  5. TERMS AND CONDITIONS FOR THE USE, REPRODUCTION AND DISTRIBUTION

  9. (1) "Subject Matter of the License" means the copyrighted works of the software

  11. protected under copyright, design and/or patent law which are made available

  13. attached to the work as well as the application and user documentation.

  15. (2) "License" means the terms and conditions for the use, reproduction and
  16. distribution of the Subject Matter of the License in accordance with the
  17. provisions of this document.

  19. (3) "Licensor(s)" means the copyright holder(s) or the entity authorised by law
  20. or contract by the copyright holder(s) to grant the license.

  22. (4) "You" (or "Your") means a natural or legal person exercising the

  25. (5) "Source Code" means the version of the code of the software components of
  26. the Subject Matter of the License in the programming language.

  57. §2 Granting of usage rights

  60. provisions of this License, You are hereby granted by all Contributors, for the
  61. term of the copyrights in the Subject Matter of the License, the

  65. - worldwide and perpetual,
  66. - irrevocable and non-terminable

  71. software and data components – in particular to store or load it permanently
  72. or temporarily, to display it and run it, including to the extent
  73. reproductions are necessary to that end,
  74. - to modify, interpret, edit or redesign in another way,
  75. - to store, reproduce, exhibit, publish, distribute in tangible or intangible
  76. form, on any medium or in any other way, for commercial and non-commercial
  77. purposes, in particular to communicate privately or publicly, also through
  78. image, audio and other information carriers, irrespective of whether by wire
  79. or wireless means,
  80. - to use in databases, data networks and online services, including the right
  81. to make the software and data components of the Subject Matter of the License
  82. available in source code or object code to users of the aforementioned
  83. databases, networks and online services for research and retrieval purposes,
  84. - to allow third parties to use or operate,
  85. - to use for own purposes but also to provide services to third parties,
  86. - to distribute
  87.  
  88. the Subject Matter of the License in its original or modified, interpreted,
  89. edited or redesigned form.

  91. This right of use relates to the Subject Matter of the License in particular
  92. its source code and object code of the software components in all forms
  93. (including - where applicable - design rights).

  95. §3 Grant of a patent license
  96.  
  97. Subject to the terms and conditions of this License and compliance with the
  98. provisions of this License, You are hereby granted by each Contributor a
  99.  
  100. - perpetual,
  101. - worldwide,
  102. - non-exclusive,
  103. - free of charge,
  104. - irrevocable (with the exception of the restrictions set out in this
  105. Section 3)

  107. patent license in all rights deriving from the patents, owned and licensable by
  108. the Contributor at the time of the submission of the Contribution, to
  109.  
  110. - produce,
  111. - have produced,
  112. - use,
  113. - offer for sale,
  114. - sell,
  115. - import and otherwise transfer
  116.  
  117. the Subject Matter of the License.
  118.  
  119. However, this patent license covers only those rights deriving from the patents
  120. of the respective Contributors as are indispensable in order not to infringe
  121. that patent and only to the extent that the use of the Contributor’s respective
  122. Contributions, whether in itself or as a combination with other Contributions
  123. of the Contributors or any third parties together with the Subject Matter of
  124. the License for which these Contributions were submitted, would otherwise
  125. infringe that patent. For avoidance of doubt, no patent licenses are granted
  126. for the use of the Subject Matter of the License or the Contributions which
  127. become necessary for lawful use because third party modifications are made to
  128. the Subject Matter of the License or the respective Contributions after the
  129. Contributions has been submitted by the Contributors. Under no circumstances
  130. will anything in this Section 3 be construed as granting, by implication,
  131. estoppel or otherwise, a license to any patent for which the respective
  132. Contributors have not granted patent rights when they submitted their
  133. respective Contributions.

