  7. we learned late last year before the
  8. 0:02
  9. election several days before the
  10. 0:03
  11. election there's a public resource
  12. 0:06
  13. called the FBI bulked file which would
  14. 0:09
  15. be just google FBI vault file you'll see
  16. 0:12
  17. that after cases are disposed of one way
  18. 0:15
  19. another frequently the FBI will put
  20. 0:17
  21. public information out there on that
  22. 0:20
  23. site and so they're two separate dumps
  24. 0:22
  25. one around November I think first are
  26. 0:26
  27. there about 2nd of 2016 and one several
  28. 0:30
  29. weeks after that totally about 600 pages
  30. 0:33
  31. and the people in your crowdsource group
  32. 0:36
  33. who are familiar with FBI files will
  34. 0:40
  35. have a field day going through the many
  36. 0:41
  37. pages that are not redacted because what
  38. 0:44
  39. these what he's confirmed is that
  40. 0:46
  41. actually there was an FBI investigation
  42. 0:49
  43. actually the US Attorney was serious
  44. 0:51
  45. about it and actually by early December
  46. 0:54
  47. 2001 James Comey himself was became the
  48. 1:00
  49. US Attorney leading the charge out of
  50. 1:02
  51. the Southern District in this
  52. 1:03
  53. investigation and on September 4th 2001
  54. 1:06
  55. we a week sadly before the events Rhetta
  56. 1:10
  57. Benson's of number 11th robert muller
  58. 1:13
  59. what became the head of the FBI
  60. 1:15
  61. so these notes joe numerate gives names
  62. 1:21
  63. of many people who are involved it
  64. 1:23
  65. doesn't give the names for the people
  66. 1:25
  67. who were interviewed but it gives you
  68. 1:27
  69. the for federal code statutes that they
  70. 1:30
  71. were investigating and they
  72. 1:32
  73. characterized that the case as US
  74. 1:35
  75. against william j clinton and of the
  76. 1:39
  77. four and other people and the forum code
  78. 1:43
  79. statutes include public corruption lying
  80. 1:46
  81. and interfering in a unity government
  82. 1:50
  83. matter so if you have it there before
  84. 1:52
  85. you you can see that there was major
  86. 1:55
  87. league activity it went on until early
  88. 1:58
  89. 2005 and you know what shocks me when I
  90. 2:01
  91. first saw this is that you know this is
  92. 2:03
  93. prime massage evidence on the FBI
  94. 2:05
  95. website put out to confirm that indeed
  96. 2:08
  97. there was an investigation and that
  98. 2:10
  99. instead of driving to an indictment to a
  100. 2:12
  101. conviction which is
  102. 2:13
  103. abandoned right around I noticed this
  104. 2:16
  105. thing was open up on November 18 2004 so
  106. 2:20
  107. muller and call me were involved
  108. 2:24
  109. actively involved in some in inserting
  110. 2:27
  111. Colby's case leading for time this
  112. 2:29
  113. investigation they couldn't get the job
  114. 2:31
  115. done query you know how hard were they
  116. 2:34
  117. really trying right and were they going
  118. 2:37
  119. through the paces in that one now so
  120. 2:39
  121. that that's that's one early thing then
  122. 2:41
  123. the second thing and what you can see
  124. 2:43
  125. from this what it's in the public domain
  126. 2:44
  127. and mind you the FBI the US Attorney and
  128. 2:47
  129. others would have had a lot of
  130. 2:48
  131. information they think to describe it as
  132. 2:51
  133. a gold mine or you know the pressure
  134. 2:53
  135. drove regeneration yet yeah and and they
  136. 2:57
  137. weren't able to put two and two together
  138. 2:58
  139. and see that this was obviously a
  140. 3:00
  141. charity front there's exactly anytime
  142. 3:02
  143. print exactly when call me took got
  144. 3:05
  145. involved you could go and read Joe
  146. 3:07
  147. connaissance book now Joe is a
  148. 3:09
  149. left-leaning actually a very gifted
  150. 3:11
  151. author and believe it or not in his book
  152. 3:13
  153. man of the world which came out right
  154. 3:15
  155. before the election last year it's a
  156. 3:17
  157. balanced you know fairly balanced
  158. 3:19
  159. obviously it's pro question but it's a
  160. 3:21
  161. fairly balanced book and it talks about
  162. 3:23
  163. the pros and the cons of what was going
  164. 3:26
  165. on just at that time that early in 2002
  166. 3:28
  167. it recounts that Maggie Williams the
  168. 3:31
  169. chief of staff of the Clinton Foundation
  170. 3:33
  171. then began to work with IRA Magaziner
  172. 3:36
  173. on what he doesn't say in the book but I
  174. 3:38
  175. can tell you was a completely illegal
  176. 3:41
  177. operation to subcontract in the name of
  178. 3:45
  179. the Clinton Foundation to IRA Magaziner
  180. 3:47
  181. consulting company and various
  182. 3:49
  183. volunteers an effort to in theory fight
  184. 3:51
  185. hiv/aids around the world was never
  186. 3:53
  187. authorized lawfully in any jurisdiction
  188. 3:55
  189. never accounted for proper this started
  190. 3:58
  191. in 2002 just as the FBI was investigated
  192. 4:01
  193. just as Comey was investigating and the
  194. 4:03
  195. investigation went on for three years
  196. 4:04
  197. and they couldn't catch anything you
  198. 4:07
  199. know it's just preposterous so good I'm
  200. 4:11
  201. not done okay alright so so that's the
  202. 4:14
