  353. 1. Per reftel request, post submits the following semi-annual report
  354. covering the period September 2008 through February 2009.
  355.

  357. COUNTRY CONDITIONS
  358. ------------------
  359.  
  360. 2. Malawi is among the world's poorest countries, with more than
  361. two-thirds of the population living in poverty. The HIV/AIDS
  362. pandemic has further deteriorated existing economic and social
  363. conditions in the country and has claimed the lives of nearly a
  364. million Malawians from all walks of life. Faced with an inefficient
  365. infrastructure and the difficulty of improving one's economic
  366. situation, Malawians often look for a better life elsewhere. The
  367. United States remains an attractive destination for those seeking a
  368. better life.
  369.  
  370. 3. Lilongwe is a medium-low fraud post. Corruption is a significant
  371. issue for this fledging democracy where fraud can occur at any level
  372. within Malawian society and government institutions. Malawian
  373. passports and residency permits, along with most civil documents,
  374. are easy to obtain with falsified information. This fact, coupled
  375. with porous borders, understaffed and ill-equipped immigration and
  376. law enforcement officials, makes Malawi a highly attractive target
  377. for mala fide travelers and immigrant traffickers. Malawian
  378. government officials recognize the susceptibility of their country
  379. to these threats, but thus far have been unable to take effective
  380. action to prevent fraud.
  381.  
  382. ---------
  383. NIV FRAUD
  384. ---------
  385.  
  386. 4. NIV fraud is generally unsophisticated, with a sizable number of
  387. cases committed by third country nationals posing as Malawian
  388. citizens or residents. In the past, Zimbabweans, Nigerians,
  389. Somalis, Pakistanis and Ethiopians have been discovered illegally
  390. transiting Malawi, obtaining illegitimate documents and passports
  391. for suspected travel to South Africa and the US. Post has not
  392. detected any organized fraud in Malawi. In any case, consular
  393. officers do not reply on most documentation submitted by applicants
  394. because of its susceptibility to fraud.
  395.  
  396. 5. During the reporting period, post detected a mala fide traveler
  397. through IDENT. The applicant, a female Malawian holding a genuine
  398. passport, had applied twice previously, once using her true identity
  399. and a second time using a false identity. Post initially had
  400. problems obtaining her finger prints, which we later determined was
  401. caused by her use of a clear synthetic material to mask her
  402. fingerprints. A review of the case revealed the applicant had
  403. successfully obtained two genuine passports containing false
  404. information, in addition to her real passport. In a similar case,
  405. post detected another imposter using a genuine passport also through
  406. IDENT. In this later case, the applicant was an alien absconder who
  407. had recently been removed from the United States. In both
  408. instances, the individuals were able to obtain their false identity
  409. passports from local immigration offices without resorting to
  410. bribery or malfeasance. In both cases, Consular and RSO coordinated
  411. their review of these cases with Malawian Immigration authorities.
  412. While arrests were made, both individuals were released after 48
  413. hours and we are not aware of any further criminal or civil
  414. proceedings arising from these cases.
  415.  
  416. 6. In October 2008, Post conducted a verification study focused on
  417. J-1 Au Pairs. Anecdotal information, including poison pen emails,
  418. indicated this program was being used as an immigration avenue to
  419. the U.S. The study, which focused on J-1s issued to Au Pairs during
  420. the period October 2005 to October 2007, revealed an overstay rate
  421. in excess of 90%. Post immediately took steps to correct this
  422. situation including closer review of qualifications and ties along
  423. with discussions with the Au Pair Exchange Program Director(s) in
  424. Malawi and South Africa.
  425.  
  426. 7. NIV fraud within the A and G visa categories continues to be a
  427. challenge. A lack of control over diplomatic notes and diplomatic
  428. passports has lead to a number of inappropriate requests and
  429. fraudulent behavior. These matters typically including sponsorship
  430. of individuals posing as immediate family members or requests
  431. dealing with an A3 or G3 for a domestic employee who is replacing
  432. another A3/G3 domestic employee who "disappeared" while in the
  433. United States. Within the reporting period, Post met with Ministry
  434. of Foreign Affairs Officials regarding the use and verification of
  435. Diplomatic Notes and the Department's guidelines regarding the
  436.

  440. sponsorship of immediate family members for A and G visas.
  441.  
  442. 8. Post has experienced a decrease in student visa fraud in the past
  443. three years since the Malawi government added enhanced security
  444. features to Malawi School Certificate of Education (MSCE)
  445. certificates (roughly equivalent to high school diplomas), making
  446. them less susceptible to alteration.
  447.  
  448. 9. We continue to experience a large number of travelers "sponsored"
  449. by various churches, religious groups and individual missionaries in
  450. the United States. Given the large number of religious-related
  451. avenues available to travel to the United States, church affiliation
  452. is viewed in Malawi as an effective method to obtain a visa. These
  453. travelers typically apply with someone who is clearly approvable or
  454. has already been to the United States and returned. When detected,
  455. Post applies appropriate ineligibilities for these individuals who
  456. knowingly used their position and/or travel history to advance the
  457. applications of unqualified applicants.
  458.  
  459. 10. Finally, we note that during the entire period of this report,
  460. only one NIV applicant revealed that they had a disqualifying
  461. communicable disease. In a country where there is a substantial
  462. prevalence of disqualifying communicable diseases within the
  463. population at large, this may indicate that some NIV applicants are
  464. failing to provide accurate medical information.
  465.

