  31. possible plea bargain that's being
  32. 0:53
  33. spoken about for Hillary Clinton with
  34. 0:56
  35. regard to the email server and
  36. 0:59
  37. specifically the legal implications with
  38. 1:02
  39. regard to the fraud that you've been
  40. 1:03
  41. following for so many years in the
  42. 1:05
  43. Clinton Foundation sure so what happened
  44. 1:09
  45. is that yesterday I believe a very
  46. 1:12
  47. famous writer former head of the New
  48. 1:14
  49. York Times Magazine Ed Klein I was done
  50. 1:17
  51. a series of books based on his great
  52. 1:20
  53. sourcing put out a story on Newsmax
  54. 1:24
  55. suggesting that lawyers from the Justice
  56. 1:27
  57. Department our US Justice Department had
  58. 1:28
  59. offered some sort of a plea deal wherein
  60. 1:32
  61. Hillary might be given the chance to
  62. 1:36
  63. confess to some element of behavior
  64. 1:40
  65. involving this secret server and the
  66. 1:42
  67. emails and in exchange for whatever she
  68. 1:44
  69. does in that agreement the Justice
  70. 1:47
  71. Department would in theory according to
  72. 1:49
  73. the reporting abandon any probes of the
  74. 1:52
  75. Clinton Foundation and related issues I
  76. 1:55
  77. saw that story and while I think Newsmax
  78. 1:58
  79. has some interesting stuff from time to
  80. 2:00
  81. time I right away thought that it was
  82. 2:02
  83. rubbish because you know it just doesn't
  84. 2:04
  85. really make sense i divided the two
  86. 2:07
  87. broad areas the the Benghazi tragedy
  88. 2:10
  89. which is a deplorable tragedy and the
  90. 2:12
  91. question of sending private communicant
  92. 2:15
  93. communications over unsecure private
  94. 2:17
  95. servers that's one whole area of proper
  96. 2:20
  97. inquiry but I told Peter Schweitzer two
  98. 2:23
  99. years ago that the area of the Clinton
  100. 2:25
  101. Foundation is a lot more interesting one
  102. 2:28
  103. from a prosecutorial standpoint I say
  104. 2:30
  105. all this just as somebody reads and
  106. 2:32
  107. understands English not as a lawyer
  108. 2:33
  109. right but it strikes me that the legal
  110. 2:37
  111. standards that are applied when you go
  112. 2:38
  113. after a chair
  114. 2:39
  115. it's behaving illegally organized and
  116. 2:42
  117. operating illegally soliciting illegally
  118. 2:44
  119. getting involved with diverting private
  120. 2:47
  121. diverting money to private persons to
  122. 2:49
  123. insiders the down in Florida where the
  124. 2:53
  125. Becks are there's a congressperson I
  126. 2:55
  127. don't think from your district Corrine
  128. 2:56
  129. brown who was just convicted over a much
  130. 3:00
  131. smaller version of charity fraud slush
  132. 3:03
  133. fund $800,000 slush fund operating over
  134. 3:06
  135. four years she faces hundreds of years
  136. 3:08
  137. in prison I saw that like three hundred
  138. 3:10
  139. years yeah it was three hundred fifty
  140. 3:12
  141. years but she was only convicted on a
  142. 3:14
  143. high proportion of all of the 24 counts
  144. 3:17
  145. so and that's a that's a very good
  146. 3:19
  147. comparable in a sense because both
  148. 3:21
  149. ladies are around the same age
  150. 3:23
  151. here you have an African American
  152. 3:25
  153. sitting Congress person running to serve
  154. 3:28
  155. I think another term after serving
  156. 3:31
  157. twelve previous terms and in John July
  158. 3:33
  159. six last year our US Attorney Department
  160. 3:37
  161. Justice decided to throw the book at
  162. 3:39
  163. this woman in the middle of an election
  164. 3:40
  165. campaign yet they let Hillary Clinton
  166. 3:43
  167. off at the same day James Comey I
  168. 3:45
  169. believe around the same day said and how
  170. 3:48
  171. he was able to reach the conclusion that
  172. 3:50
  173. they weren't gonna prosecute Hillary
  174. 3:53
  175. Clinton over the the server issue so I
  176. 3:55
  177. think it's a spot-on comparable and the
  178. 3:57
  179. Clinton Foundation fraud is in economic
  180. 3:59
  181. terms

