We will never sell or provide Your Data to another party without your explicit consent or as you have agreed in this Policy.</li>\n\t<li>-By joining our network and providing us Your Data, you grant us the right to use Your Data for purposes that will enhance the value we provide <em>FBN</em> Members and as described below. This may include using anonymized data from all <em>FBN</em> Members to create insightful models and provide transparent information to the <em>FBN </em>Network.</li>\n\t<li>-We own the Services and the Content, including aggregated and/or anonymized data, analytics, benchmarking, etc.</li>\n\t<li>-You may elect to share Your Data with other <em>FBN </em>Members and you will have full control over who and the type of data you share.</li>\n\t<li>-As a contributory network and community, our Services operate best when <em>FBN</em> Members contribute Ag Data, and we may require you to contribute Ag Data in order to access and use certain Services, such as <em>FBN </em>Price Transparency or <em>FBN</em> Seed Finder.</li>\n\t<li>-You may see advertising or have access to certain opportunities to interact with other companies. We only partner with companies that we trust and, in our judgment, will provide you value.</li>\n\t<li>-If we are ever sold or acquired by another company, this Policy will continue to apply to any successor.</li>\n</ul>\n\n<p>&nbsp;</p>\n\n<p>\U200b<strong>By using or accessing the Services and in any other interactions you may have with us in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, and you hereby consent, to the fullest extent permitted in your jurisdiction, that we will collect, use, and share Your Data in the following ways, which are essential to providing you the Services.</strong></p>\n\n<p>Remember that your use of our Services is at all times subject to the Terms of Service (https://www.farmersbusinessnetwork.com/page/show/tos), which incorporates this Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Service (https://www.farmersbusinessnetwork.com/page/show/tos).</p>\n\n<p><strong><a id=\"Q1\" name=\"Q1\"></a>Scope.&nbsp;&nbsp;</strong>This Policy covers our treatment of Your Data that you provide to us or that we gather when you are accessing or using our Services, but not to the practices of companies we don&rsquo;t own or control, or people that we don&rsquo;t manage. &nbsp;</p>\n\n<p>When we refer to our &quot;Affiliates&quot; we mean our subsidiaries, including, but not limited to, FBN Inputs, LLC, FBN CM LLC, FBN Finance, LLC, Farmer&#39;s Business Network Canada, Inc., Yorkton Distributors (1976), Ltd., and FBN BR LLC.</p>\n\n<p>When we refer to &quot;Ag Data&quot; we mean any agricultural data, as broadly understood in the agricultural industry, including, but not limited to, your agronomic data, application data, climate data, harvest data, invoice data, planting data, land data, machine data, pricing data, weather data, and the type of agricultural products or services you use and purchase from us or other parties.</p>\n\n<p>When we refer to &ldquo;Financial Data&rdquo; we mean any credit, financial, or payment information, including, but not limited to assets and liabilities, bank account numbers, credit card numbers, credit history, employment history, income sources, payment history, payment preferences, and social security/social insurance number. Note: Financial Data provided by you or gathered about you by us from third parties in connection with a credit application or for other purposes may be subject to and protected by additional terms and conditions listed therein.</p>\n\n<p>When we refer to &ldquo;Personal Data&rdquo; we mean any information other than Ag Data or Financial Data, including, but not limited to: (a) Company name, points of contact, account users, employees, agents, responsible parties, etc., (b) contact information including, but not limited to, email address, business phone numbers, address, etc., (c) your pictures and likeness, (d) communications, information or other materials that you provide us, and (e) business relationship information, including information relating to your agreements with us, preferences, etc.</p>\n\n<p>When we refer to &ldquo;Data&rdquo; we mean all three types of data defined above, and when we refer to &ldquo;Your Data&rdquo; we mean data that you own and have granted us a license to use.</p>\n\n<p>We gather various types of Data from our Users in order to:</p>\n\n<ol>\n\t<li>we collect Personal Data from you to establish and manage our relationship with you, including setting up your user account and profile, contacting you about our Services, managing your account, etc.;</li>\n\t<li>analyze, personalize and update the Service;</li>\n\t<li>we collect Financial Data to determine your financial eligibility for our Services, extended terms or financing, manage our level of risk, administer or service your account, make reports to credit reporting agencies, as needed, collect on your debt, including through collection or legal proceedings, and as otherwise necessary for the provision of extended terms and/or financing and the protection of our business;</li>\n\t<li>send you marketing materials and information that we believe may be of interest to you;</li>\n\t<li>protect us against error, fraud, theft and damage to our goods and property;</li>\n\t<li>enable us to comply with applicable laws or regulatory requirements; and,</li>\n\t<li><a id=\"Q6\" name=\"Q6\"></a>for any other permitted business purposes.