  7. Good morning
  8.
  9. I'd like to refer you to the city charter section C-73-B Purchasing procedures.
  10.
  11. This section specifically relates to the sale of real property no longer needed for the city purposes (not relating to in rem). Within this section it is stated that city owned real property "may not be sold, leased, space therein leased, or otherwise disposed of in the form of a franchise or license if said bid is less than fair market value..."
  12.
  13. It is my understanding that the assessed value as stated by the mayor during the planning committee meeting last week was north of $700,000, which is far more than the proposed sale price contained in the sale agreement on the upcoming council meetings agenda.
  14.
  15. I would ask for a legal determination on city charter section C-73-B as it relates to this sale to ensure we as a city council are not being asked to break the city charter by the administration.
  16.
  17. Your prompt response will be greatly appreciated.
  18.
  19. Thanks,
  20.
