This ECOVACS HOME Privacy Policy (hereinafter referred to as this “Policy”) explains the way we process (which includes collect, use and disclose) your personal information and the rights you have under this Policy, when you use the ECOVACS HOME App provided by us (hereinafter referred to as the “App”) to control and administer the robotic cleaning device that are connected to your App user account (hereinafter referred to as the “Device”). Being the App operator, we act as the controller of your personal information which we will obtain directly from you as the data subject. The App may contain links to external websites operated by our affiliates, third parties or us. When you click on such a link, the website will be presented in the web browser of your smart phone and the processing of your personal information will be subject to the privacy policy of the relevant website.

When you register for an App account, we will collect and store your personal information, including your email address, password and Ecovacs ID. By providing your information, you are warranting that the personal information you have provided to us are complete and accurate. To facilitate our internal processing to refer to the data related to your App account, upon the completion of your App account registration, an Ecovacs ID (which is a random character string) will be assigned to your App account. By having you bound with an App account and an Ecovacs ID, the App and we can recognize your commands and needs and to differentiate you among the other users, through which we can transmit your commands correctly to your Device, and to serve you on the basis of long-term understanding and perform the ECOVACS HOME User Agreement with you.

Your account registered with our e-shopping channel (if applicable) can also work as an App account or vice versa, we will recognize the accounts as owned by the same person if the same email address is provided for registration. To maintain and secure the performance by your Device of your commands and your Device status to be transmitted to reach your App account interface, and for your ease of review, some information sourcing from your Device needs to be transmitted through or stored at our servers. Among such information, those which may be deemed as your personal information include: (i) SSID, network layout and IP address of Wi-Fi network access status your Device refers to; (ii) model, serial number of your Device; (iii) the operational log, status data of your Device; (iv) error and upgrade history of your Device; (v) cleaning environment 2D or 3D map generated by your Device; (vi) voice recordings recorded by your Device’s microphone; and (vii) photos/videos recorded by your Device’s vision sensor or camera in the cleaning environment (if applicable).

With regards to the last item mentioned above, please note that: in case your Device is equipped with a vision sensor or camera, it will take photos/videos to recognize obstacles around and thereby decide its cleaning route during its operation. If due to technical reasons such recognition does not or is difficult to be processed by your Device, in order to solve such recognition needs and make your Device functional again, such photos/videos may be autonomously transmitted to and processed at our servers, or processed manually by our employees. For some models of the Device, you may be able to view through the App videos taken in a real-time manner and/or their records, in this case, your Device can act as a visual monitor.

(i) For all such personal information transmitted through and stored at our servers, we conduct data processing to achieve the performance of your commands, to the end of performing the ECOVACS HOME User Agreement with you. A special case is to follow your instruction to have the information on your Device to be shared with other users: you may opt through the App to have your Device to be used and controlled by one or more users jointly (the “Device Sharing”), in which situation will be the “Main Account Holder”, and other users you invite and approve to control your Device through their App interface will be “Sub Account Holders”. If you are one of the Sub Account Holders, your commands over the shared Device can be viewable by the Main Account Holder and other Sub Account Holders.

(ii) We also use some personal information, along with your Ecovacs ID, to compile analysis to spot potential market needs and common faults, and support the long-term viability and ongoing updates of our technology regarding information systems, Devices and mobile applications. Such personal information used for this purpose will be limited to your Device model, the records for commands performed by your Device, warnings and tips on your Device, your Device cleaning logs and errors, cleaning environment 2D or 3D map generated by your Device, voice recordings recorded by your Device’s microphone; and photos/videos recorded by your Device’s vision sensor or camera in the cleaning environment. If you delete voice recordings, photos or videos via the App, these photos, videos and voice recordings may continue to be held and used by us. You are entitled to request that we delete such personal information to the extent specified in this Policy.