  203. first leg the second piece is that
  204. 4:17
  205. Muller stays in as head of the FBI from
  206. 4:20
  207. September 4th 2001 to September I think
  208. 4:25
  209. it was around the same time December 4th
  210. 4:28
  211. 2013 so all along the way
  212. 4:31
  213. you know first here's a botched I would
  214. 4:34
  215. argue a botched initial investigation
  216. 4:36
  217. and then they left this Clinton
  218. 4:37
  219. Foundation metastasize into a global
  220. 4:40
  221. scandal and then under Obama actually in
  222. 4:44
  223. the you know as Hillary and Bill
  224. 4:46
  225. negotiate with incoming Obama
  226. 4:48
  227. administration starting in November 2008
  228. 4:50
  229. the Clinton Foundation's a disaster at
  230. 4:53
  231. that point you can see that in the
  232. 4:54
  233. public violence did you go to New York
  234. 4:55
  235. state California look at the 2007 annual
  236. 4:58
  237. report look at the correspondence file
  238. 5:00
  239. you look at Massachusetts what happened
  240. 5:03
  241. to their core hiv-aids operation up in
  242. 5:05
  243. Massachusetts you could tell it was
  244. 5:07
  245. flagrantly in violation of the law then
  246. 5:10
  247. you check in France in public records
  248. 5:12
  249. and you'll see that the French
  250. 5:13
  251. government opened an investigation that
  252. 5:16
  253. took a while to go through which
  254. 5:18
  255. uncovers massive in proprieties now they
  256. 5:20
  257. don't bring it home in France they don't
  258. 5:22
  259. bring it across the finish line they
  260. 5:23
  261. don't trigger a u.s. investigation who
  262. 5:25
  263. knows why that may have been covered up
  264. 5:28
  265. you know there's some question in my
  266. 5:31
  267. mind as to who in France at that time
  268. 5:32
  269. may have been it looked at this and said
  270. 5:35
  271. you know this is great
  272. 5:36
  273. we have the questions we have Obama an
  274. 5:38
  275. embarrassing place you have leverage so
  276. 5:40
  277. you know we don't yet really know what
  278. 5:42
  279. happened there but all the while Muller
  280. 5:44
  281. is on top of the FBI at this time in
  282. 5:47
  283. addition the largest vendor the most
  284. 5:50
  285. significant largest company that was a
  286. 5:52
  287. vendor to this hiv/aids things company
  288. 5:54
  289. called ran boxy there by February 14
  290. 5:58
  291. 2006 an investigation was opened that
  292. 6:02
  293. was ultimately led by rod Rosen C
  294. 6:04
  295. interim boxy and the question of whether
  296. 6:06
  297. they were selling and we were buying to
  298. 6:09
  299. the Clinton Foundation and to our
  300. 6:11
  301. government through PEPFAR presidents of
  302. 6:13
  303. Emergency Plan for AIDS relief whether
  304. 6:15
  305. we were buying adulterated trust in
  306. 6:17
  307. distributing around the world finally in
  308. 6:20
  309. 2009 and that vesting stretch that
  310. 6:22
  311. investigation took seven years from
  312. 6:24
  313. February of 2006 that may is 2013 and
  314. 6:27
  315. rod Rosen seems group did not catch that
  316. 6:30
  317. there are two more pieces the second
  318. 6:32
  319. third and out of four pieces is that
  320. 6:35
  321. starting in 2008-2009 timeframe Raja
  322. 6:39
  323. Gupta so now this grace felon who at one
  324. 6:41
  325. point ran one of the largest most
  326. 6:43
  327. significant consulting firms in the
  328. 6:44
  329. world Mackenzie Rashad Gupta began to be
  330. 6:47
  331. under scrutiny presumably by our FBI by
  332. 6:50
  333. again in the Southern District of New
  334. 6:51
  335. York for insider trading and his ties to
  336. 6:55
  337. the Clintons you know should have been
  338. 6:57
  339. known by that time they were Rajat Gupta
  340. 6:59
  341. had been involved with the connecting
  342. 7:02
  343. Clinton Foundation up to ran boxing he's
  344. 7:04
  345. been involved hiring Chelsea Clinton in
  346. 7:07
  347. McKinsey he'd been involved with a
  348. 7:09
  349. company called mind spirit LLC's the
  350. 7:11
  351. matter of public record funneling money
  352. 7:13
  353. to the Clintons without the complete
  354. 7:15
  355. disclosure of the significance of that
  356. 7:17
  357. you know tracing all the related party
  358. 7:19
  359. connections so that investigation I
  360. 7:21
  361. would argue didn't go as hard as it
  362. 7:23
  363. could have gone against Rashad Gupta and
  364. 7:25
  365. the final piece is that beginning in
  366. 7:28
  367. January 2010 uh something called the the
  368. 7:31
  369. clinton bush haiti fund was organized
  370. 7:34
  371. and in the 2010 filings for the clinton
  372. 7:37
  373. foundation the largest donation largest
  374. 7:40
  375. single expensive largest single item was
  376. 7:43
  377. a grant of thirty seven point two
  378. 7:45
  379. million through the clinton bush haiti
  380. 7:46
  381. fund from the main fund but the problem
  382. 7:49
  383. with it is they list the grant is going
  384. 7:51
  385. to clinton bush haiti fund in maryland
  386. 7:53
  387. where no such fund was ever registered
  388. 7:55
  389. and this is again right under the nose
  390. 7:58
  391. of rod rose messina and i said there
  392. 7:59
  393. were four pieces there's a fifth the 50s
  394. 8:02
