  353. 1. (U) SUMMARY: On Tuesday January 31, President
  354. Yushchenko signed the law giving interim adoption
  355. authority to the National Adoption Center (NAC),
  356. clearing the way for prospective adoptive parents to
  357. process their adoptions to conclusion. The NAC has a
  358. plan in place to prioritize appointments and serve
  359. families in a timely fashion. At a recent meeting with
  360. CG, NAC Director welcomed USG efforts to improve
  361. American parents' compliance with post-adoption
  362. reporting requirements. The NAC advised that the
  363. Minister of Family, Youth, and Sports continued to be
  364. interested in a bilateral agreement on adoption. END

  367. 2. (U) On January 31, President Yushchenko signed the
  368. law, passed by the Rada on January 12, giving interim
  369. authority over adoptions to the Ministry of Education's
  370. National Adoption Center (NAC) until the new adoption
  371. authority is legally established under the Ministry of
  372. Family, Youth, and Sports (ref A). This law will go
  373. into effect upon its publication in the Ukrainian
  374. parliament's official newspaper "Holos Ukrainy," which
  375. could occur as early as February 2. The law, designed
  376. to fix the adoption processing gap created December 22
  377. when the Rada passed new adoption authority legislation,
  378. gives the NAC lame duck status to process adoptions
  379. until May 1, 2006 -- the final date by which the new
  380. adoption central authority must be established under the
  381. Ministry of Family, Youth, and Sports (MinFYS). (Note:
  382. Lyudmila VOLYNETS and others in MinFYS have cautioned
  383. that the NAC would only be able to process adoptions
  384. until March 22 -- three months after passage of the
  385. initial December 22 legislation. MinFYS officials
  386. expect a temporary suspension of all intercountry
  387. adoptions between March 22 and May 1, the date the new
  388. authority is expected to be operational. End note.)

  390. 3. (SBU) In a Friday meeting with CG, NAC Director
  391. Yevheniya CHERNYSHOVA said that the NAC would continue
  392. processing not only suspended cases, but also cases that
  393. had originally been scheduled through the end of
  394. January. According to Chernyshova, there are 256
  395. dossiers caught in the recent stoppage. 103 are
  396. American cases (this includes all families from December
  397. and those that had been scheduled through the end of
  398. January). Chernyshova said first priority would be
  399. given to prospective adoptive parents (PAPs) who had
  400. already identified children, and were only awaiting NAC
  401. concurrence to conclude the adoption in court. Second
  402. in line would be PAPs who had been in the process of
  403. identifying children in December when the NAC suddenly
  404. lost its adoption authority. Through the month of
  405. February the NAC would reschedule appointments for those
  406. PAPs (twenty five Amcit families) whose original January
  407. appointments had to be missed due to the suspension.
  408. Chernyshova said the NAC would give priority
  409. appointments to PAPs who were already in Ukraine (in a
  410. way, rewarding those who had chosen not to heed advice
  411. to delay travel until new procedures were confirmed).

  413. 4. (SBU) CG briefed Chernyshova on USG efforts to
  414. encourage American parents' compliance with Ukrainian
  415. law on post placement adoption reports, including A/S
  416. Harty's conference call with American Adoption Service
  417. Providers (ASPs) (ref B). Chernyshova welcomed news
  418. that the USG had engaged ASPs at such a high level and
  419. said she would report this to FYS Minister, Yuriy
  420. Pavlenko. Chernyshova said only Canada and Spain had
  421. achieved 100 percent compliance, but these countries'
  422. citizens had not been able to submit new adoption
  423. dossiers, since the NAC had not had authority to accept
  424. them. She equivocated when asked what would occur after
  425. presidential signature of the law.
  426.  
  427. 5. (SBU) Chernyshova relayed that Minister Pavlenko had
  428. returned from his trip to the United States still
  429. intending to pursue a bilateral adoption agreement with
  430. the United States along the lines of the U.S.-Vietnam
  431. agreement. CG emphasized that the USG preferred to use
  432. a multilateral vehicle such as the Hague Convention on
  433. Intercountry Adoption. CG noted that a bilateral
  434. agreement such as the one with Vietnam could take years
  435. to conclude. Since the U.S. and Ukraine were moving
  436. toward Hague Convention accession, a bilateral agreement
  437. should not be necessary. Chernyshova rebutted that the
  438. minister's present thinking was in favor of a bilateral
  439. agreement regardless of the progress towards the Hague
  440. Convention. She noted that other countries such as
  441. Italy, which were already signatories to the Hague
  442. Convention, were discussing bilateral agreements within
  443. the convention framework.
  444.  
  445. 6. (U) COMMENT: We have been actively engaged on this
  446. issue since December 22, and we look forward to
  447. efficiently processing orphan visa cases for the
  448. families who have been caught in the suspension. We
  449. will continue to track developments in the coming weeks
  450. and appropriately inform the American adoption community
  451. through e-mail notices and web page updates.
