  1. Sedition
  2. Article 544: The prisoners of sedition are those who, without being included in the crime of rebellion, rise up publicly and tumultuously to prevent, by force or outside the legal channels, the application of the Laws or any authority, official corporation or public official, the legitimate exercise of their functions or the fulfillment of their agreements, or of the administrative or judicial resolutions.

  4. Article 545: 1. Those who have induced, sustained or directed sedition or appear in it as its main perpetrators, shall be punished by imprisonment of eight to ten years, and ten to fifteen years, if they were persons in authority. In both cases, they will also be subject to absolute disqualification [from public employment or office] for the same period of time.
  5. 2. Outside these cases, the penalty shall be four to eight years' imprisonment, and special disqualification from public employment or office for four to eight years.

  8. Rebellion
  9. Those who rise up violently and publicly for any of the following purposes are guilty of the crime of rebellion:

  11. 1.To repeal, suspend or modify the Constitution in whole or in part.
  12. 2. To remove or deprive, in whole or in part, the King or Queen or the Regent or members of the Regency of their prerogatives and powers, or to force them to perform an act contrary to their will.
  13. 3. To prevent the free celebration of elections for public offices.
  14. 4. To dissolve the General Courts, the Congress of Deputies, the Senate or any Legislative Assembly of an Autonomous Community, to prevent them from meeting, deliberating or resolving, to remove any resolution from them or to take away any of their powers or competences.
  15. 5. To declare the independence of a part of the national territory.
  16. 6. To substitute for another the Government of the Nation or the Governing Council of an Autonomous Community, or to use or exercise by itself or to deprive the Government or the Governing Council of an Autonomous Community, or any of its members of their powers, or to prevent or restrict their free exercise, or to force any of them to carry out acts contrary to their will.
  17. 7. Remove any kind of armed force from the obedience of the Government.

  19. Public disorders
  20. Those who, acting in a group or individually but protected by it, disturb the public peace by executing acts of violence on persons or things, or by threatening others with such acts, shall be punished by imprisonment from six months to three years.
  21. These penalties shall be imposed without prejudice to any penalties that may correspond to the specific acts of violence or threats that have been carried out.

  23. Disobedience
  24. Those who, without being covered by article 550, resist or seriously disobey the authority or its agents in the exercise of their duties, or private security personnel, duly identified, who carry out private security activities in cooperation with and under the command of the Security Forces and Corps, shall be punished by imprisonment of three months to one year or a fine of six to eighteen months.
