  2. ⚠️ A Word on Open3DLab, SmutBase & 3D Asset Licensing
  3. ═══════════════════════════════════════════════════════════════

  5. *for anyone wanting to use assets or get started in 3D*

  9. 🧰 How I Handle Assets
  10. ───────────────────────────────────────────────────────────────
  11.
  12. I do use assets from online sources, but the legwork is frontloaded. I make sure
  13. everything I grab is either Royalty Free or CC0, and any Blender addons I use are
  14. GPL, MIT, or Royalty Free.
  15.
  16. That way I don't need to maintain spreadsheets full of attribution tables,
  17. especially given the size of my Blender Asset Browser.
  18.
  19. Simply put: I avoid any CC licenses (CC-BY, CC-BY-NC, CC-BY-ND, etc.) entirely,
  20. as they're too restrictive to use without constant worry.
  21.

  24. 🚩 The Problem with Open3DLab & SmutBase
  25. ───────────────────────────────────────────────────────────────
  26.
  27. These communities take ZERO CARE when it comes to proper attribution or licensing.
  28. That's exactly why I avoid them like the plague.
  29.
  30. To make matters worse, even though each asset page has a "License" section, there's
  31. no way to filter or search by license on the site. So if you wanted to only browse
  32. CC0 or GPL assets, tough luck. You'd have to check every single page manually.
  33.
  34. The time spent double-checking just isn't worth it, and here's the kicker: they
  35. often entirely misattribute their assets. They treat porting someone else's model
  36. as equivalent to having made the original, then slap on a CC-BY (or worse, ND/NC)
  37. license demanding *they* be credited... while not even linking to the original source.
  38.
  39. Example:
  40. I once went down a rabbit hole trying to track down a DAZ3D model in the
  41. official shop, only to confirm that some guy on Open3DLab had ported it
  42. without ever linking the original. And technically, you need to *own* the
  43. original to be allowed to use a port.

  47. 🔍 Case Study: The Fluid Painter NSFW Extension

  51.
  52. Fluid Painter is a GPL-licensed addon sold on Superhive (formerly Blender Market).
  53. Under the GPL, any derivative that contains even a few lines of the original code
  54. is automatically subject to the same license.
  55.
  56. Here's the irony: the NSFW extension was made by the same creator, yet they
  57. licensed it under CC-BY instead of GPL. Whether this was an oversight or
  58. intentional, it doesn't matter. Since the extension is a derivative of their own
  59. GPL-licensed code, the GPL still applies. You do NOT need to adhere to the CC-BY
  60. license. It's legally invalid.
  61.

  64. 🔍 Case Study: DAZ3D "Barn Garage" Takedown
  65. ───────────────────────────────────────────────────────────────
  66.
  67. Original DAZ3D Shop listing:

  70. Open3DLab posting (now taken down):

  72.
  73. I reported this conversion to DAZ3D directly. A sales representative confirmed
  74. that none of the DAZ licenses allow redistribution of converted models. They
  75. reported the listing I flagged along with a selection of others.
  76.
  77. The result: the Open3DLab page now shows a takedown notice, stating the content
  78. was deleted through the Notice and Take Down (NTD) procedure in compliance with
  79. the DMCA.
  80.
  81. This is proof that reporting works. These aren't untouchable uploads. If the
  82. original rights holder is made aware, they can and will act.
  83.
  84.
  85. ───────────────────────────────────────────────────────────────
  86. 📌 Where I Stand Going Forward
  87. ───────────────────────────────────────────────────────────────
  88.
  89. I have come to a decision. Henceforth, I will NOT collaborate with artists or
  90. interact with people that knowingly use Scenes and Rips obtained via Open3DLab.
  91.
  92. Keep in mind, O3DL does contain actual fully featured and truly publicly accessible
  93. stuff. As in actual free 3D models, without legal concern.
  94.
  95. I am drawing this line in the sand to preemptively distance myself from people that
  96. misattribute using video game rips not for the sake of homage, but easy work and
  97. easy money. In that same vein, I am distancing myself from people that just use it
  98. to skip any form of effort.
  99.
  100. If you have even the slightest amount of skill or passion, you can make great
  101. scenes from just free assets, no payment even necessary.
  102.
  103. I have reported and at least gotten one DAZ3D Conversion taken down from the site.
  104. I encourage you to do the same. We are not talking about cracking the newest gaming
  105. release of a multibillion dollar corporation here. These people take away the small
  106. amount of money that freelancers in the 3D space would have ever made. And
  107. sometimes, they profit from it themselves.
  108.
  109.
  110. ───────────────────────────────────────────────────────────────
  111. 📝 TL;DR
  112. ───────────────────────────────────────────────────────────────
  113.
  114. Take licenses seriously. Actually vet your stuff BEFORE you download it, so you
  115. don't have to worry about it later.
  116.
  117. People assume that sharing and being generous somehow absolves them of licensing
  118. responsibilities. It doesn't. It's always on YOU to make sure you're not
  119. downloading something that was made available illegally.
  120.
  121. (And yes, sharing GPL-licensed products with friends or even republishing them is
  122. legally fine. You're just morally questionable if you go beyond sending it to a
  123. friend and essentially re-release someone's paid work for free.)