</li>\n</ol>\n\n<p>Since we only work with businesses and their authorized representatives, we do not knowingly collect or solicit Data from anyone under the age of 13. If you are under the age of 13, please do not attempt to register for the Services or send any Data. If we learn that we have collected Data from a child under the age of 13, we will delete that information as quickly as possible. If you believe that a child under the age of 13may have provided us Data, please contact us at&nbsp;<a href=\"mailto:info@farmersbusinessnetwork.com\">info@farmersbusinessnetwork.com</a>.</p>\n\n<p><strong>Changes.&nbsp;&nbsp;</strong>We&rsquo;re always working to improve the Services, so this Policy may need to change along with the Services. We reserve the right to change this Policy at any time, but if we do, we will bring it to your attention by placing a notice on the website, by sending you an email, and/or by some other means. If you don&rsquo;t agree with the new Policy, you are free to reject them; but that means you will no longer be able to use the Services.</p>\n\n<p><strong>Information Collection.</strong></p>\n\n<p><strong><em>Information You Provide to Us.&nbsp;&nbsp;</em></strong>Your Data may be transmitted to/from and stored &nbsp;by us or third party service providers in the U.S., Canada, and other countries such as Romania where we conduct engineering and software development. As such, Your Data may potentially be accessible to the law enforcement and national security authorities of those jurisdictions. For example, through the account registration process and/or through your account settings, we may collect Personal Data. We may also collect Financial Data in order to process a loan application. Certain information may be required to register with us, to take advantage of some of our features, or to order products from us.</p>\n\n<p>We may communicate with you if you&rsquo;ve provided us the means and consent to do so. We may use your Personal Data to send confirmations, promotions, invoices, technical notices, updates, security alerts, support, and administrative messages. For example, if you&rsquo;ve given us your email address, we may send you promotional email offers on behalf of other businesses or if you have asked us to provide those businesses with you contact information so they can follow up with you, or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive communications from us, please indicate your preference by emailing info@farmersbusinessnetwork.com.</p>\n\n<p><strong><em>Information Collected Automatically; Cookies.&nbsp;&nbsp;</em></strong>Whenever you interact with our Services, we automatically receive, cache, and record information from your browser or device, which may include your IP address and domain used to access our Services, location, device identification, &ldquo;cookie&rdquo; information, the type and version of browser and/or device you&rsquo;re using to access our Services, the page or feature you requested, and the page you entered and exited at (&ldquo;Traffic Data&rdquo;). &ldquo;Cookies&rdquo; are identifiers we transfer to your browser or device that allow us to recognize your browser or device, record your preferences, and tell us how and when pages and features in our Services are visited, by how many people and for how long. We may use Traffic Data to provide support services to individually identified users. You may be able to change the preferences on your browser or device to prevent or limit your device&rsquo;s acceptance of cookies, but this may prevent you from taking advantage of some of our features.</p>\n\n<p>Our Services include links to third party sites, content and ads that we believe <em>FBN </em>Members may find useful. Our linking to third party sites does not constitute a recommendation or endorsement by us of any content or information available through such site. These third parties may also transmit cookies to your browser or device, when you click on ads that appear on the Services. Also, if you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Policy does not cover the use of cookies by any third parties, and we aren&rsquo;t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor &ldquo;Do Not Track&rdquo; requests you have set using your browser or device.</p>\n\n<p>We may use the Traffic Data we collect to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve the Services &ndash; for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible, or for any and all permitted business purposes.