  1. On behalf of Quagsire, I, u/Ardente04 or CuddleMonster, am moving for an appeal on his ban through the subreddit, as per the instructions provided by one of the owners. I am writing this appeal on his behalf, instead of Quagsire himself or anyone else, because I am bipartisan to the events that have taken place; therefore, I have no reason to lie for anyone, whether it's Quagsire, the owners, or anyone else.

  3. First and foremost, I must address the events that led up to and followed the ban for various reasons, which will become evident. At around 15-20 minutes before 9 PM (EDT), Quagsire, Mango, GachaMint, myself, and several others moved from the room one voice chat to the video chat. From what I can recall, we all had been on the voice chat for about an hour before switching; however, I can not be sure. Nonetheless, once on the video chat, Quagsire would leave about 15 minutes in due to it being nearly 9 o'clock his time. It should be noted that Quagsire is unable to use discord anytime later than 9 pm (EDT) due to his internet being shut off at that exact time.

  5. Moving on, nothing of importance would occur until the next day when Quagsire would attempt to access the server only to find his account was banned. At exactly 8:36 AM, Mango contacted me, asking if I knew anything regarding the ban's reasoning. Quagsire was given not given any sort of indication regarding his banning whatsoever. The lack of communication made me believe that the ban must have been made in error, as I found it ludicrous to ban someone while they were offline intentionally and not even leave a message with an explanation. Unfortunately, I would not get answers until around 7:30 PM when PyramidHead and Cotton got on the server and saw my messages inquiring about the situation; It should be noted that I also contacted an Admin, someone who would surely know about a ban or at least be able to look it up in the audit logs. Still, they were unaware that the ban had even occurred. According to PyramidHead, Quagsire was an alt for an old member of the server who had previously been banned. This was a shock for everyone on the server.

Of course, one would imagine that with an accusation as serious as ban evasion, the accusers would be willing to provide the accused their evidence; however, both owners refused several times, stating that they did not have to. With no information regarding this supposed alt, they simply told us that Quagsire could submit an appeal on the subreddit if he wanted to. Well, despite attempting to leave the accused with barely anything to defend themselves, there is thankfully a large amount of evidence in their favor.

  9. Among all the evidence in favor of Quagsire, the greatest proof is the distinct lack of information against him. The only evidence the owners have provided backing their claims was the testimony of an unknown user in the original voice chat who supposedly claimed to recognize Quagsire's voice as another banned user. With so many unknowns in that statement alone, such as who the alt was and who reported it, the evidence is circumstantial at best, if that. Not to mention, Quagsire's mic was not the easiest thing to hear clearly due to his mic being a pair of earbuds. At times his voice would go rather quiet and become difficult to understand. As several people can attest, I had to ask what he was saying on multiple occasions.

  11. Moreover, Quagsire being in the voice chat in the first place, is evidence of his innocence. No intelligent human being, such as Quagsire, would ever think that it would be a smart idea to go onto the voice chat of a server they had previously been banned on because someone could recognize them; furthermore, the fact that the individual did not even attempt to ask Quagsire about being an alt brings their claim's validity into question. If this individual can not go the measly step of asking someone a question before jumping to conclusions and immediately reporting them, they should not be taken entirely seriously.

Therefore, it is in my complete and honest opinion that Quagsire is completely innocent, and he has fallen victim to false accusations, humiliation, and a failure of the server's current moderation system. Not only do I believe that his ban should be appealed in its entirety, but I have also concluded that the server is in desperate need of some better protection measures regarding the public members and the moderation team. It is absurd that the owners would make a ban without consulting or informing the rest of the moderation team first. It is ridiculous that one individual's testimony out of more than 5 individuals would be enough to enforce a ban. It is downright tyrannical that the owners would fail to provide the necessary information to make a proper appeal, such as the supposed original account id and the time of the original ban. In America, at least, a person is innocent until proven otherwise. In a court of law, the burden of proof is not on the defendant but the plaintiff. With all of that said, I rest my case. Without any other actual evidence, which is not circumstantial or anecdotal in nature, having been provided, it is in my, u/Ardente04 aka CuddleMonster, opinion that DumbRatBoy#6235, aka Quagsire, is 100% innocent of the accused crimes and an appeal should be issued as soon as possible.

  15. ** Appeal aside, I also believe a formal apology should be made to Quagsire. He has been humiliated, as everyone on the server believes he's some ban evader and has been left not knowing what to do because the owners refuse to help. Such deplorable behavior should not just be accepted because it was the owners. As moderators, owners, and public members, we are all responsible for our actions and have a responsibility to be kind and respectful to our peers.
