  5. This “Summary of Contract” is a simplified explanation of the important clauses for understanding the content of the insurance. Please ensure to read this for confirming and understanding the content, and refer “General Insurance Terms and Conditions” when you apply for the insurance. Also, please store this stipulation together with the insurance policy certificate in a safe place. If you have any questions, please do not hesitate to contact us.

  11. I. Features of our plan
  12. Our insurance plan is for non-Japanese visiting or residing in Japan which covers emergency costs for in case of death or grave, critical health condition due to illness or injury within Japan. Upon death, in critical condition or disappearance, the company will pay the coverage for travel and accommodation costs for family members (or representatives) to come here to Japan, expenses to bring the deceased to his/her home country and other post-death extra expenses.

  14. II. Coverage
  15. The summary of major payable benefits is as follows. Please confirm the details in the General Insurance Terms and Conditions.
  16. (1) Payable Benefits
  17. Emergency Plan
  18. Benefits will be paid when the insured person dies, or is in grave, critical health condition caused by unforeseen accidents or sudden illnesses occurring inside Japan, duly acknowledged by a medical institution in Japan; or if the insured person is declared missing by the police and other search and rescue authorities caused by disasters in a ship or aircraft (within Japan) in which the insured person was on board.
  19. The costs of travel and accommodation of up to two family members (or their representatives) to come to Japan and expenses incurred to bring the deceased to his/her home country, and to dispose things left behind by the deceased will be covered.
  20. In case of death, a priority amount of 200,000 yen will be paid to cover extra expenses.
  21. (2) Unpayable Benefits
  22. As for unpayable benefits, please refer clause V. in “Information Calling for Attention”.

  24. III. Insurance Claim Procedures
  25. 1. The insurance policyholder, insured or beneficiary shall fill out necessary information on the designated VIVA VIDA Co., Ltd. benefit claim form, and submit the form accompanied by one medical diagnosis report from a licensed physician, receipt of payment to medical institution (for medical coverage only, original receipts only are acceptable) and passport copy (ID and VISA page) as soon as possible.
  26. 2. In case the claim is reimbursable, we make payment within 30 working days from the date all the necessary documentation is obtained.
  27. 3. Unpaid premiums are subject to claim by VIVA VIDA Co., Ltd. upon benefit reimbursement.

  29. IV. Inception Date
  30. (1) New insurance policy applications
  31. When the company sent an approval notice of application, and the effective date is not designated, inception shall start at midnight of the day following that on which VIVA VIDA Co., Ltd. received premium payment. Exclusion period for non-reimbursement of Life insurance/Common death and Medical Benefits is 7 days. Medical payment reimbursement and life insurance benefit for death caused by chronic conditions etc. described in Appendix 3 of General Insurance Terms and Conditions are not eligible for benefit reimbursement within 120 days from the inception of the new insurance policy. In short-term policy, all the medical payment reimbursement and life insurance benefit for death caused by chronic conditions etc. described there are excluded.
  32. (2) Insurance Renewal
  33. When premiums are paid by the termination date, the corresponding date of the previous inception year of the previous policy inception shall be the effective date of the renewed policy.
  34. In short-term policy, even after renewal, medical payment reimbursement and life insurance benefit for death caused by chronic conditions etc. described in Appendix 3 are not eligible for benefit reimbursement.

  37. Annual plan is the basic insurance plan. Short-term plan for 1, 2, 3 and 6 months also can be purchased.

  56. (2) Payment of Premiums
  57. 1. Premiums shall be received by VIVA VIDA Co., Ltd. for bank transfers or convenience store payments after receiving application form. Invoice for premium payment is sent for convenience store payments. Predetermined premium payments shall be completed immediately after receiving the invoice.
  58. 2. Premiums for annual plans can also be paid in from 2 up to 6 installments. For short-term plan, 6 month plans in up to 2 installments, other plans 1 time payment only.

  61. VII. Disbursement
  62. No disbursement to policyholders.

  64. VIII. Cancellation Return
  65. (1) Policyholder has the right to cancel any forthcoming insurance policy.
  66. (2) If policyholder wishes to cancel an insurance policy, policyholder should submit the cancellation documentation designated by VIVA VIDA Medical Life Co., Ltd. In such case, the cancellation date shall be the date when VIVA VIDA Medical Life Co., Ltd. receives the cancellation documentation and will refund the premiums based on the percentage table below. However, the premiums paid within the month of such cancellation will not be refunded.

  68. Pre-term Cancellation
  69. Cancellation return (rounding off the sum following JPY decimal point) shall be determined by multiplying the one-time premium payment by the following percentage depending on the policy term and the lapsed months (less than one month shall be round up to one month) from the inception date and the cancellation date of the policy.

