  2. E3 CONTEST
  3. OFFICIAL RULES
  4. 1. No purchase necessary. To be eligible to win, a participant must be a legal resident of Canada who is 21 years of age or older at the time of entry. Any potential participant who is an employee or contingent staff of Microsoft Corporation or Microsoft Canada Inc. (“Microsoft”), their affiliated companies, advertising agencies, prize suppliers or other representatives involved in any part of the administration and execution of this contest, or a member of the respective immediate families of such employees or anyone with whom such employees are domiciled (whether related or not) is ineligible to participate in the contest. “Immediate family” is defined as parents, siblings, children, spouse or common law partner (regardless of where they live). In addition, Microsoft is committed to complying with government gift and ethics rules and therefore government employees are not eligible to participate.
  5. 2. The contest will run from Monday, May 1, 2017 at 5:00:00 p.m. Eastern Time (“ET”) to Sunday, May 14, 2017 at 11:59:59 p.m. ET (the “Contest Period”).
  6. 3. To enter, eligible participants must: Visit xbox.com/en-CA/promotions/ultimate-xbox-canada-fan (“Contest Website”) during the Contest Period. Create and submit a video not longer than 60 seconds about why they should be named the biggest Xbox Canada fan (the “Video”). Follow the instructions on the Contest Website to submit your entry information and post your video to a social media channel with the hashtag: #XboxCAFanContest. The entry information and the Video together are referred to as an Entry. All Entries must be submitted within the Contest Period to be eligible. There is a limit of one (1) Entry per person/per email address. Participants will be judged on a scale from one (1) to ten (10) based on the following evenly weighted criteria:
  7. (i) Enthusiasm for the Xbox brand
  8. (ii) Creativity (the “Judging Criteria”)
  9. (b) Each Video:
  10. • Must be the original work of the Entrant produced for this Contest;
  11. • Must not have been entered in or won previous contests or awards;
  12. • Must not have been published previously in any medium; must not infringe on any party’s intellectual property, including but not limited to copyright, trademark or right of privacy of publicity or any other rights;
  13. • Must be suitable for display and publication on any social media platform worldwide (e.g. it may not be obscene or indecent, including but not limited to nudity or profanity); it must not contain obscene or pornographic material, it must not contain defamatory statements or messages (including but not limited to words, images, or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic or other group), it must not include threats to any person, place, business, group or world peace, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations;
  14. • Must not feature or reference any trademarks, logos, characters or any copyrighted works other than what is inherently required to create the Video; and,
  15. • Must not feature alcohol products, tobacco products (including cigarettes, cigars, pipe tobacco, chewing tobacco, electronic cigarettes, and snuff), contraceptives, feminine hygiene products, fireworks, firearms and ammunitions, prescription drugs, illegal drugs and related drug paraphernalia, nutritional supplements, lotteries and gambling (including horse or dog racing and products or services related to gambling)

  17. Microsoft reserves the right to disqualify an Entry if in its reasonable opinion does not comply with these Official Rules or if it does not comply with applicable law or regulation.

By submitting an Entry, you irrevocably grant Microsoft, its respective affiliates, legal representatives, assigns, agents and licensees, the unconditional, unlimited and perpetual right and permission to reproduce, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit, edit and/or otherwise use or reuse (without limitation as to when or to the number of times used) the Entry, including, but not limited to, depictions contained therein (in each case, as submitted or as edited/modified in any way by Microsoft in its sole discretion), as well as to use your name, image, likeness, voice, and/or statements regarding your participation in this Contest (with or without using your name) in any and all media without limitation as to time or territory, and without additional compensation to, notice to, or approval from you or any other party. You waive intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude Microsoft’s use of the Entry, and agree not to sue or assert any claim against Microsoft for the use of the Entry or your likeness or statements. You acknowledge that by entering your Entry, Microsoft does not waive any rights to use similar or related ideas previously known to Microsoft, or developed by its employees, or obtained from sources other than you.

