  1. My videos should be reinstated under fair use for the following reasons:
  2.
  3. The videogame involved in this counter notification has been transformed into a demonstration in a non-interactive educational Youtube video with text/voice commentary, non-game content, and video edits. The purpose of all the videos is to educate viewers on how to use emulators.
  4.
  5. Very little of the aforementioned game is used. The videos do not show, nor distribute the games in their entirety. The most important part of the videogames is to make inputs and interact with the games, which is not possible via a Youtube video.
  6.
  7. Youtube videos cannot replace videogames because videos are non-interactive, unlike videogames which require players to make inputs.
  8.
  9. Emulation itself is legal, and so is showing the use of emulators (https://en.wikipedia.org/wiki/Video_game_console_emulator#Legal_issues).
  10. None of the videos promote any form of piracy and there is no distribution of copyrighted files. I do not share any links to pirated/copyrighted files, like games/ROMs, decryption keys, firmware, bios files, and more. Obtaining a dumped copy of the original machine's Firmware or game is legal as fair use. I actively help people obtaining their files using legal methods.
  11.
  12. There is no law against showing or promoting emulators, and doing so is not copyright infringement.
  13. Under Section 512(f) of the DMCA, misuse of the DMCA (and Youtube Copyright System) may result in legal consequences.
  14. Copyright owners must consider fair use before issuing takedown notices, see Lenz v Universal (https://en.wikipedia.org/wiki/Lenz_v._Universal_Music_Corp.)

  16. Belgian Anti-Piracy Federation (BAF) has striked & removed 8 of my other videos and did not respond to my emails and calls. There is no contact information or website available for me to contact BAF. The mail provided with the strike also does not respond.
