  25. We the People of Blue Sky Waiting, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the Republic of Blue Sky Waiting.

  31. [1.0] RATIFICATION
  32. This Constitution shall be submitted to public debate in a forum within B.S.W., whereupon it will be discussed amongst all citizens equally and clauses shall be debated and re-written as necessary. At any point in time, the Drafter of the Constitution may submit the current draft to a public vote. The draft must pass amongst the people with a two-thirds majority in order to be ratified; anything less shall cause it to be reconsidered until submitted later. Explicit abstentions do not count towards the total. Once the Constitution is in effect, elections will be held and the Junta will relinquish authority. The Constitution may later be amended through Clause 6.

  38. [2.0] THE GOVERNMENT
  39. The Governing Apparatus shall consist of a President and a Vice President, each of which are also citizens. All citizens, regardless of administrative capacity, receive precisely one vote in all elections & referendums.
  40. [2.1] ADMINISTRATIVE RESPONSIBILITIES
  41. The President of the Republic shall also hold the responsibilities of Administrator of the server, and have the rights to manage the server, manage roles, manage channels, manage messages, kick & ban members, add new members, & sundry other capabilities. This Constitution does not grant the President the authority to disband the server. The Vice President of the Republic shall also hold the responsibilities of Moderator of the server, and have the rights to manage channels, manage messages, kick members, add members, & sundry other responsibilities.
  42. [2.2] CIVIC RESPONSIBILITIES & GOVERNMENTAL BRANCHES
  43. Within the Republic, the President and the Vice President have the same civic responsibilities and authorities. Each has the ability to review & approve petitions, announce referendums, track votes, and enforce the results of democratic legislation. The President & the Vice President are thus the executive branch of the government, but retain the legislative authority to approve petitions. The Citizenry is the legislative branch of the government and has the power to propose petitions, invoke referendums, ban players, and extend & reduce the franchise. The failure to execute legislation properly and in an expedient manner is unlawful & possibly tyranny [3.3].

  49. [3.0] THE DEMOCRATIC PROCESS
  50. Within the Republic, each Citizen has one vote that they may cast during elections & referendums.
  51. [3.1] ELECTIONS
  52. Elections for Presidency and Vice-Presidency are to be held every 6 months, on January 1st and July 1st. The first elected administration will serve a partial term, as will any administrations that fill a power gap or who otherwise come in to power later than the normal election time. There is no limit to the number of terms that may be served. To run for office, a citizen must have a running-mate. In the eventuality that a Party of a citizen and their running-mate are elected, then the citizen shall assume the role of President and the running-mate shall assume the role of Vice President. No citizen may run with more than one Party during any one election. The voting period shall begin at 12:01 a.m. on the First of the month and conclude 7 days later.
  53. [3.2] POWER TRANSFERAL
  54. The standing President shall freely relinquish authority and their role to the newly elected President. The same shall be done for the Vice President.
  55. [3.3] IN THE EVENT OF TYRANNY
  56. In the event that a President becomes tyrannous, as determined by consensus of the people, a referendum may be held without the approval of the President or Vice President. If a one-half majority consensus accuses the President, Vice President, or current administration of tyranny, the Constitution dictates they should immediately abdicate and emergency elections should be held, where any abdicating individuals may not stand for reelection. However, conditions may occur where the administration refuses to abdicate. Because of the arbitrary power granted by the Administrator role, no recourse on the server may be found. However, citizens of B.S.W. have an arbitrary capacity to relocate. The citizenry of B.S.W. may secede to form a new server, in which case the following happens: (1) The founder of the new server becomes the General of the Junta of B.S.W. (2) The tyrant or tyrants may be reinvited to the new territory, but they may never again stand for any election in any Republic or Junta of B.S.W. (3) The General will hold new elections, in accordance to a normal election procedure as delineated in this Constitution, as soon as all willing citizens are regathered in the Junta. (4) The Junta shall become the Nth+1 Republic of Blue Sky Waiting, where N is the number of the current republic.

  62. [4.0] CIVIC PARTICIPATION
  63. Citizens have the ability to petition for new legislation, actions by the administration, banning or kicking members, or sundry other actions as performable by the administration. Upon approval, the petition may become a referendum.
  64. [4.1] PETITIONS
  65. Petitions require two signatories to be reviewed by the President or the Vice President, which then can choose to approve or veto the petition. If a member of the administration wishes to call for a petition and establish a referendum, he has no more rights than a citizen, and cannot approve his own petition. The other member of the administration must approve the petition. Petitions are gathered informally between the Citizens of the Republic, and once 2 signatories are gathered they present it to the Administration. A referendum must be announced by either member of the Administration within 72 hours of petition approval.
  66. [4.2] REFERENDUMS
  67. Upon being approved and announced, a Petition becomes a Referendum. When voting on referendums, each citizen gets one vote. A referendum may pass with a 1/2 or more majority vote. Explicit abstentions do not count towards the total. The period of voting for a referendum is 7 days after the petition is announced by the administration. Absences are counted neither for nor against the total; if on a server of 7, three people vote yes and one person votes no, then the referendum is considered to have passed with a 75% majority. A referendum comes into effect immediately after a successful vote and it is the Administration's responsibility to execute the legislation and duly record the bureaucracy of the server.
  68. [4.3] EXILE

If a citizen causes enough problems that the rest of the populace wishes to either reduce the franchise or ban the person altogether, the people may petition for a referendum to either ban the individual in question or simply reducing the franchise, causing the removal of their Citizen role. The process for either procedure is as Extending the Franchise (5.0).

  75. [5.0] Extending the Franchise
  76. This is a special, more restrictive case of the Petition/Referendum process. When a new member joins the server, they receive an Immigrant role. Immigrants may not vote in either elections nor referendums, nor may they propose or second a petition, nor may they run for office or otherwise participate in the civic government of the server. For an Immigrant to become a Citizen, the following must occur: (1) The Immigrant must express willing interest to join the citizenry; (2) The petition for citizenship must be seconded by a citizen; (3) the petition must be reviewed and approved by either the President or the Vice President; (4) A referendum must occur where the Immigrant's citizenship petition receives a 2/3 majority vote to join the server. Explicit abstentions do not count towards the total. Even upon a successful referendum, either administrative member may veto the application.

  82. [6.0] Amending the Constitution
  83. This is a special, more restrictive case of the Petition/Referendum process. If the citizens of the server wish to modify the Constitution, a petition with 3 signatories must be submitted for review and approval to the Administration. Upon approval, a referendum is held where an 80% majority vote must be in favour of for the amendment to pass. Explicit abstentions do not count towards the total. Even upon a successful referendum, either administrative member may veto the amendment. Once an amendment is passed, it immediately enters into effect.
