- motions and supporting evidence. I am submitting this is haste after a recent
- physical confrontation that has put my continued ability to finalize this Claim
- For An Award at significant risk. I will attempt to send the document via fax as
- well but that may be prohibitively expensive, or require the sending of fax
- pages in partitioned increments.
- Please confirm:
- 1. The receipt of these documents.
- 2. The validity of the Form WP-APP.
- 3. The date to which these documents were received by the SEC.
- 4. Acknowledgement that my Claim For An Award and associated documents will
- start processing or be placed in a queue for processing.
- For quick reference, this claim pertains to at least the following two TCR
- Numbers, TCR1444760433067 (10/13/2015) and TCR1446566870080 (11/3/2015).
- However, because the SEC has admitted to the deletion and spoliation of records
- and given the fact that I have lost access to files as a result of selling
- devices to buy food, need to delete because of imminent discovery of my
- identity, and attacks on my computer devices - there are many more relevant
- files which will be found via discovery.
- I have chosen to submit this early; As a result of all of the time and effort
- spent on this Claim For An Award, I have a backlog of over 20 new frauds that
- need to be reported to the SEC and other law enforcement agencies. In the
- interest of protecting investors and following my morals it is necessary for me
- to dedicate my time to bringing those frauds to light as soon as possible and it
- is not in the interest of our financial markets for me to put my own interests
- above soon-to-be scammed investors.
- Please take care in processing this Claim For An Award, my situation is very
- fragile and a failure to afford due process could cause additional irreparable
- damage to me, the financial markets, and the victims of fraud. Everything I have
- done and reported to the financial regulators has been in an effort to protect
- investors and consumers and protect our financial markets from fraudsters. By
- efficiently adjudicating this Claim For An Award I will be able to continue my
- efforts to assist others and safeguard our financial markets.

- I am writing today, on behalf of many Whistleblowers, to clarify the OWB stance
- on how receiver based settlements or actions will be counted towards
- Whistleblower awards.
- As you know, the ongoing litigation by the SEC has placed Jay Peak and related
- companies into receivership, the receivership has then acted on behalf of the
- SEC and on behalf of the investors in entering into a number of settlements and
- recovering monies.
- I would encourage you office to consider receivership actions as actions of the
- SEC and allow Whistleblowers to claim an award for those actions. As you know,
- there are many Whistleblower's in the Jay Peak case and it would be highly
- encouraging to them and would be Whistleblowers if you office posted Notices Of
- Cover Actions this month for the recent $13 million dollar settlements initiated
- by the receivership on behalf of the SEC. This construction will help carry out
- the intent of Congress.

- more days to file for an award, it is imperative that problems be addresses
- immediately and that the OWB provide me with confirmation that these documents
- have been received on a specific date.
- I do not meet to be an annoyance, but given my delicate situation I have having
- even more stress and difficulty sleeping as I repeatedly mull over the potential
- consequences if your office does not process this Claim or somehow does not

