  48. 4. Server/Files/Builds Related

  51. 4.1 You agree that when purchasing a server, build, or file that all payments are to be done through paypal send to family or friend. Failing to do so will result in you not getting you files
  52. 4.2 If "McXServers" breaks their part of the terms "Forcing OP, Redistributing" The "Customer” Is able to request a full refund if they are able to prove we broke the terms.
  53. 4.3 If this was a transformation build (You pay for setup) We are not liable what happens after the server is setup nor what happend with the host the server is on
  54. 4.4 "McXServers" is a private company run completely on payments and not out of pocket money.
  55. 4.5 We do not issue refunds for files unless we have broken out terms, (more info 5.1)

  58. 5. Breaking the Terms

  61. 5.1 As said in 4.2 If "McXServers” Breaks their part of the terms you are able to request a full refund if you are able to proove we broke the terms (able to be found in 6.3)
  62. 5.2 If the "Customer" breaks their part of the terms (charging back) paypal will be notified to cancel the chargeback as it was a violation of these terms
  63. 5.3 We reserve all rights to use contact the host and or server owner and ask for the files to be removed if the terms are broken

  66. 6. Terms For Seller (us)

  69. 6.1 "McXServers” Agrees not to do the following, Force OP On a server in which we have sold the files to, We agree not to redistribute the files sold to the server
  70. 6.2 If you discover these terms where broken you have 60 days to contact a staff member (7.1) and ask for a refund.
  71. 6.3 After 60 days from the purchase date the sellers terms are no longer active while the buyers do not change.

  84. 8.2. All Users are strongly advised to try reaching a settlement by the means of mediation and/or negotiation related to the issues or disputes derived from these Terms, before addressing the court as the final legal instance.
  85. 8.3. These Terms between you and the Provider which regulate the issues and situations herein described and explained are to supersede any other agreement or document previously signed or accepted, in written or oral form, between you and the Provider.