  183. many torrent times larger I believe that

  185. then whatever Akron Brown had done and

  187. it reminds me a little bit of you know

  189. the sad fact that when it comes to

  191. cocaine you know african-americans seem

  193. to go get thrown away forever over crack

  195. cocaine whereas white affluent Americans

  197. when they get caught with the the other

  199. form of cocaine frequently they skate so

  201. I mean there's one-tenth the conviction

  203. time yeah so I saw the story and it

  205. appeared to me just on this spot that it
  206. 4:33
  207. was rubbish and then today just moments
  208. 4:35
  209. ago before we started this broadcast the

  211. great tom Fitton of judicial watch the

  213. great and indefatigable tom Fitton a
  214. 4:43
  215. wonderful person i think we can all
  216. 4:45
  217. agree he he has won yet another victory
  218. 4:49
  219. in that the State Department now has to
  220. 4:51
  221. go can
  222. 4:52
  223. to do search a more exhaustive search
  224. 4:54
  225. for these missing Benghazi emails so we
  226. 4:57
  227. do without judicial watch a judicial
  228. 4:59
  229. watch it yeah I mean they're doing the

  231. work it would seem of the entire Justice
  232. 5:03
  233. Department and of course the IRS is
  234. 5:05
  235. completely captured but orange is doing

  237. all the work of the FBI so I was doing

  239. all the work at the DOJ and it is quite

  241. a thing and the backs are you know doing
  242. 5:15
  243. their part as well right well one of the
  244. 5:18
  245. things though that brought up last night

  247. when we had him on the broadcast was

  249. that the statute of limitations has just
  250. 5:29
  251. about run out on those emails for
  252. 5:31
  253. Hillary and that the even if there were
  254. 5:34
  255. a plea deal being discussed it wouldn't
  256. 5:38
  257. be relevant and there is no ability to
  258. 5:41
  259. follow through on an investigation at
  260. 5:44
  261. this point

  263. anyway well alone and that in fact he
  264. 5:47
  265. talked about we talked about the IRS
  266. 5:50
  267. audit you know notion around the private
  268. 5:53
  269. foundations and holding them accountable
  270. 5:55
  271. and the way you describe Charles that

  273. the law requires and you know he seemed

  275. to think that that made a lot of sense

  277. because you don't have the statue of
  278. 6:06
  279. statute of limitations

  281. clock ticking on you so long as that
  282. 6:11
  283. thing is in existence and you know the
  284. 6:15
  285. idea that so many others are tied up
  286. 6:18
  287. into the accountability of the Clinton
  288. 6:23
  289. Foundation such as the Gates Foundation
  290. 6:26
  291. who has contributed to it you know
  292. 6:30
  293. that's an even more beautiful aspect of
  294. 6:32
  295. that Ruth I think you know it's very
  296. 6:35
  297. straightforward

  299. yeah let me suggest another comparable

  301. to go with Charles is comparable which

  303. is that if indeed the there's a plea
  304. 6:59
  305. agreement to plead to some aspect of the
  306. 7:03
  307. emails and in exchange for not going
  308. 7:04
  309. after the Clinton Foundation that's
  310. 7:06
  311. basically you know pleading guilty to a
  312. 7:09
  313. DUI so you don't get charged for murder
  314. 7:11
  315. right right that's not serious right
  316. 7:16
  317. well you know and it's even more
  318. 7:17
  319. interesting in a way I think because

  321. Trish is right on the statute of
  322. 7:22
  323. limitations point the Clinton Foundation
  324. 7:24
  325. the main Clinton Foundation operated
  326. 7:26
  327. began operations officially from October
  328. 7:28
  329. 23rd 1997

  331. to December 31st 1997 on their website
  332. 7:34
  333. and in public records I have found no
  334. 7:36
  335. evidence that they ever filed a tax
  336. 7:38
  337. return for that important period October
  338. 7:40
  339. 23 1997 to December 31st 1997 the