</p>\n\n<p><strong><em>Information We May Collect From Other Sources. </em></strong>As a general rule, we collect information directly from you. In most circumstances, where the information we collect about you is held by a third party, we will obtain your permission before we seek out this information from such sources (such permission may be given directly by you, or implied from your actions.) From time to time, we may utilize the services of third parties and may also receive data collected by those third parties in the course of the performance of their services for us or otherwise. Where this is the case, we will take reasonable steps to ensure such third parties have represented to us that they have the right to disclose your information to us. When permitted by applicable law or regulatory requirements, we may collect information about you from other sources without your knowledge or consent.</p>\n\n<p>We may also collect market-related information, which may include information concerning market trends and activities impacting our business or your business. This information may include contract terms, financial information and other information for the purpose of market analysis and strategic planning. In addition, we may also collect information related to our media, investor and public relations activities and information related to our interactions with financial and other advisors.</p>\n\n<p>Our operations include, but are not limited to, activities related to: (i) creating and maintaining a farmer-to-farmer agronomic information network; (ii) using data science and machine learning to provide <em>FBN</em> Members with insights about each of their fields; (iii) the sale of farming related goods and services; and (iv) crop marketing. As such, we may also collect information from and about individuals and businesses participating in and/or impacted by these business activities.</p>\n\n<p><strong><em><a id=\"Q4\" name=\"Q4\"></a>Information Collected From Other Websites and Do Not Track Policy.&nbsp;&nbsp;</em></strong>Through cookies we place on your browser or device, we may collect information about your use of our Services including the website visited prior to reaching www.farmersbusinessnetwork.com. We do not collect information about your online activity after you leave our Services. Just like any other usage information we collect, this information allows us to provide and improve the Services and customize your online experience, and otherwise as described in this Policy. Your browser may offer you a &ldquo;Do Not Track&rdquo; option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. When you turn on the Do Not Track function in your browser, we stop collecting the information from your browser that allows us to tailor advertisements and other content specifically to you that is based on your visits to our advertising partners&rsquo; websites. Specifically, we stop collecting information from the unique browser cookie that links your browser to visits to third party sites. Do Not Track signals are set on a browser-by-browser basis, so you must set them on every browser you use if you do not wish to be tracked. Remember that this is just&nbsp;<em>our</em>&nbsp;Do Not Track policy, and we can&rsquo;t and don&rsquo;t make any promises about how third parties react when you set this signal on your browser.</p>\n\n<p><strong>Sharing of Your Data.&nbsp;&nbsp;</strong>We neither provide nor sell your Your Data in personally identifiable form to anyone except as expressly permitted. However, we may share Your Data with third parties as described in this Policy, our Terms of Service or when you provide your consent.</p>\n\n<p>We reserve the right to access, read, preserve, and disclose Your Data, as follows:</p>\n\n<ol>\n\t<li>as permitted or required by applicable laws or regulatory requirements, including, but not limited to, comply with search warrants, subpoenas or court orders;</li>\n\t<li>internally, across FBN Companies to provide you the Services;</li>\n\t<li>to enforce or apply our Terms of Service&nbsp;and other agreements;</li>\n\t<li>to protect the rights, property, or safety of FBN Companies, our employees, our <u>Users</u>, or others; and,</li>\n\t<li>when you have submitted a credit application, we may share Personal Data and Financial Data with (a) credit bureaus, credit reporting agencies, and financial institutions to confirm your financial situation and your initial and ongoing eligibility, (b) persons retained to administer or service your account, (c) persons involved in the financing or securitization or facilitation of the financing or securitizing of our business for the purpose of providing or facilitating such financing or securitization, and (d) other persons as necessary in connection with your credit application and the protection of our business.</li>\n</ol>\n\n<p><strong><em>Information that&rsquo;s no longer personally identifiable.