  395. is laureate the for-profit educational I
  396. 8:05
  397. would argue fraud that began as a
  398. 8:08
  399. leveraged buyout in two thousand six
  400. 8:09
  401. seven operating from again Maryland
  402. 8:12
  403. where rod Rosenstein was a seated US
  404. 8:15
  405. Attorney and they didn't seem to catch
  406. 8:17
  407. any of this so you know this thing there
  408. 8:20
  409. are so many conflicts here in so many
  410. 8:21
  411. areas where if you had you know the type
  412. 8:24
  413. of team that is apparently currently
  414. 8:26
  415. targeting Trump and has already managed
  416. 8:28
  417. unlike in the Clinton Foundation
  418. 8:29
  419. investigation to immediately get it
  420. 8:31
  421. seems the grand jury impaneled makes you
  422. 8:34
  423. have the same approach the same fair
  424. 8:36
  425. minded approach that in theory Muller's
  426. 8:38
  427. taking against Trump trained on this
  428. 8:40
  429. these five strands I just told you that
  430. 8:42
  431. you know we have to start building a
  432. 8:45
  433. large number of additional prisons to
  434. 8:47
  435. put away all the trustees and all the
  436. 8:50
  437. professionals the accountants the
  438. 8:51
  439. lawyers the consult
  440. 8:52
  441. the donors I mean this is a gigantic
  442. 8:55
  443. mess well and so on that note to you you
  444. 8:59
  445. bring me to the second question which is
  446. 9:02
  447. you know a lot of us are sort of feeling
  448. 9:06
  449. a little bit helpless in that we see
  450. 9:09
  451. that our law enforcement systems at the
  452. 9:13
  453. federal and local levels are so
  454. 9:16
  455. corrupted that you know prosecuting
  456. 9:18
  457. something like this seems impossible but
  458. 9:21
  459. you've identified you know an approach
  460. 9:25
  461. to this you know through the tax side of
  462. 9:29
  463. things that seems like it really is if
  464. 9:32
  465. you just got you know it's the easiest
  466. 9:35
  467. route to successfully taking the whole
  468. 9:39
  469. thing down because of the way that the
  470. 9:41
  471. relationships work between the donors
  472. 9:43
  473. and the foundations so can you talk a
  474. 9:46
  475. little bit about starting from spinning
  476. 9:48
  477. in terms of when what where the
  478. 9:51
  479. foundation went wrong from the start
  480. 9:52
  481. because I think you've said that
  482. 9:55
  483. initially they were never set up
  484. 9:57
  485. properly and then how that impacts all
  486. 10:00
  487. of these other foundations that have
  488. 10:02
  489. given to the Clinton Foundation right so
  490. 10:06
  491. when I started on this whole area of
  492. 10:08
  493. exposing fraud I began with a very
  494. 10:12
  495. complex entity General Electric which is
  496. 10:15
  497. you know was at the time a nine hundred
  498. 10:17
  499. billion dollar enterprise counting the
  500. 10:19
  501. market value its equity in its debt film
  502. 10:21
  503. 'i'm much larger than pledge foundation
  504. 10:25
  505. and far more complex when you're in the
  506. 10:27
  507. any area of for-profit land investment
  508. 10:30
  509. investing pooling corporate fraud and
  510. 10:33
  511. investment fraud is very difficult you
  512. 10:35
  513. have to prove what's called it's a latin
  514. 10:38
  515. term see enter as sdie nter which
  516. 10:41
  517. basically means knowing intent you
  518. 10:43
  519. knowing knowingly intended to defraud
  520. 10:46
  521. somebody then you have to prove that
  522. 10:48
  523. that action cause actual harm and in
  524. 10:52
  525. corporate fraud that's very difficult to
  526. 10:54
  527. do because corporations have armies of
  528. 10:56
  529. lawyers and they always argue that all
  530. 10:58
  531. decisions or team decisions and they
  532. 11:00
  533. always get legal opinions in accounting
  534. 11:02
  535. opinions and they have something called
  536. 11:03
  537. the business judgment rule that gives go
  538. 11:06
  539. to directors and executives amazing
  540. 11:08
  541. defensive Latins bucket yeah what
  542. 11:11
  543. defenses insulation so on the other hand
  544. 11:15
  545. why I got involved so actively in this
  546. 11:17
  547. in the beginning one of the important
  548. 11:19
  549. determining factors for me was when I
  550. 11:21
  551. realized that in charity fraud there is
  552. 11:23
  553. no such obligation all you have to do to
  554. 11:27
  555. prove solicitation and operating fraud
  556. 11:29
  557. is to prove that the disclosures on a
  558. 11:32
  559. charity like these which are called
  560. 11:33
  561. public charities they're continuously
  562. 11:35
  563. soliciting from the public if you can
  564. 11:38
  565. show that the disclosures that the
  566. 11:40
  567. public have are false and material is
  568. 11:42
  569. materially misleading that means that
  570. 11:45
  571. they you know they can train contain
  572. 11:48
  573. material for significant false
  574. 11:50
  575. statements or they'll mix material
  576. 11:53
  577. information which if you knew it might
  578. 11:56
  579. change your behavior might might if you
  580. 11:57
  581. knew that they were punk bilking
  582. 11:59
  583. investors if you knew that the
  584. 12:01
  585. executives had checkered records the
