  3. Courts have consistently upheld plenary power on the matter of immigration. Even in the case of discriminatory policies as the entire history of US immigration law shows. This is because immigration covers Sovereignty, National Security, and Foreign Affairs. Subjecting it to judicial review would be foolish, inefficient, and de facto undermine the powers of the other two branches. Moreover, immigration enforcement is not punishment in the eyes of the courts. Punishment is having life, liberty, and property denied. And there is no right of entry so "freedom of movement" isn't a question
