I am a authorized reseller of these servers and any payments that go to me will immediately pay off any due invoices. You will get a reminder invoice two weeks and one week prior to the due date.

By agreeing to pay for any services you accept these terms of servers which have been show to you prior to payment.

Anti-Fraud / Abuse Measures

1) We will run all orders through MaxMind and FraudRecord, by signing up you agree that you allow us to run your information through these databases.
2) By signing up, you confirm that any information inputted is legitimate.
3) IMPORTANT - If you have a FraudRecord score of 30 or higher, and an above-average MaxMind score, we are fully allowed to deny you service with no compensation.

Spam / Legal Marketing

1) Mass Mailing is not valid IP Justification.
2) If excessive amount of mail is sent (1,000 +) per day we will be allowed to block all mailing ports. (This is to protect our IP's, but, if usage is fully legitimate we will rarely do this)
3) Any listing in SpamHaus or any other SBL is an immediate termination at no compensation.
4) Mass Mailing that is legal under the can-spam act is allowed.




General Legal Information (Temporary)

1. Legal Adult Content is allowed, but nothing that is illegal within the US or EU (ex: Underage or Forced)
2. You may not upload any material that violates or infringes on the copyright, intellectual property rights or trademark rights of any individual or organization.
3. IRC websites/servers are not allowed.
4. Piracy, hacking, cracking, phreaking, warez, exploitive software or text that educates or encourages this activity and/or use is not allowed.
5. You may not host any material that defames, abuses, harasses or threatens any person or group.
6. Spam is strictly prohibited, and will result in immediate suspension of services at our discretion.
7. You may not use our service in the commission of any crime that violates the laws of local, state, and federal government of the United States of America. Violations of this provision may result in us making your information and information about your service and it's use available to law enforcement with or without your consent or knowledge.
8. You are solely and fully responsible for the contents of your account. Any and all repercussions will be borne solely by you as the account holder. In no event will McMyHost be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use McMyHost's services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.
9. At no time will a refund be provided.
10. Any invoice overdue is automatically applied a late fee of $5.00.
11. Non payment is not a valid form of cancellation and your service will automatically renew.
12. a) Please provide 1 day notice of any cancellation (Service will be suspended at end of billing cycle, not immediately after we receive the cancellation request).
b) On Dedicated Servers 10 days notice is required.
13. We are not liable for any damage or loss of data due to insufficient cooling, heating, bandwidth or acts of God. This includes VPS or dedicated servers. If we receive any chargebacks your account will be immediately suspended and service terminated.
14. Anyone caught violating our Acceptable Use Policy or Terms of Service may be terminated without warning and with no refund.

3) No DDoS / Booters...
4) No public VPN's
5) No copyrighted material
5) Anything that will attract abuse.
