- An Act to Criminalize Promotion of Harmful Practices that Encourage Gender Dysphoria and Destabilize Gender Identity of Children
- Section 1. Definitions
- For the purposes of this Act, the following terms shall have the meanings given to them:
- (a) "Harmful Practices" means any practice, activity, or ideology that encourages or promotes gender dysphoria or destabilization of gender identity of children under the age of 18, including but not limited to drag shows, gender ideology lessons, and gender transitioning procedures.
- (b) "Person or Entity" means any individual, corporation, organization, association, partnership, or any other legal entity.
- (c) "Gender Dysphoria" means a psychological condition in which an individual's gender identity differs from their biological sex.
- (d) "Destabilization of Gender Identity" means any act or practice that undermines, denies, or confuses a child's biological sex and/or gender identity.
- Section 2. Prohibition of Harmful Practices
- (a) No person or entity shall engage in any harmful practices that encourage gender dysphoria or destabilize the gender identity of children under the age of 18.
- (b) No person or entity shall promote or provide financial support to any harmful practices as described in subsection (a) above.
- Section 3. Penalties
- (a) Any person or entity that violates this Act shall be guilty of a Class C felony, punishable by a fine not exceeding $50,000 and imprisonment for a term not exceeding 10 years, or both.
- (b) Any person or entity that knowingly assists or aids another person or entity in violating this Act shall be guilty of a Class D felony, punishable by a fine not exceeding $10,000 and imprisonment for a term not exceeding 5 years, or both.
- Section 4. Enforcement
- (a) This Act shall be enforced by any law enforcement agency or officer having jurisdiction in the state of Missouri.
- (b) Any person or entity may bring an action for injunctive relief to enforce the provisions of this Act.
- (c) The Attorney General of the state of Missouri shall have the power to bring an action for civil penalties and damages to enforce the provisions of this Act.
- Section 5. Severability
- If any provision of this Act or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Act which can be given effect without the invalid provision or application.
- Section 6. Effective Date
- This Act shall become effective immediately upon its passage and approval by the Governor.