- Given the recent physical attacks there is an elevated risk that I am unable to
- continue my Whistleblower submissions, thus I am writing this quick email to
- consolidate some of my pending Whistleblower tips because it is likely that I
- will be unable to write a full narrative on them:
- 1. *Golden 1 Center (Sacramento Kings Stadium and Business EB-5 Project sponsored by Golden Gate Global Regional Center)* 1. Falsely claims in marketing material that the Golden Gate Global Regional Center has not received a single I-526 denial, however, based off the disclose USCIS WAC Numbers on Baidu Cloud, at least two investors have received final I-526 denials in Golden Gate Global projects, including the Hunter's Point Shipyard projects. 2. In relation to the Golden 1 Center project, the project was completed on September 30, 2016 and the project had a formal ribbon cutting ceremony to mark the completion of the project. However, as of October 24, 2016 at least one EB-5 agent, GoodHopeVisa, continues to market this project to investors despite the fact that construction has been completed, meaning investors will not be eligible job creation. As is relevant to securities law the continuing marketing activities by Golden Gate Global violate the law by: 1. Falsely claiming EB-5 funds will be deployed during construction. 2. Falsely claiming EB-5 funds will be deployed only during Q4 of 2015, and Q1, and Q2 of 2016, when in reality if an investor subscribes today the EB-5 funds will not be deployed for roughly 20 months. These false representations give investors a false sense of security that their investments are going to the job creation phase of the project. 3. Falsely claiming the project is still an EB-5 eligible project when in reality the EB-5 funds being raised now and likely before are simply being used to re-finance a fully funded project and thus is not creating jobs but instead artificially preserving jobs, which as the USCIS set forth in the termination of the VictorVille Regional Center is not a valid method of economic impact. 3. As is common, a single will full violation of securities law lends to a significantly higher probability that other wrongdoing is occurring as well, in this case the following is relevant: 1. The use of aggressive marketing ignores facts and falsely claims that the Hunter's Point Shipyard projects are entirely sold out and all of the homes have been pre-purchased, which is not true. 2. Confidential investor information, including subscription agreements, passport scans, escrow documents, bank accounts details, and entire I-526 petitions, commission referral agreements, etc were previously available on baidu.pan directories such as: http://pan.baidu.com/share/home?uk=1464934011#category/type=0 3. There are highly regarded opinions by the majority of learned EB-5 lawyers and industry players that the economic impact report used by Golden 1 Center are entirely made up and do not represent reality. Given the letters from the Sacramento City concerning a $325 million bond raise and the capital stack provided to investors it is suggested that EB-5 funds are simply being used to pay back bond holders and not actually create jobs. The probability of this significantly increases when considering the fact that this project was fully funded before the contemplation of EB-5 funding, yet investors are provided with known to be false capital stack pie charts showing only $223 million from the Sacramento City when in reality over $325 million was provided via bond funds. 4. Etc. 2. *The Home Express Inn Investment Project located at 644-646 39th Street *is/was a premeditated scam run by Luo Jie Chen, Xi Zhao, and Han Dong Zhang. The scam, which appears to have stolen over $2,000,000 was conducted with a half-assed business plan, inadequate job creation reports, and economically absurd projections. After raising millions of dollars Luo Jie Chen, Xi Zhao, and Han Dong Zhang attempted to sell the project and mis-spent / co-mingled investor funds for personal reasons and or non-related development activities. The $2,000,000 was never returned to investors but the project was declared a failure. Attached are the wholly inadequate investment proposal documents. See brooklyn hotel - rfs copy 2.pdf 3. *All projects associated with the New York City Metro Regional Center LLC*
- are fake and have embezzled investor funds. To investigate this in the most
- efficient manner, please review the 8th Avenue project, which is nothing but
- ridiculousness. This project claims to invest $350,000,000 in funding to
- build a small city within a run-down area of New York where it is not
- financially possible to do so. See NY 8th Ave presentation 2015-02-04 -WSLD
- copy for proof. (More generally, every single project that has investors
- referred to it by WestLead Capital and or Raymond Ku is a fake EB-5 project
- that embezzles investor funds.)

- Center has posted an entire website database here:

- investor username, investor emails, etc, as well as ample information
- regarding the illicit marketing activities of the Home Paradise Regional
- Center. Put bluntly, the Home Paradise Regional Center is almost an exact
- copy of the fraud conducted in Path America for example:
- 1. The project is already fully funded by a Chinese development company,
- particularly, Oceanwide Holdings LTD.
- 2. The project is co-mingled investor funds.
- 3. The project conducts aggressive marketing and cross selling of EB-5
- products to US Persons who may have purchased a house though
- USEB5.com.cn affiliates.
- 4. The individuals behind the Home Paradise Regional Center also act as
- unlicensed brokers of US homes at this website:

- 5. All the conflicts of interest, such as payments to lawyers as unlicensed
- broker-dealers are not disclosed to investors.
- 6. The principal of Home Paradise Regional Center, Edward Chen, CEO Of
- First Financial Investment Group, LLC has scammed millions from
- investors promising short term flipping of real estate investments with
- guaranteed returns. See FFIG docs.

- uncertain, given the sensitivity of these documents and potential conflicts of
- interest, that it would be appropriate to send this information to the generic

