  8. Using credit to buy your phone or tablet - explanatory information
  9. 1. What is the credit-sale agreement for?
  10. This agreement allows you to buy your new phone or tablet from Tesco Mobile Limited using the credit described below.

  12. 2. Your total amount of credit and your monthly payments
  13. Your total amount of credit is £1124.70. If you are a new Pay monthly customer, we will take your first payment of £37.49 today and you'll repay the rest by monthly Direct Debit payments of £37.49 each month for 29 months. If you are an existing Pay monthly customer, you'll repay the credit using your registered payment method to make payments of £37.49 each month for 30 months; however, we recommend that you make your payments by Direct Debit to avoid charges you may incur from your payment card provider. This credit-sale agreement is 0% APR.

  15. 3. Is this credit-sale agreement right for you?
  16. You can see from point 2 above that this is a fixed period credit-sale agreement, where you'll be making fixed payments over a set period of time. You can, however, always pay early without any additional charges.

  20. 4. What happens if you don't make the payments?
  21. If you don't make the payments in accordance with the credit-sale agreement, there may be serious consequences. For example, you could be sued for the debt (and the costs of suing you) and your credit reference file could be affected negatively. These things are likely to make it harder for you to obtain credit in general in the future.

  23. 5. Your right to withdraw from the credit-sale agreement
  24. You have the right to withdraw from the credit-sale agreement without giving any reason before the end of 14 days beginning with the day after the day on which the agreement is made, or, if later, the day after the day on which you receive a copy of the executed agreement. This is a right you have under the Consumer Credit Act. If you do withdraw in this way, you must repay to us the total amount of credit without delay and within 30 calendar days beginning the day after the notice to withdraw if given by you to us.

  26. 6. Tesco Mobile Pay monthly Service Agreement
  27. As well as entering into a credit-sale agreement, you will enter into a Tesco Mobile Pay monthly Service Agreement on or before the date of the credit-sale agreement. You must make a monthly payment under the Tesco Mobile Pay monthly Service Agreement in addition to the monthly repayments for the phone or tablet you buy from us.

  29. 7. Your Right to cancel the agreement and return the phone
  30. As well as your right to withdraw from the credit-sale agreement under the Consumer Credit Act (see above), we give you a right to cancel the agreement for up to 14 working days after the day you receive your phone or tablet. To do this, you must tell us that you want to cancel and you must then return the phone or tablet to us in the same condition in which you received it in its original and undamaged packaging with all of its components and any accessories. If you buy the phone or tablet from our Phoneshop then you should go back there if you decide to cancel. If you buy it Online or through Telesales then you should phone 0345 301 4455.

  32. 8. Pre-Contract Credit Information
  33. In addition to this explanatory information, you will be provided with a Pre-Contract Credit Information document known as Standard European Consumer Credit Information. This document contains detailed information about the credit-sale agreement including the amount you will have to repay. If you are buying the phone or tablet from a Phoneshop, you can ask to be given a print of the Pre-Contract Credit Information (which you can take away) or ask for it to be emailed to you, or both. If you are buying the phone or tablet Online or through Telesales, you can click on the button to have a copy emailed to you.

  82. 4 Other important legal aspects

  149. You are entitled, under Section 77B of the Consumer Credit Act 1974 ("the Act"), to receive a statement of account in the form of a table on request and free of charge at any time during the period of this agreement. This will show the details of each instalment owing under this agreement, the date on which each instalment is due, the amount and any conditions relating to its payment and a breakdown of each instalment showing how much comprises capital, interest and any other charges.
  150. Right of withdrawal
  151. Under Section 66A of the Act you have the right to withdraw from this agreement without giving any reason before the end of 14 days beginning with the day after the day on which the agreement is made, or, if later, the day after the day on which you receive a copy of the executed agreement.
  152. If you withdraw, you must repay to us the Amount of credit without delay and within 30 calendar days beginning the day after the notice to withdraw is given by you to us.

  158. You are entitled, under Section 94 of the Act, to repay what you owe us under this credit-sale agreement early, in whole or in part. You can do this by calling us on 0345 301 4455, or 4455 from your Tesco Mobile phone, and making payment using a debit card.

  160. If you are not a business customer, you have the right to complain to the Financial Ombudsman Service. You can contact the Financial Ombudsman Service by post at the Financial Ombudsman Service, Exchange Tower, London E14 9SR, by telephone on 0800 023 4567 or by email to complaint.info@financial-ombudsman.org.uk. If you are a business customer then you may have a right to complain to the Financial Ombudsman Service. Please contact us if you are in any doubt as to your rights.

  163. Electronic communications
  164. Except where the law otherwise requires, you agree that we may communicate with you and send you documents to your email address and via an online electronic system, which can be accessed by you online using the password and instructions provided to you by us.

  166. New Pay monthly customers - payments by direct debit
  167. Existing Pay monthly customers - payments by your registered payment method. However, we recommend that you make your payments by Direct Debit to avoid charges you may incur from your payment card provider.
  168. CREDIT-SALE AGREEMENT - TERMS AND CONDITIONS
  169. 1 Sale of the Goods
  170. We agree to sell to you, and you agree to purchase, the Device(s) on the credit terms and conditions set out above and below.

