  10. <p>1.1 Welcome to www.sykescottages.co.uk (the
  11. "<strong>Site</strong>") which is owned and operated by
  12. Sykes Cottages Limited ("<strong>we</strong>",
  13. "<strong>our</strong>" or
  14. "<strong>us</strong>", as applicable). Please see further

  17. <p>1.2 These Booking Conditions apply to the reservations you make
  18. with us for holiday properties featured on our Site
  19. ("<strong>Bookings</strong>"), whether by telephone or
  20. via the Site, and the accommodation rental services you receive
  21. from owners of those properties under your contract with them.
  22. Please note that additional terms and conditions apply to the use
  23. of and access to the Site by you and other visitors. Please see our
  24. <span class="c1">Terms of Use</span> for details of those
  25. terms.</p>
  26. <p>1.3 Please read these Booking Conditions and our <span class="c1">Terms of Use</span> together with their related policies
  27. carefully before you access, use, or make a Booking, as all these
  28. terms will apply when doing so. We recommend that you print or save
  29. a copy of all these terms and conditions for future reference.
  30. <strong>By making a Booking with us, you confirm that you accept
  31. all these terms and conditions and that you agree to comply with
  32. them.</strong></p>
  33. <p>1.4 We provide this Site so that you and other holidaymakers can
  34. reserve accommodation in holiday cottages, log cabins and other
  35. properties featured on our Site
  36. ("<strong>Properties</strong>"). We provide a service via
  37. this Site that allows you to make Bookings at each Property
  38. ("<strong>Booking Service</strong>"), however the
  39. accommodation that you book is a service provided by the relevant
  40. owner of each Property ("<strong>Owner</strong>"). We act
  41. as booking agent for Owners and consequently, the contract for the
  42. provision of the accommodation rental and related services
  43. ("<strong>Rental Services</strong>") is solely between
  44. you and the relevant Owner, not us. Please see further the
  45. <span class="c1">Our Role</span> section below.</p>
  46. <p>1.5 To make these Booking Conditions easier to read, we use a
  47. number of definitions. We refer to: "<strong>Rental
  48. Contract</strong>" as the legally binding agreement between
  49. you and the Owner for the Rental Services you receive in connection
  50. with a Booking; "<strong>Rental Charges</strong>" as the
  51. fees payable by you under the Rental Contract that we collect from
  52. you on behalf of the applicable Owner;
  53. "<strong>Deposit</strong>" as the initial instalment of
  54. the Rental Charges quoted during the Booking process and payable by
  55. you when making a Booking; "<strong>Rental
  56. Balance</strong>" as the balance of the Rental Charges payable
  57. by you after payment of the Deposit; "<strong>Holiday
  58. Period"</strong> as the dates for which you reserve a Property
  59. <strong>i</strong>n your Booking; "<strong>Booking
  60. Details</strong>" as details specific to your Booking
  61. including the Property, Holiday Period and any restrictions
  62. notified to you

  64. during the Booking process; and "<strong>Guests</strong>"
  65. as holidaymakers other than you that are booked to stay at the
  66. Property during the Holiday Period under your Booking.

  69. 1.6 We have a number of policies referred to in these Booking
  70. Conditions, including our <span class="c1">Privacy Policy</span>
  71. and <span class="c1">Cookie Policy</span>. They all form part of
  72. our agreement with you so please take the time to read them.</p>

  74. these Booking Conditions to ensure you understand the terms and

  87. <h2>2 Your privacy and our use of cookies
  88. <br></h2>
  89. <p>2.1 We take your privacy very seriously. Please read our
  90. <span class="c1">Privacy Policy</span> to see how we use your
  91. personal information, including the information you submit about
  92. yourself when making a Booking. By submitting your personal
  93. information to us, you agree to our use of that information in the
  94. ways described in our <span class="c1">Privacy Policy</span>,
  95. including sharing your information with Owners for the purposes of
  96. their provision of the Rental Services.

  98. <br>
  99. 2.2 Like many online services we use a feature called a
  100. 'cookie', which is a small data file that is sent to your
  101. browser from a web server and stored on your device's hard
  102. drive. References in these Terms to 'cookies' also include
  103. other means of automatically accessing or storing information on
  104. your device. By agreeing to these Booking Conditions, you are
  105. providing your consent for us to use cookies in the ways described
  106. in our <span class="c1">Cookie Policy</span>, however, you may
  107. delete any of these cookies at any time if you wish. Please see our
  108. <span class="c1">Cookie Policy</span> for detailed information on
  109. the types of cookies we use on the Site, the purposes for which we
  110. use each cookie, how you can disable and enable the use of certain
  111. cookies and the consequences of doing so.

  114. 2.3 We may record telephone calls between us for monitoring and
  115. training purposes. In the event of a dispute between us, we reserve
  116. the right to review any recorded calls between us.

  118. <h2>3 Our role
  119. <br></h2>
  120. <p>3.1 We act as agent for the Owner by taking and arranging
  121. Bookings for the Properties that appear on this Site. We do not own
  122. any of the Properties but we reserve the right to refuse any
  123. Bookings in accordance with these Booking Conditions.
  124. <br>
  125. <br>
  126. 3.2 Once we have accepted a Booking in the way described in the
  127. <span class="c1">Making a Booking</span> section below, a legally
  128. binding Rental Contract will be formed between you and the Owner
  129. under which the Owner will make the Property available to you and
  130. provide the Rental Services for the Holiday Period. Just to be
  131. clear, we will not be a party to the Rental Contract.
  132. <br>
  133. <br>
  134. 3.3 The following will all form part of the Rental Contract between
  135. you and the Owner:
  136. <br></p>

  138. <p>3.3.1 your Booking Details;
  139. <br></p>
  140. </blockquote>

  142. <p>3.3.2 these Booking Conditions; and
  143. <br></p>
  144. </blockquote>

  146. <p>3.3.3 any other special or additional conditions that we draw to
  147. your attention during the booking process before we accept your
  148. Booking.