  586. 12:02
  587. trustees and that's what hold with help
  588. 12:05
  589. from you
  590. 12:07
  591. and you make a donation you could
  592. 12:08
  593. certainly argue that that you know it's
  594. 12:10
  595. the material fact so if you have the
  596. 12:12
  597. Cheerilee misleading disclosures and
  598. 12:13
  599. you're soliciting not collecting
  600. 12:15
  601. soliciting asking for money and in
  602. 12:18
  603. particularly asking for money across
  604. 12:19
  605. state lines using the telephone using
  606. 12:22
  607. the internet using the mails arm these
  608. 12:25
  609. are very serious crimes and so generally
  610. 12:30
  611. what happens when you look at in charity
  612. 12:32
  613. land thankfully most people operate
  614. 12:35
  615. charities there are exceptions but most
  616. 12:37
  617. people are honest and they get involved
  618. 12:39
  619. in that work not because it's explicitly
  620. 12:42
  621. not to make money but to give money away
  622. 12:44
  623. and to help people and often to do it
  624. 12:47
  625. anonymously or without taking you know
  626. 12:49
  627. credit and holding that action over the
  628. 12:51
  629. heads of the recipient so the laws are
  630. 12:54
  631. written such that when the IRS which
  632. 12:57
  633. would be the an IRS you know the federal
  634. 12:59
  635. IRS or a state taxing authority smells
  636. 13:02
  637. trouble they just simply contact the
  638. 13:06
  639. Attorney General in the state or the UN
  640. 13:08
  641. Department of Justice will the IRS
  642. 13:09
  643. contact the charity says let show us
  644. 13:11
  645. your books and you prove to us that you
  646. 13:14
  647. are complying with the law
  648. 13:15
  649. not the other way around you proved us
  650. 13:17
  651. another thing that's really crucial
  652. 13:20
  653. is that you don't get unbridled license
  654. 13:24
  655. to operate a charity is there that the
  656. 13:25
  657. rules are actually pretty clever you
  658. 13:27
  659. fill out an application into form called
  660. 13:29
  661. 10:23 it's incredibly detailed you may
  662. 13:33
  663. not lie on the form and you are granted
  664. 13:35
  665. a I would argue a conditional license
  666. 13:38
  667. bill mccoshen person when you read the
  668. 13:40
  669. language the IRS explicitly stated in
  670. 13:43
  671. January of 1998 when they granted the
  672. 13:45
  673. conditional what's called a
  674. 13:48
  675. determination letter based on your
  676. 13:50
  677. submission in this document we are
  678. 13:53
  679. granting you federal tax exemption
  680. 13:56
  681. assuming you carry out the activities
  682. 13:59
  683. and devote yourself for the purposes
  684. 14:01
  685. which are laid forth in this application
  686. 14:04
  687. and it is crystal clear in the
  688. 14:06
  689. application that this was a domestic
  690. 14:08
  691. charity it was not authorized to do any
  692. 14:11
  693. international activities in this to be a
  694. 14:13
  695. building and endowment the house the
  696. 14:17
  697. records of the two presidencies the
  698. 14:20
  699. house what are called presidential
  700. 14:21
  701. records which are defined by statute in
  702. 14:23
  703. the presidential Records Act of 1978
  704. 14:26
  705. so it's crystal clear that's what it was
  706. 14:29
  707. supposed to be how's those public
  708. 14:32
  709. records which are the property weed of
  710. 14:33
  711. people and create a research facility so
  712. 14:37
  713. scholars can study those records that's
  714. 14:39
  715. what this was authorized to do and
  716. 14:41
  717. nothing more than that and back when
  718. 14:43
  719. they applied the applications out there
  720. 14:45
  721. the public domain is on their website it
  722. 14:47
  723. is crystal clear they did not check the
  724. 14:51
  725. box marked nine ten or the they do not
  726. 14:54
  727. enter the activity code nine ten which
  728. 14:56
  729. is for international that did not enter
  730. 14:58
  731. activity codes to fight hiv/aids or gage
  732. 15:01
  733. and climate change or any of these
  734. 15:03
  735. things and these are specifically
  736. 15:05
  737. options that are available
  738. 15:06
  739. buta mark moreover when they registered
  740. 15:10
  741. in the states where they did register
  742. 15:11
  743. they never said they were going to be
  744. 15:13
  745. international they never said they would
  746. 15:15
  747. apply climate change they never said
  748. 15:17
  749. they were going to do of hiv/aids work
  750. 15:19
  751. in this early period and there's no
  752. 15:22
  753. record that they ever amended their
  754. 15:24
  755. Articles of Incorporation which is the
  756. 15:26
  757. only way that you can change your
  758. 15:28
  759. purposes now here I have to go out and
  760. 15:30
  761. cordon distinction the Clintons are fun
  762. 15:33
  763. of basically luring meaningful
  764. 15:37
  765. distinctions in the law there is a major
  766. 15:40
  767. league and I'm a lawyer but this is well
  768. 15:42
  769. coached by many lawyers foundations our
  770. 15:46
  771. operate and charities are authorized to
  772. 15:49
  773. get federal tax exemption only for
  774. 15:51
  775. specific purposes which are defined in