</em></strong>&nbsp;We may anonymize Your Data so that you are not personally identified, and provide that information to our partners and third party service providers and make it available through our Services. We may also provide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose Your Data to a partner in a manner that would directly identify you personally, as an individual.</p>\n\n<p>We may allow advertisers and/or merchant partners (&ldquo;Advertisers&rdquo;) to choose the demographic information of users who will see their advertisements and/or promotional offers and you agree that we may provide any of the information we have collected from you in non-personally identifiable form to an Advertiser, in order for that Advertiser to select the appropriate audience for those advertisements and/or offers. For example, we might use the fact you are located in Omaha to show you ads or offers for Omaha businesses, but we will not tell such businesses who you are. Or, we might allow Advertisers to display their ads to users with similar usage patterns to yours, but we will not disclose usage information to Advertisers except in aggregate form, and not in a manner that would identify you personally. Note that if an Advertiser asks us to show an ad to a certain audience or audience segment and you respond to that ad, the Advertiser may conclude that you fit the description of the audience they were trying to reach.</p>\n\n<p>We may deliver a file to you through the Services (known as a &ldquo;web beacon&rdquo;) from an ad network. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network&rsquo;s servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site. You may be able to opt-out of web beacon tracking <a id=\"Q3\" name=\"Q3\"></a>conducted by third parties through our Services by adjusting the Do Not Track settings on your browser; please note that we don&rsquo;t control whether or how these third parties comply with Do Not Track requests.</p>\n\n<p><strong><em>Third Party Service Providers</em></strong><strong>.</strong>&nbsp;We employ other companies and people to perform tasks on our behalf and we may need to share Your Data with them to provide Services to you. For example, we may share Your Data with our third party IT, data processing and payment processing service providers so that we can operate our business. We do not reveal personally identifiable Data to parties outside our affiliates for their independent use unless: (1) you request or authorize it; (2) the information is provided to help complete a transaction initiated by you; (3) the Financial Data is provided to a credit bureau or similar information reporting agency; or (4) the disclosure otherwise is lawfully permitted or required. Any third-party service providers which are engaged by us must agree to follow the privacy standards set by this <a id=\"Q10\" name=\"Q10\"></a>Policy or similar standards that are equally protective of our members</p>\n\n<p><strong><em>Sharing Your Data with Other FBN Members and Professionals.</em></strong>&nbsp; Please note that the Services allow you to share Your Data with other parties, including other <em>FBN </em>Members and Professionals and you should make sure your sharing settings are configured to your preferences before sharing Your Data by: (1) clicking on &quot;Account&quot;, (2) clicking on &quot;My Team&quot;, (3) clicking on &quot;Edit Team Member&quot; next to person you wish to share Your Data with, (4) clicking &quot;Manage Permissions&quot;, and (5) selecting your sharing preferences. To the extent you share Your Data with others, you grant them a license to use and exercise all rights in Your Data, as permitted by the functionality of the Services. We are not responsible for how others use Your Data, or the advice or information they provide you when you share Your Data.</p>\n\n<p><a id=\"Q7\" name=\"Q7\"></a></p>\n\n<p><strong><em>Business Transfers</em></strong>. We may choose to buy or sell assets. If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of ownership, or a grant of a security interest in all or part of us through, for example, an asset share or share sale, or some other form of business combination, merger or joint venture, Your Data could be one of the assets transferred to or acquired by a third party. Even if that happens, this Policy (including the provisions governing changes to this Policy) will continue to apply to the use of Your Data.</p>\n\n<p><strong>Security of Personal Information.&nbsp;&nbsp;</strong>Your account is protected by a password for your privacy and security. Any payment terms or &ldquo;free trial&rdquo; terms presented to you in the process of using or signing up for Paid Services are part of these terms. Please visit our payment page at&nbsp;<a href=\"http://www.farmersbusinessnetwork.com/\">www.farmersbusinessnetwork.com</a>&nbsp;for information about membership costs and renewal fees.