  151. 3.4 As our obligations to you are limited to those in connection
  152. with the Booking Service, we accept no liability for any defects or
  153. unavailability of the Property or any other problems with your
  154. holiday. Your rights under these Booking Conditions and the Rental
  155. Contract are directly against the Owner. Please see further the
  156. <span class="c1">Our liability</span> section.
  157. <h2>4 Your use of our Booking Service
  158. <br></h2>
  159. <p>4.1 Our Booking Service is available to you for your personal,
  160. non-commercial use only. You may not offer for resale any Booking
  161. Services or Rental Services for any Properties that appear on our
  162. Site without our express written permission.
  163. <br></p>
  164. <h2>5 Property and Rental Services Descriptions
  165. <br></h2>
  166. <p>5.1 We make every effort to ensure that the descriptions
  167. (including Rental Charges and
  168. <br>
  169. availability) relating to the Properties and Rental Services on our
  170. Site are accurate and
  171. <br>
  172. complete. These descriptions include details of the Property and
  173. Rental Services including photos, the availability period of the
  174. Property for rental, the Rental Charges and any additional charges,
  175. the facilities available at the Property, maximum occupancy
  176. numbers, any accreditations, awards or descriptions of quality
  177. relating to the Property including star ratings. If we discover a
  178. mistake or error relating to this information we will correct this
  179. promptly on our Site and will contact you if that information
  180. relates to a Booking that you have already made using our Site.