  776. 15:54
  777. statute 501 C 3 and are limited you are
  778. 15:57
  779. not allowed to go and set up it to the
  780. 15:59
  781. the trishna grand charity to do whatever
  782. 16:01
  783. suits your fancy tomorrow morning when
  784. 16:03
  785. you wake up you have to say this is a
  786. 16:05
  787. purpose and it is exclusively charitable
  788. 16:08
  789. within the meaning of that statute 501 C
  790. 16:10
  791. 3 our return 11 Code Section 501 C 3 and
  792. 16:14
  793. their Articles of Incorporation control
  794. 16:18
  795. what that definition is so you have to
  796. 16:21
  797. be precise in the Articles of
  798. 16:23
  799. Incorporation
  800. 16:23
  801. and nowhere in any of the US Articles of
  802. 16:27
  803. Incorporation does it state if the
  804. 16:30
  805. Clinton Foundation has the power to do
  806. 16:32
  807. all these things that they have in fact
  808. 16:33
  809. done and taking credit for which I would
  810. 16:35
  811. argue all illegal moreover if you're
  812. 16:39
  813. going to leave this one this is really
  814. 16:41
  815. astonishing there are many many
  816. 16:43
  817. agreements which you can find if you're
  818. 16:45
  819. persisted and you have time that are
  820. 16:47
  821. omitted from the Clinton Foundation
  822. 16:49
  823. website a crucial one of these is what's
  824. 16:51
  825. called a joint use and operating
  826. 16:52
  827. agreement between the Clinton Foundation
  828. 16:55
  829. and the National Archives believe it or
  830. 16:57
  831. not the record that I see shows that the
  832. 16:59
  833. president of the Clinton Foundation at
  834. 17:01
  835. the time Williams skip Rutherford and I
  836. 17:04
  837. are Magaziner and I believe Bill Clinton
  838. 17:06
  839. guiltily
  840. 17:07
  841. defrauded the National Archives
  842. 17:10
  843. themselves and I failed to tell the
  844. 17:13
  845. National Archives that they had engaged
  846. 17:15
  847. in this new hiv/aids activity
  848. 17:17
  849. internationally that they had created a
  850. 17:19
  851. new subsidiary they do not disclose that
  852. 17:21
  853. in the document I think they do not
  854. 17:23
  855. disclose the application for this new
  856. 17:26
  857. entity they do not disclose whether or
  858. 17:28
  859. not this new entity had ever gotten
  860. 17:30
  861. what's called a determination letter for
  862. 17:32
  863. that activity I see no evidence that
  864. 17:34
  865. they ever got that activity that
  866. 17:36
  867. authorization and so between April 20th
  868. 17:39
  869. 2004 in November 18th 2004 there's quite
  870. 17:43
  871. a public record of Clinton Foundation
  872. 17:46
  873. executives defraud
  874. 17:47
  875. donors and even defrauding our National
  876. 17:49
  877. Archives because under the law the way
  878. 17:52
  879. in which the Clinton Foundation
  880. 17:54
  881. organized its donation to the National
  882. 17:56
  883. Archives they granted a 19 what in
  884. 17:59
  885. effect a 99 year license to use a
  886. 18:02
  887. proportion of portion of this facility
  888. 18:04
  889. in Little Rock to the National Archives
  890. 18:06
  891. in order for that grant to be effective
  892. 18:10
  893. the Clinton Foundation would have to be
  894. 18:11
  895. a lawfully organized and operated
  896. 18:14
  897. charity on the date of the grant
  898. 18:16
  899. November 18 2004 and all the way forward
  900. 18:19
  901. and they had broken their authority and
  902. 18:22
  903. put themselves they are now in a
  904. 18:24
  905. position where could we ever get a new
  906. 18:26
  907. head of the IRS who is honest we
  908. 18:28
  909. certainly don't have one now and a head
  910. 18:30
  911. of the acting a head of the charities
  912. 18:32
  913. divisions on us we also don't have one
  914. 18:34
  915. now if we ever were to get fair minded
  916. 18:36
  917. honest people who would follow the law
  918. 18:38
  919. they would take a look at this record if
  920. 18:40
  921. they're not already doing so and they
  922. 18:42
  923. would retro actually revoke the license
  924. 18:45
  925. of this charity as far back as I would
  926. 18:48
  927. argue the very beginning and in so doing
  928. 18:51
  929. they would present the trustees with a
  930. 18:53
  931. gigantic
  932. 18:54
  933. tax bill and they would penalties and
  934. 18:57
  935. interest for corporate income taxes as
  936. 18:59
  937. well as presenting significant donors
  938. 19:02
  939. like the Gates Foundation and others
  940. 19:03
  941. with gigantic tax bills when I say
  942. 19:06
  943. gigantic I would see scope here at
  944. 19:09
  945. federal level if I really want it to be
  946. 19:11
  947. aggressive and send a message for tens
  948. 19:14
  949. of billions of dollars in recovery ends
  950. 19:17
  951. of billions of dollars and then in at
  952. 19:19
  953. state level the tax rates are lower so
  954. 19:21
  955. it's smaller amounts but it's still the
  956. 19:23
  957. many billions of dollars and last I
  958. 19:26
  959. checked the federal government's in
  960. 19:27
  961. deficit most of the big states are in
  962. 19:30
  963. deficit I think we need to collect our
  964. 19:32
  965. tax revenue and I think a lot of these
  966. 19:34
  967. people are very rich and have the
