  350. 1. Per reftel (a), Post submits the following semi-annual report for
  351. the period March 2009 through August 2009.

  354. COUNTRY CONDITIONS
  355. ------------------
  356.  
  357. 2. Landlocked Malawi is one of the world's most densely populated
  358. and least developed countries. The economy is predominately
  359. agricultural with approximately two-thirds of the population living
  360. in poverty. The Malawi Government faces many challenges including
  361. developing a market economy, improving educational facilities,
  362. dealing with the challenges posed by HIV/AIDS, maintaining fiscal
  363. discipline and reinforcing anti-corruption practices. Faced with the
  364. difficulty of improving one's economic situation, Malawians often
  365. seek a better life elsewhere. The United States remains an
  366. attractive destination for some of those individuals.
  367.  
  368. 3. Lilongwe is a medium-low fraud post. Malawian passports and
  369. residency permits, along with most civil documents, can be obtained
  370. with falsified identity information. This situation, coupled with
  371. its porous borders, understaffed and ill-equipped immigration and
  372. law enforcement offices, makes Malawi a highly attractive target for
  373. mala fide travelers and immigrant traffickers. In view of Malawi's
  374. location on the land transit route from East Africa to South Africa,
  375. many refugees, asylum seekers, and other parties headed to South
  376. Africa often seek fraudulently obtained identity documents in
  377. Malawi. Malawian government officials recognize the susceptibility
  378. of their country to these challenges and threats, but thus far have
  379. been unable to take effective action to curb this security failing.
  380.  
  381. ---------
  382. NIV FRAUD
  383. ---------
  384.  
  385. 4. NIV fraud is generally unsophisticated, with a sizable number of
  386. cases committed by third country nationals posing as Malawian
  387. citizens or residents. In the past, Ethiopians, Eritreans,
  388. Pakistanis, Somalis, Burundians, Rwandans, Zimbabweans and DRC
  389. nationals have been discovered illegally transiting Malawi. These
  390. individuals are known to have obtained illegitimate documents and
  391. passports for travel to South Africa and the US. Post has not
  392. detected any organized fraud in Malawi. Typically, consular
  393. officers do not rely on documentation submitted by applicants
  394. because of its susceptibility to fraud.
  395.  
  396. 5. During the reporting period, post detected an applicant who
  397. assumed the identity of a previously refused applicant. The mala
  398. fide applicant used the prior applicant's passport and photo as his
  399. appearance and facial features were similar to the prior applicant.
  400. The mala fide applicant was refused after Post detected his
  401. attempted subterfuge. Subsequently, the prior applicant, who Post
  402. believes was complicit in the fraud, refused to cooperate with
  403. Post's investigation into the matter.
  404.  
  405. 6. Post has experienced a decrease in student visa fraud in the
  406. years since the Malawi government added enhanced security features
  407. to Malawi School Certificate of Education (MSCE) certificates
  408. (roughly equivalent to high school diplomas), making them less
  409. susceptible to alteration.
  410.  
  411. 7. We continue to experience a large number of travelers "sponsored"
  412. by various churches, religious groups and individual missionaries in
  413. the United States. Given the large number of religious-related
  414. avenues available to travel to the United States, church affiliation
  415. is viewed in Malawi as an effective method to obtain a visa. These
  416. travelers typically apply with another person who is clearly
  417. approvable or has already been to the United States and returned.
  418. For example, Post handled a large number of applicants seeking to
  419. attend the Seventh Day Adventist Youth Camporee in Wisconsin this
  420. past August. Post coordinated checks with both the local Church and
  421. Church leaders in the United States in an attempt to eliminate mala
  422. fide applicants. When detected, Post applies appropriate
  423. ineligibilities for these individuals who knowingly used their
  424. position and/or travel history to advance the applications of
  425. unqualified applicants.
  426.

  428. IV FRAUD
  429. --------

  431. 8. IV fraud generally relates to the IV application process rather
  432. than the applicant's relationship to the petitioner. Many of our IV
  433. cases deal with third country nationals (TCN) who reside in Malawi.

  445. 9. N/A. Post's DV cases are handled and processed by Embassy Harare.

  449. ACS AND U.S. PASSPORT FRAUD
  450. ---------------------------
  451.  
  452. 10. Post has not detected any cases involving ACS or passport fraud
  453. during the reporting period. With our low ACS load, Post is able to
  454. give considerable oversight and review of our passport and CRBA
  455. cases.
  456.  
  457. --------------
  458. ADOPTION FRAUD
  459. --------------
  460.  
  461. 11. Adoption fraud is not yet an issue in Malawi. Malawi's
  462. restrictive adoption laws and requirements have so far deterred most
  463. AMCITs interested in pursuing inter-country adoptions. Previously,
  464. most adoptions petitions were processed through the I-130 process
  465. and Post is able to undertake in-depth reviews of the documentation
  466. and the orphan status of the adoptee child. However, in a recent
  467. hi-profile adoption court case, the Malawi Supreme Court rendered a
  468. decision which may serve to open the door to increased inter-country
  469. adoptions. Post has already experienced a significant percentage
  470. increase in I-600 adoption cases with NVC forwarding five approved
  471. I-600As in the last two months alone. Normally, Post might receive
  472. one or two I-600s for an entire year. Post will track this trend
  473. and report on any developments.
  474.