  182. <br>
  183. 5.2 The Property and Rental Services descriptions do not constitute
  184. advice or recommendation given by us. We do not independently
  185. verify accreditations, awards or star or other quality ratings and
  186. such ratings are only indicative of what level of quality you can
  187. expect from a particular Property. We will not be liable for
  188. inaccuracies or errors in this information or the accommodation
  189. information as this information is supplied to us by Owners.
  190. <br>
  191. <br>
  192. 5.3 Rental Charges shown in the search listings on our Site are per
  193. Property (and not per person). It is your responsibility to check
  194. the total price before completing the Booking process.
  195. <br>
  196. <br>
  197. 5.4 We do not accept responsibility for any changes or closures to
  198. amenities or attractions mentioned in the Property or Rental
  199. Services descriptions on our Site.
  200. <br></p>
  201. <h2>6 Making a Booking
  202. <br></h2>
  203. <p><em>Eligibility</em>
  204. <br>
  205. <br>
  206. 6.1 To be eligible to make a Booking and enter into a Rental
  207. Contract you must:
  208. <br></p>
  209. <blockquote>
  210. <p>6.1.1 be 18 years of age or over and have the legal capacity to
  211. enter into legally binding agreements;
  212. <br></p>
  213. </blockquote>
  214. <blockquote>
  215. <p>6.1.2 register with us on the Site (in advance or when Booking)
  216. or by telephone by providing your real name, phone number, email
  217. address and other requested information; and
  218. <br></p>
  219. </blockquote>
  220. <blockquote>6.1.3 possess a valid credit or debit card issued by a
  221. bank acceptable to us.
  222. <br></blockquote>
  223. <p><em>Booking methods</em>
  224. <br>
  225. <br>
  226. 6.2 You may make a Booking directly using the Site or by contacting
  227. us by telephone or by email using the details in the <span class="c1">Contact us</span> section.
  228. <br>
  229. <br>
  230. 6.3 If you provide your Booking details to us by email, we will
  231. send to you a link on the Site so that you can make a Booking
  232. online.
  233. <br>
  234. <br>
  235. <em>The contract between you and us and between you and Owners</em>
  236. <br>
  237. <br>
  238. 6.4 By making a Booking with us you are making an offer to:
  239. <br></p>
  240. <blockquote>
  241. <p>6.4.1 receive our Booking Service; and
  242. <br></p>
  243. </blockquote>
  244. <blockquote>6.4.2 enter into a Rental Contract with the applicable
  245. Owner.
  246. <br></blockquote>
  247. <p>6.5 The following steps have to take place before a contract is
  248. made between us for the provision of the Booking Service and
  249. between you and the applicable Owner for the provision of Rental
  250. Services under a Rental Contract:</p>
  251. <blockquote>6.5.1 you submit your Booking form to us on the Site by
  252. submitting your Booking Details and your payment details for
  253. processing by pressing 'Pay Now'. Before submitting your
  254. Booking on the Site, the Booking process will give you the
  255. opportunity to review the Booking, these Booking Conditions and the
  256. Booking Details for your chosen Property and, if you require, make
  257. amendments to your Booking.</blockquote>
  258. <blockquote>For telephone bookings we will read you details of your
  259. Booking and Booking Conditions for your confirmation. You may make
  260. any required amendments at this point. We will then request payment
  261. details and process these.;</blockquote>
  262. <blockquote>6.5.2 you will receive an on-screen acknowledgement of
  263. your Booking and a receipt for your payment by email at the address
  264. provided</blockquote>
  265. <blockquote>For telephone bookings we will verbally confirm your
  266. booking reference and will send you a receipt for your payment by
  267. email at the address provided;</blockquote>
  268. <blockquote>6.5.3 we check the availability of the Property
  269. relating to your Booking and, provided we have processed your
  270. payment, we will send you an email confirming your booking together
  271. with a copy of these Booking Conditions and other details relating
  272. to your Booking ("<strong>Booking
  273. Confirmation</strong>");</blockquote>
  274. <blockquote>6.5.4 we accept:</blockquote>
  275. <blockquote>
  276. <blockquote>a) your offer to receive our Booking Services;
  277. and</blockquote>
  278. <blockquote>b) acting on the applicable Owner's behalf as its
  279. agent, your offer to enter into the Rental Contract,
  280. <br></blockquote>
  281. </blockquote>
  282. <blockquote>in each case, at the time we take payment for the
  283. Booking Fee and Deposit. Accordingly, nothing that we say or do
  284. will amount to any acceptance of your offer until we actually take
  285. payment for the Booking Fee and Deposit, at which point a contract
  286. will be made between us for the Booking Service and between you and
  287. the Owner for the provision of Rental Services under the Rental
  288. Contract.</blockquote>
  289. <p><br>
  290. 6.6 You will not be able to make a Booking for a Holiday Period
  291. that falls too far in the future. However, for certain Properties,
  292. you may have the opportunity to make a provisional Booking via the
  293. Site for your desired Holiday Period. The fee for such Booking will
  294. be quoted during the Booking process. If you make a provisional
  295. Booking, we will notify you if and when the Property becomes
  296. available for Bookings for your desired Holiday Period. You may
  297. cancel a provisional Booking at any time by contacting us using our
  298. details in the <span class="c1 c1">Contact Us</span> section and we
  299. will refund you the fee you have paid for the provisional Booking
  300. in full within 14 days of receiving your request. If you confirm
  301. your provisional Booking by making a Booking then we will deduct
  302. the fee for the provisional Booking from the applicable Booking
  303. Fee. If the Owner withdraws the Property from the Site or you do
  304. not make a Booking when we give you the opportunity to do so, the
  305. provisional Booking will be automatically cancelled and we will
  306. refund the fee you have paid for the provisional Booking in full
  307. within 14 days of cancellation.
  308. <br>
  309. All refunds will be made using your original payment method.
  310. <br></p>
  311. <h2>7 Fees, charges and payment
  312. <br></h2>
  313. <p>7.1 The fees and charges will be as quoted on this Site from
  314. time to time and, unless otherwise stated, are quoted in pounds
  315. sterling. We use our best efforts to ensure that these are correct
  316. at the time when the relevant information was entered onto our
  317. systems. However, it is always possible that, despite our best
  318. efforts, some of the fees and charges on the Site may be
  319. incorrectly priced. We will normally check these prices as part of
  320. our confirmation procedures so that:</p>
  321. <blockquote>
  322. <p>7.1.1 where the actual Rental Charges or other fees are less
  323. than those quoted on the Site at the time you made your Booking, we
  324. will charge the lower amount when confirming the Booking to you;
  325. and</p>
  326. <p>7.1.2 where the actual Rental Charges or other fees are higher