  177. Pay the Repayments to us by Direct Debit or if you are an existing customer by way of your registered payment method, promptly by their due date. Prompt payment is essential.

  179. 2.2 Tesco Mobile Pay monthly Service Agreement

  181. Enter into a Tesco Mobile Pay monthly Service Agreement on or before the date of this credit-sale agreement in relation to the Device(s).

  183. 2.3 Change of your details; electronic communications

  185. Notify us within 7 days of any change of your address or of your name, or your email address or bank details. You must keep your unique security key to the online electronic system to access and print your consumer credit-sale agreement secure. You also agree to tell us promptly if you suspect or become aware that your unique security key for the online electronic system has been lost or become known to anyone else.

  187. 3 Implied Terms
  188. We sell the Device(s) subject to the terms implied by the Consumer Rights Act 2015, including section 17 (relating to our title to the Device(s)), section 11 (relating to sale by description), sections 9 and 10 (relating to implied terms as to quality or fitness) and section 13 (relating to sale by sample). These terms and conditions do not affect or exclude any other terms implied by law.

  190. 4 Early repayment and variation
  191. You may repay the Amount of credit early, in whole or in part, at any time. If you repay early in part we will reduce the period of the credit-sale agreement to accord with the remaining Repayments and give you notice of the variation in writing.

  193. 5 Your right to end this credit-sale agreement
  194. In addition to your rights under clause 3, you may repay and end this credit-sale agreement at any time by giving us at least 30 days notice in writing and making payment of the amount applicable under clause 7.

  196. 6 Our right to end this credit-sale agreement

We may end this credit-sale agreement, if you break clause 2.1 or persistently break clause 2.3 of this credit-sale agreement, by giving you the required statutory notice in writing, including an opportunity to remedy any breach capable of remedy, and requiring you to make payment of the amount applicable under clause 7.

  199. 7 Your responsibility to us on termination
  200. If you or we end this credit-sale agreement, you must pay us the outstanding balance of the Amount of credit plus any other sums which may have become due by you to us under this credit-sale agreement.

  202. 8 General
  203. 8.1 We may transfer our rights and obligations under this credit-sale agreement provided that this does not adversely affect your rights. You may not transfer your rights or obligations under this credit-sale agreement.

  205. 8.2 If any term in this credit-sale agreement shall not be enforceable, it will not affect the enforceability of the other terms.

  207. 9 Interpretation
  208. 9.1 In these Terms and Conditions:

  210. (a) Clause headings are for ease of reference only and shall not affect the interpretation of any provision.

  212. (b) "Devices", "Repayments" and "Amount of credit" shall have the meanings given to them above.

  214. 9.2 In this credit-sale agreement, words in the singular shall include the plural number and the reverse.

  216. 10 Sharing your information
  217. 10.1 General

  219. We may use and share your information, information relating to your performance under this credit-sale agreement and other information about you available to us to identify you and consider your application for credit, to help us make informed business decisions, and to inform you about Tesco Group products and services.

  221. 10.2 Credit Reference Agencies

  223. We will first search our own records, and if necessary the records at credit reference agencies who will supply us with credit information, as well as information from the Electoral Register, about you. We will also add to your record with the credit reference agency details of your credit-sale agreement with us, the payments you make under it and any default or failure to keep to its terms. We may use credit scoring or other automated decision-making systems when assessing your application and to verify your identity. Credit searches and other information which is provided to us and/or the credit reference agencies, about you and those with whom you are linked financially may be used by us and other companies if credit decisions are made about you, or other members of your household. This information may also be used for debt tracing and the prevention of money laundering as well as the management of your account. Information held about you by the credit reference agencies may already be linked to records relating to one or more of your partners and you may be treated as financially linked, which means your application will be assessed with reference to any associated records.

  225. 10.3 Fraud Prevention Agencies

  227. If false or inaccurate information is provided and fraud is identified or suspected, details may be passed to fraud prevention agencies. Law enforcement agencies may access and use this information. We and other organisations may also access and use this information to prevent fraud and money laundering, for example, when: checking applications for, and managing credit and credit related or other facilities; recovering debt; checking insurance proposals and claims; checking details of job applicants and employees. We and other organisations may access and use from other countries the information recorded by fraud prevention agencies.

  243. We may pass your information to other members of the Tesco Group. We will never pass your information to anyone else, except where we have your permission, where we are required or permitted to do so by law, to other companies who provide a service to us and any successors in title to our business. Your information will never be released to companies outside the Tesco Group for their marketing purposes.

  249. 11 Complaints about your credit-sale agreement
  250. 11.1 If you have a complaint about your credit-sale agreement, please contact Customer Care on 0345 301 4455 or 4455 from your Tesco Mobile phone. If you are still not happy, please ask to speak to a manager. If you would like to write to us with your complaint, please write to Tesco Mobile Limited, Dumers Lane, Radcliffe, Bury BL9 9QL.

  252. 11.2 If you remain unhappy or you think that we haven't dealt with your complaint satisfactorily within 8 weeks, you can refer your complaint to the following external regulatory body: Financial Ombudsman Service (FOS), telephone 08000 234 567 or www.financialombudsman.org.uk.

  254. 11.3 This credit-sale agreement is subject to and will be interpreted in accordance with English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.

  256. By signing, you will be legally bound by the Credit-sale Agreement and its Terms and Conditions.
