  1. The "Justice" system:

  3. I am very much at odds with the typical person's idea of "Justice".
  4. So I felt it necessary to write an article in what I think the Justice system should be like:

  6. My first contention about the "Justice system" is , I think we should get rid of any kind
  7. Of punishment in the justice system.
  8. I think jail should only be used to keep dangerous people away from society. I mean like
  9. Violent crimes and direct theft. Perhaps there is something to be said about the need
  10. For deterrence, but I think there are ways to cause deterrence with ought necessarily
  11. Using jail as such deterrent in every case.
  12. For example, what should be done with the bankers of the sub-prime loan scheme?
  13. Some people suggest jail as a proper punishment for such a white collar crime, but I
  14. would suggest 3 things instead of a jail sentence:
  15. 1.- paying a penalty fee, which should be used to restore the money to the original
  16. People who were scammed. Also, this fee should be proportional to the person's salary
  17. So a very rich banker would pay a huge amount while a poorer criminal would pay
  18. a smaller fee.
  19. 2.-social service, enforced by a penalty fee (and possibly even prison as a way to get people
  20. To actually participate in the social service system, but not as a punishment)
  21. needing to do unpaid social service would act as a deterrent. These fees should also be
  22. Proportional to the person's income.
  23. 3.-take away the person's passport and block him from wiring money abroad.
  24. This would be done so that the person cannot escape from doing his share of the social
  25. Service he has been sentenced to do.

  27. Even when people do go to jail, it should NEVER be as a punishment, it should ALWAYS
  28. be to protect society from harm.

  30. In this way all prisoners who are in prison for say things like using marijuana should be
  31. Released.

  33. Keeping people in prison is expensive, and it should be only used on people that are
  34. Really dangerous.

  36. There are things like penalty fees that can be used against people that commit white collar
  37. Crimes and these can be used to restore the people that have been harmed.

  40. Also, one thing I think we need to keep in mind, is that achieving "Justice" as in "fairness"
  41. is an unattainable goal... We are not born equal, and even attempting to be fair seems
  42. Like an unrealistic goal to me...
  43. Take a look at nature, nature is completely unfair. And we are part of nature... Look at
  44. The animals in Africa, the lion eats a zebra and he is not punished... We are also animals
  45. With perhaps the ability to reason, but we never stopped being animals. So I think eliminating
  46. Our primal instincts is unrealistic.

  48. Who gives the system the right to punish another human being? Nobody.

  50. Also, the word "Justice" seems to mean "punishment" to many people like Muslims
  51. I think we need to redo the system, so that it is no longer about punishment, but about
  52. Purging dangerous people from society.

  55. Now, as to deterrence, perhaps jail cells should be kept frugal, not as a punishment,
  56. but as a deterrent against people wanting to commit the crimes.

  58. I know it is a very small change I am actually asking for, it is mostly a change in *intention*
  59. not as much as a change in action... Although I do want action in liberating all white collar
  60. Criminals from jail, and non-violent drug users, or people that have cheated on their taxes.

  62. Also, I think criminal records should always be kept private, never made public. When a person has
  63. gone thru the system, and done what was required of him, there should be nothing preventing him
  64. From getting a proper job... How should a criminal turn away from a life of crime when he cannot get
  65. a proper job?