  327. than those quoted on the Site at the time you made your Booking, we
  328. will contact you as soon as possible to inform you of this error
  329. and we will give you the option of continuing to book the Property
  330. at the correct (higher) price or cancelling your Booking. We will
  331. not process your Booking until we have your instructions. If we are
  332. unable to contact you using the contact details you provided during
  333. the Booking process, we will treat the Booking as cancelled and
  334. notify you in writing.
  335. <br>
  336. <br></p>
  337. </blockquote>
  338. <p>7.2 The fees and charges may change from time to time, but
  339. changes will not affect any Booking which we have confirmed with a
  340. Booking Confirmation.</p>
  341. <p>7.3 All Booking Fees, Rental Charges and all other fees and
  342. charges quoted on this Site include VAT, where applicable.
  343. <br>
  344. <br>
  345. 7.4 Before submitting your Booking online, you will be presented
  346. with details of the total Rental Charges payable for your Booking
  347. together with details of the following amounts payable at the time
  348. of your Booking:</p>
  349. <blockquote>
  350. <p>7.4.1 the Booking Fee (which is <strong>non-refundable</strong>
  351. once your Booking is confirmed);</p>
  352. <p>7.4.2 the Deposit and, if the date the Rental Balance would
  353. normally fall due for that Booking has already passed, the Rental
  354. Balance too; and</p>
  355. <p>7.4.3 any additional fees and charges quoted during the Booking
  356. process when you make your Booking (for example, card handling
  357. fees, heating supplements, pet charges and linen charges).
  358. <br>
  359. <br></p>
  360. </blockquote>
  361. <p>7.5 If you are paying a Deposit rather than the entire Rental
  362. Charges when making your Booking, you will also be presented with
  363. the date by which you will need to make payment to us for the
  364. Rental Balance. Please note, we may (but are not obliged to)
  365. contact you to remind you of the due date for payment of the Rental
  366. Balance.</p>
  367. <p>7.6 We currently accept various forms of payment including via
  368. credit and debit card. Please refer to our <span class="c1">Payment
  369. Methods</span> page for details of the payment cards and methods
  370. that we currently accept.
  371. <br>
  372. <br>
  373. 7.7 We take the payments due at the time of Booking from your
  374. chosen payment method once you have entered your payment details
  375. and have clicked the 'Confirm Card Details' button, subject
  376. to payment authorisation.
  377. <br>
  378. <br>
  379. 7.8 If the Rental Balance or any other additional payments are due
  380. after you make your Booking, then:</p>
  381. <blockquote>
  382. <p>7.8.1 if you authorised us to take payment for these amounts
  383. when you made your Booking, we will automatically take payment from
  384. you using your original payment method. If there has been a change
  385. to the Rental Charges due to changes in the exchange rates and
  386. additional amounts are payable, we will contact you before taking
  387. payment. Please see further paragraph 8.1 below; or</p>
  388. <p>7.8.2 if you did not authorise us to take payment for these
  389. amounts when you made your Booking, you will need to make these
  390. payments either by using the payment feature within your account on
  391. the Site or by contacting us by telephone using the number in the
  392. <span class="c1">Contact us</span> section below.</p>
  393. </blockquote>
  394. <h2>8 Payment currencies, interest and credit card surcharges
  395. <br></h2>
  396. <p>8.1 During the booking process you may be presented with an
  397. option to pay for your Booking in one or more currencies. The
  398. payment currencies we accept for a particular Booking will be
  399. notified to you during the Booking process. The exchange rate for
  400. all payments will be based on exchange rates set by our internal
  401. systems which may increase and decrease based on changes in the
  402. market. If on the date your Rental Balance is due, changes to these
  403. exchange rates result in an increase of 5% or more to the Rental
  404. Charges we quoted at the time you made your Booking, then we may
  405. increase the Rental Balance to include this additional amount. If
  406. you do not wish to pay this amount, you may end your Rental
  407. Contract giving notice within 14 days of the date we notify you of
  408. the increase.
  409. <br>
  410. <br>
  411. 8.2 If you do not make any payment to us by the due date we and/or
  412. Owners may charge interest to you on the overdue amount at the rate
  413. of four percent (4%) a year above the base lending rate of the Bank
  414. of England from time to time. This interest shall accrue on a daily
  415. basis from the due date until the date of actual payment of the
  416. overdue amount, whether before or after judgment. You must pay us
  417. interest together with any overdue amount.</p>
  418. <p>8.3 We incur fees from credit card companies when you pay by
  419. credit card and will pass these on. Such credit card surcharges
  420. will be advised at the time of booking. We also reserve the right
  421. to charge you any banking fees we incur for handling dishonoured
  422. cheques, bank transfers or any other payments, which you must
  423. reimburse to us within seven (7) days of our written request.
  424. <br>
  425. <br>
  426. 8.4 Please note some Owners may charge a 'good housekeeping
  427. bond', which will be included alongside the charges quoted to
  428. you during the Booking process. The Owner will communicate directly
  429. with you to collect and (if appropriate) return this bond. We have
  430. no control over the payment or return of such bonds by the Owner.
  431. The Owner must, within 7 days of the end of the relevant Holiday
  432. Period return all or part of the bond to you and, if retaining any
  433. part of the bond, notify you in writing of the reasons for doing
  434. so.</p>
  435. <h2>9 Gift vouchers
  436. <br></h2>
  437. <p>9.1 You may order gift vouchers from us by completing the
  438. <span class="c1">Gift Voucher Purchase Form</span> and posting the
  439. form to us at the address set out in our <span class="c1">Gift
  440. Voucher</span> page. You may choose to receive your gift vouchers
  441. by email or by post and we will send the vouchers using the method
  442. and address that you specify in the form within 30 days of the date
  443. we receive your form. If you have not received your gift voucher or
  444. code within the applicable period, please contact us using the
  445. details set out in the <span class="c1">Contact us</span> section.
  446. <br>
  447. <br>
  448. 9.2 Gift vouchers are available in denominations of £25 and
  449. can be used to pay for Bookings in part or in full. Where the cost
  450. of a Booking is less than the value of the gift voucher, no cash
  451. refunds will be given.</p>
  452. <p>9.3 A gift voucher can be redeemed online during the Booking
  453. process by entering the unique code which appears on your gift
  454. voucher.</p>
  455. <p>9.4 Gift vouchers are valid for a period of two (2) years from
  456. the date of purchase and can be used for any Booking with a Holiday
