  12. This email is in response to a conversation we'd had today regarding some of the events culminating with the current situation I am facing here with my home at 13508 Pinnacle Gardens Circle and have faced here for well over a decade.

  14. Let me say firstly that Board Members for our homeowners association have grossly overstepped their bounds and have done so for a number of years. I am unsure you are aware of the magnitude of this or the violations to my rights, my personal property and my home, inside and out, and disrespect for the Rules and Regulations initially set in place upon the inception of these By-Laws.

At this juncture it remains to be seen whether there can be an amicable resolution after the Board Members' actions this past month as I am still consulting with a variety of individuals as to which direction to proceed, including legal measures as well as a protective order prohibiting those members from harassing and terrorizing me, my home, my guests and my property any further.

That being said I do have a string of paperwork since my initial occupation of this townhome when it was originally built in 2004 which does show a continual degradation and breakdown in communication leading up the the most recent chain of events. The lack of responsiveness of this Board, which is to represent the residents, has crossed the line - they apparently now see themselves as a nazi gestapo rather than a group whose intent was to maintain this subdevelopment, manage it's finances efficiently in order to enhance and maintain the quality of life for all of the residents here. They have in fact, done exactly the opposite for many of us.

  20. The communication breakdown and strong-arming came into effect approximately the year they changed the by-laws to where we could no longer rent our townhomes if we so chose. Prior to that I had been having problems with Ben Lampton - initially with sexual innuendos, inappropriate questions about my personal life, my relationships, etc... I did my best to stave off those comments politely as I could for a while. When this vote was about to take place Ben came to my home unannounced and sat down here in my dining room to discuss - twice. The first time he attempted to sugar coat his words until I mentioned that only reason I'd purchased this home was to eventually rent it out and move into a standalone home somewhere so I could have a yard, a garden, flowers, etc... He sat here for quite a while and during that conversation made attempts to pry into my personal sexual activities with my significant other of 15 years saying something to the effect I was being "wasted" on someone who didn't appreciate a beautiful woman, and that he would like to return. I declined the invitation. As Ben was in a position of authority here that placed me in a precarious position therefore I attempted to handle it as graciously as I could.

  22. Ben then returned for a second visit, again unannounced - I only recall it was in the evening after dark. During that visit he attempted to put his arms around me and also puckered his lips as to kiss me, which I rebuffed. This was when his affect turned somewhat angry and he basically told me I had to sign or vote to have the deed restriction put on these homes not to be able to rent or there would be a huge problem for me, as I was the only resident who refused to sign. He said, "We don't want "those kind of people" living here, Vicky, you know, black people and gay people" - we want to keep this a good neighborhood. But he was indeed angry and said, "You have to sign - you don't have a choice". Being tired from getting home from work, etc...and somewhat confused and angered by what transpired with Ben, I signed.

After that point there were a few times (this was when I was walking my dog over to Krogers) Ben would show up there - I was sitting in front of Krogers one day and Ben came over to me, stood right in front of me and said, "You like it, don't you Vicky" - these were the encounters I was having with him and refused to subject myself to it. From these points forward life became worse for me here - not only with Ben but the Board in general and their attorney, Mark - they even sent me a notice for a $25 when I did not bring in my garbage container in one day - this was when I'd broken my leg and my garage door was broken. I'd notified the Board of this yet they still sent me the fine - and I do believe I paid it.

All of my requests for assistance from the Board, all of my requests for items which needed to be completed, went ignored, and my quality of life here deteriorated to the point I refused to communicate with them in any way, shape or form. Yet they have resorted to nothing more than a group of gestapo Peeping Toms - I have had many occurrences where they were peering through my closed bedroom blinds - both day and night. It is beyond ridiculous - it is total insanity. This group had transformed into a vigilante of George Zimmermans attempting to squelch anyone who questioned their authority. Any suggestions for improvements made to board members were claimed as their own.

  28. That being said, I am putting the ball into your court. This is where the bad blood and breakdown of communication came in and yes, I have become jaded with the individuals who were supposed to represent us here.

  30. I also believe there is and was a gross mismanagement of our Association Dues here by the members of the Board and they have not acted in the best interests of the homeowners here.