  21. 4. Entries will be judged on May 15, 2017 at 1950 Meadowvale Blvd. Mississauga, Ontario L5N 8L9. The participant with the highest cumulative score will be selected as a potential winner. The chances of being selected depend upon the number of eligible entries received and the quality of your submission as it rates against the Judging Criteria.
  22. 5. The selected participant will be notified by email within seven (7) days of the judging and, prior to being declared a winner, will be required to correctly answer, unaided and without mechanical or electronic assistance, a time-limited, mathematical skill-testing technical question, to be administered via the email address provided.
  23. 6. If the selected participant is unable to correctly answer the skill-testing question, cannot be reached by phone or email within seven (7) days of the judging, or otherwise does not meet all contest conditions, his or her prize will be forfeited and the entrant with the next highest score will be selected.
  24. 7. There is one (1) prize available to be won which consists of two (2) Fan Fest tickets for Sunday, June 11, two (2) E3 Event tickets for June 13-15, 2017 five (5) nights standard hotel accommodation (double occupancy) in a hotel selected by Microsoft and return air transportation for two (2) to Los Angeles from the Canadian commercial airport nearest the winner’s residence and $500CDN in spending money.. Approximate retail value $5,000CDN based on sample Toronto departure. Actual value will vary depend on point of departure. Winner is not entitled to, and will not receive, the difference between the approximate stated value and the actual value of the Prize. The prize will be couriered to the winner’s home within one (1) week of the receipt of the signed declaration and release. All taxes related to a prize are payable by the winner. Winner will be responsible for all ground transportation, meals and all personal and other expenses not specifically described above as included in the prize. Travel arrangements will be made through Microsoft or its agent. Winner and guest are responsible for any required travel documentation and must travel together when required or the prize will be forfeited. Winner and guests must be free from any legal restrictions to travel as required and Microsoft will not be responsible for inability to do so.
  25. 8. The prize is non-transferable and no cash alternatives will be provided except at Microsoft’s sole discretion. Microsoft reserves the right to substitute the prizes described above with prizes of equal or greater value.
  26. 9. By entering, all participants agree to abide by these Official Rules and the decisions of Microsoft which are final and binding. All entries become the property of Microsoft and will not be returned.
  27. 10. To be declared a winner, a selected participant will be required to sign a declaration and release to: (a) confirm compliance with these Official Rules; (b) release Microsoft from all liability; (c) accept the prize as awarded; and (d) consent to the use of winner’s name, city and/or province of residence, photograph, voice, image, likeness, biographical information and information about the prize, for any publicity or programming purposes, commercial or otherwise, throughout the world in any and all media used by Microsoft and its advertising and promotional agencies in connection with the contest, without payment or compensation.
  28. 11. The contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited.
  29. 12. No correspondence will be entered into with participants except with the selected entrant.
  30. 13. The personal information collected in connection with the administration of this contest will be managed in accordance with Microsoft’s privacy statement which is available at http://go.microsoft.com/fwlink/?LinkId=521839.

Subject to the approval of the Régie des alcools des courses et des jeux, Microsoft reserves the right in its sole discretion to cancel or suspend the contest should causes beyond the control of Microsoft corrupt the administration, security, fairness, integrity or proper conduct of the contest (such as tampering or infection by computer virus, fraud, technical failures, printing or distribution errors, or any other causes or occurrences have compromised the fairness or integrity of the contest) If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of prizes than contemplated in the contest rules, there will be a random draw amongst all eligible prize claimants after the contest closing date to award the prize.
  32. 15. Microsoft assumes no responsibility for any (i) late, lost, delayed, not received, damaged, misdirected, incomplete, defective or altered entries; (ii) failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient or traffic congestion on the Internet or at any web site; or (iii) any combination thereof, including any injury or related damage to entrants or any other persons, whether computer-related or resulting from participation or downloading of any materials in this contest.
  33. 16. With respect to Québec residents and to entries originating within the Province of Québec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  34. 17. In the event of any discrepancy or inconsistency between these Official Rules and disclosures or other statements contained in any contest-related materials, including but not limited to the contest entry form, or point of sale, television, print or online advertising, these Official Rules shall prevail, govern and control.
  35. 18. Any questions, comments or complaints regarding the contest must be directed solely to Microsoft. All trade-marks are the property of their respective owners.