</p>\n\n<p><strong>Recurring Charges/ Automatic Renewal Conditions</strong>. For our annual or multi-year membership services, you agree that your default payment card will automatically be charged by us (through our payment card processing service provider) each year (or on the applicable anniversary for multi-year subscriptions) at the then-current applicable membership rate (see Price Adjustments, below), until you cancel your membership or until prohibited by applicable law. If your default payment card does not process or honor payment, we reserve the right to automatically charge any other payment cards connected to your account. You may cancel your annual subscription by contacting FBN Support (phone: 1.844.200-FARM or email support@farmersbusinessnetwork.com) or directly through your account at any time. If you wish to terminate your membership and avoid a charge for the subsequent year, you must do so at least two (2) days before the annual renewal date of your membership. The annual renewal date is the same day of the year that you first signed up. If you do not cancel at least two (2) days before the annual renewal date for your membership, but you do cancel before your annual renewal date, contact us for a refund. If you cancel after your annual renewal date, you may be charged for that year and your cancellation would then be effective the following year, subject to applicable law. We will not send you an annual statement. Receipts for recurring charges can be viewed and printed from your account. If you revoke authorization to charge your payment card, or if for any reason your payment card issuer does not process or honor payment, we reserve the right to cancel your subscription or suspend your use of the Services.</p>\n\n<p><strong>Price Adjustments</strong>. We may modify our prices at any time or modify which Services are included. If we modify our price for any membership which renews automatically, we will give you notice, either in your account or through other means, of the new prices at least thirty (30) days before the beginning of the renewal term &nbsp;in which the prices will be effective. If you (i) do not cancel your subscription as described in the &lsquo;Recurring Charges/Automatic Renewal Conditions&rsquo; section above, or (ii) are located in a jurisdiction that requires your explicit agreement, you agree to the new prices and authorize us to charge your payment card accordingly.</p>\n\n<p><strong>Payment Methods. </strong>For membership related charges, we only accept credit cards and checks. For <em>FBN Direct</em><sup>SM</sup> purchases, we only accept ACH payments, credit cards, and checks. We reserve the right to charge you any processing or transaction fees. When we partner with third parties, such as NACHA, Stripe, Plaid, or banks, to offer you different payment methods, you are solely responsible for reviewing and complying with those third parties&#39; respective terms and conditions, and for completing any required authorization forms or other documents requested by us or those third parties. Furthermore, you consent to us disclosing your Financial Data and Personal Data to such payment processors for purposes of processing payment. We reserve the right to add or discontinue any payment method at any time and without notice. We may modify or discontinue a particular Service, or the requirements for access and use, at any time. Certain Services may operate best when <em>FBN </em>Members contribute Ag Data. As a result, we may from time to time require you to provide certain kinds of Ag Data in order to use certain Services. To the fullest extent permitted by law, you are prohibited from using the Services to benefit other parties, for resale, wholesale or retail purposes, or to provide other services. If your use of the Services is prohibited by applicable laws, then you aren&rsquo;t authorized to use the Services.&nbsp;</li>\n\t<li>You will not share your account or password with anyone, and you&rsquo;ll take reasonable steps to protect the security of your account and your password. You&rsquo;re responsible for any activity associated with your account and subaccounts.</li>\n\t<li>You will not contribute any Content or otherwise use or interact with the Services in a manner that:\n\t<ul style=\"list-style-type:circle;\">\n\t\t<li>infringes or violates the intellectual property rights or any other rights of anyone else (including ours);</li>\n\t\t<li>is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable or unlawful;</li>\n\t\t<li>jeopardizes the security of your Farmer&rsquo;s Business Network account or anyone else&rsquo;s, such as allowing someone else to use your user name or password to access the Services (except on your behalf);</li>\n\t\t<li>violates the security of any computer network, or wrongfully obtains any passwords or security information;</li>\n\t\t<li>&ldquo;crawls,&rdquo; &ldquo;scrapes,&rdquo; or &ldquo;spiders&rdquo; any page, data, or portion of or relating to the Services or Content (through use of manual or automated means) or copies any significant portion of the Content;<a id=\"Q6\" name=\"Q6\"></a></li>\n\t\t<li>decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services; or</li>\n\t\t<li>is false or misleading.</li>\n\t</ul>\n\t</li>\n</ul>\n\n<p>&nbsp;</p>\n\n<p><strong>Changes.