  968. 19:36
  969. wherewithal to pay their fair share of
  970. 19:38
  971. taxes was there not a an IRS audit in
  972. 19:44
  973. Dallas occurring last year I thought I
  974. 19:47
  975. had read that yeah so clean so what
  976. 19:51
  977. happened is the you know there is one
  978. 19:54
  979. Ely at least one Ely Congress person who
  980. 19:58
  981. happens to be a woman named Marsha
  982. 19:59
  983. Blackburn Marsha Blackburn
  984. 20:01
  985. earng was instrumental in pushing the
  986. 20:05
  987. FTC Federal Trade Commission to go after
  988. 20:07
  989. something alternatively called the Texas
  990. 20:09
  991. cancer charity group or the Tennessee a
  992. 20:13
  993. charity group these were for charities
  994. 20:16
  995. run by family that were just gold frauds
  996. 20:18
  997. they raised money from a gullible public
  998. 20:21
  999. to buy cancer medicine to distribute in
  1000. 20:24
1001. Africa does that sound familiar and and
  1002. 20:27
1003. instead they just spent in a high living
  1004. 20:29
1005. and so she pushed the FCC to quit that
  1006. 20:33
1007. group out of business and you know get
  1008. 20:35
1009. some justice which happened and she
  1010. 20:37
1011. noticed his Clinton Foundation stuff so
  1012. 20:38
1013. she sent them a letter and she fill a
  1014. 20:41
1015. letter to the last year she sent a
  1016. 20:43
1017. letter to the IRS and the FPC and one
  1018. 20:47
1019. other I forget which one demanding an
  1020. 20:49
1021. investigation the Act the same person is
  1022. 20:52
1023. still there well I would argue should be
  1024. 20:53
1025. carried out of there and frog-marched
  1026. 20:55
1027. into a grand jury there's running its
  1028. 20:58
1029. tax-exempt departments sent back eight
  1030. 21:01
1031. you know dear Jane letter you know not
  1032. 21:04
1033. even you know a letter saying you know
  1034. 21:07
1035. we'll think about it or something like
  1036. 21:09
1037. that head and anyway what Marcia
  1038. 21:12
1039. Blackburn did not take that lying down
  1040. 21:13
1041. and as a result the Dallas office you're
  1042. 21:16
1043. talking about of the IRS did have to
  1044. 21:18
1045. announce that they were opening an
  1046. 21:19
1047. investigation so what I would say when I
  1048. 21:22
1049. got into this March 16 2015 and wrote
  1050. 21:25
1051. that article for Breitbart with so many
  1052. 21:27
1053. red flags why isn't the IRS audit and
  1054. 21:29
1055. Clinton Foundation which you can read
  1056. 21:30
1057. for yourselves it's still online um you
  1058. 21:35
1059. know I I knew then that the question is
  1060. 21:39
1061. not is this a fraud the question is how
  1062. 21:41
1063. many people have cooperated to Bangkok
  1064. 21:45
1065. and obstruct the full and proper
  1066. 21:48
1067. investigation of this fraud how many
  1068. 21:50
1069. people are involved because there have
  1070. 21:51
1071. to have been an awful lot of people in
  1072. 21:54
1073. key states like California New York and
  1074. 21:56
1075. the IRS around the world among the
  1076. 21:59
1077. donors how many trustees how many
  1078. 22:02
1079. executives knew about this and decided
  1080. 22:04
1081. what what geniuses decided that we have
  1082. 22:08
1083. to cover this up because it's too
  1084. 22:10
1085. embarrassing and just let them still do
  1086. 22:12
1087. it you know where are the deliberations
  1088. 22:14
  1089. surrounding the
  1090. 22:15
1091. where are the board minutes in what
  1092. 22:17
1093. states we're in cities were these boards
  1094. 22:18
1095. help who participated by telephone how
  1096. 22:21
1097. much money was sent to what bank
  1098. 22:23
1099. accounts inside and outside the US using
  1100. 22:25
1101. wires how much wire fraud is there how
  1102. 22:27
1103. much bank fraud is there how much
  1104. 22:29
1105. solicitation slaughter is there and who
  1106. 22:31
1107. is responsible for this and then the
  1108. 22:33
1109. biggest question of all is with all this
  1110. 22:35
1111. attention and there has been a lot of
  1112. 22:37
1113. attention on how many executives and
  1114. 22:41
1115. former executives and donors and others
  1116. 22:43
1117. may already be cooperating with the
  1118. 22:47
1119. authorities in an investigation now we
  1120. 22:49
1121. learned last week I learned actually
  1122. 22:52
1123. learn a few weeks earlier through a book
  1124. 22:54
1125. produced written by sharyl Attkisson
  1126. 22:56
1127. that came out on June 27 2000 17 we
  1128. 22:59
1129. learned on page 242 that the New York
  1130. 23:03
1131. Times knew by August of 2016
  1132. 23:06
1133. according to excellent sourcing that for
  1134. 23:10
1135. field offices of the FBI DC New York LA
  1136. 23:14
1137. and Little Rock were actively
  1138. 23:16
1139. investigating the Clinton Foundation by
  1140. 23:18
1141. August of 2016 and the New York Times
  1142. 23:21
1143. that stay in New York Times to decide
  1144. 23:23
1145. they have salutely had to break the law
  1146. 23:25
1147. and publish Donald Trump's tax return to
  1148. 23:28
1149. work 2005 or whatever on the front page
  1150. 23:30
1151. that same group felt they had to do that
  1152. 23:33
1153. but they weren't going to tell the
  1154. 23:35
1155. public about the existence of four
  1156. 23:37