  457. Period that starts before the voucher's validity period
  458. expires. Any remaining balance on a gift voucher may no longer be
  459. used after expiry of its validity period.
  460. <br>
  461. <br>
  462. 9.5 If a Booking is purchased with a gift voucher which is
  463. subsequently cancelled, any refunded amount will be credited to the
  464. gift voucher.
  465. <br>
  466. <br>
  467. 9.6 Gift vouchers cannot be exchanged for cash, replaced if lost or
  468. damaged and are non-refundable. Without our express written
  469. permission, we do not permit you or any third party to sell or
  470. trade our gift vouchers.
  471. <br></p>
  472. <h2>10 Your right to cancel or transfer a Booking
  473. <br></h2>
  474. <p>10.1 Please check all the details in your Booking Confirmation
  475. promptly after receiving the confirmation and notify as soon as
  476. possible if you think we have made any mistakes or errors with your
  477. Booking.</p>
  478. <p>10.2 Please contact us directly using the contact details in the
  479. <span class="c1">Contact Us</span> section if you would like to
  480. amend your Booking. If an Owner agrees to amend the Booking,
  481. additional charges including additional Rental Charges and/or an
  482. administration fee may also be payable to cover our costs of making
  483. the amendment. This does not affect your legal rights.
  484. <br>
  485. <br>
  486. 10.3 After you receive your Booking Confirmation:</p>
  487. <blockquote>
  488. <p>10.3.1 you will not be entitled to cancel the Booking Service
  489. for a particular Booking and obtain a refund as we will already
  490. have completed the provision of the Booking Service for that
  491. Booking; and
  492. <br>
  493. 10.3.2 you will not have a legal right to cancel the Rental
  494. Contract as the Rental Services provided under it are accommodation
  495. and leisure services for which the contract provides a specific
  496. period of performance. You may, however, end the Rental Contract in
  497. accordance with the section <span class="c1">Your right to end a
  498. Rental Contrac</span>t.
  499. <br></p>
  500. </blockquote>
  501. <p>10.4 You may not transfer your Rental Contract to another
  502. person. If you do not stay at the Property during the Holiday
  503. Period but your Guests do, you will still be legally responsible
  504. for all your obligations under the Rental Contract and these
  505. Booking Conditions and your Guests' compliance with them.
  506. Please see further paragraph 13.4.</p>
  507. <h2>11 Cancellations of your Booking by us and Owners
  508. <br></h2>
  509. <p>11.1 We may cancel your Booking on an Owner's behalf if:</p>
  510. <blockquote>
  511. <p>11.1.1 we become aware of any health and safety or
  512. quality-related issue with the applicable Rental Services or
  513. Property or its immediate surroundings (for example contamination
  514. to the Property's water supply);</p>
  515. <p>11.1.2 our agency agreement with the relevant Owner terminates
  516. due to a breach by the Owner.</p>
  517. </blockquote>
  518. <p>11.2 An Owner may cancel your Booking due to circumstances or
  519. events outside their reasonable control. Please see further
  520. paragraph 25.10.</p>
  521. <p>11.3 If we or an Owner cancels a Booking in accordance with this
  522. paragraph 11, we may (but are not obliged to):</p>
  523. <blockquote>
  524. <p>11.3.1 arrange alternative accommodation for you and your Guests
  525. of an equivalent type and standard in a similar location. We will
  526. not be liable for any costs associated with arranging alternative
  527. accommodation and such alternative may be subject to the payment of
  528. additional charges by you if the Rental Charges for the alternative
  529. are higher than those under the cancelled Booking; and/or</p>
  530. <p>11.3.2 obtain a refund from the relevant Owner of any amounts
  531. paid by you to that Owner in relation to the cancelled Booking.
  532. <br></p>
  533. </blockquote>
  534. <h2>12 Booking restrictions
  535. <br></h2>
  536. <p>12.1 The maximum Holiday Period for any Booking is generally 28
  537. consecutive days, subject to availability. However, certain
  538. Properties may have a shorter maximum Holiday Period.</p>
  539. <p>12.2 If a Property requires a minimum Holiday Period or has a
  540. maximum Holiday Period shorter than 28 days, this will be clearly
  541. stated on the relevant Property description page on our Site.</p>
  542. <h2>13 Your responsibilities
  543. <br></h2>
  544. <p>13.1 You must make sure that all the information you provide to
  545. us in connection with your Booking is true, accurate, current and
  546. complete. If any of your details change (e.g. email address, postal
  547. address), you must promptly update your details.</p>
  548. <p>13.2 You accept financial responsibility for all transactions
  549. made under your name or account.</p>
  550. <p>13.3 You promise to us and to each Owner that during the Holiday
  551. Period:</p>
  552. <blockquote>
  553. <p>13.3.1 that the number of people occupying the Property will not
  554. exceed the number stated on in your Booking Confirmation;</p>
  555. <p>13.3.2 that the Property will be used solely for the purpose of
  556. a holiday by you and your Guests;
  557. <br>
  558. <br>
  559. 13.3.3 that you will (and ensure that your Guests will) show all
  560. due consideration and respect for any Owners and their
  561. representatives and neighbours or other persons or parties that
  562. have a connection with the Property. This includes refraining from
  563. abusing your stewardship of the Property or dangerous, offensive,
  564. violent or anti-social behaviour towards such persons or parties;
  565. <br>
  566. <br>
  567. 13.3.4 that you will (and ensure that your Guests will) use the
  568. Property and Rental Services lawfully, will not abuse any
  569. facilities provided as part of the Rental Services and will comply
  570. with any health and safety or other policies or instructions
  571. notified to you by us or the Owner in connection with the Property
  572. or Rental Services;
  573. <br>
  574. <br>
  575. 13.3.5 to allow the Owner or his representative to access the
  576. Property at any reasonable time during the Holiday Period provided
  577. the Owner provides reasonable advance notice (except in
  578. emergencies);
  579. <br>
  580. <br>
  581. 13.3.6 to keep the Property and all furniture, utensils, equipment,
  582. fixtures and fittings in or on the Property in the same state of
  583. repair and condition as at the commencement of the Holiday Period
  584. and to ensure that at the end of that period the Property is left
  585. in the same state of order and cleanliness in which it was found.
  586. <strong>The Owner (or us acting on their behalf) may make an
  587. additional, reasonable charge for professional cleaning after your
  588. and your Guests' occupancy as may be required to return the
  589. Property to its original state of cleanliness and
  590. tidiness;</strong></p>
  591. <p>13.3.7 to report as soon as possible to the Owner (or his
  592. representative) any breakages or damage caused by you or your
  593. Guests during the Holiday Period. <strong>Without affecting any
  594. other remedies that the Owner has under the Rental Contract, you
  595. promise to fully reimburse the Owner for the cost of replacement or
