  7. Article 1 In the Act of 24 July 2015. Law on Assemblies (Dz.U. 2019 pos. 631 t.j. of
  8. 2019.04.03) is amended as follows:

  11. (a) Article 1 shall be replaced by the following:
  12.  
  13. "The Act regulates the principles and procedure for organising, holding and dissolving
  14. assemblies, as well as the principles of restrictions on the organisation and holding of assemblies."

  17. (b) In Article 4, paragraph 3 shall be added, which shall read as follows
  18.  
  19. reading: "3. During the assembly it shall be prohibited to:
  20. (a) to possess and use any material whose content refers
  21. to the matters listed in Article 10(2) of the Act;
  22. b) use religious symbols and objects connected with
  23. practice of religious rites in a manner likely to offend feelings religious feelings
  24. other persons, including by means of their artistic transformation,
  25. (c) use of religion or references to religion in the context of the matters
  26. listed in Article 10(2) of the Act;
  27. d) possess and use any objects of erotic or sexual nature, in particular objects imitating sexual organs
  28. sexual nature, in particular objects imitating reproductive organs
  29. reproductive organs,
  30. (e) the possession and use of artistically processed emblems or national colours
  31. national colours in connection with the matters referred to in Article 10(2) of the Act,

  34. referred to in Art. 10, section 2 of the Act,

  37. i) any behaviour and actions detrimental to public morals, including in
  38. particularly those which may offend or demoralise children or adolescents under the age of 18".

  40. (c) Article 10(2) is replaced by the following:
  41. "The purpose of the assembly may not concern".
  42. (a) Questioning marriage as a union between a man and a woman,
  43. (b) promoting the extension of the institution of marriage to same-sex couples,
  44. (c) advocating same-sex unions or unions composed of
  45. more than two persons,
  46. (d) promoting the treatment of same-sex unions or unions composed of more than two persons
  47. (d) promote privileged treatment of same-sex unions or unions composed of more than two persons,

  54. (d) In Article 10, a paragraph 2a shall be added to read as follows:
  55. "By promotion of shall mean shall mean any forms dissemination, disseminating, agitating, lobbying, claiming, expecting, demanding,
  56. recommend, recommend or promote."
  57. (e) The existing text of Article 10(2) is moved to Article 10(3).
  58. (f) In Article 10, a new paragraph 4 is added, to which the existing text of Art. 10(3) is transferred to Article 10.
  59. (g) Article 14(1) is replaced by the following:
  60. "its purpose violates the freedom of peaceful assembly, its holding violates Art.
  61. 4 or the principles for holding assemblies, or its purpose or the holding of the assembly
  62. contravenes penal provisions or the purpose of the assembly relates to one or more of the
  63. issues referred to in Article 10, paragraph 2 of the Act;"
  64. (h) Article 26 shall be replaced by the following:
  65. "To the assemblies referred to in Article 21, the provisions of Article 12, Article 13, Article 17 and Article 19
  66. (1), (5) and (7) shall apply mutatis mutandis, while the provisions of Article 10(1)(3), Article 10(2), Article 14(1), Article 14(2) and Article 19(2) shall apply mutatis mutandis.
  67. 2, point 1 of Article 14, Article 15 and Article 16 shall apply directly.
  68. (i) Article 26a(2) shall be replaced by the following:
  69. "In the application referred to in paragraph 1, the organiser shall give a justification of the purpose
  70. cyclic organisation of assemblies with the indication of the number and the timetable of their
  71. of their organisation. The purpose of the assembly may not relate to the issues listed in Article 10
  72. section 2."
  73. Art. 2 In the Act of 31 January 1980 on the Emblem, Colours and Anthem of the Republic of Poland and on state seals (Dz.U.2019.1509 t.j. of 2019.08.12)
  74. shall be amended as follows:
  75. (a) Article 1(3) shall be replaced by the following:
  76. "The symbols of the Republic of Poland remain under special protection by law,
  77. provided for in separate provisions, including in the act regulating the principles of
  78. organisation and holding of assemblies."
  79. Article 3 The Act shall come into force after 14 days from the date of its announcement.
