  8. I would like to point out that at no point did I tell anyone I was hitting them off, the beginning part was a joke that when people say "I'm going to send you packets" it really can't be considered a threat since the person didn't claim they would overburden their router with packets, rather they simply said they would send some. The rest refering to DDos was simply responding to the statement blade made which was that he had 4 connections, to which I said 4 isn't a huge challenge. At no point in this did I threaten or imply that I would actually take any action against blade. While I realize this may be something that could easily be confused with DDos threats I assure you that I have not threatened any users with DDos over an OCN service. I would however make sure to avoid situations that could be confused as such in the future, were I to be appealed.
  9. Thanks for the quick response.

  12. My joke was not a joke threatening blade as well, it was a joke pointing out that unless someone specifically said they were to overburden the other person's router intentionally, it couldn't be considered a DDos threat. I'm sorry that this misunderstanding happened and would I would like to apologize for the confusion it caused. Please evaluate the meaning of my words at surface context rather than looking for a subtext that doesn't exist. Thanks regardless. (to Brott and the other staff viewing this)

  15. It's clear this is DDoS threats, this is not allowed or legal.
  16. MidnightBeth
  17. MidnightBeth commented 2 months ago
  18. I'm sorry but how is this ddos threats?
  19. The first msg is a joke, it points out how people oversimplify the meaning of "im sending you packets".
  20. Then I say last chance because it was blade's last chance to tell me the code I wanted until I got it from someone else, which I did. (I now have the code)
  21. Finally blade said he has 4 internet connections, to which I pointed out that 4 internet connections isn't a very difficult challenge should I have wanted him hit offline. This was followed by a confirmation message to twix that he also would not give me the code.
  22. At no point did I threaten blade or twix and neither of them has been hit offline, keylogged, doxed or anything else that can be considered malicious. I didn't threaten them, they just took it as a threat. As I said its my fault for leaving the gray area where this could have been mistaken for a DDos threat and I will avoid doing so in the future; however this is clearly not a DDos threat when closely examined, so I would appreciate this being appealed, sorry to cause this issue in the first place.
  23. Thanks for the quick response and your time spent replying to and reading this

  26. Sure it might be a joke, but a thread none the less. Even the most malicious user could make a DDoS joke, and it seems like that's what they do, too, to scare.
  27.
  28. We take this very seriously, this is never allowed, even as a joke.
  29. MidnightBeth
  30. MidnightBeth commented 2 months ago
  31. But ALL modern commonly used networks use network packets and my joke clearly identifies itself as a joke by making light of the fact that "I'm sending you packets" really only implies that the person has connection over the internet with that person, and therefore couldn't actually be considered a threat unless taken at level which the observer assumed that there are implications of a threat which were not actually present in the text...
  32. MidnightBeth
  33. MidnightBeth commented 2 months ago
  34. Therefore the joke should be identified not as a threatening to DDos joke but rather as a joke at how people threaten to DDos by pointing out the flaw in their statement.

  37. When am I allowed to re-appeal this btw?

  40. and thanks for your time again. Ik that responding to a closed appeal is going the extra mile for the player and I appreciate you continuing communication on my punishment.
  41. Brottweiler
  42. Brottweiler commented 2 months ago
  43. Yeah you can escalate it.
  44. MidnightBeth
  45. MidnightBeth commented 2 months ago
  46. I don't really have an issue with you or feel that there is a bias against me (I just believe it is a misunderstanding of the joke). Isn't escalation only used in a case such as that? I'm going to escalate for now but as I mentioned I don't feel that there is a bias or issue with the handling of the appeal at this point of time.

  49. Hey, no new problems. Just need whoever deals with the appeal next to read over everything.
  50. Brottweiler
  51. Brottweiler commented 2 months ago
  52. You escalate if you want to bring it to a "higher power", if you are unhappy with my decision you can escalate it further. In this case, another admin would handle the appeal.
  53. MidnightBeth
  54. MidnightBeth commented 2 months ago
  55. Ok, thanks. Is there one escalation per appeal? Also, if I am denied by the second admin as well, is my appeal permanently denied? and can I re-appeal at a later date? Thanks again.
  56. Brottweiler
  57. Brottweiler commented 2 months ago
  58. Normally mods punish players, and it can get escalated to a higher staff; admin.
  59. When admin punishes, another admin handles escalation.
  60.
  61. Admin is the highest so you don't get past that, but yeah, you can bump the appeal after a while and ask for a "new chance" which basically just goes for bans.

  70. I would also like it noted that me and blade are actually friends and this is the comment from our conversation on skype. Idk if his opinion matters in this but, I figured it's better to include it.

  74. I'm sorry, but this seems pretty clear to me. I understand that it may have been a joke, but this kind of joke is something we cannot tolerate under any circumstances.

  77. How soon can I bump this appeal asking for it to be re-considered?
  78. MidnightBeth
  79. MidnightBeth commented 2 months ago
  80. Also, the focus of the responses seem to be to tell me that despite it being a joke it's bannable; my point is that while I understand that jokingly threatening DDos is not allowed, I was merely making a joke about how people threaten to DDos others, "Im going to send you packets", when packets aren't directley equivalent to a DDos threat. This validates it as a joke directed at how people threaten to DDos and is unrelated to the actual action of DDosing.
  81. MidnightBeth
  82. MidnightBeth commented 2 months ago
  83. In this case the rule seems very sweeping with any joke relating to DDos without actually having merit as a threat being enforced as a DDos threat and therefore a violation of the rules.

  86. Hey, just bumping to get an answer for my question. No rush, just didn't want this to get lost under a lot of appeals.

  119. I don't really have much new information to add other than the already stated points. Since it is a rather long discussion I will summarize my reasons for appealing briefly.|
  120. -The person I supposedly threatened believes that the ban is false and that it was not intended as a threat, there is evidence he holds these perspectives in the appeal.
  121. -The admin was not there at the time and was unable to fully grasp the mood and meaning of the conversation and statement due to this.
  122. -The person I supposedly threatened never was DDos'd by me or anyone following my instructions.
  123. -I have permission from the owner of the team who I supposedly demanded to receive the token of to be in that channel and was also accepted into the team once I am un-banned.
  124. -I am a valuable and contributing member of the community who dearly misses being able to play on the server.
  125. -The wording of the supposed threat clearly defines itself not only a joke but a non-threat as I define my sending packets as "the exchange of information on the internet.
  126. -I am sorry for the confusion and issues my joke caused and have promised to avoid such jokes in the future.
  127.
  128. If at all possible I would like to set up a meeting with an admin or multiple regarding the punishment and my appeal on mumble, a TS or over Skype as I believe verbal communication to be the best way of explaining the situation and finding a decision that satisfies both parties.
  129.
  130. Thanks ahead of time for what I am sure will be a speedy and efficient response to my appeal. <3

  139. Sorry for the wait, after looking through the appeal and evidence I have decided that what you have done does not seem to warrant a permanent ban. I have set the punishment to expire in one month which gives you a total of three months of being banned. That should be enough time for you to learn your lesson.
  140.
  141. Do not threat to DDoS users, whether you are joking or not.
