms of Use or the Privacy Policy;
    sell services via the Site which you do not deliver or which are not available;
    to interfere in any way with the business of any other user of the Site;
    in any other way that violates these Terms;
    engage in the trading of items that are stolen or scammed from other individuals;
    participate or engage in behavior considered unfair or are intended to cheat and/or scam other users;
    use fraudulent methods to purchase tangible or intangible goods or functionality from the website;
    attempt to impersonate CSGOShop Staff, Administrators, Moderators, or users;
    disrupt the usability of the website through use of any form of denial of service (DDoS) attack or other means;
    threaten, harm, harass or abuse other users of the website through word or action;
    allow your account to fall into disorder with Valve by allowing it to acquire a trade ban;
    allow your account to fall into disorder with Valve, causing their representatives to order CSGOShop to cancel your account;
    allow your account to be tagged as a scammer by SteamRep;
    attempt to deliberately circumvent systems that are in place to limit or stop trade of certain items; or
    attempt to deliberately exploit bugs or design flaws, or undocumented features to gain an advantage.

CSGOShop shall have the right, but no obligation, to monitor the content on the Site and/or Services to determine compliance with these Terms and any other operating rules we establish. CSGOShop shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted to the Site or Services. CSGOShop neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement on the Site and/or Services, whether it is provided by CSGOShop, our employees, or a third party.

Under no circumstances will CSGOShop be liable for any loss or damage of any kind caused by reliance on information obtained through the Site or Services. CSGOShop is not responsible for any offensive, defamatory, obscene or other posting made through the Site and/or Services. We reserve the right at all times to disclose any information we believe necessary to satisfy any law, regulation or governmental request, or to refuse to post or to remove any information or materials, in whole or in part, that in CSGOShop’s sole discretion is inappropriate, objectionable or in violation of these Terms.

Neither CSGOShop nor any third party content provider shall assume or have any liability for any action or inaction by CSGOShop or any third party content provider with respect to any conduct, communication or posting on the Site and/or Services.
11. Release and Indemnity

You hereby expressly and irrevocably release and forever discharge CSGOShop, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of actions, suits, proceedings, liability, debts, judgments, claims and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of your use of the Site, including, but not limited to, any liability which arises pursuant to the sale of a Consigned Product.

In no event shall CSGOShop be liable under contract, tort, strict liability, negligence or other legal theory with respect to the Site, the Services or any content (i) for any lost profits or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, (ii) to provide substitute goods or services (however arising), or (iii) for any direct damages in excess of (in the aggregate) one hundred Canadian dollars (CDN$100).
12. Revisions and Errata

The materials appearing on CSGOShop's web site could include technical, typographical, or photographic errors. CSGOShop does not warrant that any of the materials on its web site are accurate, complete, or current. CSGOShop may make changes to the materials contained on its web site at any time without notice. CSGOShop does not, however, make any commitment to update the materials. Winners of raffles may be subject to a requirement. If the user is unable to comply with the requirements, they are not eligible for the prize, and the raffle will be redrawn. Requirements include a clean SteamRep profile, no bans from Valve, and the ability to create a short video or post detailing the process as needed.
13. Links

The Site and/or Services may provide, or third parties may provide, links to other World Wide Websites or resources. Because CSGOShop has no control over such sites and resources, you acknowledge and agree that CSGOShop is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that CSGOShop shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content or goods or services available on or through any such site or resource.
14. Disclaimer of Warranties

