  1. Greetings.
  2.
  3. I wish it didn't come down to this, that I didn't had to bring this to reddit to -hopefully- get my situation sorted out.
  4.
  5. I'm a twitch user since 2012, which is pretty much when twitch started growing in my country. Since then I got to know many people, and I also got to be moderator in many different streams, since I'm someone that uses the chat quite frequently, so streamers would always hand me a moderator to help keep their chat in check.
  6.
  7. Unfortunately, this changed a little more than two months ago.
  8.
  9. That day, when I logged into Twitch, I got the notice: My account was suspended because of "Attempts or threats to cause harm."
  10.
  11. This instantly made me go like "??????" Because this was something that I never did, but then I thought "Well, I guess I banned someone, and then maybe he got his friends to spam-report me or something." So I decided to contact the support, because of course they would help me out.
  12.
  13. But actually they didn't.
  14.
  15. It has been two months since I first tried to appeal my ban. The first answer I got was this one:

  18.
  19. When I saw that it was something related to my IP, for a moment I thought that maybe it was my brother fault, since we share the internet and I don't really know what he does when. But it actually was not, since when I went to his computer to check if his account also got banned that was not the case. It was something that happened only to my account alone.
  20.
  21. So I went ahead and followed the protocol. I filled in the form that they asked, and some days later I got another answer:

  24.
  25. They now accused me of DDoSing someone, or threatening to. This is something that I never did in my time using twitch, as I rarely ever got banned.
  26.
  27. First, I sent them this answer:

  29.
  30. Some time later, seeing the lack of answer, I sent this:

  32.
  33. But I get nothing from support.
  34.
  35. I know that it's very simple to simple... Go and create a new account. But I also know that somewhere in their terms of service or community guidelines it's said that if I get banned for a reason like this I'm not allowed to create a account ever again.
  36.
  37. But it's not just that. This ban is DEFINITLY something that I never did. I never threatened to DDoS anyone, and I never DDoS'ed anyone at all.
  38.
  39. All I'm asking them is to review my case. They can read my all my messages in these six years using twitch and they will see that, unless they somehow find something that is somehow out of context, I NEVER threatened someone with DDoS. I don't know about the US, but here in my country DDoS is against the law, so by saying that I DDoS someone they're just accusing me of a crime, and one that I did not do.
  40.
  41.
  42. And a bit more reasons as to why I couldn't DDoS, even if I wanted to:
  43.
  44. 1 - It's virtually impossible to get the IP of a streamer or someone in chat, simple because there's twitch server doing the middle-ground between you and anyone else in twitch.
  45.
  46. 2 - Since they're saying that it's a issue related to my IP, I can say that my internet upload speed can download at about 400kb/s and can upload at most 60kb/s. Let's say that I actually tried to DDoS Twitch servers themselves with this... I really don't think that this is nearly enough.
  47.
  48. 3 - My IP is dynamic. One day I have this IP, another day someone else will have the same IP.
  49.
  50. 4 - One of the most common practice of DDoS is to put websites up. Once someone access these websites they will redirect your internet and kinda make you "ping" their target. Stuff like this happened to League of Legends servers a few years ago.
  51.
  52. 5 - I might be wrong here, but let's say for a moment that I actually got the IP of someone, a streamer or someone in chat, and actually DDoS'ed them... How do Twitch know about it? I don't think that Twitch has the means to monitor the internet.
  53.
  54.
  55.
  56. Anyway... All I want with this is very simple: I want the support to actually do their work and review the case, because otherwise there's no reason to even exist a "Ban Appeal" section. The answers (And the lack of) seens lazy, and seens to be something like "Well, you got this, so just accept it."
  57. I'm no Lawyer, but the fact that their Terms of service say "We reserve the right to suspend your accounts at our discretion and without notice." means... Absolutely nothing. Terms of Service aren't above each country own law, and at the moment that you offer your services in other countries you must abide by their law. I don't know about other US, but at least on my country they can't just "suspend your account". Specially since they sell stuff like subscribers and allow people to link their account to some API's where they can have money into it.
  58.
  59. I for example, on the month that I got banned had a subscription in one channel. Besides that, I also had my twitch account linked to a API from a streamer where as we donate and watch him we will get points, and then we can use these points to buy games... I had about 50.000 points there, which is a lot.
  60.
  61. Suspending accounts when you feel like doing it without any rhyme or reason is the same as if your bank decided to simple shut your account down because they feel like it, and then you also end up losing all the money that is there.
  62.
  63.
  64. Hopefully, this post can get enough upvotes, then hopefully someone on Twitch can see it, and then hopefully I can get a fair judgement. Because that is all I'm asking for. Because I did not do what they're accusing me.