1157. active investigations in those four
  1158. 23:40
1159. field offices and you know while I agree
  1160. 23:42
1161. with your comment about the
  1162. 23:43
1163. politicization of Justice and even of
  1164. 23:46
1165. the FBI I really do have great
  1166. 23:49
1167. confidence in this field office
  1168. 23:51
1169. professionals or the FBI I think those
  1170. 23:53
1171. people walk out their front doors every
  1172. 23:55
1173. day strapping on a help protection and
  1174. 23:58
1175. they face real dangers wherever they are
  1176. 24:01
1177. and it looks up direct in the eye and
  1178. 24:03
1179. they stare them down and they bring the
  1180. 24:04
1181. worst criminals out there they bring
  1182. 24:07
1183. these people regularly to justice 24/7
  1184. 24:09
1185. so I bet you there what if you field
  1186. 24:11
1187. office personnel who are irate over what
  1188. 24:14
1189. that we have heard that we've heard that
  1190. 24:17
1191. repeatedly that you know they're they
  1192. 24:20
1193. keep threatening to leak if something's
  1194. 24:23
1195. not done and then promises are made and
  1196. 24:25
1197. in fact I heard that
  1198. 24:28
1199. earlier this year when Comey made his
  1200. 24:32
1201. visit out with all of the field offices
  1202. 24:36
1203. the field heads that they said they were
  1204. 24:39
1205. you know this needed to be prosecuted or
  1206. 24:43
1207. they were going to leak and it was
  1208. 24:44
1209. Loretta Lynch is my understanding that
  1210. 24:47
1211. threatened them and said that they would
  1212. 24:49
1213. wind up in jail if they dared not let
  1214. 24:53
1215. this go so that we've heard that many of
  1216. 24:56
1217. them are working very hard to try and
  1218. 24:58
1219. move moving investigation forward I
  1220. 25:02
1221. think you're absolutely right about that
  1222. 25:04
1223. yeah the other thing I would say you
  1224. 25:06
1225. know I heard this you know the Clintons
  1226. 25:08
1227. and John Podesta in particular are
  1228. 25:09
1229. masterful at these ridiculous arguments
  1230. 25:12
1231. it sounds good if you have you know only
  1232. 25:15
1233. a third of your brain plugged in but
  1234. 25:18
1235. this argument that was advanced earlier
  1236. 25:20
1237. in the week well you know it would a
  1238. 25:21
1239. Podesta I think he was interviewed by
  1240. 25:23
1241. Katie Couric on Yahoo said something
  1242. 25:26
1243. like um it would great decades of
  1244. 25:29
1245. political norms if the Justice
  1246. 25:31
1247. Department prosecuted a political enemy
  1248. 25:35
1249. of the present now let's think about
  1250. 25:37
1251. that for a second that's exactly how
  1252. 25:39
1253. they get away with this charity Club you
  1254. 25:41
1255. know there's nothing nobody has ever
  1256. 25:43
1257. been prosecuted for these pressures for
  1258. 25:45
1259. that because nobody serious you know
  1260. 25:48
1261. what ever dream of doing the type of
  1262. 25:50
1263. baloney these people have done which is
  1264. 25:52
1265. rampant you're using this as a personal
  1266. 25:55
1267. slush fund to fund their political
  1268. 25:56
1269. ambitions to pay for deaf people out of
  1270. 25:59
1271. pre-tax money out of donor money instead
  1272. 26:02
1273. of paying out of their personal pockets
  1274. 26:04
1275. using you do you realize I just found
  1276. 26:07
1277. with all the work I've done I just found
  1278. 26:08
1279. there's a form that you have to fill out
  1280. 26:10
1281. in charity where if you are our
  1282. 26:13
1283. significant player in the charity and
  1284. 26:14
1285. Bill puttin in Chelsea and Hillary all
  1286. 26:16
1287. would be if you are reimbursed more than
  1288. 26:19
1289. $1,000 for expenses in a year you have
  1290. 26:21
1291. to provide full details that they have
  1292. 26:23
1293. never done that all their travel never
  1294. 26:26
1295. done that none of that goodness
  1296. 26:27
1297. Chelsea's wedding they even paid for
  1298. 26:29
  1299. Chelsea's wedding which well that's the
  1300. 26:32
  1301. rumor I haven't seen I haven't seen
  1302. 26:34
1303. improve that but you're right I mean
  1304. 26:35
1305. it's just you're not allowed to when you
  1306. 26:37
1307. operate a real charity and I've been
  1308. 26:40
  1309. involved with some small
  1310. 26:41
1311. real ones um people question every
  1312. 26:44
1313. potential expect you know you fire up a
  1314. 26:47
1315. corporate jet and go around the world
  1316. 26:48
1317. saying and you know go on African
  1318. 26:51
1319. safaris and bringing along mistresses or
  1320. 26:54
1321. girlfriends and you know hangers on and
  1322. 26:57
1323. people you know want to maybe support
  1324. 26:59
1325. your wife is president I think you know
  1326. 27:01
1327. what to do that every penny that you
  1328. 27:04
1329. raise is supposed to go toward primarily
  1330. 27:07
1331. the authorized purpose of the charity so
  1332. 27:10
1333. if you're supposed to be a little rock
  1334. 27:12
  1335. based national archives presidential
  1336. 27:14
1337. archives storing presidential records so
  1338. 27:16
1339. the scholars can research them you're
  1340. 27:18
1341. really not supposed to take a donation
  1342. 27:20
1343. and fly off to Africa and see whether
  1344. 27:22
1345. the waters clean or dirty maybe you know