  32. Rather than walking around buildings looking for strings hanging from trees it would behoove the board to have noticed the dead and dying trees, drainage that did and does not drain, health hazards such as standing water. environmental hazards, deteriorating buildings, roadways that were never fixed (seal coating will not be adequate) - I believe there were bond monies held for the final paving of our streets - where is that? The road's been broken up since the day I moved here. When is this board going to start paying attention to issues that affect the structural integrity and lifespan of this development.

  34. I am requesting a full, independent review of monies paid into the Association and where these monies were spent - complete with receipts, invoices, Statements, etc.... I am also requesting data on what Contractors were hired as well as what bids were submitted and how many bids were submitted as well as requests for quotes.

I am requesting copies of permits when the structural integrity was changed as a result of sectioning off these buildings after the lightning strike next to me and I am requesting documentation that all work was done in accordance with all local and State building and fire codes to ensure MY unit's safety as we were never notified these units were going to be partitioned off above the garages.

  38. I am requesting a copy of the Right-of-Way obtained by Bell South prior to installing the FIOS cable here after my home was purchased, and where this cable runs, exactly. If it runs under my home I was never notified and it was not here when I moved here.

  40. Our dues are way over and above what they should be - something is very, very wrong here at Pinnacle Gardens.

  53. Here is what I know about the situation that you are having with your neighbor:

  55. -Patty is not picking up after her dogs-but there’s plastic bags of dog waste.
  56. -At one time Patty was leaving plastic bags of dog waste- that is no longer happening since Patty has her unit for sale.
  57. -Patty use to have 2 dogs, now only has the smaller dog. Other neighbors often heard the larger dog but are now not hearing the smaller dog.
  58. -Apparently at one time there was a guy named Derrick who lived there and seemed to be a source of the problem-but he no longer lives there.
  59. -Apparently you are also doing something to annoy Patty because she is banging on the walls to get you to settle down.

  61. Patty has every right to own a dog and dogs bark. This is very subjective. What Patty calls barking occasionally, you are calling barking constantly. This is very difficult for an association to handle. If the government, through the police, is not interested in doing anything when they are called to a site, then it is almost impossible to expect the association to be able to do anything about it.

  63. We have sent a letter to Patty just to make sure she is aware that you are complaining about her. It seems apparent that both of you are doing things that annoy one another. I would be more than happy to sit down with the both of you to try to work out some kinda tolerance level you both can live with but that is the extent the board will do in this situation. No other neighbor is complaining about her. No other neighbor is hearing the dog. Most of the behavior in the emails you keep sending us, you yourself admits no longer exists.

  87. Looks like I need to report a problem we're having over here by my townhouse - 13508 Pinnacle Gardens Circle.

  89. The townhouse next-door, 13510, is currently co-occupied by a Derrick Niev along with the owner, Patricia Hannah (sp?). Please understand I personally know neither of them, however Patricia did come over here one day crying about her inability to evict Derrick from her home (I do not know the relationship nor do I care to know) - she stated he was taking her car, taking money from her car, driving drunk, etc.... and I simply advised her to contact the authorities. She also indicated he was driving a truck that's outside here without being registered or insured (it's an old maroon colored pickup). Again, I advised her to contact the appropriate authorities.

  91. Shortly thereafter my front glass storm door had been shattered at 5AM. I do not know who did it but did file a police report. It appeared as though a fist may have punched out the top pane.

  93. The problems:

  95. 1. They've got plastic bags of dog waste out front continually (two dogs - german shepard & shih-tzu). Photo attached.

  97. 2. If they do walk the dogs (which is rarely), they are not picking up their dog's waste - we have witnessed this many times. Patricia does pick it up - Derrick does not. The bags of dog waste are from inside the home which I'm guessing they apparently do pick up occasionally, but are leaving them outside.

  99. 3. The dogs bark continually inside their townhouse when they leave them home unattended. Continually. We are unable to enjoy the peace and quiet of our home here.

  101. 4. They blast loud music frequently - Johnny Cash's "I walk the line", FWIW - till late a night. But only when Derrick's truck is not here.
  102.  
  103. 5. They either do what sounds like shooting video games or watching war movies or Western shoot-em-ups all weekend long at full volume which shakes the photos on our walls. Mostly when Patricia's car is not here, so we're guessing it's Derrick.