THIS SITE, ITS CONTENT, AND ANY ASSOCIATED SERVICES ARE PROVIDED BY CSGOSHOP ON AN “AS IS” AND “AS AVAILABLE” BASIS. CSGOSHOP MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE, TO THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED ON THIS SITE, OR TO THE FUNCTIONALITY OF ANY SERVICES ASSOCIATED THEREWITH. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, CSGOSHOP DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OF WORKMANLIKE EFFORT, OF SUITABILITY, AVAILABILITY, ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF CONTENT, OR OF NON-INFRINGEMENT, AS WELL AS WARRANTIES ARISING THROUGH COURSE OF DEALING OR USAGE OR TRADE. FURTHER, CSGOSHOP MAKES NO REPRESENTATIONS OR WARRANTIES THAT THIS SITE AND/OR ITS CONTENTS ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE. CSGOSHOP IS NOT RESPONSIBLE FOR TYPOGRAPHICAL ERRORS OR OMISSIONS RELATING TO PRICING, TEXT, PHOTOGRAPHY OR ANY OTHER CONTENTS ON THIS SITE.
BY USING SITE, YOU ACKNOWLEDGE THAT YOUR USE OF THE SITE, INCLUDING YOUR USE OF ANY AND ALL ASSOCIATED CONTENT, DATA OR SOFTWARE DISTRIBUTED BY, DOWNLOADED OR ACCESSED FROM OR THROUGH THIS SITE, AND ANY ASSOCIATED SERVICES IS SOLELY AT YOUR OWN RISK. CSGOSHOP DOES NOT WARRANT OR GUARANTEE THAT ITS SITE OR SERVERS OR E-MAILS SENT BY OR ON BEHALF OF CSGOSHOP ARE FREE OF VIRUSES, WORMS OR OTHER HARMFUL COMPONENTS. FURTHER, CSGOSHOP DOES NOT GUARANTEE THE CONTINUOUS, UNINTERRUPTED AND ERROR-FREE OPERATION OF ITS SITE, NOR THAT ALL COMMUNICATIONS BETWEEN YOU AND CSGOSHOP, OR BETWEEN YOU AND ANY OTHER USER OF THE SITE, WILL BE SECURE FROM ACCESS OR INTERFERENCE BY THIRD PARTIES.
15. The Security of the Site

CSGOShop maintains reasonable safeguards and personnel policies that are designed to guard the Site, the Services, our systems and our sellers’, customers’, business partners’ and others’ information. For example, for the security of your online visit to the Site, CSGOShop may make use of firewall barriers, encryption techniques and/or authentication procedures.

Unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while CSGOShop strives to protect your information, it cannot ensure or warrant the security of any content you transmit to us, and you do so at your own risk. In the event of a breach of the confidentiality or security of your personal information, CSGOShop will notify you as necessary so you can take appropriate protective steps. Unless you indicate otherwise, we may notify you under such circumstances using the email address you provided to us when you registered with the Site.
16. Electronic Communications

When you visit the Site, use the Services or send emails to CSGOShop, you are communicating with us electronically. You consent to receive communications from CSGOShop electronically. CSGOShop may communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that CSGOShop provides to you electronically satisfy any legal requirement that such communications be in writing.
17. Resolution of Disputes

If a dispute arises out of, or in connection with this Agreement, the parties agree to first meet to pursue resolution through negotiation.
18. Remedy

You agree that if you are dissatisfied with the Site or any Services offered in connection with the Site, if you do not agree with any part of these Terms, or if you have any other dispute or claim with or against CSGOShop concerning your use of the Site or access to the Services or otherwise to do with these Terms, your sole and exclusive remedy is to discontinue using the Site and any Services offered in connection with the Site.
19. Governing Law

Any claim relating to CSGOShop's web site shall be governed by the laws of Toronto without regard to its conflict of law provisions.
20. Terms of Sale

All sales are final once paid and delivered, and no refunds are permitted except with respect to any statutory warranties or guaranties that cannot be excluded or limited by law.
21. Usability

Users of CSGOShop shall abide by the following requirements and are liable for damages in the case of contravention of the same: (i) are not known scammers (judged at our discretion or listed by the SteamRep website); or (ii) use a non-private, valid, trading-enabled Steam account in transactions.
22. Account Balance

Any accounts with a negative balance of over $20.00 USD will be sent to a collection agency for assignment if the funds cannot be recovered within 3 months. This is included but not limited to; payment errors, payment reversals, and payment chargebacks. Users found to be in violation of anti-fraud laws in their country are to be prosecuted to the maximum extent allowed. By using this website, you agree that you will not reverse or file false claims to recover funds after goods have been delivered to the customer.