  341. statute of limitations does not up does
  342. 7:47
  343. not limit you when you fail to file a
  344. 7:50
  345. report so they are trouble with that
  346. 7:53
  347. short period and they have done it with
  348. 7:55
  349. several other I won't go into all the
  350. 7:57
  351. minutiae unless you want me to but in
  352. 7:59
  353. several other cases they have followed a
  354. 8:01
  355. consistent practice of having
  356. 8:03
  357. significant operations during a short
  358. 8:05
  359. period but not filing the return so for
  360. 8:08
  361. the Clinton Health Access Initiative
  362. 8:09
  363. between September 29th 9 2009 and
  364. 8:13
  365. December 31st 2009 though that entity
  366. 8:17
  367. was very active and the record would
  368. 8:19
  369. suggest it was very
  370. 8:21
  371. active they did not file a return for
  372. 8:23
  373. that short period and they did not file
  374. 8:25
  375. a proper liquidation return of the
  376. 8:27
  377. Clinton full of the Clinton Foundation
  378. 8:30
  379. when they liquidated the predecessor
  380. 8:32
  381. company after 2009 so there are multiple
  382. 8:36
  383. omitted returns all of which gets them
  384. 8:38
  385. in legal jeopardy and then they made the
  386. 8:41
  387. huge mistake and I actually warned them
  388. 8:43
  389. in 2015 the Clinton Foundation publicly
  390. 8:46
  391. I said you've got to abandon your tax
  392. 8:49
  393. returns and you gotta mint all of your
  394. 8:51
  395. tax returns to get out of trouble and
  396. 8:53
  397. instead of doing that or to try to get
  398. 8:55
  399. out of trouble they thought to be really
  400. 8:57
  401. cute and they just amended their tax
  402. 8:59
  403. returns from 2010 to 2013 and filed a
  404. 9:04
  405. new return a fresh return for 2014
  406. 9:07
  407. consistent with the amended returns well
  408. 9:09
  409. if they didn't amend 98 they didn't file
  410. 9:12
  411. 97 and they didn't amend 98 through 2009
  412. 9:15
  413. so they actually compounded in my view
  414. 9:18
  415. their problems because it's not as
  416. 9:20
  417. simple as just getting the report right
  418. 9:23
  419. there also soliciting they're down there
  420. 9:25
  421. in Florida the becks will know that in
  422. 9:28
  423. Florida if I register the bill Hillary
  424. 9:29
  425. and Chelsea Clinton Foundation in
  426. 9:31
  427. Florida I don't set up a new domestic
  428. 9:34
  429. Florida corporation with a slightly
  430. 9:37
  431. similar name called the William J

  433. Clinton Foundation corporation on I

  435. think it was June 2nd 2009 I when I when

  437. that's a different entity from the
  438. 9:49
  439. parent company you don't have to set up
  440. 9:51
  441. a new to admit you just register the the
  442. 9:54
  443. parent 1 which is an Arkansas
  444. 9:56
  445. corporation as a foreign corporation
  446. 9:58
  447. inside Florida and back in 2009 there
  448. 10:02
  449. are a lot of shenanigans involving Haiti

  451. right that I think we routed illegally
  452. 10:07
  453. through this Florida corporation so the
  454. 10:09
  455. the Clintons are are right now I

  457. actually went on the site this morning

  459. they're soliciting money because bills
  460. 10:16
  461. humpty-dumpty birthday's coming up and
  462. 10:18
  463. it one of them you the sign of birthday
  464. 10:19
  465. card what you're soliciting while we're
  466. 10:21
  467. on the on the broadcast

  469. they haven't corrected any of this
  470. 10:23
  471. paperwork and were they to go to a mr.

  473. Beck's point to sign this plea agreement

  475. they would have to finally disclose that

  477. Hillary bill and Chelsea illegally took
  478. 10:33
  479. control

  481. converting this thing from a public
  482. 10:36
  483. charity into an attempted private
  484. 10:38
  485. foundation in 2013 to 2015 that they
  486. 10:43
  487. attempted this illegal I mean they they
  488. 10:45
  489. said they did it it is illegal to do
  490. 10:48
  491. what they did I believe and then they
  492. 10:50
  493. hid it from the electorate during the
  494. 10:51
  495. primary season in the campaign and
  496. 10:53
  497. they're only now correcting in certain
  498. 10:55
  499. states this information sochi hillary
  500. 10:58
  501. was in control of the clinton foundation
  502. 10:59
  503. while she was running for president
  504. 11:02
  505. without disclosing it to her political
  506. 11:05
  507. donors to the campaign donors and then
  508. 11:08
  509. it went down the whole campaign lost now

  511. they're trying to correct it she was in
  512. 11:12
  513. a position to control things so any any
  514. 11:14
  515. settlement here which said that earlier
  516. 11:17
  517. that she had engaged in illegal activity
  518. 11:20
  519. is relevant to her charity filings and
  520. 11:22
  521. would that failure to disclose itself
  522. 11:25
  523. also be an illegal act oh I think so I
  524. 11:27
  525. mean let the backs answer that question
  526. 11:29
  527. but I think so what do you think guys

