Today, on July 09, 2014, I arrived to begin my second shift of the day around 7:00 p.m. When I arrived a homeowner by the name of Misty Minyard was sitting with her guest at the black pool table on the right (from pool entry). The guest was smoking a cigarette and drinking a beer. There were two beer cans near each other so it is possible that he was well into his second one. I informed him that doing so was against the HOA rules. He then began to attempt to negotiate with me and again, I restated the rule and said that I had asthma and smoking, as well as alcohol, were not allowed in the pool area. He eventually walked out of the pool area and the homeowner, Ms. Minyard walked over and apologized for her cousin's behavior. I then asked her if I had verified her and then proceeded to verify her again. The homeowner's address is as follows;

  16. Shortly after verifying the woman, the family continued their pool activities and the man got into the pool. Not too long after, the children from their party found the box of cigarettes with a lighter in it. I told the children not to play with it and to just leave it alone. I am not sure where the children found the box, but my attention was drawn when they were fumbling with it at the trash can. From what it looked like to me the children either found the box in the pool or near the stairs. The children disposed of the contents on their own regards and returned to the pool.

  18. I did inform Luis of the man and his smoking, as well as his attempts to negotiate in a response to a message I received from Luis about his upcoming arrival to deliver my check. While Luis was there he did reemphasize the rules to the guest and then exited the pool area. When the party began to leave I began to record on my cell phone. The following encounter is recorded and attached to this document. The beginning of the recording is an unrelated conversation that someone else and I were having. However, I began to record for security purposes in case an alteration took place. The man (identified as Richard in the recording) became upset and began to curse. I was unaware of what or to whom he was upset with until his comments became racial. He left with his family, commenting and threatening as he departed.

  20. I immediately called the police, and informed Luis. While waiting for the authorities, my boyfriend and I heard loud singing coming from the direction in which we witnessed members of the homeowner's party walk in. We could not hear the words clearly, but the voice resembled the man that caused the issues at the pool. About more or less than thirty minutes after calling, Officer S. Folds and I believe the other was Officer Tanghin arrived and were given a description of the situation. They informed me that there was nothing that they could do but to inform the HOA and encourage the board to not allow the individual to return. They also wrote down my name and the address as well as the Minyard's.

  22. As the pool monitor, I have run into a few scenarios over the course of my employment these past two years. I have never felt this concerned or in danger before. I ask that if this document and/or situation is shared that my information (name, address and family information) remains confidential. This is a matter that does make me concerned about continuing to perform as the pool monitor alone for hours at a time. I do request that the board discuss taking the next necessary precautions regarding this incident and inform me of anything that I need to do. I thank Luis for assisting me with this encounter and pray that this neighborhood is still a safe place to reside and hope for a solution to come shortly to protect our families and well being.