  105. 6. If I so much as make a sound over here, Derrick bangs on my walls for 10-15 minutes, and has twice now come and repeatedly rang my doorbell and banged on my front door at 10PM. I've have asked Patricia (via email which I would be happy to forward to you) to tell Derrick to stop banging on my walls and banging on my front door. He banged on my front door two nights ago complaining about the volume on my computer, and I told him if he keeps his volume down I'd be happy to do the same - and shut the door. He sat outside the front of my townhouse for over 1/2 hour. I probably should have called the authorities however at the time I believe he was simply intoxicated and felt it was better just to ignore.

  107. I prefer not to bring the authorities into the picture, however I think it's important that Pinnacle Gardens be aware of what's been happening here lately in the event the issue escalates.

  109. Whichever of the above are in violation of our Bylaws, please issue notification to them. I would greatly appreciate it.

We can always upgrade once the residents get used to the idea.

  557. The meeting was called to order by Ben. Other Board members present included Erin, Sandy, Peggy, and Nancy. Others present were Sydney and guests, Kathy Conway and Amanda Redden.

  559. Erin gave the Treasurer’s report. She reported progress is being made on past dues. Erin will file a lien on Nelson Toney, 13514 PCG, in the amount of $600. Sandy moved to file the lien ourselves (in lieu of an attorney). It was seconded and approved.

  561. Old Business:
  562. 1. There was a malfunction of a toilet causing damages in two units, 13537 and 13539. The owners of these units, Kathy Conway and Amanda Redden were in attendance to present their situation. The night the problem occurred a call went to the emergency pager of Kentucky Realty and they responded by calling someone to come out and check the problem. A hole was cut in the wall of 13537 to determine where the water leak was originating. It was determined to be coming from 13539 but the owner was not at home and could not be reached until somewhat later.
  563. Some items reported to have occurred:
  564. A) Ben called Pinnacle Gardens insurance to inquire about possible coverage and was told to file a claim so coverage could be determined.
  565. B) The P.G. insurance adjustor on the scene told the Unit owners they did not need to file with their home owners insurance because P.G. would take care of it. Consequently neither occupant filed with their home owners insurance.
  566. C) P.G. insurance has a $2500 deductible.
  567. D) The master deed states limitations on what the insurance will cover/not cover regarding the inside of a unit.
  568. E) Tenco Services, Inc. Sent a letter and copy of all the bills. A copy was provided to all Board members and to the Unit owners. A check in the amount of $1174.61 was also sent in care of Kentucky Realty. The check has not be deposited in P. G. account.
  569. F) The occupants are requesting P. G. reimburse them the remainder (or portion thereof) of the expenses incurred.
  570. At this point Ben stepped down as President and asked Sandy, Vice President, to take over the meeting. Discussion continued. Ben moved we refuse to pay any bills for the claims at this time. Erin seconded. Discussion followed. The Board agreed the P.G. insurance company did not handle the claim inquiry and dialogue with the unit owners correctly. Question was called and the motion was approved.
  571. Ben then moved to have the meeting continue as a closed meeting in case of possible litigation in this matter. It was seconded and approved. Both unit owners and Sydney left the meeting at this point. The Board continued discussion to sort out the issues and come up with a resolution that would work for everyone. When a consensus was reached the Unit owners were asked and did return to the meeting. The results are as follows:
  572. 1) Amanda (Unit 13539) was asked to file all bills with her home owners insurance (State Farm) and she agreed to do this immediately. Erin will provide her with the needed insurance information from our Master Deed to give to State Farm. Erin also volunteered to help Amanda if she needed any other information.
  573. 2) Upon receipt of the State Farm settlement, a determination will be made regarding the balance to be paid.
  574. 3) It was the feeling of the Board that Unit 13537, Kathy, should not be out any money.
  575. 4) The check from Tenco Services, Inc. will not be cashed until the settlement from State Farm is received.

Since the home above us have now landscaped it has altered the drainage patterns even more - it does not appear drainage was taken into consideration when the Board approved these landscaping designs as some directly interfere with the swale behind my house.

Our backyards were under water. Yet the board makes inspections and would not correct this and did not see this? It could just be the ground structure and something coming up - methane, perhaps, who knows? I do not know if there is any fracking or drilling in this area. Since the day I moved here I'd attempted to get the site work plans and could not. I no longer had time nor desire to pussyfoot around with this Board that has done nothing but harass me and ignored the problems in our subdivision. I simply had to "git 'er done" to preserve my house and my privacy.