  596. repair for such breakages or damage. We may collect such payments
  597. on the Owner's behalf;</strong></p>
  598. <p>13.3.8 to arrive after 3 p.m. on the arrival day and to vacate
  599. the Property by 10 a.m. on the day of departure unless you have
  600. selected alternative check-in and check-out dates during the
  601. Booking process (as detailed in your Booking Confirmation) or
  602. agreed otherwise with the Owner;</p>
  603. <p>13.3.9 not to allow any person other than you and your Guests to
  604. use the facilities and amenities of the Property without the
  605. express permission of the Owner; and</p>
  606. <p>13.3.10 to notify all Guests before the Holiday Period starts of
  607. your and their obligations under this paragraph 13.3.
  608. <br>
  609. <br></p>
  610. </blockquote>
  611. <p>13.4 You will be responsible for all Guests staying at the
  612. Property and the things they do (and do not do) even if you do not
  613. stay there yourself during the Holiday Period.</p>
  614. <p>13.5 It is your responsibility to ensure you, your Guests and
  615. any pets have the relevant travel and health documents and
  616. requirements needed for visiting the country in which a Property is
  617. located. These include any passport or other identification
  618. documents, visa requirements and, in the case of pets, any vaccines
  619. or microchips. We will not be liable for any expenses incurred
  620. resulting from your missing, incomplete or incorrect documentation
  621. or any non-compliance with such requirements.
  622. <br>
  623. <br>
  624. 13.6 In the event that you or any Guest fails to comply with the
  625. requirements set out above in paragraph 13.3, the Owner (or their
  626. representative) can refuse to allow you and your Guests to enter
  627. and stay at the Property or can require you and your Guests to
  628. leave the Property before the end of the Holiday Period. In either
  629. case, you will be treated as having broken the terms of Rental
  630. Contract and the provision set out in the <span class="c1">Owners' right to end a Rental Contract</span> section will
  631. apply.</p>
  632. <h2>14 Owners' responsibilities
  633. <br></h2>
  634. <p>14.1 The Owner will:</p>
  635. <blockquote>14.1.1 perform the Rental Services using reasonable
  636. care and skill;</blockquote>
  637. <blockquote>14.1.2 as soon as possible, notify you in writing of
  638. any changes to the description of the Property and/or Rental
  639. Services relating to your Booking which would make our descriptions
  640. of the Property inaccurate, incomplete or misleading;</blockquote>
  641. <blockquote>14.1.3 ensure that the Property is vacant and that you
  642. and your Guests have exclusive access to the Property and Rental
  643. Services for the full period of the Holiday Period;</blockquote>
  644. <blockquote>14.1.4 ensure that suitable arrangements are in place
  645. for you to collect and return the keys/access cards for the
  646. Property;</blockquote>
  647. <blockquote>14.1.5 not make any use of the Property (including
  648. conducting any viewings of the Property) during the Holiday
  649. Period;</blockquote>
  650. <blockquote>14.1.6 show all due consideration and respect to you
  651. and your Guests including refraining from any dangerous, offensive,
  652. violent or anti-social behaviour towards you and your
  653. Guests;</blockquote>
  654. <blockquote>14.1.7 will ensure that the Owner, the Property and the
  655. Rental Services comply with all applicable laws and regulations
  656. during the Holiday Period;</blockquote>
  657. <blockquote>14.1.8 comply with the terms of the Rental Contract and
  658. act in good faith at all times;</blockquote>
  659. <blockquote>14.1.9 respond to queries, complaints and problems
  660. which arise during or after the Holiday Period and use its best
  661. efforts to resolve them; and</blockquote>
  662. <blockquote>14.1.10 if VAT forms part of the Rental Charges,
  663. provide you with a VAT invoice at your written request.
  664. <br></blockquote>
  665. <h2>15 Pets</h2>
  666. <p>15.1 Pets are only allowed at Properties where this is expressly
  667. stated in the applicable Property description. If you take a pet to
  668. a Property that does not allow them, or exceed the stated
  669. number/size of pet(s), the Owner (or his representative) has the
  670. right to:</p>
  671. <blockquote>
  672. <p>15.1.1 refuse to allow you and your Guests to enter or stay in
  673. the Property; or</p>
  674. <p>15.1.2 ask you and your Guests to leave the Property before the
  675. end of the Holiday Period.
  676. <br></p>
  677. </blockquote>
  678. <p>15.2 If the Owner exercises their rights under paragraph 15.1,
  679. the Owner may end the Rental Contract in accordance with the
  680. <span class="c1">Owners' right to end a Rental Contract</span>
  681. section.
  682. <br>
  683. <br>
  684. 15.3 You will be liable for all damage caused by your and your
  685. Guests' pets. If you are allowed a pet/pets in the Property,
  686. you should remove all traces (inside and outside) from the Property
  687. of pet occupation before you and your Guests' vacate the
  688. Property at the end of the Holiday Period. <strong>The Owner may
  689. make an additional, reasonable charge for professional cleaning
  690. after your and your Guests' occupancy due to any pets that have
  691. stayed at the Property.</strong> You must not allow pets on beds or
  692. on furniture within the Property and pets must not be left alone in
  693. the Property at any time. If you break the terms of this paragraph
  694. 15.3, the Owner (or their representative or us on their behalf) may
  695. notify you that you have broken those terms and if you continue to
  696. do so may end the Rental Contract and require you and your Guests
  697. to leave the Property before the end of the Holiday Period.
  698. <br>
  699. <br>
  700. 15.4 Registered assistance dogs are allowed in all Properties
  701. featured on our Site, even where the property description states
  702. that pets are not allowed, provided that you comply with the
  703. provisions in paragraph 15.3. You must notify us of the intended
  704. presence of any assistance dogs prior to Booking. If you have an
  705. allergy to dogs, please be aware that we and Owners cannot
  706. guarantee that an assistance dog has not stayed in a particular
  707. Property recently. We and Owners cannot accept responsibility for
  708. any suffering which may occur as a result of such animals having
  709. been present in a Property.</p>
  710. <h2>16 Insurance</h2>
  711. <p>16.1 You are strongly advised to take out adequate travel
  712. insurance prior to departing for your holiday. It is your
  713. responsibility to check that your insurance cover is adequate.</p>
  714. <p>16.2 During the Booking process you may be given the option
  715. to purchase holiday insurance cover. The purchase of any insurance
  716. products is entirely optional. Sykes Cottages Limited (also t/a
  717. Hogans Cottages) is an appointed representative of ITC Compliance
  718. Limited which is authorised and regulated by the Financial Conduct
  719. Authority (their registration number is 313486) and which is
  720. permitted to advise on and arrange general insurance contracts.

