Senate Confirmation: During confirmation, he was criticized for his role in the CIA's post-9/11 detention and interrogation program. He briefly became head of a base in Thailand, where a detained Al Qaeda agent was interrogated using techniques that are equated with torture. Haspel told MPs that the CIA should not carry out the interrogation program.

Haspel sparked controversy over his involvement as head of a secret CIA site in Thailand in 2002, where prisoners were tortured  using "sophisticated interrogation techniques", including waterboarding. At that time, the Bush administration considered this technique to be legally valid based on a series of secret legal opinions that expanded executive authority and narrowed the definition of torture. Haspel's involvement in this sophisticated interrogation technique was revealed in August 2018 when a freedom of information suit by the National Security Archive (George Washington University) was granted by the court. CIA documents signed or written by Haspel while serving as the head of a secret Thai site describe physical torture of detainees, including by means of waterboarding and confinement.