  476. USE OF DNA TESTING
  477. ------------------

  479. 12. Post did not conduct DNA testing during the reporting period.
  480.  
  481. ----------------------------------
  482. ASYLUM AND OTHER DHS BENEFIT FRAUD
  483. ----------------------------------
  484.  
  485. 13. Post did not handle any asylum or DHS benefit cases during the
  486. reporting period. Post did, however, receive approved Visas 92/93
  487. cases from the National Visa Center (NVC). Establishing the
  488. relationship between petitioners and beneficiaries is difficult in
  489. such cases and Post has limited resources to carry out
  490. investigations to establish relationships between the petitioners
  491. and the beneficiaries. Visas 92 and 93 beneficiaries are typically
  492. not citizens or permanent residents of Malawi. If possible, the
  493. Department of Homeland Security and United States Citizenship and
  494. Immigration Service (DHS/USCIS) should provide additional
  495. information that could help establish relationships between the
  496. petitioners and beneficiaries. For example documents that could
  497. assist Post in establishing relationships may include birth
  498. certificates or records, marriage certificates, national
  499. identification cards, school records, church records, family
  500. photographs, health records, home village addresses, home town area
  501. addresses, province/region or district addresses, occupational
  502. records, clan or tribe, mother language, father language, last
  503. address before travel to the US, and/or any other relevant
  504. information that could lead to confirming family relationships.

  507. ALIEN SMUGGLING, TRAFFICKING, ORGANIZED CRIME, AND TERRORIST TRAVEL

  510. 14. Per Paragraphs 3 and 4 above, Malawi serves as a transit country
  511. for third country nationals enroute to South Africa. According to
  512. Malawian Authorities, smugglers reportedly charge aliens transiting
  513. Malawi the equivalent of $1400 U.S. dollars.
  514.

  516. DS CRIMINAL FRAUD INVESTIGATIONS
  517. --------------------------------

  519. 15. The Regional Security Office and Consular Section have a strong
  520. working relationship and have frequently collaborated on cases and
  521. issues of concern.

  531. 16. Malawi's primary identity documents (passports, birth
  532. certificates, etc.) create the biggest challenge for Post's fraud
  533. prevention efforts. Genuine documents containing fraudulent
  534. information are the biggest threat. Most documents are easily
  535. obtained by applicants from any area or level of socio-economic
  536. status. Birth certificates, death certificates, and marriage
  537. certificates are often created many years after the event and merely
  538. reflect the attestation of the individual requesting the document.
  539. Malawi's lack of document controls means that corruption and bribery
  540. are not essential to receive any new document desired. Malawi's
  541. Commissioner of Immigration has informed us that a new, more secure
  542. passport may be issued early in 2010.
  543.

  545. COOPERATION WITH HOST GOVERNMENT AUTHORITIES
  546. --------------------------------------------

  548. 17. Post has received satisfactory cooperation from host country
  549. counterparts. While Malawian Immigration and Police Officials have
  550. been very cooperative with our requests to verify documents and
  551. cooperate with investigations, Malawi does not have sufficient
  552. resources, training or expertise to counter the gaps in the security
  553. of their identity documents. Post is working to provide the GOM with
  554. Department sponsored training in this regard.
  555.

  557. AREAS OF PARTICULAR CONCERN
  558. ---------------------------
  559.  
  560. 18. The availability of genuine identity documents using false
  561. information is a significant concern. As a general rule, most
  562. Malawians do not obtain an identity document until they are an
  563. adult. At that juncture, as long as they have a friend or relative
  564. willing to attest to their chosen "identity", they can receive a
  565. birth certificate which is then used to obtain an official
  566. government identity document such as a passport. This fact, coupled
  567. with Malawi's porous borders and its location as a transit route in
  568. proximity to East African nations known to harbor terrorists and
  569. criminals, raises the specter of mala fide travelers obtaining U.S.
  570. visas or Malawi passports through fraud.

  573. STAFFING AND TRAINING
  574. ---------------------
  575.  
  576. 19. Post's Consular Section consists of one Consular Officer, one
  577. EFM and one LES - there is no dedicated FPU. The Consul has
  578. extensive experience and attended FSI's Advanced Consular Course,
  579. and has previously attended FSI's Analytic Interviewing and Advanced
  580. Consular Name checking Techniques courses.
  581.  
  582. 20. The LES Consular Assistant is designated the fraud investigator
  583. for the consular section and has received OJT. This LES (along with
  584. Consul) have developed excellent working relations with the local
  585. and national-level Malawi authorities including Immigration, Police,
  586. Airline representatives, and the Malawi National Examination and
  587. Testing Board (MANEB). The LES Consular Assistant has not received
  588. formal fraud training, and was recently denied a training seat in
  589. the November 2009 FSN Fraud course. Post has been promised serious
  590. consideration for the March 2010 convening of this course.
