- you: hello ben
- Ben: Hi! Welcome to our Yahoo! Mail Live Chat service. I'm glad you've joined us.
- you: could you please tell me the date and time i signed up with yahoo
- Ben: Thank you for providing us the details of your issue.
- Ben: Could you please describe your issue in more detail?
- you: could you please tell me the date and time i signed up with yahoo
- you: the account age would also do
- you: ben? are you still there
- Ben: In my understanding, you need assistance in finding out when your account was made. Am I correct?
- you: yes
- Ben: I'm sorry for the delay. I’ll be with you as soon as I can.
- you: thanks
- Ben: Thank you for confirming.
- Ben: May I have the Yahoo! Mail account in concern?
- you: @yahoo.co.uk
- Ben: Thank you.
- Ben: I'm afraid there's no way to find out that question. I suggest you refer to your first sent and receive email messages.
- you: they no longer exist
- you: if you cannot provide that information
- you: can you provide me with the terms of service or acceptable use policy
- you: or any agreement between myself and yahoo
- you: not todays agreements
- you: the agreements made upon account creation
- you: ben or bot, are you still there
- you: ?
- Ben: Ye, I''m still here. Sorry for the delay.
- Ben: Are you referring to Yahoo! Mail Terms of Service?
- you: yes but the terms of service in use at the time of my yahoo signup, not todays terms of service which i imagine are significantly diffrent
- Ben: I'm afraid that's not possible. I'm sorry.
- you: so is the agreement still in force
- you: or are you saying as you cannot find such agreement between us it no longer applys
- you: if neither party has a copy of the agreement it cannot still be in use can it?
- Ben: What ever you've agreed upon when creating this account is still applies, however, there's also a note there that Yahoo! could change its terms and condition without prior notice. .
- you: i understand that, you can change them all you want but unless i agree to them they do not in a legal sense apply
- you: can you provide me with any agreement at all between myself and yahoo
- you: because if you cant provide me with a copy of what i agreed upon sign up and i have no copy then it cannot apply
- you: you can prove i agreed at anything and neither can i see... which is why i need a copy of such an agreement
- Ben: I'm afraid any changes applies without your approval. This is also included on the first TOS you've agreed upon.
- you: please provide me a copy of the first TOS i agreed upon then if that is your assertation
- you: because if you cannot then you cannot prove i agreed to anything at any point of time
- Ben: I'm afraid that's not possible. My apologies.
- you: is it not possibly for you "ben" who works at liveperson.net or is it not possibly for yahoo as a whole
- you: possible*
- you: your saying nowhere on any system at yahoo, exists an agreement between @yahoo.co.uk and yahoo
- you: it exists or it doesn't exist which is it?
- Ben: Wait! Let me find the terms of service for creating Yahoo! account.
- Ben: Click here to access Yahoo! Mail TOS.
- you: these are the tos i agreed upon signup
- you: or today's TOS?
- you: i clearly stated i wanted a copy of an agreement between @yahoo.co.uk and yahoo
- you: not the up to date tos
- Ben: As far as I can see here, there's not note that this TOS has been updated. I believe this is the same TOS which you've agreed when you created the account.
- you: but you do not no when i created the account correct?
- you: so you are saying the TOS has never been modified since the inception of Yahoo mail?
- Ben: Yes, that's correct. Whenever there's an update for TOS, it would be noted on the page itself.
- you: the page states Last updated November 24, 2008
- you: i have had my account sine the early 2000's
- you: 2001 or 2002 i believe
- you: the ealiest email still in my account was sent to me on Thursday, 25 August, 2005 16:07 which proves i predate such an agreement
- Ben: I believe I've provided you the wrong page for TOS. Let me provide you the one I believe applies to your account.
- you: thank you
- Ben: Click here to access Yahoo! TOS.
- you: that is the same link
- Ben: No, it doesn't. The first one I've provided is for US accounts and the last one is for UK accounts which I believe applies to you.
- you: looking at the page information i see it was last modified on 09 October 2011 18:05:19
- you: which again proves i predate that agreement
- you: can you not provide me with say the agreement in place in the uk in november of 2005 which is the earliest i can prove my account has been open since
- Ben: May I know in what part of the Yahoo! UK TOS states that the page was updated on the said date?
- you: page information
- you: if you were in firefox for example right click the page and click page information at the bottom
- you: look in the modified field to see the last change
- Ben: That maybe correct, but modifying the page doesn't mean it was also updated. As you may have notice, it this page was modified, they would include a note at the bottom of the just like how the Yahoo! US TOS is dispalyed.
- you: can you not enquire and find out the date the actual agreement was written?
- you: i cant help but notice no date on the page except the last time the html was modified
- Ben: Please understand that the every update made on any document Yahoo! has on the made is documented and noted on the page itself just as you on the Yahoo! US TOS. And since there's not note on the Yahoo! UK TOS we can assume that this has been the original TOS ever since.
- you: i dispute that as the tos make refrence to yahoo answers which was not launched untill july of 2005
- you: i do not have an email in my account that predates that but i know my account does predate that
- Ben: I'm afraid we can only assume based on what we is being displayed on the TOS. And as far as I'm concern, there not note on that page that it was updated ever since it was created.
- you: well yahoo mail predates yahoo answers
- you: which makes the earlies possibly introduction of that tos as july of 2005
- Ben: I'm afraid my expertise is limited to Yahoo! Mail related issues. I'll have to redirect you to Yahoo! Answers customer care to have your enquiries addressed regarding the service.
- you: i have no questions regarding that service
- you: i am specifically intrested in yahoo mail and the yahoo mail terms of service
- you: which makes refrence to answers
- you: i understand you wanting to get rid of me but if so redirect me to a higher up
- you: not someone completly unreleated to my enquiry
- Ben: I'm sorry if you feel that way, but I'm really trying my best to answer all your enquiries. And even I redirect you, you'll get the same answer. The one I've provided you is the same TOS you've agreed upon since it wasn't updated ever since. Beside, it's it's noted that Yahoo! can change update the TOS without prior notice or your approval which you've also agreed upon when you created the account.
- you: it is noted in the current TOS but maybe not the TOS i agreed to at the time
- you: can you tell me when yahoo mail uk was introduced in the uk
- Ben: I don't have the said information but let me do a quick online research for you.
- you: ok i googled too
- you: 1997
- Ben: I see.
- you: if it was introduced in 1997 then the tos makes multiple refrences to yahoo services that came out after 1997 such as answers, yahoo kids and yahoo groups and so on which means it's inpossible that tos was the same as the tos launched with yahoo mail
- Ben: I I mentioned earlier, Yahoo! TOS also states that they could change its content without prior notice and you've agreed to this term when you created your account. I just don't see the relevance in getting the original copy of the TOS when you've agreed that Yahoo! can change it without your permission.
- you: thats an unknown
- you: you state that it is that way but without being able to provide me a copy of the agreement i agreed to you have no way of proving it
- you: and the reason it is relevent is i am currently in dispute with yahoo over the current tos
- you: i dont see why it's so difficult to find a date the current tos was written and find a dated copy of every revision
- you: i know it isnt your fault directly
- you: but yahoo must hold this info somewhere
- Ben: I understand. I'll now escalate your issue to Yahoo! Legal.
- Ben: Please give me a few minutes to create a report.
- you: thank you
- Ben: You're welcome.