  704. Am in receipt of invoice which was so kindly left in my front door. Firstly let me say Paul did a fabulous job blasting the 1" of mold from the back of my townhouse and that was worth the price of admission alone. He is welcome back here any time.
  705. 2. Be advised there is a hot spot behind, under and in front of my home as well as those adjacent to me. Air temp yesterday was 75 degrees and the ground temp measured close to 140 degrees.
  706. 3. Be advised I have raked away the rubber coated mulch surrounding the dying tree which was infested with cabbage worms for the past four years (as is 13506) - this tree's roots are totally exposed and above ground. There is an aeration tube inserted next to the tree. I have inserted an aeration tube between the tree's main trunk in hopes of reviving it. The tree is dying and has been slowly for a number of years. I have trimmed all the branches I am able to.
  707. 4. I have been in contact with two environmental specialists to ascertain the possible causes for the subsurface heating. I suggest the board do the same as there are a number of possible causes, none of which are positive. If recall during the two water main breaks in front of my home there was an oil slick seepage - there is a problem.
  708. 5. I have placed stone around the water standpipe behind my home to prevent further erosion and degradation to the substructure. I have removed the Spanish Moss along my back windows which was placed by the landscaper as it is a known allergen. I have also filled that with sand and lined with lava stone which will permit the sand to seep down into the clay to prevent further freeze-thaw expansion which will further degrade the stability of my and Shannon's (13510) foundation movement and will divert a good portion of that drainage away from Shannon's property. The stone will allow the water a pathway to the drain and the sand will seep into the cracked clay below the stone.
  709. 6. I have filled the small catch basin behind my home w. approximately 1" of pea gravel to compensate for the standing water which has been there for years causing bacteria (Serratia Marcesens) and breeding grounds for mosquitoes. I do not pour concrete therefore this hopefully will be a viable solution to a problem that has existed since the homes have been built.
  710. 7. I have poured a 1:5% chlorine bleach mix down the above drain which will hopefully kill any further Serratia Marcesens infestation. This should not result in harm to any fauna which might come in contact with the mix. Hopefully this will be sufficient. If it is not "The Board" is free to investigate further and contact an environmentalist for a more precise remedy.

  798. We did have that water main break a couple of years ago although I'm not certain how long that ran. I'm assuming the compaction under that main was checked? If not perhaps it should be? I've also noticed a smell of what appears to be ammonium choride - I've noticed it twice and did once contact 911 about it and they indicated they did not detect any problems. I just wanted to be sure you were aware of this, FYI.

  800. 2. I was wondering if perhaps we could have something like "building captains" for each building as a contact point as we do now have kids in our subdevelopment. I do have two next to me that are home alone in the afternoons and I would feel more comfortable if they had another reliable contact as I am not always home on a consistent basis. I do know other subdevelopments have these as a rule of thumb and it would be prudent for PG to have this as well - or at least a "Safe Place" for these kids to recognize in the event they needed it.

  830. I hope all is well with you. I see that Pinnacle Gardens has been working on a Neighborhood Block Watch program (from the Board minutes), however I've not received any information about it.

  832. Last Saturday morning, approx. 5:30AM - 6:30AM, there was either an attempted robbery or vandalism in the front of my townhouse. Someone had either tried gaining entrance through the front door and smashed the top front pane of my storm door, or as the police also indicated, it could have simply been "someone mad at someone and had the wrong house".

  834. After speaking to a few other residents about it here, it was bought to my attention that a few others have had similar experiences as well - none of which I was aware of, but I was told the Board was aware them.

  836. Had the Board been aware of previous burglary/burglary attempts/vandalism or any other crimes in Pinnacle Gardens, I feel it is a great injustice that the residents are not and have not been informed.

  838. I'd heard my dog bark that morning and heard the front storm door shut, but was only awakened by the dog barking - I did not hear the glass break. I listened further and did not hear anything else and didn't think much of it, until I opened the front door later and saw what happened.

  840. Had I known there were other attempts in this subdivision, I certainly would have pursued it more vigorously at that moment, as I will now in the future.

  842. What can we do to speed up this "Neighborhood Block Watch", perhaps have a sign outside like the subdivision across the street, and keeping residents such as myself informed?
