  9. motions and supporting evidence. I am submitting this is haste after a recent
  10. physical confrontation that has put my continued ability to finalize this Claim
  11. For An Award at significant risk. I will attempt to send the document via fax as
  12. well but that may be prohibitively expensive, or require the sending of fax
  13. pages in partitioned increments.

  20. 4. Acknowledgement that my Claim For An Award and associated documents will

  23. For quick reference, this claim pertains to at least the following two TCR
  24. Numbers, TCR1444760433067 (10/13/2015) and TCR1446566870080 (11/3/2015).
  25. However, because the SEC has admitted to the deletion and spoliation of records
  26. and given the fact that I have lost access to files as a result of selling
  27. devices to buy food, need to delete because of imminent discovery of my
  28. identity, and attacks on my computer devices - there are many more relevant
  29. files which will be found via discovery.
  30. I have chosen to submit this early; As a result of all of the time and effort
  31. spent on this Claim For An Award, I have a backlog of over 20 new frauds that
  32. need to be reported to the SEC and other law enforcement agencies. In the
  33. interest of protecting investors and following my morals it is necessary for me
  34. to dedicate my time to bringing those frauds to light as soon as possible and it
  35. is not in the interest of our financial markets for me to put my own interests
  36. above soon-to-be scammed investors.

  38. Please take care in processing this Claim For An Award, my situation is very
  39. fragile and a failure to afford due process could cause additional irreparable
  40. damage to me, the financial markets, and the victims of fraud. Everything I have
  41. done and reported to the financial regulators has been in an effort to protect
  42. investors and consumers and protect our financial markets from fraudsters. By
  43. efficiently adjudicating this Claim For An Award I will be able to continue my
  44. efforts to assist others and safeguard our financial markets.

  77. I am writing today, on behalf of many Whistleblowers, to clarify the OWB stance
  78. on how receiver based settlements or actions will be counted towards
  79. Whistleblower awards.
  80. As you know, the ongoing litigation by the SEC has placed Jay Peak and related
  81. companies into receivership, the receivership has then acted on behalf of the
  82. SEC and on behalf of the investors in entering into a number of settlements and
  83. recovering monies.
  84. I would encourage you office to consider receivership actions as actions of the
  85. SEC and allow Whistleblowers to claim an award for those actions. As you know,
  86. there are many Whistleblower's in the Jay Peak case and it would be highly
  87. encouraging to them and would be Whistleblowers if you office posted Notices Of
  88. Cover Actions this month for the recent $13 million dollar settlements initiated
  89. by the receivership on behalf of the SEC. This construction will help carry out
  90. the intent of Congress.

  106. more days to file for an award, it is imperative that problems be addresses
  107. immediately and that the OWB provide me with confirmation that these documents
  108. have been received on a specific date.
  109. I do not meet to be an annoyance, but given my delicate situation I have having
  110. even more stress and difficulty sleeping as I repeatedly mull over the potential