  467. IV FRAUD
  468. --------
  469.  
  470. 11. IV fraud generally relates to the IV application process rather
  471. than the applicant's relationship to the petitioner. Many of our IV
  472. cases deal with third country nationals (TCN) who reside in Malawi.
  473. Verification of documentation in these cases is extremely
  474. challenging. Finally, due to the high prevalence of HIV/AIDS in
  475. Malawi, some applicants have attempted to bribe medical officials to
  476. obtain approved medical examinations. To combat this trend, Post
  477. has identified several certified, reliable and trustworthy panel
  478. physicians and laboratories for medicals.
  479.

  481. DV FRAUD

  484. 12. N/A. Currently Post's DV cases are handled and processed by
  485. Embassy Harare. Post intends to train consular staff personnel in DV
  486. handling and processing and will assume this responsibility from
  487. Embassy Harare in the next year.
  488.

  490. ACS AND U.S. PASSPORT FRAUD
  491. ---------------------------
  492.  
  493. 13. Post has not had any cases involving ACS or passport fraud in
  494. recent memory. With our low ACS load, Post is able to give
  495. considerable oversight and review of our passport and CRBA cases.
  496. Post is currently working a citizenship case where the claimant left
  497. the U.S. some 30+ years ago and failed to renew the U.S. passport he
  498. received as an infant. While there are no outward indicators of
  499. fraud at this juncture, this case illustrates the complexity of some
  500. of the ACS cases Post handles which require careful review and
  501. investigation to resolve.
  502.

  504. ADOPTION FRAUD
  505. --------------
  506.  
  507. 14. Adoption fraud is not an issue in Malawi at this juncture.
  508. Malawi's restrictive adoption laws and requirements deter most
  509. AMCITs interested in pursuing inter-country adoptions. Most
  510. adoptions cases are processed through the I-130 process and Post is
  511. able to undertake in-depth reviews of the documentation and the
  512. orphan status of the adoptee child.

  518. 15. Post did not conduct DNA testing during the reporting period.

  521. ASYLUM AND OTHER DHS BENEFIT FRAUD

  525. reporting period.

  535. 17. Post's immigration and police contacts report that Somali,
  536. Eritrean Congolese, (DRC) and Ethiopians use Malawi as a rest point
  537. enroute to South Africa. Smugglers reportedly charging each alien
  538. the equivalent of $1400 U.S. dollars. Post has also noticed alien
  539. smuggling attempts through the NIV process. These attempts
  540. typically involve diplomatic notes for unqualified applicants or the
  541. sponsorship of these applicants by well-regarded AMCITs who served
  542. in Malawi as missionaries or with NGOs.
  543.  
  544. --------------------------------
  545. DS CRIMINAL FRAUD INVESTIGATIONS
  546. --------------------------------
  547.  
  548. 18. The Regional Security Office and Consular Section have a strong
  549. working relationship and have frequently collaborated on cases and
  550. issues of concern. Most recently, RSO and Consular worked together
  551. on two cases of identity imposters.
  552.

  554. HOST COUNTRY PASSPORTS, IDENTITY DOCUMENTS, AND CIVIL REGISTRY
  555. --------------------------------------------- --------
  556.  
  557. 19. Malawi's primary identity documents (passports, birth
  558. certificates, etc.) create the biggest challenge for Post's fraud
  559. prevention efforts. Genuine documents containing fraudulent
  560. information are the biggest threat. Most documents are easily
  561. obtained by applicants from any area or level of socio-economic
  562. statute. Birth certificates, death certificates, and marriage
  563. certificates are often created many years after the event and merely
  564. reflect the attestation of the individual requesting the document.
  565. Malawi's lack of document controls means that corruption and bribery
  566. are not essential to receive any new document desired.
  567.  
  568. 20. In a meeting held in February 2009, the Commissioner of
  569. Immigration indicated that Malawi plans to introduce biometrics (a
  570. thumb print) in its passports in the near future. The Commissioner
  571. of Immigration also agreed to share information in cases involving
  572. passport fraud, Malawi visas, and residence and work permits. The
  573. Consular staff continues to work closely with immigration officials
  574. to investigate fraud and report the authenticity of these
  575. documents.

  578. COOPERATION WITH HOST GOVERNMENT AUTHORITIES

  581. 21. Post has received satisfactory cooperation from host country
  582. counterparts. While Malawian Immigration and Police Official have
  583. been very cooperative with our requests to verify documents and
  584. cooperate with investigations, Malawi does not have the resources,
  585. training or expertise to counter the gaps in the security of their
  586. identity documents.

  589. AREAS OF PARTICULAR CONCERN

  592. 22. The availability of genuine identity documents using false
  593. information is of significant concern. Malawi's porous borders and
  594. its location as a transit route in proximity to other East African
  595. nations known to harbor terrorists and criminals raise the specter
  596. of these undesirables obtaining U.S. visas or passports through
  597. fraud.
  598.

  600. STAFFING AND TRAINING
  601. ---------------------

  603. 23. Post's Consular Section consists of one Consular Officer, one
  604. EFM and one LES - there is no dedicated FPU. The Consul has
  605. extensive experience and recently attended FSI's Advanced Consular
  606. Course, and has previously attended FSI's Analytic Interviewing and
  607. Advanced Consular Namechecking Techniques courses.
  608.  
  609. 24. The LES Consular Assistant is designated the fraud investigator
  610. for the consular section and has received OJT. This LES (along with
  611. Consul) have developed excellent working relations with the local
  612. and national-level Malawi authorities including Immigration, Police,
  613. Airlines representatives, the Malawi National examination and
  614. Testing Board (MANEB). The LES Consular Assistant has not received
  615. any formal fraud training, but will be nominated for FSI's FSN Fraud
  616.
