- Know your COVID-19 testing rights
- Under the Healthcare Testing Accountability Order issued on September 16, 2020, which will go into effect September 25, 2020, your healthcare provider is legally required to provide you with a COVID-19 test if:
- You are experiencing COVID-19 symptoms
- You have been exposed to someone who a confirmed case of COVID-19;
- You were referred by Santa Clara County’s Public Health Department to your provider for COVID-19 testing; or
- You are an “Essential Worker”
- Additionally,
- Your healthcare provider cannot hassle you about eligibility for a COVID-19 test. Specifically, they cannot ask you to provide proof of eligibility to get tested.
- Your healthcare provider cannot delay testing you.
- If you have symptoms, were exposed to a confirmed case of COVID-19, or were referred for testing by the County Public Health Department, your provider must test you within the next day when you request a test.
- If you’re an essential worker, your provider must test you within 3 business days of the time you requested a test
- Be sure to visit sccgov.org/coronavirus for more details.
- Also, your healthcare provider must provide your test results to you within three calendar days of the test.
- Your healthcare provider should not charge you directly for COVID-19 testing. Your insurance may be charged but you will not be.
- If you are having difficulty obtaining a COVID-19 test through your healthcare provider, you can report your concern at www.scccovidconcerns.org by clicking on the box titled “Report a Concern About a Business, School, or Healthcare Provider.”