- prefer encryption, I do not want general access to these documents to
- inappropriate sway the Claims Review Staff and Whistleblower Office actions.
- Within *Wharton 1.pdf*, Ms. Nikkia Wharton incorrectly instructs me to send my
- Whistleblower tips in multiple parts. This was entirely correct guidance and Ms.
- Wharton refused to respond to my numerous subsequent inquiries requesting
- confirmation that my voluminous submissions were being received by tip review
- staff. As a result of Ms. Wharton's incorrect instructions and failures to
- respond to Whistleblower inquiries over 11 months of Whistleblower tips and
- thousands of hours of my efforts had been wasted. This ultimately manifested in
- Mr. Vincente Martinez informing me in July 2016 that all of my multi-part
- submissions can not be reviewed and that SEC staff were ignoring many of my tips
- because they believed all tips to be un-reviewable. Accountability is necessary
- to prevent these enormous damages from occurring again and if Ms. Wharton was
- tasked with reviewing or providing input for my Claim she may ignore significant
- information as it would shed light on her wrongdoing and the damages caused.
- Similar to the above, within *McCreery 1.pdf*, Mr. Jack McCreery incorrectly
- states that using the SEC's Whistleblower Portal will allow the SEC to review my
- multi-part and voluminous submissions. Mr. McCreery also refused to reply to my
- numerous inquiries asking for confirmation that 10MB multi-part submissions are
- being reviewed by SEC staff.
- Additionally, within *Wharton 2**.pdf*, there are references to a phone call
- that I had with Ms. Wharton and Mr. McCreery. Within this phone call, among
- other things, Ms. Wharton instructed me to provide "significantly more
- elaboration and legal analysis". A practice I adopted from late 2015 to July
- 2016, when once again it was proven that Ms. Wharton's statements were incorrect
- and mis-leading. Indeed, in a July 2016 call with Mr. Martinez, I was told to
- provide 5-7 paragraphs of narrative that can be reviewed within 15 minutes -
- which is almost the exact opposite of what Ms. Wharton had instructed me to provide.
- Once again, the involvement of Ms. Wharton and Mr. McCreery in these situations
- will cause inappropriate bias as they will be motivated to hide their mistakes
- and thus disregard substantial and critical evidence that is relevant to my claim.

- deletion and spoliation of records.

- emails amount between Ms. Spillane and Mr. Miller discussing the deletion of
- certain Whistleblower tips and associated attachments that I have provided.
- These emails lend to the fact that SEC staff coordinated to delete or ignore

- prior filings, on multiple occasions I was forced to sell computer
- electronics, was subject to electronic hacks, and suffered corruption as a

- about important evidence that the DHS would surely be interested in.
- Specifically, in package (tracking number EA015163946CN) there included a 1TB
- hard drive containing evidence of rampant foreign direct investment fraud, with
- a specific emphasis on ongoing EB-5 fraud cases, including more instances where
- individuals submit known to be forged I-526 source of funds information.
- I ask that you please ensure that the DHS receives a copy of the information
- submitted on this hard drive. While I have submitted it to the SEC's
- Whistleblower Office with instructions to share it with law enforcement
- officials I am uncertain this will occur.

- I am still in the process of preparing some additional documents I hope will be
- of use for the SEC and other law enforcement agencies. These documents should
- clarify matters related to my claim, my submissions of evidence, and ongoing frauds.
- Unfortunately, as a result of some highly decisive, politically related
- Whistleblowing (emphasis added) I have been under even more pressure and was
- previously under substantial duress, having a moment of freedom I wish to
- present you with the following:
- First, I apologize if the packaging of the Whistleblower submission within
- EA015163946CN caused any confusion or insult. There is a need to camouflage such
- sensitive disclosures to not only protect my identity but also evade postal
- censorship in multiple countries. In the future I would hope the SEC would
- provide a PGP key or similar public key in which I can encrypt the information
- with - defending against any possibility that information is intercepted via
- shipment.
- An immediate backup image should be made of the USB hard drive, I explicitly
- informing the SEC that the information on this drive is a matter of evidence for
- other matters and thus - by law - must be safeguarded by the government.
- The hard drive was formatted and prepared using a Mac computer, however, it was
- formatted to be cross-compatible with both Mac and Window computers. If there is
- any trouble, I would recommend that after the drive be imaged attempts be made
- to access the files via a Mac computer. (Depending on the versions, patches,
- updates, and drives of certain windows Machines there may be some troubles
- despite being formatted for cross-compatibility.)
- Although I previously mentioned this, please take action to share all of the
- physical documents with the appropriate staff. For example, documents relating
- to fraudulent projects within New York should be copied and sent to New York Staff.
- Furthermore, the information on the drive, organized by state, should be
- distributed and made available to regional offices responsible for enforcement
- in those states. For example, folders labeled as "California" should be shared
- with the Los Angeles and San Francisco SEC offices in a ubiquitous and
- non-esoteric manner.

