- I mentioned it yesterday, but I didn’t realize the extent to which conservatives are claiming that it is illegal to burn the gay flag. It is definitely not illegal to burn a gay flag. All these cases they are linking of people being charged for defacing a gay flag involved real crimes, specifically theft and vandalism.
- Some of these cases have been “enhanced” as hate crimes, with people getting worse charges than they would for stealing a non-gay object and burning it. That is obviously bad. But these people are purposefully trying to deceive people and make them think it is against the law to burn a gay flag.

- And even if Democrats had made it illegal to burn the gay flag, why would Trump not just write a law legalizing burning gay flags? Why would your argument be “we need to do censorship to match their censorship”? That is a terrible argument and a terrible way of thinking about politics.
- Burning the US flag is not really very important in itself. Obviously, I support it, but it might seem too abstract to be relevant. But that isn’t the point. What we saw under Biden and are now seeing under Trump is the government getting more and more involved in censorship of speech. Of course, it was all the way back in 2017 that I was banned from everything. That was, however, “private companies” banning me. I said at the time that if the government was not going to protect my speech, which is what the Constitution says it’s supposed to do, then it wasn’t really any different than the government censoring me. I pointed out that I would have much preferred to pay a fine or do a few months in jail – i.e., receive a government punishment for my speech – than be banned from all internet and financial services for the rest of my life.
- Saying “it’s only the government that is allowed to strip you of your freedom of speech” would be like saying “it’s only the government that’s not allowed to murder you.”
- There is an entire underlying issue around freedom of speech here, and it is very concerning how conservative commentators are dealing with it.