In the event that a balance becomes owing by you to CSGOShop (a “Balance”) due to a chargeback to CSGOShop initiated by you or otherwise due to a revocation of your authorization for payment of fees due to CSGOShop, you hereby agree that CSGO has the right and CSGOShop hereby reserves the right to withhold or maintain possession of any items, products, or goods (the “Withheld Goods”) which you have transferred to CSGOShop, whether as a Consigned Product or otherwise until the Balance is satisfied by the User, provided that the Withheld Goods have a value not exceeding the Balance, as determined in good faith by CSGOShop. Should you fail to satisfy a Balance within thirty (30) days after it has become due and owing by you to CSGOShop, you hereby irrevocably transfer all right, title, and interest to the Withheld Goods to CSGOShop and you hereby agree and acknowledge that CSGOShop may dispose of such Withheld Goods in its absolute discretion. Upon the disposition of such Withheld Goods, the Balance shall be deemed to have been satisfied by the User.
23. Account Cancellation and Suspension

CSGOShop Ltd. reserves the right to terminate your account at any given time without reason or notice to you. If you have been found guilty of: charging a completed payment back to CSGOShop or revoking the authorization for a payment to be made to CSGOShop, scamming CSGOShop, scamming a member of the community, breached the terms of license, or found to have purposely abused the system for malicious personal gain, or have used any form of fraudulent information or account, your CSGOShop account will be immediately terminated, and all outstanding payments and credits seized. CSGOShop Ltd. reserves the right to donate all seized payments and credits to a charity of choice.
24. Termination

CSGOShop may terminate or suspend any and all Services and/or your user account immediately, without prior notice or liability, including without limitation if you breach the Terms. Upon termination of your account, your licence will be revoked and your right to use the Site and/or Services will immediately cease. If you wish to terminate your CSGOShop account, you may simply discontinue using the Site and/or Services. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
For greater certainty, any obligation on your part to pay a fee to CSGOShop pursuant to these Terms or any other agreement between you and CSGOShop shall survive termination or suspension, whether by you or CSGOShop. Any fee so payable will remain payable and your failure to pay such fee within a reasonable time shall be deemed to constitute a breach of your agreement with CSGOShop and may result in legal action.

Furthermore, your failure to pay any such fee shall be a ground for termination of your account.
Content that you have shared with others on the Site and/or Services may still be available after the termination of your account.
25. Survival

Any of these Terms which by its nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability, shall survive termination and continue in full force and effect except to the extent expressly set out in these Terms.
26. Severability

The invalidity or unenforceability of any of these Terms shall not affect the validity or enforceability of any other of these Terms and any such invalid or unenforceable term shall be deemed to be severable.
27. G2A Addendum

When you use G2A Pay services provided by G2A.COM Limited (hereinafter referred to as the "G2A Pay services provider") to make a purchase on our website, responsibility over your purchase will first be transferred to G2A.COM Limited before it is delivered to you. G2A Pay services provider assumes primary responsibility, with our assistance, for payment and payment related customer support. The terms between G2A Pay services provider and customers who utilize services of G2A Pay are governed by separate agreements and are not subject to the Terms on this website.

With respect to customers making purchases through G2A Pay services provider checkout, (i) the Privacy Policy of G2A Pay services provider shall apply to all payments and should be reviewed before making any purchase, and (ii) the G2A Pay services provider Refund Policy shall apply to all payments unless notice is expressly provided by the relevant supplier to buyers in advance. In addition the purchase of certain products may also require shoppers to agree to one or more End-User License Agreements (or "EULAs") that may include additional terms set by the product supplier rather than by Us or G2A Pay services provider. You will be bound by any EULA that you agree to.

We and/or entities that sell products on our website by using G2A Pay services are primarily responsible for warranty, maintenance, technical or product support services for those Products. We and/or entities that sell products on our website are primarily responsible to users for any liabilities related to fulfillment of orders, and EULAs entered into by the End-User Customer. G2A Pay services provider is primarily responsible for facilitating your payment.

You are responsible for any fees, taxes or other costs associated with the purchase and delivery of your items resulting from charges imposed by your relationship with payment services providers or the duties and taxes imposed by your local customs officials or other regulatory body.