</strong></p>\n\n<p><strong><em>Changes to these Terms and Conditions</em></strong><strong>.&nbsp;&nbsp;</strong>We&rsquo;re always working to improve the Services, so these Terms may need to change along with the Services. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods is specifically excluded from application to these Terms. The parties hereby consent to the exclusive jurisdiction of the state or federal courts located in San Francisco, California or the Northern District of California, respectively.</p>\n\n<p><strong><em>Canadian Users only- </em></strong>These Terms are governed by and will be construed under the laws of the Province of Alberta, without regard to the conflicts of laws provisions thereof. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods is specifically excluded from application to these Terms. You agree, subject to the arbitration provision below, to the exclusive jurisdiction of the courts located in Calgary Alberta, or the Federal Court as applicable, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.</p>\n\n<p><strong>Severability; No Waiver; Entire Agreement</strong> The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You and us agree that these Terms are the complete and exclusive statement of the mutual understanding between you and us, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. Notwithstanding, from time to time, you and us may enter into other agreements concerning the sale and/or purchase of services or products, or for other purposes, which are subject to additional terms and conditions. In the event of any conflict or inconsistency between those terms and conditions and these Terms, those terms and conditions shall take priority. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of FBN Companies, and you do not have any authority of any kind to bind us in any respect whatsoever. Except for the FBN Parties, you and us agree there are no third party beneficiaries intended under these Terms.</p>\n\n<p><strong><em>Agreement to Arbitrate and Class Action Waiver.&nbsp;&nbsp;</em></strong>We encourage you to contact our Customer Support team at support@farmersbusinessnetwork.com in the event of any disputes. If we can&rsquo;t resolve a dispute through Customer Service,&nbsp;<strong><em>you and us agree to resolve any claims relating to the Terms, the Privacy Policy, or the Services through final and binding arbitration.&nbsp;</em></strong>This applies to all kinds of claims under any legal theory.&nbsp;It also applies even after you have stopped using our Services.</p>\n\n<p>An arbitration proceeding is before a neutral arbitrator instead of a judge and jury, so&nbsp;<strong><em>we are all giving up our right to a trial before a judge and jury</em></strong>. Arbitrations have different rules than lawsuits in court. They are less formal than lawsuits in courts, and provide limited opportunity to force the other side to share information relevant to the dispute&mdash;a process called discovery. The arbitrator can award the same damages and relief on an individual basis that a court can award to an individual. But, if any of us does not like the arbitrator&rsquo;s decision, the courts only have a limited ability to change the outcome of arbitration or make the arbitrator reconsider his or her decision. If we have a dispute about whether this agreement to arbitrate can be enforced or applies to our dispute, we all agree that the arbitrator will decide that, too.</p>\n\n<p>The arbitration will be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. The arbitration will take place in San Francisco, California for U.S. Users and in Calgary, Alberta for Users Members.</p>\n\n<p><strong><em>No Class Actions.</em></strong></p>\n\n<p>You agree that you can only bring a claim against any of the FBN Parties on an individual basis. That means:</p>\n\n<ol>\n\t<li>You cannot bring a claim as a plaintiff or class member in a class action, consolidated action or representative action.&nbsp;</li>\n\t<li>The arbitrator cannot combine more than one person&rsquo;s claim into a single case, and cannot preside over any consolidated, class or representative arbitration proceeding (unless you and us both agree to change this).&nbsp;</li>\n\t<li>The arbitrator&rsquo;s decision or award in one person&rsquo;s case can only impact the person who brought the claim, and cannot be used to decide other disputes with other members.</li>\n</ol>\n\n<p>If a court decides that this subsection on &ldquo;No Class Actions&rdquo; is not enforceable or valid, then the entire Agreement to Arbitrate and Class Action Waiver will be null and void, but the rest of the Terms and Privacy Policy will still apply.</p>\n\n<p id=\"tos-revision\"><strong>Change Log &ndash; This change log is a summary only. If your subscription is a free trial, payment will be due immediately upon expiration of your free trial. If you have a valid credit card on file with us, we will automatically charge that card upon expiration of your free trial.