  499. Given the recent physical attacks there is an elevated risk that I am unable to
  500. continue my Whistleblower submissions, thus I am writing this quick email to
  501. consolidate some of my pending Whistleblower tips because it is likely that I
  502. will be unable to write a full narrative on them:
  503.  
  504. 1. *Golden 1 Center (Sacramento Kings Stadium and Business EB-5 Project sponsored by Golden Gate Global Regional Center)* 1. Falsely claims in marketing material that the Golden Gate Global Regional Center has not received a single I-526 denial, however, based off the disclose USCIS WAC Numbers on Baidu Cloud, at least two investors have received final I-526 denials in Golden Gate Global projects, including the Hunter's Point Shipyard projects. 2. In relation to the Golden 1 Center project, the project was completed on September 30, 2016 and the project had a formal ribbon cutting ceremony to mark the completion of the project. However, as of October 24, 2016 at least one EB-5 agent, GoodHopeVisa, continues to market this project to investors despite the fact that construction has been completed, meaning investors will not be eligible job creation. As is relevant to securities law the continuing marketing activities by Golden Gate Global violate the law by: 1. Falsely claiming EB-5 funds will be deployed during construction. 2. Falsely claiming EB-5 funds will be deployed only during Q4 of 2015, and Q1, and Q2 of 2016, when in reality if an investor subscribes today the EB-5 funds will not be deployed for roughly 20 months. These false representations give investors a false sense of security that their investments are going to the job creation phase of the project. 3. Falsely claiming the project is still an EB-5 eligible project when in reality the EB-5 funds being raised now and likely before are simply being used to re-finance a fully funded project and thus is not creating jobs but instead artificially preserving jobs, which as the USCIS set forth in the termination of the VictorVille Regional Center is not a valid method of economic impact. 3. As is common, a single will full violation of securities law lends to a significantly higher probability that other wrongdoing is occurring as well, in this case the following is relevant: 1. The use of aggressive marketing ignores facts and falsely claims that the Hunter's Point Shipyard projects are entirely sold out and all of the homes have been pre-purchased, which is not true. 2. Confidential investor information, including subscription agreements, passport scans, escrow documents, bank accounts details, and entire I-526 petitions, commission referral agreements, etc were previously available on baidu.pan directories such as: http://pan.baidu.com/share/home?uk=1464934011#category/type=0 3. There are highly regarded opinions by the majority of learned EB-5 lawyers and industry players that the economic impact report used by Golden 1 Center are entirely made up and do not represent reality. Given the letters from the Sacramento City concerning a $325 million bond raise and the capital stack provided to investors it is suggested that EB-5 funds are simply being used to pay back bond holders and not actually create jobs. The probability of this significantly increases when considering the fact that this project was fully funded before the contemplation of EB-5 funding, yet investors are provided with known to be false capital stack pie charts showing only $223 million from the Sacramento City when in reality over $325 million was provided via bond funds. 4.   642. Within *Wharton 1.pdf*, Ms. Nikkia Wharton incorrectly instructs me to send my
  643. Whistleblower tips in multiple parts. This was entirely correct guidance and Ms.
  644. Wharton refused to respond to my numerous subsequent inquiries requesting
  645. confirmation that my voluminous submissions were being received by tip review
  646. staff. As a result of Ms. Wharton's incorrect instructions and failures to
  647. respond to Whistleblower inquiries over 11 months of Whistleblower tips and
  648. thousands of hours of my efforts had been wasted. This ultimately manifested in
  649. Mr. Vincente Martinez informing me in July 2016 that all of my multi-part
  650. submissions can not be reviewed and that SEC staff were ignoring many of my tips
  651. because they believed all tips to be un-reviewable. Accountability is necessary
  652. to prevent these enormous damages from occurring again and if Ms. Wharton was
  653. tasked with reviewing or providing input for my Claim she may ignore significant
  654. information as it would shed light on her wrongdoing and the damages caused.
  655. Similar to the above, within *McCreery 1.pdf*, Mr. Jack McCreery incorrectly
  656. states that using the SEC's Whistleblower Portal will allow the SEC to review my
  657. multi-part and voluminous submissions. Mr. McCreery also refused to reply to my
  658. numerous inquiries asking for confirmation that 10MB multi-part submissions are
  659. being reviewed by SEC staff.
  660. Additionally, within *Wharton 2**.pdf*, there are references to a phone call
  661. that I had with Ms. Wharton and Mr. McCreery. Within this phone call, among
  662. other things, Ms. Wharton instructed me to provide "significantly more
  663. elaboration and legal analysis". A practice I adopted from late 2015 to July
  664. 2016, when once again it was proven that Ms. Wharton's statements were incorrect
  665. and mis-leading. Indeed, in a July 2016 call with Mr. Martinez, I was told to
  666. provide 5-7 paragraphs of narrative that can be reviewed within 15 minutes -
  667. which is almost the exact opposite of what Ms. Wharton had instructed me to provide.
  668. Once again, the involvement of Ms. Wharton and Mr. McCreery in these situations
  669. will cause inappropriate bias as they will be motivated to hide their mistakes
  670. and thus disregard substantial and critical evidence that is relevant to my claim.