  529. well my first thought is that I think

  531. that the American people deserve a trial
  532. 11:41
  533. and all these issues and I say that

  535. because the Clinton Foundation and
  536. 11:51
  537. foundations more broadly are the Nexus
  538. 11:56
  539. by which corruption has crept into our
  540. 12:01
  541. political system and become so virulent
  542. 12:04
  543. they are the means by which various
  544. 12:11
  545. interests control our government they go
  546. 12:14
  547. through the Foundation's themselves and
  548. 12:16
  549. so this all needs to come out in court
  550. 12:21
  551. through a legal proceeding I think the
  552. 12:24
  553. American people deserve a trial on all
  554. 12:26
  555. these issues and I think that the issues
  556. 12:31
  557. involving the Clinton Foundation are
  558. 12:33
  559. just part of a broader story about the
  560. 12:36
  561. corruption in our political system and
  562. 12:38
  563. so we really need to start setting legal
  564. 12:40
  565. precedents and the only way you do that
  566. 12:42
  567. legally is by going to try you don't do
  568. 12:48
  569. that in settlements and a plea agreement
  570. 12:50
  571. is what a settlement is so you know the
  572. 12:53
  573. very concept you know the even apart
  574. 12:56
  575. from the issue that you know would be
  576. 12:58
  577. pleading to a much lesser crime to avoid
  578. 13:01
  579. getting prosecuted for an you know just
  580. 13:04
  581. a much greater crime you know and just
  582. 13:06
  583. oppose the concept of a plea agreement
  584. 13:11
  585. for any of those issues well here's a
  586. 13:14
  587. question I put to the whole panel I mean
  588. 13:17
  589. do we think what's the implications of
  590. 13:19
  591. all this is this plea agreement being
  592. 13:20
  593. put forward just to confuse the American
  594. 13:22
  595. people further and just move the ball
  596. 13:24
  597. down the field a little bit longer and
  598. 13:26
  599. then they'll do something else to cover
  600. 13:28
  601. up the rest of these crimes yeah I think
  602. 13:30
  603. I mean I'm not a political expert but I
  604. 13:33
  605. think the clintons to understand the
  606. 13:35
  607. clinton's behavior they look at
  608. 13:36
  609. everything through a political lens
  610. 13:37
  611. there's no such thing as right and wrong

  613. there's only the only thing that matters

  615. is keeping the Clintons and their people
  616. 13:44
  617. in power and anything you do to keep
  618. 13:46
  619. them in power is a good thing anything

  621. you do to restrict their power or punish

  623. them is a bad thing so that's why John

  625. Podesta and I'll say this flat-out he is
  626. 13:54
  627. a weasel of all weasels that's what
  628. 13:57
  629. that's why last week he came out and he
  630. 14:01
  631. tried on the gullible captured
  632. 14:04
  633. mainstream media the idea that you know
  634. 14:06
  635. it would it would violate decades of
  636. 14:09
  637. political norms to prosecute somebody
  638. 14:12
  639. who lost a presidential election I mean
  640. 14:14
  641. a ridiculous argument and you know it's
  642. 14:18
  643. but you know there's almost let's call
  644. 14:21
  645. it 50 percent of the popular vote
  646. 14:22
  647. roughly voted in favor of Hillary
  648. 14:25
  649. Clinton so there are a lot of sore
  650. 14:26
  651. losers out there and they can stir up
  652. 14:28
  653. trouble many of them work in the
  654. 14:30
  655. mainstream media at CNN New York Times
  656. 14:31
  657. Washington Post so they can write
  658. 14:33
  659. stories muddying the waters and that was
  660. 14:35
  661. the first attempt to do this then the
  662. 14:37
  663. second attempt is I think to say well
  664. 14:40
  665. she was going to be reasonable she's
  666. 14:42
  667. prepared to move forward so now she
  668. 14:43
  669. wants to be a minister you know we could
  670. 14:46
  671. talk about that one but she was I think
  672. 14:50
  673. we could die baby I mean I mean that was
  674. 14:54

  679. to make yourself right by God right Yeah

  703. those foundation IRS style prosecutions

  705. of those kinds of crimes like is that

  707. something you know if it were to begin

  709. on a local level you know it seems to me
  710. 15:55
  711. it would sort of tug at a thread that
  712. 15:57
  713. really ties all of this together and if

