- Adoptive parents file lawsuit against agency

- A Clark County couple have filed a wrongful adoption lawsuit against Catholic Charities of Southern Nevada, claiming the agency failed to disclose relevant information when they adopted their son in 1985.
- The couple filed the complaint May 7 in District Court against the organization, which was known as the Nevada Catholic Welfare Bureau Inc. at the time of the adoption. The Nevada Supreme Court heard arguments in a similar case last week.
- The lawsuit says the agency told adoptive parents that children would not come from families with "histories of substance abuse and other dysfunctional background."
- The document says the boy was born Dec. 18, 1984, and placed in the couple's home later that month. The couple adopted him about six months later, the complaint said.
- According to the lawsuit, the boy displayed developmental problems throughout his life and was diagnosed in May 1994 with "fetal alcohol syndrome/fetal alcohol effect."
- The lawsuit claims the couple asked during the adoption process if the boy's family had any history of substance abuse or any other problems that might affect him. According to the complaint, the defendant's agents denied that the family had any history of substance abuse or other "unusual circumstances."
- The couple later learned the boy's biological mother had "smoked three and a half packs of cigarettes a day, drank whiskey or tequila daily and took `speed' during the first trimester of her pregnancy," the complaint said.
- Kathryn Haisan, spokeswoman for Catholic Charities of Southern Nevada, said the agency had not been served with the lawsuit as of Monday. She said she would not comment on the allegations until she had a chance to review the complaint.
- The lawsuit claims the agency "had a duty to advise the plaintiffs of any medical or social history of the biological parents which may affect the child."
- According to the complaint, the couple would not have proceeded with the adoption if they had known about the biological mother's use of alcohol and drugs during her pregnancy.
- The lawsuit claims the agency "intentionally failed to disclose the relevant medical and social history of the adoptive child and biological mother in an attempt to induce the plaintiffs to become adoptive parents."
- The complaint seeks unspecified compensatory damages for past and future medical expenses, as well as unspecified damages for emotional suffering.
- In the unrelated case heard last week by the Supreme Court, a Las Vegas couple are pursing litigation against the state Welfare Division because they claim officials failed to tell them their child's biological parents were schizophrenic. The adoptive child also is schizophrenic.