  715. submissions, Ms. Wharton's actions to allow the deletion of Whistleblower
  716. records violates SEC Rule 21F-17, the Privacy Act, Dodd-Frank Act, and the
  717. SEC's own data retention policies - all which act to deter the SEC's ability
  718. to protect investors. These facts are highly relevant to the present Claim
  719. For An Award because the deletion of records has put me at an insurmountable
  720. disadvantage and given such it would only be appropriate to grant me full
  721. discovery in an attempt to reduce the irreparable damages caused by the
  722. deletion and spoliation of records.
  723. 2. Furthermore, there exists emails among myself, Margarett Spillane
  724. (SpillaneM@SEC.GOV), and Gregory N Miller (MillerG@sec.gov) and private
  725. emails amount between Ms. Spillane and Mr. Miller discussing the deletion of
  726. certain Whistleblower tips and associated attachments that I have provided.
  727. These emails lend to the fact that SEC staff coordinated to delete or ignore
  728. my Whistleblower tips. Indeed, after explaining to Ms. Spillane and Mr.
  729. Miller the source of these tips and the copious reasons as to why they are
  730. not privileged, Ms. Spillane and Mr. Miller acted to introduce an
  731. blanket-like ban on many of my Whistleblower tips for many months, until
  732. numerous tips and videos were submitted proving, beyond any doubt, that I
  733. regularly came across and had been given the information that I had
  734. submitted to the SEC. *These emails will need to be recovered via discovery and considered as evidence in my claim.* *Anything less is simply an invitation for public litigation and judicial review. *It is believed some of these emails included tsa256@gmail.com <mailto:tsa256@gmail.com> and taylor.amarel@gmail.com <mailto:taylor.amarel@gmail.com> as to, from, or cc addresses. 3. Attached as, *New York Insecure Coms.pdf*, is a quintessential example of

  738. staff and is not segregated as many SEC investigations are. Furthermore, the
  739. email contains my name, tip, and company subject to the tip - showing that
  740. the SEC has failed to take reasonable safeguards to keep my identity safe.
  741. Standard security procedures such as using ZIX Mail, segregating tip and
  742. identity information, and making communications from a private email address
  743. were all ignored by SEC staff.
  744. 4. Finally, as I attempt to recover the relevant information it is necessary
  745. for the SEC to provide core index information that would allow for the
  746. reconstruction or rediscovery of information that was removed as a result of
  747. SEC negligence or threats to my life. As discussed in more detail in my
  748. prior filings, on multiple occasions I was forced to sell computer
  749. electronics, was subject to electronic hacks, and suffered corruption as a
  750. result of the persecution, poor financial conditions, and continued
  751. harassment of me as a Whistleblower. This has caused some relevant data to
  752. be lost, thus why I requested discovery. However, recognizing that discovery

  947. In an effort to streamline the discovery process I have attempted to recovery as
  948. much information as possible and have been submitting it to you for
  949. consideration and support of my motions. In this email I have attached a few
  950. relevant documents.