- This matter deserves to be expedited because it pertains to ongoing fraud within
- a number of Regional Centers.
- At the request of law enforcement, I submitted a 1TB hard drive detailing frauds
- in over 100 separate regional center projects. This information was submitted to
- the SEC via a shipment with tracking number EA015163946CN.
- I urgently request that you forward this information to the USCIS investigations
- / fraud detection departments and immediately coordinate with the SEC in
- obtaining a copy of the information submitted.
- The information on the drive contains evidence of over $3 billion in fraud -
- including but not limited to the following:
- 1. Bad acting lawyers willfully submitting forged source of funds documents. In
- one instance the regional center receives a $500,000 wire transfer from the
- investor - then secretly returns $350,000 to the investor via chinese banks.
- Because the project is already fully funded by traditional financing, the
- end result is that $500,000 is sent to the US, $350,000 is secretly returned
- to the investor via Chinese banks, and the individual conducting this scheme
- pockets $150,000. Meaning, even though I-526 petitions are being
- adjudicating - not a single dollar is actually going to job creation. This
- scheme is aggressively marketed to less wealthy individuals who may not have
- $500,000 readily available but can borrow money from family and friends and
- then re-pay debts after receiving the secret return of $350,000.
- 2. Countless instances of regional centers and projects willfully discussing
- how to illegally sugarcoat their project marketing documents with materially
- false statements or materially important facts that are being omitted.
- 3. Instances of passport, birth certificate, and houkou forgery to allow
- non-family members to be sponsored by an un-related EB-5 petitioner.
- 4. Instances of where money is coming from questionable locations, such as an
- individual who is paying for their immigration from bribes received while
- working as a senior government official with an official salary of about
- $2,000 per month.
- 5. Significant evidence, documents, recording, and supporting details
- concerning almost every active, public and non-public SEC investigation,
- including but not limited to:
- 1. Hundreds of documents relating to Jay Peak, including letters written by
- Bill Stenger harassing Whistleblowers from raising alarm bells as early
- as 2014.
- 2. Documents pertaining to the illegal actions of Chicagoland Foreign
- Investment Group which has has a ponzi scheme claiming that investors
- only needed to provide $100,000 before filing an I-526 petition and
- could make payments up to $500,000 in quarterly intervals which would
- allow an acceptable response to an RFE. This tactic was simply a way to
- get money in their pockets which they then embezzled.
- 3. Marketing documents relating to Path America's illicit behavior of
- paying for site visits with investor funds mean for job creation.
- 4. Information and documents pertaining to illegal marketing statements and
- actions by PhoenixMart and AZ Sourcing.
- 5. Thousands of documents, bank details, and forged certification letters
- by Charles Liu, the operator of the now disgraced Proton Therapy Cancer
- Center.
- 6. Hundreds of documents, videos, and recordings pertaining to questionable
- involvement of Chinese government agents of state owned enterprises.
- 7. Thousands of documents, including recorded conversations between the
- owners and operators of the GEM Coin fraud, precisely detailing how they
- individuals conducted the scam, sent money overseas, and were well aware
- that they were scamming investors.
- 8. Many more documents, all organized by state, regional center, law firm,
- group, or fraudulent phenomenon within this industry. The information
- also show violations of tax laws, common law, international regulations,
- etc.
- I urge you to contact the SEC's Whistleblower office and request a image of the

- 4.) Lewis Laskin and other members of Oriental Dolphins claim to be
- supervised by FINRA member NMS Capital, however, they do not involved NMS
- Capital and routinely violate FINRA rules and well as SEC rules -
- effectively acting as an unlicensed broker-dealer of securities.
- 5.) JJW Consultancy and Oriental Dolphins have not disclosed to you the
- numerous conflicts of interest present, nor have they abided by FINRA Rule
- 2040, requiring the acknowledgement of commissions paid to others.
- 6.) The projects marketed by JJW Consultancy and Oriental Dolphins are
- behind schedule and delayed by years. The construction and completion dates
- used in marketing materials have been known to be false for many years.
- 7.) The marketing materials are full of super-coated and untrue statements
- in an attempt to make you believe that the project and its managers are
- better than they actually are.
- Notwithstanding the above, the existence of a very detailed lawsuit against
- JJW Consultancy should give you reason to worry. And you may want to
- consider taking the following actions:
- 1.) Hiring a third party lawyer to review the situation.
- 2.) Contacting JJW Consultancy and Lewis Laskin to ask about the progress of
- your investment and confirm how your funds have been used or will be used.
- 3.) Ask that Oriental Dolphins and Lewis Laskin provide you with certified
- financial statements prepared by a third party accountant.
- 4.) Consider asking for a refund and moving your money into another more
- reputable project.
- 5.) Contact the SEC and FINRA to file a complaint to ensure that money is
- not stolen.
- I was a victim of fraud myself and write to you in the hopes of protecting

- you need to dig because many of the items submitted to the SEC have been
- lost in my care - i know this is kinda a shitty situation, but many of
- my records of SEC tips were lost when i jumped out of my apartment in
- the middle of the night after numerous individuals tried to break in,
- everything was encrypted but i lost a few archives that were not backed
- up in too many places
- the sec has these records and it is possible to recover the entire scope
- and width of this by submitting foia requests to the SEC.
