  1. The following are the infractions that took place at FMC 2019 in relation to Justin Lois.

  3. The first warning for Justin(not a yellow but a warning) was issued in round one because he interjected into a dispute between a teammate of his(Andrew Hayes), and their opponent (Heath Shepherd, who was Justin’s round 3 opponent) when a judge(myself) was already at the table.

  5. The first yellow card was issued to Justin in round 2 as before the game him and his opponent defined craters as being in play with the minus 2 to charge rolls. During turn one Justin made a charge move through a crater and did not use the -2 modifier. He argued that because the closest model wasn’t in the crater it did. It apply. This is false and he would have otherwise failed the charge. This game was on the twitch stream and there was not a judge at the table at the time of the infraction, the judge(myself) was called over by Jason Horn(who was running the stream) and called it to my attention. I decided not to change the gamestate but did issue a yellow for misplaying the rules.

  7. Justin’s second and third yellows were issued because of incidents that took place during round 3. Again, I myself was the judge at the table to make the call, the following is the scenario as it played out from the start of the incident during round three two the eventual disqualification of Justin:

  9. When I arrived at the table(to which I was not called by either player, Duncan (a fellow TO of the event) approached me and said hey I think they may need a judge so I walked to the table) the time was expired on both clocks.

  11. I was in a he said she said situation. So I gave the players the option to either finish rolling out the last action, or to completely remove turn 6 and score it at 5. Heath then picked up the dice that were rolled and rolled his saves. We scored the round at that point.

It was this exchange of dice roll that led me to notice Justin was using -3 ap on his battlecannons though I didn’t realize it until after I had left the table and had spoken to both players individually (Heath did mention to me in our talk the -3ap to which I told him I would investigate it).

  15. I talked to both players individually after that round and explained why I called it the way I did. Both Justin and Heath were respectful to me and at the time understood and “agreed” or went at least went with my decision. I also informed both of them at this time because chess clocks had been an issue in multiple games, that they would be using clocks on Sunday all three games, and that if there was ANY issue whether right or wrong and a judge ruling was needed because of the use of the clock, they would receive two yellows. (Both had already received one earlier in the event, so this would have given them 3 yellows and a red so they would be DQ’d.)

This morning, while I was waiting for Justin to arrive so I could give him his second yellow for using his battlecannons incorrectly, two neutral players that were witnesses to the game approached me on their own to inform me that when round 6 was started in that game, both clocks were under 5 minutes. As per ITC chess clocks, no round should be started if both players are under 5 minutes.

Since the clock was expired when I arrived at the able and both of these players were neutral parties that were not members of either team, or even the same team for that matter, I decided that as per ITC CoC I needed to issue a yellow to both players for not properly following the clock rules. I saw Heath first, and I talked to him about the issue and my ruling. He was understandably frustrated but I believe it was the right call. My conversation I had planned for Justin had changed as this would be his third yellow, thus giving him a red and the DQ.

Brian and I took Justin in the hall and informed him of this decision and he didn’t take it well (in my opinion) he accused me of singling him out, and told me that he wasn’t cheating and that it wasn’t his responsibility to know his opponents army or rules. I put my foot down and said listen. You are a competitive player at the top level of a major event. You have played in hundreds of games and a ton of events, you know that a necron immortal has a 3+ armor save and your battle canons are -2. When Heath picked up the dice Justin told him “you need 6’s” I personally heard this as I was at the table along with Duncan and the two witnesses.

  23. Justin tried to argue, I told him I wasn’t having it and that I needed him to grab his things and leave. He asked to stay in the hall, and Brian and I agreed and told him he could as long as he was cordial and didn’t talk about what had happened. We walked away.

  25. I turned around and watched him walk straight to Heath and say something then walked away. Heath shook his head and came walking straight to me and before he spoke I asked him what Justin said. Heath informed me that Justin said something along the lines of “thanks man you got what you wanted and got me DQ’d, good job”(I don’t remember he exact verbiage. It’s been a long weekend)

  27. I then turned to Brian and asked him to talk to Justin and get it resolved. They went and spoke for a while and Justin came to me and apologized. We allowed him to stay since he rode with his team. He was fine after this point.
  28. After the event, the judges and I all gathered and decided to ban him from our event for his behavior both during the Event and following his disqualification.
