- Wanted to make one small comment about Oracle v. Google, as I think both of you have given too much weight to the emails from Google. Under 17 USC 107, fair use is defined and four factors listed. Note that the infringer's state of mind is not one of those factors. If there is a finding of infringement, the emails might make a difference in determining damages, but copyright infringement does not require intent.