  723. <h2>17 Promises the Owner makes to you about the Property and
  724. Rental Services</h2>
  725. <p>17.1 The Owner promises to you that:</p>
  726. <blockquote>
  727. <p>17.1.1 it has the right to provide the Rental Services and enter
  728. into the Rental Contract with you</p>
  729. <p>17.1.2 the Owner will maintain, at the Owner's expense and
  730. with a reputable insurance company, policies to meet the
  731. Owner's liabilities under the Rental Contract with you;</p>
  732. <p>17.1.3 the Property and the Owner will comply with all
  733. applicable laws and regulations, in particular, relating to fire,
  734. health, safety and planning and data protection; and</p>
  735. <p>17.1.4 the Property is properly maintained, clean, tidy and in
  736. good repair at the start of the Holiday Period.</p>
  737. </blockquote>
  738. <h2>18 Our liability
  739. <br></h2>
  740. <p>18.1 We do not exclude or limit in any way our liability to you
  741. where it would be unlawful to do so. This includes liability for
  742. death or personal injury caused by our negligence or the negligence
  743. of our employees, agents or subcontractors; for fraud or fraudulent
  744. misrepresentation; or for breach of your legal rights in relation
  745. to the Booking Service including the right to receive services
  746. supplied with reasonable skill and care.</p>
  747. <p>18.2 To the fullest extent permissible under applicable law, we
  748. disclaim any and all other promises, warranties, conditions, or
  749. representations relating to the Booking Service, whether express,
  750. implied, oral or written. In particular, we do not make any
  751. promises about:</p>
  752. <blockquote>
  753. <p>18.2.1 the availability of the Booking Service or the Site or
  754. that they will be provided uninterrupted or error or
  755. virus-free;</p>
  756. <p>18.2.2 errors or inaccuracies in any documentation supplied by
  757. Owners or their representatives, including any documentation that
  758. appears on the Site; or</p>
  759. <p>18.2.3 the quality, suitability or performance of the Rental
  760. Services, the Property or the Owner. You understand that we may not
  761. have conducted any checks on Owners or their Properties and the
  762. inclusion or offering for sale of Rental Services does not
  763. constitute an express or implied endorsement or recommendation by
  764. us of such services. We do not guarantee the accuracy of, and
  765. disclaim liability for any inaccuracies relating to the Rental
  766. Services offered for sale through us. We shall not be liable for
  767. any damages arising as a result of any inaccurate information or
  768. errors on our Site which relate to information about Property or
  769. Rental Services. We shall not be liable to you for any losses in
  770. the event of Owners overbooking, cancelling bookings in full or in
  771. part or due to circumstances or events beyond our or their
  772. control.</p>
  773. </blockquote>
  774. <p>18.3 We do not authorise anyone to make any promises on our
  775. behalf.</p>
  776. <p>18.4 We will not be responsible or liable:</p>
  777. <blockquote>
  778. <p>18.4.1 for Owners' performance of their obligations under
  779. any Rental Contracts with you or any actions and/or omissions by
  780. them (or their nominated representatives) in relation to the
  781. Property or Rental Services that you book using the Booking
  782. Service; or</p>
  783. <p>18.4.2 for any losses related to any business of yours including
  784. but not limited to lost data, profits, revenue, business,
  785. opportunity, goodwill, reputation or business interruption.</p>
  786. </blockquote>
  787. <p>18.5 When Booking certain Properties only, we may provide you
  788. with the option to use the Booking Service to also purchase travel
  789. tickets (e.g. ferry travel). In accordance with The Package Travel,
  790. Package Holidays and Package Tours Regulations 1992, all passengers
  791. purchasing travel tickets with Sykes Cottages Ltd are fully insured
  792. for all monies paid to us, including repatriation (if required),
  793. arising from the cancellation or curtailment of your travel
  794. arrangements due to the unlikely event of the insolvency of Sykes
  795. Cottages Ltd.
  796. <br></p>
  797. <p>A certificate detailing this cover will be given to each and
  798. every passenger as evidence of cover. Please ensure that you have
  799. been given the appropriate certificate(s) at the time of
  800. booking.</p>
  801. <p>This insurance has been arranged by MGA Cover Services on behalf
  802. of Towergate Chapman Stevens through CBL Insurance.</p>
  803. <p>In all other cases, you accept that we have not in any way
  804. selected or assembled your travel arrangements for you. Your
  805. accommodation arrangements are not a package and do not fall within
  806. the meaning of The Package Travel, Package Holidays and Package
  807. Tours Regulations 1992</p>
  808. <p>18.6 You acknowledge that personal belongings and vehicles
  809. (together with their contents) belonging to you and your Guests are
  810. left at the Property entirely at your and their own risk. We accept
  811. no liability to you for any loss, damage or injury to you or your
  812. Guests, or your or their personal property during the Holiday
  813. Period, except to the extent such loss, damage or injury is caused
  814. by our negligence.</p>
  815. <p>18.7 If either we or you fail to comply with these Booking
  816. Conditions, neither of us shall be responsible for any losses that
  817. the other suffers as a result, except for those losses which are a
  818. foreseeable consequence of the failure to comply with these Booking
  819. Conditions. Losses are foreseeable where they were contemplated by
  820. you and us at the time we accept a Booking made by you.</p>
  821. <h2>19 Owners' liability</h2>
  822. <p>19.1 Owners do not exclude or limit in any way their liability
  823. to you where it would be unlawful to do so. This includes liability
  824. for death or personal injury caused by their negligence or the
  825. negligence of their employees, agents or subcontractors; for fraud
  826. or fraudulent misrepresentation; or for breach of your legal rights
  827. in relation to the Rental Services including the right to receive
  828. the Rental Services supplied with reasonable skill and care.</p>
  829. <p>19.2 If either you or an Owner fail to comply with the terms of
  830. the Rental Contract, including these Booking Conditions, neither
  831. you nor the Owner shall be responsible for any losses that the
  832. other suffers as a result, except for those losses which are a
  833. foreseeable consequence of the failure to comply with those terms.
  834. Losses are foreseeable where they were contemplated by you and the
  835. Owner at the time we accept a Booking made by you.</p>
  836. <h2>20 Your rights as a consumer</h2>
  837. <p>20.1 We and Owners are under a legal duty to supply services
  838. that are in conformity with our respective contracts with you. You
  839. have certain legal rights as a consumer under the law and nothing
  840. in these Booking Conditions affects your legal rights. Advice about
  841. your legal rights in relation to the services we and Owners provide
  842. is available from your local Citizens' Advice Bureau or Trading
  843. Standards office. For detailed information please visit the

