- Sen. Mary Landrieu, D-La., a strong adoption advocate, says the legislation is flawed because most parents who adopt "special needs" children, generally defined as those in foster care, won't qualify for the credits. That's because most special needs adoptions are subsidized and come with few costs.
- The adoption tax credit -- $5,000 for regular adoptions and $6,000 for special needs adoptions -- was first approved by Congress in 1996 as an incentive for adoption. A recent U.S. Treasury report said that 50,000 parents qualified for the tax credit in 1998, but only a small percentage of the credits were for special needs children, who often are the hardest to place for adoption.
- "If we do not make a change in the bill, if we do not make a change in the phraseology about this tax credit, we are going to leave behind 100,000 children," Landrieu said. "If the train is leaving the station, it is as if you are waving good-bye to 100,000 children in this nation, some of the most vulnerable children, children the system has failed, children whose parents abandoned them, abused them or grossly neglected them. The system has already failed them once; I do not have the heart and I do not think we have the heart to fail them again."