  952. 1. Within *Wharton 2.pdf*, there are references to a phone call conversation
  953. among myself, Ms. Wharton, and Mr. McCreery. I wanted to add that this is
  954. one of the conversations where Ms. Wharton admitted that many of my
  955. Whistleblower tips were being deleted from SEC computers. Yet no action was
  956. being taken to confirm the source of my disclosures, despite my regular
  957. offerings to discuss the source of my information directly with SEC staff or
  958. provide additional elaboration as needed. As elaborated upon in my prior
  959. submissions, Ms. Wharton's actions to allow the deletion of Whistleblower
  960. records violates SEC Rule 21F-17, the Privacy Act, Dodd-Frank Act, and the
  961. SEC's own data retention policies - all which act to deter the SEC's ability
  962. to protect investors. These facts are highly relevant to the present Claim
  963. For An Award because the deletion of records has put me at an insurmountable
  964. disadvantage and given such it would only be appropriate to grant me full
  965. discovery in an attempt to reduce the irreparable damages caused by the
  966. deletion and spoliation of records.
  967. 2. Furthermore, there exists emails among myself, Margarett Spillane
  968. (SpillaneM@SEC.GOV <mailto:SpillaneM@SEC.GOV>), and Gregory N Miller
  969. (MillerG@sec.gov <mailto:MillerG@sec.gov>) and private emails amount between
  970. Ms. Spillane and Mr. Miller discussing the deletion of certain Whistleblower
  971. tips and associated attachments that I have provided. These emails lend to
  972. the fact that SEC staff coordinated to delete or ignore my Whistleblower
  973. tips. Indeed, after explaining to Ms. Spillane and Mr. Miller the source of
  974. these tips and the copious reasons as to why they are not privileged, Ms.
  975. Spillane and Mr. Miller acted to introduce an blanket-like ban on many of my
  976. Whistleblower tips for many months, until numerous tips and videos were
  977. submitted proving, beyond any doubt, that I regularly came across and had
  978. been given the information that I had submitted to the SEC. *These emails will need to be recovered via discovery and considered as evidence in my claim.* *Anything less is simply an invitation for public litigation and judicial review. *It is believed some of these emails included tsa256@gmail.com <mailto:tsa256@gmail.com> and taylor.amarel@gmail.com <mailto:taylor.amarel@gmail.com> as to, from, or cc addresses. 3. Attached as, *New York Insecure Coms.pdf*, is a quintessential example of
  979. how SEC staff have carelessly put my identity at risk. Indeed, the attached
  980. document shows an email from the group inbox newyork@sec.gov
  981. <mailto:newyork@sec.gov> which is accessible by an enormous amount of SEC
  982. staff and is not segregated as many SEC investigations are. Furthermore, the
  983. email contains my name, tip, and company subject to the tip - showing that
  984. the SEC has failed to take reasonable safeguards to keep my identity safe.
  985. Standard security procedures such as using ZIX Mail, segregating tip and
  986. identity information, and making communications from a private email address
  987. were all ignored by SEC staff.
  988. 4. Finally, as I attempt to recover the relevant information it is necessary
  989. for the SEC to provide core index information that would allow for the
  990. reconstruction or rediscovery of information that was removed as a result of
  991. SEC negligence or threats to my life. As discussed in more detail in my
  992. prior filings, on multiple occasions I was forced to sell computer
  993. electronics, was subject to electronic hacks, and suffered corruption as a
  994. result of the persecution, poor financial conditions, and continued
  995. harassment of me as a Whistleblower. This has caused some relevant data to
  996. be lost, thus why I requested discovery. However, recognizing that discovery
  997. may be lengthy I have endeavored to provide as much preliminary or pointing
  998. evidence as possible that I have recover or acquire through other methods -
  999. with the goal of improving the efficiency of this claim adjudication. To
  1000. this end, it is requested that the SEC provide me the following information
  1001. (information that would readily be available to Whistleblowers if this tip
  1002. was the subject of litigation or was conducted in a non-secretive settlement
  1003. proceeding).
  1004. 1. The regional office or regional offices responsible for investigating
  1005. the covered action. (In litigated cases this information is readily
  1006. available on the Complaint and within high profile settlements the SEC
  1007. announces a press release which attributes the regional center,
  1008. supervising staff, and investigation staff responsible for the action -
  1009. neither of these disclosures occurred putting me at a disadvantage).

  1882. An immediate backup image should be made of the USB hard drive, I explicitly

  1884. other matters and thus - by law - must be safeguarded by the government.
  1885. The hard drive was formatted and prepared using a Mac computer, however, it was
  1886. formatted to be cross-compatible with both Mac and Window computers. If there is
  1887. any trouble, I would recommend that after the drive be imaged attempts be made
  1888. to access the files via a Mac computer. (Depending on the versions, patches,
  1889. updates, and drives of certain windows Machines there may be some troubles
  1890. despite being formatted for cross-compatibility.)
  1891. Although I previously mentioned this, please take action to share all of the
  1892. physical documents with the appropriate staff. For example, documents relating
  1893. to fraudulent projects within New York should be copied and sent to New York Staff.
  1894. Furthermore, the information on the drive, organized by state, should be
  1895. distributed and made available to regional offices responsible for enforcement
  1896. in those states. For example, folders labeled as "California" should be shared
  1897. with the Los Angeles and San Francisco SEC offices in a ubiquitous and
  1898. non-esoteric manner.
  1899. I spent hundreds of hours organizing, formatting, and reviewing the information
  1900. within the drive and took extensive efforts to make much of the information text
  1901. searchable. (Emphasis added). The ability for SEC staff to search this
  1902. information digital can not be understated. To conserve resources and maintain
  1903. an effective enforcement program please have all ongoing EB-5 investigators
  1904. immediately query the entire database using key words relating to their ongoing
  1905. or future investigations.
  1906. For example, SEC staff working on the Jay Peak case should search the files for
  1907. keywords such as "Jay Peak" or "Vermont". Similarly, SEC staff working on the
  1908. Path America case can readily access hundreds of documents and evidence by
  1909. searching "Path America". This is true for other ongoing investigations such as:

  1911. 1. The Proton Therapy Fake EB-5 Cancer Center Project. (Hundreds of marketing

  1958. the SEC via a shipment with tracking number EA015163946CN.
  1959. I urgently request that you forward this information to the USCIS investigations
  1960. / fraud detection departments and immediately coordinate with the SEC in
  1961. obtaining a copy of the information submitted.
  1962. The information on the drive contains evidence of over $3 billion in fraud -
  1963. including but not limited to the following:

  1965. 1. Bad acting lawyers willfully submitting forged source of funds documents. In
  1966. one instance the regional center receives a $500,000 wire transfer from the
  1967. investor - then secretly returns $350,000 to the investor via chinese banks.
  1968. Because the project is already fully funded by traditional financing, the
  1969. end result is that $500,000 is sent to the US, $350,000 is secretly returned
  1970. to the investor via Chinese banks, and the individual conducting this scheme
  1971. pockets $150,000. Meaning, even though I-526 petitions are being
  1972. adjudicating - not a single dollar is actually going to job creation. This
  1973. scheme is aggressively marketed to less wealthy individuals who may not have
  1974. $500,000 readily available but can borrow money from family and friends and
  1975. then re-pay debts after receiving the secret return of $350,000.
  1976. 2. Countless instances of regional centers and projects willfully discussing
  1977. how to illegally sugarcoat their project marketing documents with materially
  1978. false statements or materially important facts that are being omitted.
  1979. 3. Instances of passport, birth certificate, and houkou forgery to allow
  1980. non-family members to be sponsored by an un-related EB-5 petitioner.
  1981. 4. Instances of where money is coming from questionable locations, such as an
  1982. individual who is paying for their immigration from bribes received while
  1983. working as a senior government official with an official salary of about
  1984. $2,000 per month.
  1985. 5. Significant evidence, documents, recording, and supporting details
  1986. concerning almost every active, public and non-public SEC investigation,
  1987. including but not limited to:
  1988. 1. Hundreds of documents relating to Jay Peak, including letters written by
  1989. Bill Stenger harassing Whistleblowers from raising alarm bells as early
  1990. as 2014.
  1991. 2. Documents pertaining to the illegal actions of Chicagoland Foreign
  1992. Investment Group which has has a ponzi scheme claiming that investors
  1993. only needed to provide $100,000 before filing an I-526 petition and
  1994. could make payments up to $500,000 in quarterly intervals which would
  1995. allow an acceptable response to an RFE. This tactic was simply a way to
  1996. get money in their pockets which they then embezzled.
  1997. 3. Marketing documents relating to Path America's illicit behavior of
  1998. paying for site visits with investor funds mean for job creation.
  1999. 4. Information and documents pertaining to illegal marketing statements and
  2000. actions by PhoenixMart and AZ Sourcing.
  2001. 5. Thousands of documents, bank details, and forged certification letters
  2002. by Charles Liu, the operator of the now disgraced Proton Therapy Cancer
  2003. Center.
  2004. 6. Hundreds of documents, videos, and recordings pertaining to questionable
  2005. involvement of Chinese government agents of state owned enterprises.
  2006. 7. Thousands of documents, including recorded conversations between the
  2007. owners and operators of the GEM Coin fraud, precisely detailing how they
  2008. individuals conducted the scam, sent money overseas, and were well aware
  2009. that they were scamming investors.

  2296. lost in my care - i know this is kinda a shitty situation, but many of
  2297. my records of SEC tips were lost when i jumped out of my apartment in
  2298. the middle of the night after numerous individuals tried to break in,
  2299. everything was encrypted but i lost a few archives that were not backed
  2300. up in too many places

  2303. and width of this by submitting foia requests to the SEC.
