Thank you for purchasing and using the Suzhou ZWO Co., Ltd. (hereinafter referred to as "ZWO") ASIAIR (hereinafter referred to as "ASIAIR", including AISAIR hardware, AISAIR software), and customer services! In order to use ASIAIR and access the services, the user must carefully read, fully understand and abide by the terms and conditions (hereinafter referred to as "this agreement").

I. Scope of This Agreement

This agreement is an agreement between the user and ZWO regarding the purchasing of AISAIR hardware by the user, downloading, installing, and using the AISAIR software. This agreement is collectively referred to by the individuals or organizations that purchase and use ASIAIR as the "User".

II. About This Service

2.1 The content of this service refers to the astronomical photography tool provided by ZWO to User, and the software service based on the tool (hereinafter referred to as "the service").
2.2 User needs to purchase ASIAIR hardware and download ASIAIR software to use this service. ZWO will provide User with instructions for use and make every effort to ensure the normal operation of this service.
2.3 In this service, the app provides multiple application versions but not limited to iOS and Android (specifically based on the version provided by ZWO), and User must select the software version that matches the installed device.
2.4 ZWO will continuously update the application, etc. This agreement automatically applies to all versions of hardware, software, and services provided by ZWO.
2.5 ZWO gives User a non-transferable, non-exclusive license to copy a copy of the ASIAIR software only for backup purposes to use ASIAIR and the service. This copy must contain all the copyright information in the original software.
2.6 All other rights not expressly granted by this section and other terms of this agreement are retained by ZWO. ZWO does not constitute a waiver of the right if it does not exercise any of the foregoing rights.

III. ASIAIR Software Acquisition and Uninstall

3.1 User can get ASIAIR software directly from ZWO's website, or from the corresponding platform's app store (currently only support Google Play, Tencent tmyapp, Xiaomi Market, HUAWEI AppGallery, Vivo App Store, and App Store).
3.2 If a user obtains ASIAIR or an installer with the same name as the ASIAIR from a third party not authorized by ZWO, ZWO cannot guarantee that the software will function properly and will not be liable for any damage caused to User.
3.3 ZWO may develop different software versions for different terminal devices, and User should choose the appropriate version to download for installation according to the actual situation.
3.4 After downloading the installer, User needs to follow the steps suggested by the software to install it correctly.
3.5 If User no longer needs to use ASIAIR or needs to install a new version of the software, they can uninstall it by themselves.

IV. ASIAIR Software Update

4.1 In order to improve User’s experience and improve the service content, ZWO will continuously strive to develop new services and provide software updates for User from time to time (these updates may include software replacement, modification, function enhancement, version upgrade, etc.).
4.2 Older versions of the software may not work after the updated version of ASIAIR is released. ZWO does not guarantee that the old version of ASIAIR and its corresponding service will continue to work. Please check and download the latest version at any time.
4.3 User agrees that ZWO may notify the User of the software update through announcements, update logs, etc., but ZWO does not need to specifically notify the User.

V. Rules of Using ASIAIR

5.1 Any acts of using system loopholes, cracking, and other illegal means to modify AIR will not be protected. ZWO has the right to cancel and/or not provide related services. All losses and liabilities arising from the infringer shall be borne by the infringer.
5.2 User understands and agrees that User shall not use AIR for any illegal behavior. Otherwise, any legal consequences and responsibilities arising therefrom shall be borne by the User, and ZWO has the right to suspend or terminate the provision of services to the User.

VI. User Notes

6.1 The User understands and agrees that in order to provide effective services, ASIAIR will utilize resources such as the processor and GPS of the User's devices.

VII. Disclaimer and Limitation of Liability

7.1 User understands and agrees that ASIAIR and the service are provided "as is" and ZWO makes no warranties, express or implied, with respect to the service, including but not limited to the applicability, continuity, etc. of the Service.
7.2 User understands and agrees that ZWO shall not be liable for any damages or consequences resulting from the interruption of the Service during the use of the Service.

VIII. Intellectual Property Rights Statement

8.1 ZWO is the intellectual property right holder of ASIAIR. All intellectual property rights, trademark rights, patent rights, trade secrets, and other intellectual property rights of ASIAIR, as well as all information related to ASIAIR, are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. ZWO enjoys the above intellectual property rights, except for the rights that the relevant rights holders are entitled to in accordance with the law.

IX. Others

9.1 The use of ASIAIR by the User is deemed to have been read and agreed by the User to be bound by this agreement.
9.2 The headings of all the terms of this agreement are for convenience only and have no actual meaning and cannot be used as a basis for an interpretation of the meaning of this agreement.
9.3 The terms of this agreement are partially invalid or unenforceable for any reason, and the remaining terms are still valid and binding on both parties. (End of content)