  715. you can sure find the right place to
  716. 16:02
  717. start then you have you know you can be
  718. 16:06
  719. strategic in how you move forward you
  720. 16:08
  721. know so I wondered if you've had any
  722. 16:10
  723. insight as to you know and you Charles

  727. Elizabeth about you know trying to move
  728. 16:20
  729. forward in that kind of way or if it's
  730. 16:22
  731. not coming all right do you want me to

  733. start yeah so um basically what we know

  735. because it came supposedly from the IRS
  736. 16:31
  737. in response to a letter that the great
  738. 16:34
  739. Marsha Blackburn congressperson from
  740. 16:36
  741. Tennessee was who with her staff has
  742. 16:38
  743. done amazing work on this whole issue of
  744. 16:41
  745. trying to regulate rogue charities to
  746. 16:43
  747. bring them not simply the Clinton
  748. 16:45
  749. Foundation but all of them to heal she
  750. 16:48
  751. says several letters and got this
  752. 16:50
  753. ridiculous response last year that was a
  754. 16:53
  755. shameful response from I believe the
  756. 16:55
  757. acting current head of the tax-exempt
  758. 16:56
  759. organization you know dear form letter
  760. 16:58
  761. you know thanks for your letter and so
  762. 17:01
  763. that didn't sit well and and she got a
  764. 17:04
  765. response finally from the Dallas office
  766. 17:06
  767. which is the correct office
  768. 17:08
  769. saying that they did open investigation
  770. 17:10
  771. last year before the election so we know
  772. 17:12
  773. that an investigation was open we also
  774. 17:15
  775. know that wasn't the first investigation
  776. 17:17
  777. we know that going back and there's two
  778. 17:20
  779. FBI vault file dumps FBI vault file is a
  780. 17:23
  781. available to the public and there's one
  782. 17:26
  783. for the William J Clinton Foundation
  784. 17:27
  785. that's a two-part dump that has over 600
  786. 17:30
  787. pages of information and shows you how
  788. 17:32
  789. active the investigation may have been
  790. 17:34
  791. starting around February 2001 on the
  792. 17:37
  793. heels of the mark rich revelations
  794. 17:39
  795. there's a whole raft of paperwork going
  796. 17:41
  797. through 2005 and at the very end of dump
  798. 17:44
  799. 2 or section 2 of that dump there is
  800. 17:47
  801. information suggesting there was another
  802. 17:50
  803. investigation I think in New Orleans and
  804. 17:52
  805. around 2008 2009 and there may have been
  806. 17:55
  807. others so we know there has been a
  808. 17:56
  809. pattern of Investigations what is
  810. 17:59
  811. amazing to me I always I'm just a I'm
  812. 18:01
  813. just a dude you know I'm just an
  814. 18:02
  815. independent person a member of the
  816. 18:04
  817. public with with a spare time and I
  818. 18:07
  819. don't like fraud and I don't I think
  820. 18:10
  821. most Americans don't like fraud or when
  822. 18:12
  823. you see this type of epic fraud you know
  824. 18:14
  825. I felt it was incumbent of me to try to
  826. 18:16
  827. explain what I saw to the public which
  828. 18:18
  829. is what I'm doing and to try to
  830. 18:20
  831. encourage governments state federal and
  832. 18:23
  833. foreign governments to bring to expose
  834. 18:25
  835. this to prosecute these people and bring
  836. 18:28
  837. them to justice so there was the the
  838. 18:31
  839. first FBI fall file dump now there's a
  840. 18:34
  841. second one that you have up on the
  842. 18:35
  843. screen this relates to Hillary Clinton
  844. 18:37
  845. and the server yeah so yes there's

  847. another set of FBI investigations now
  848. 18:42
  849. why might these be married as Jared was

  851. saying and Elizabeth was saying
  852. 18:48
  853. foundations and in Trisha Foundation's

  855. have become one of the last unregulated
  856. 18:54
  857. Arya's in the world particularly
  858. 18:56
  859. international foundations are perfect in

  861. quotes vehicles to launder money you can

  863. set up foundation up and I think we have
  864. 19:05
  865. evidence in the Clinton Foundation you

  867. set a foundation up in Arkansas and then
  868. 19:10
  869. you start setting up other foundations
  870. 19:12
  871. they did it in Florida they did it in
  872. 19:13
  873. multiple countries and in loose
  874. 19:16
  875. countries like Papua New Guinea who in
  876. 19:18
  877. Papua New Guinea is going to check
  878. 19:20
  879. that your paperwork is right in Florida
  880. 19:23
  881. and Arkansas in London or whatever we