  135. In the event that You institute judicial patent proceedings against any entity
  136. or person (including a counterclaim or countersuit in a legal dispute), arguing
  137. that the Subject Matter of the License or a Contribution incorporated or
  138. contained therein constitutes a patent infringement or a contributory factor to
  139. a patent infringement, all patent licenses which have been granted to You under
  140. this License for the Subject Matter of the License as well as this License in
  141. itself shall be deemed terminated as of the date on which the action is filed.

  143. For avoidance of doubt, the Contributors are entitled to decide in their own
  144. discretion to abandon respectively maintain any patent designated by patent
  145. number upon delivery of the Subject Matter of the License.

  147. §4 Distribution
  148.  
  149. You may reproduce and distribute copies of the Subject Matter of the License or
  150. Derivative Works on any medium, with or without modifications, (with regard to
  151. software components) in Source or Object Code, provided that You comply with
  152. the following rules:

  154. - You must provide all other recipients of the Subject Matter of the License or
  155. of Derivative Works with a copy of this License and inform them that the
  156. Subject Matter of the License was originally licensed under this License.
  157. - You must ensure that modified files contain prominent notices indicating that
  158. You have modified the files.
  159. - You must retain all copyright, patent, trademark and name credit notices in
  160. the Subject Matter of the License in the source code of any Derivative Works
  161. You distribute, with the exception of those notices which do not belong to

  175. §5 Submission of Contributions

  182. licensing agreement that You may have concluded with a Licensor for such
  183. Contributions, such as a so-called "Contributor License Agreement" (CLA).

  185. §6 Trademarks
  186.  
  187. This License does not grant permission to use the trade names, trademarks,
  188. service marks or product names of the Licensor or of a Contributor.
  189.  
  190. §7 Limited warranty
  191.  
  192. This License is granted free of charge and thus constitutes a gift.
  193. Accordingly, any warranty is excluded. Work on the Subject Matter of the
  194. License continues on an ongoing basis; it is constantly improved by countless
  195. Contributors. The Subject Matter of the License is not completed and may
  196. therefore contain errors ("bugs") or additional patents of Contributors or
  197. third parties, as is inherent to this type of development.

  199. §8 Limitation of liability
  200.  
  201. Except in cases of intent and gross negligence or causing personal injury, the
  202. Contributors, their legal representatives, trustees, officers and employees
  203. shall not be liable for direct or indirect, material or immaterial loss or
  204. damage of any kind arising from the License or the use of the Subject Matter of
  205. the License; this applies, among other things, but not exclusively, to loss of
  206. goodwill, loss of production, computer failures or errors, loss of data or
  207. economic loss or damage, even if the Contributor has been notified of the
  208. possibility of such loss or damage. Irrespective of the above, the Licensor
  209. shall only be liable in the scope of statutory product liability, to the extent
  210. the respective provisions are applicable to the Subject Matter of the License
  211. or the Contribution.

  213. Except in the case of intent, the Contributors, their legal representatives,
  214. trustees, officers and employees shall not be liable that any of the
  215. Contributions are free from any claim of infringement of any patent or any
  216. other intellectual property right owned by any third party, accurate, devoid of
  217. mistakes, complete and/or usable for any purpose.

  219. §9 Provision of warranties or assumption of additional liability in the event
  220. of distribution of the Subject Matter of the License
  221.  
  222. In the event of distribution of the Subject Matter of the License or Derivative
  223. Works, You are free to assume support, warranty, indemnity or other liability
  224. obligations and/or rights in accordance with this License and to charge a fee
  225. in return. However, in accepting such obligations, You may act only on Your own
  226. behalf and on Your sole responsibility, not on behalf of any other Contributor,
  227. and You hereby agree to indemnify, defend, and hold each Contributor harmless
  228. for any liability incurred by, or claims asserted against, such Contributor by
  229. reason of your accepting any such warranty or additional liability.

  231. §10 Applicable law

  233. This License is governed by German law with the exclusion of its provisions on
  234. the conflict of laws and with the exclusion of the UN Convention on Contracts
  235. for the International Sale of Goods (CISG).