(iii) We refer to operational logs, cleaning environment 2D or 3D map on your Device to supplement our user profiling on you, and optimize and personalize the content of the App accordingly, provided that we obtain your consent for this if required by Law. We will also customize our advertisements or third-party advertisements (displayed among the App content, by the notification pushes within the App or on the top page of your mobile device), and our direct marketing campaigns (sent to your email address as provided during the App account registration process) to suit such profiling, provided that we obtain your consent for this if required by Law. Please note that for profiling purposes, we refer to the evaluation of your tastes, preferences and consumption habits related to market surveys and statistical analysis. The processing for profiling purposes could take place with automated forms of processing.

(iv) In case your Device is equipped with a vision sensor or camera, it is able to take photos/videos, including to recognize obstacles around and thereby decide its cleaning route during its operation. Only upon your explicit request via your App, the photos/videos captured by the vision sensor or camera will be sent to your App to use the monitoring functionality of your Device. Photos/videos taken upon your request are in high resolution. They possibly involve the collection and processing of your personal information and might enable identification of individuals in the cleaning environment, depending upon what is revealed in such photos/videos. To avoid this, you can turn the camera off anytime via your App and you can delete any photos/videos taken anytime via the App. This information is necessary to provide you with the functionalities of the App upon your explicit request. Where GDPR applies, the legal basis is Art. 6 (1) b) GDPR.

This will help the App to determine the corresponding version of the ECOVACS HOME User Agreement and the ECOVACS HOME Privacy Policy for display within the App, your preference will also be added into your profiling (if any) if you register for an App account thereafter.

To enable you to pair your App account with your Device and transmit your commands continually to your Device, during the period your account is logged in, we will collect and store (i) information of the mobile device on which you install the App, including device model operating system and its version, IP address, Mac address, country and city located; (ii) SSID, network layout, status and errors of the Wi-Fi network access your mobile device refers to; (iii) your App account’s pairing status, history and errors (if any); (iv) log-in time, commands and operational log generated in the name of your App account; and (v) voice recordings made through your App account. We will also collect and store the “unification identification code” of your mobile device, i.e. its IMEI and MEID; the use will be limited to referring to your historical data collected or generated on the specific mobile device, and to recognize if your App account has been logged in a strange mobile device which may implies an App account theft.

We undertake to maintain information safety to the level as specified by the Law, to protect your information from being improperly disclosed, destroyed, misused, or lost. We commit to take (or have taken) all reasonable measures to our best ability to safeguard the protection of the personal information through technical safety measures such as Secure Socket Layer (SSL) encryption access and an appropriate safety policy for our employees. We also communicate our privacy and security guidelines to our employees and strictly enforce privacy safeguards within our group. We have further established internal mechanisms to permit and approve the access to your personal information, and also select the trustful and qualified third-party providers of cloud facility for the storage of such data.

Please understand that due to limitation of technologies or potential malicious attacks, personal information safety accidents may unfortunately occur due to factors beyond our control. If it is impossible or difficult for us to contact every affected user individually, we will publish notifications in a reasonable and effective manner. We will also report the result of personal information safety accident to regulatory departments if required.

Since we provide products or services based on our resources and servers worldwide, your personal information might be transmitted to a jurisdiction or accessed from a jurisdiction outside of where you are located. Such destination jurisdictions are likely to include, (i) the jurisdiction where your personal information is stored (if it is the same as where you locate, the cross-border transfer does not apply); (ii) China, where our registered office, our affiliates which are involved in ECOVACS HOME products and services and most of our service providers, are located, and when our employees need to have access to your personal information for handling your issues and also conducting general analysis; (iii) the storage location of some other service providers which serve you on behalf of us through their Api/Sdk integrated into the App, mostly at your located jurisdictions, or at the jurisdiction where their relevant branch resides to peculiarly serve your located jurisdiction (U.S. in Zendesk case); and (iv) some other jurisdictions from where your App account was once logged in, provided that the data storage location for such jurisdictions differs from your domicile country. In particular, if you send to [email protected] an email, your personal information contained in such email and its delivery will directly enter China, where our email-box server is located. All such international transfers are made in connection by and between the relevant servers housed in third-party cloud facilities and physically located in such jurisdictions, and we will prompt third-party cloud suppliers to adopt appropriate safeguards in compliance with the Law. See also the Annex which specifies the countries in which the listed third parties are likely to be located, to the extent it is practicable to specify this.
