- Boumediene v. Bush/Al Odah v. US
- Background: Rasul v. Bush- Four British and Australian citizens detained in Aghanistan or Pakistan and transported to Guantanamo Bay, but when their families found out, they tried for habeas corpus. The U.S. refused because the prison was in Cuba, and so not under U.S. jurisdiction. “The district court agreed with the government, dismissing the case because it found that it did not have jurisdiction. The U.S. Court of Appeals for the District of Columbia affirmed the district court's decision.” However, the Supreme Court ruled in Rasul’s favor, because though the prison was in Cuba, the U.S. had a lease on the area and therefore total control in it: thus, U.S law should apply.
- It was following this that Boumediene v. Bush/Al Odah v. US came about. These are in fact the names for numerous cases that were consolidated together. Over 70 detainees were petitioned for, with 11 habeas petitions submitted for them.