  845. 06.</p>
  846. <h2>21 Your right to end a Rental Contract</h2>
  847. <p>21.1 You may immediately end a Rental Contract:</p>
  848. <blockquote>
  849. <p>21.1.1 if we or an Owner have told you about an error in the
  850. charges or Booking Details or a significant error in the
  851. description of the Rental Services relating to your Booking and you
  852. notify us that you do not wish to proceed; or</p>
  853. <p>21.1.2 if we notify you about a change to the Rental Charges due
  854. to changes in the applicable exchange rate and you notify us that
  855. you do not wish to proceed in accordance with paragraph 8.1.</p>
  856. </blockquote>
  857. <p>21.2 Nothing in this paragraph 21 affects or reduces your legal
  858. rights as a consumer. Please see further paragraph 20.1 regarding
  859. where to obtain advice regarding your legal rights.</p>
  860. <h2>22 Owners' right to end a Rental Contract</h2>
  861. <p>22.1 An Owner may immediately terminate their Rental Contract
  862. with you if:</p>
  863. <blockquote>
  864. <p>22.1.1 you and your Guests do not comply with the obligations
  865. set out in paragraph 13;</p>
  866. <p>22.1.2 you do not comply with the applicable rules on pets in
  867. accordance with paragraph 15;</p>
  868. <p>22.1.3 if you fail to pay any housekeeping bond on the date that
  869. payment of the bond is due; or</p>
  870. <p>22.1.4 circumstances or events outside the Owner's
  871. reasonable control prevent or are likely to prevent you and your
  872. Guests from staying at the Property for the Holiday Period or the
  873. Owner from complying with any other of its obligations under the
  874. Rental Contract.</p>
  875. </blockquote>
  876. <h2>23 Consequences of the Rental Contract ending</h2>
  877. <p>23.1 If you end the Rental Contract for the reasons mentioned in
  878. paragraph 21, we will refund to you the Booking Fee and the Owner
  879. will refund to you the Deposit and any other amounts paid by you
  880. for the Booking within 14 days of the date you notify us that you
  881. wish to end the Rental Contract.</p>
  882. <p>23.2 If the Rental Contract ends during the Holiday Period, you
  883. must:</p>
  884. <blockquote>
  885. <p>23.2.1 leave the Property together with all Guests as soon as
  886. possible;</p>
  887. <p>23.2.2 notify the Owner (or their representatives) and us that
  888. you and your Guests have left the Property and the reasons for
  889. doing so; and</p>
  890. <p>23.2.3 return the keys/access cards to the location instructed
  891. by the Owner.</p>
  892. </blockquote>
  893. <p>23.3 Nothing in this paragraph 23 affects or reduces your legal
  894. rights as a consumer. Please see further paragraph 20.1 regarding
  895. where to obtain advice regarding your legal rights.</p>
  896. <h2>24 Complaints</h2>
  897. <p>24.1 If you wish to make a complaint about a Property or Rental
  898. Service, in the first instance please contact the relevant Owner
  899. (or their representative) as soon as possible. We encourage all
  900. Owners to take complaints from holidaymakers seriously and to do
  901. their best to resolve them, where possible.</p>
  902. <p>24.2 If you make a complaint and are dissatisfied with the
  903. Owner's response, please contact us as soon as possible (and in
  904. any event within 28 days of the end of the Holiday Period for the
  905. relevant Booking) with full details of your complaint and the
  906. Owner's response</p>
  907. <p>24.3 We may (but are not obliged to) liaise with an Owner to
  908. attempt to resolve your unresolved complaints.</p>
  909. <p>24.4 Nothing in this <span class="c1">Complaints</span> section
  910. will affect your legal rights or any right you may have to bring
  911. legal proceedings against an Owner under a Rental Contract.</p>
  912. <h2>25 Other important terms</h2>
  913. <p>25.1 <strong>Written Communications</strong>. You agree to
  914. receive communications from us and Owners electronically and that
  915. electronic communications will satisfy any legal requirement for
  916. communications to be in writing.</p>
  917. <p>25.2 <strong>Language</strong>. These Booking Conditions may be
  918. presented to you in more than one language. However, the English
  919. language version of these Booking Conditions shall prevail. Any
  920. contracts made under these Booking Conditions will be concluded in
  921. English.</p>
  922. <p>25.3 <strong>Our reliance on these Booking Conditions</strong>.
  923. We and each Owner intend to rely on these written Booking
  924. Conditions and any document expressly referred to in them in
  925. relation to the subject matter of any contract made under them. We
  926. and you and each Owner will be legally bound by these Booking
  927. Conditions.</p>
  928. <p>25.4 <strong>References to 'including' and other similar
  929. expressions</strong>. In these Booking Conditions, words that
  930. appear after the expression 'include', 'including',
  931. 'other', 'for example', 'such as' or
  932. 'in particular' (or any similar expression) will not limit
  933. the meaning of the words appearing before such expression.</p>
  934. <p>25.5 <strong>We may transfer this agreement to someone
  935. else</strong>. We and each Owner may transfer our rights and
  936. obligations under these Booking Conditions to another organisation.
  937. We or the Owner will contact you to let you know if this is
  938. planned. If you are unhappy with the transfer you may contact us or
  939. the Owner to end the relevant contract within 14 days of us or the
  940. Owner telling you about it and we or they will refund you any
  941. payments you have made in advance for services that have not been
  942. provided.</p>
  943. <p>25.6 <strong>Events or circumstances beyond our or an
  944. Owner's reasonable control</strong>. If we or an Owner is
  945. prevented or delayed from complying with any obligations under
  946. these Booking Conditions by anything you (or anyone acting on your
  947. behalf) does or fails to do or due to events or circumstances
  948. beyond our or an Owner's reasonable control, the inability or
  949. delay in performing those obligations will not be treated as a
  950. breach of the terms of these Booking Conditions. Examples of such