  1346. 27:24
1347. what to do that well Charles one of the
  1348. 27:27
1349. other things you had said and I may I
  1350. 27:31
1351. just I'm not sure that I understood you
  1352. 27:33
1353. correctly but I think what you had said
  1354. 27:34
1355. with these other foundations like the
  1356. 27:37
1357. Gates Foundation and other vehicles that
  1358. 27:40
1359. have been used by the ultra-wealthy to
  1360. 27:42
1361. avoid taxes they are have the same
  1362. 27:47
1363. obligation when giving to say the
  1364. 27:50
1365. Clinton Foundation to determine that it
  1366. 27:53
1367. is in fact a properly operating
  1368. 27:57
1369. foundation is that not correct
  1370. 27:59
  1371. oh it's absolute it's absolutely correct
  1372. 28:02
1373. so there is a distinction between what's
  1374. 28:04
1375. called a private foundation and a public
  1376. 28:06
1377. charity a private foundation is
  1378. 28:09
1379. something like was until recently
  1380. 28:10
1381. something like the Gates Foundation
  1382. 28:11
  1383. that's where you know a private
  1384. 28:13
1385. nutrition aground hit the lotto or has a
  1386. 28:16
1387. big successful investment and you decide
  1388. 28:18
1389. to donate appreciated stock that you may
  1390. 28:22
1391. be a cost you fifty thousand today is
  1392. 28:24
  1393. worth five hundred million
  1394. 28:25
1395. you put it in the foundation you get a
  1396. 28:28
1397. tax deduction for this appreciated value
  1398. 28:31
1399. five hundred million of stock that you
  1400. 28:32
1401. put in that only costing fifty thousand
  1402. 28:34
1403. twenty years ago and that if you're rich
  1404. 28:36
1405. and you've got other income that gives
  1406. 28:38
1407. you a gigantic tax deduction so now
  1408. 28:41
1409. you've got these appreciated shares you
  1410. 28:43
1411. sell them out of the foundation
  1412. 28:44
1413. foundation pays no tax so now it's got
  1414. 28:47
1415. five hundred million in cash right right
  1416. 28:50
1417. the in 1969 I believe is the last time
  1418. 28:53
  1419. to the fund
  1420. 28:55
1421. laws were were addressed for reform and
  1422. 28:59
1423. they became concerned back in 69 tax
  1424. 29:02
1425. rates were very high so the IRS and the
  1426. 29:05
1427. Congress was concerned that people were
  1428. 29:08
1429. using private foundations as you say
  1430. 29:10
1431. slush fund and so they instituted new
  1432. 29:13
1433. tighter regulations which force the
  1434. 29:15
1435. operators of private foundations to make
  1436. 29:17
1437. sure that monies that they gave for
  1438. 29:20
1439. specific purpose were actually used for
  1440. 29:23
1441. that purpose by entities and in fact has
  1442. 29:25
1443. been organized and we've been operated
  1444. 29:27
1445. in compliance with a lot and then if you
  1446. 29:29
  1447. said you were giving money to a 501 C 3
  1448. 29:32
1449. public charity it had better but well be
  1450. 29:35
  1451. a 501 C 3 public charity and if the Duty
  1452. 29:38
1453. was on the donor to make sure that the
  1454. 29:41
1455. recipient had complied with the law and
  1456. 29:44
1457. if the donor had reason to suspect that
  1458. 29:47
1459. the recipient the Clinton Foundation had
  1460. 29:50
1461. not complied with the law there is an
  1462. 29:52
1463. onus on the donor who would cover to
  1464. 29:55
1465. make an attempt to recover the donation
  1466. 29:57
1467. in the year in which it was made and
  1468. 29:59
1469. failure to recover it exposes donor
  1470. 30:04
1471. foundations like the Gates Foundation to
  1472. 30:06
1473. the potential of actually being shut
  1474. 30:07
1475. down in worst case scenario use it you
  1476. 30:10
1477. know if you repeatedly did this well the
  1478. 30:12
1479. record shows that between 2001 and
  1480. 30:15
1481. around 2015 the Gates Foundation has
  1482. 30:18
1483. made over a hundred separate grants to
  1484. 30:21
  1485. different Clinton Foundation operations
  1486. 30:23
1487. totaling over a hundred million dollars
  1488. 30:25
1489. on 150 million plus dollars or so um to
  1490. 30:29
  1491. numerous clinton foundation entities
  1492. 30:31
1493. that are not lawfully organized and
  1494. 30:33
1495. operated and identified the clinton
  1496. 30:36
1497. foundation i mean the debate citation
  1498. 30:37
1499. last year i notified other donors last
  1500. 30:39
1501. year and they have done absolutely no so
  1502. 30:42
  1503. far nothing
  1504. 30:43
1505. to try to fix the situation they're just
  1506. 30:45
1507. trying to cover it up right of course
  1508. 30:48
1509. well those guys thank you so much for
  1510. 30:51
1511. taking the time to talk to me
  1512. 30:53
1513. those were the key questions that i
  1514. 30:55
1515. think for a lot of people will help them
  1516. 30:57
1517. sort of get a better sense of you know
  1518. 31:00
1519. where this is all might be going and
  1520. 31:03
1521. sort of a little bit additional
  1522. 31:05
1523. perspective so i really appreciate your
  1524. 31:07
  1525. time charles
  1526. 31:09
1527. and I hope we can reach out to you again
  1528. 31:12
1529. when the timing works but I'll be in
  1530. 31:16
1531. touch I'm sure all right Thank You
  1532. 31:19
1533. Tricia to say hi to George and Jason
  1534. 31:20
1535. will do take care what