  147. IX. Joining the Insurance Plans, Membership Requirements
  148. 1. Person of foreign nationality owning a passport visiting or residing in Japan can purchase the insurance policy.
  149. 2. This plan may be purchased only as a supplement to VIVAMED-A (LIFE+SPECIFIED DISABILITY+HEALTH) or VIVALIFE-A (LIFE+SPECIFIED DISABILITY).

  159. Confirmation of Information Calling for Attention
  160.  
  161. This “Information Calling for Attention” is an explanation of the important clauses which especially require your attention. Please ensure to read this for confirming and understanding the content when you apply for the insurance. Also, please store this stipulation together with the insurance policy certificate in a safe place. This documentation does not cover all the necessary items for the insurance policy. For details, please confirm with “General Insurance Terms and Conditions”. If you have any questions, please do not hesitate to contact us.

  163. I. Cooling Off (Withdrawal of Application)
  164. The applicant can withdraw or cancel the application if it is within eight days of completion of processing of application. VIVA VIDA Co. Ltd. will refund the paid amount. Please send a request in writing for withdrawal or cancellation within eight days of completion of processing of application.

  166. II. Obligation to Disclose
  167. (1)Obligation to disclose means in the event when the applicant or customer makes a contract, he/she is obliged to disclose the personal information accurately without omission. It is necessary to send personal information only if there are revisions in the previous year content.
  168. (2)Declaration
  169. 1. Age
  170. 2. Policyholder of any life and/or health insurance
  171. 3. History of illness accompanied with operation and hospitalization
  172. 4. Requested or obtained any benefits from health insurance
  173. 5. Present health situation
  174. 6. History of chronic illness (if ever)
  175. 7. Occupation
  176. (3)When a policyholder or insured person with the intent or serious fault of negligence is found to have made a false or misleading statement within the application form, the application will be rejected and benefits will not be reimbursed; and the contract will be cancelled. In such case, the paid premium would not be refunded.

  178. III. Obligation to Inform
  179. (1)Obligation to inform means
  180. In case of any revisions in the application form and contract detail after making the contract, the policyholder is required to inform VIVA VIDA Co. Ltd. Premiums may not be refunded if the policyholder fails to notify.
  181. (2)Notification when the following occurs
  182. 1. Revisions of policyholder or insured person’s residential or contact address
  183. 2. Revisions of policyholder or insured person’s name
  184. 3. Revisions of insured person’s passport number
  185. 4. Revisions in insurance beneficiary
  186. 5. Occupation
  187.  
  188. IV. Starting Period of Coverage
  189. 1. Inception shall start at midnight of the day following that on which VIVA VIDA Co., Ltd. received premium payment. When the effective date is designated and premium payment has been done, inception shall start at midnight on the designated commencement date.
  190. 2. The termination of the period covered shall be at noon on the insurance termination date described in the insurance policy.
  191.  
  192. V. Exclusions of Coverage
  193. Aside from the escape clauses written below, if there is cancellation due to an obstruction of the obligations to disclose, a serious reason, or termination due to unpayable premium installments, he/she will not be eligible to receive benefits. Please verify the details of the General Insurance Terms and Conditions.
  194. (1)Exclusions
  195. 1. Dental care or treatment
  196. 2. Pregnancy, childbirth, and/or complications relating thereof (Sterilization operation, miscarriage, abortion, and etc.).
  197. 3. Emotional disorders, mental deficiency, personality abnormality, alcohol dependency, chemical dependency and any other mental disorders, brain disorders and related illness.
  198. 4. Injuries or injury deaths caused by incidents where insured person was under the influence of alcohol. Acute alcoholic intoxication.
  199. 5. Dialysis, hepatitis, cirrhosis, organ transplant, varicosity, and all treatments relating to body hair.
  200. 6. Traffic accidents and other accidents onboard motor vehicles including cars, motorcycles, snowmobiles, motorboats (including jet bikes), go-carts, and other vehicles of the same sort.
  201. 7. Accident by high-risk sports(during diving, bungee jumping, bobsled, luge, snowboarding, American football, soccer, futsal, rugby, basketball, mountain climbing, motor racing, boxing, judo, karate, martial arts and other professional sports).

  203. VI. Renewal
  204. 2 months prior to the insurance policy termination date, VIVA VIDA Co., Ltd. will dispatch the policy renewal and premium payment documentations (Notification of Renewal) to the policyholder.
  205. If there is no request from the policyholder receiving the Notification of Renewal, automatically this is regarded as policy renewal with the same condition of the previous inception year and the renewal is accepted after receiving the premium payment.
  206. If revisions are to be made, items shall be specified and informed to VIVA VIDA Co., Ltd.
  207. VIVA VIDA Co., Ltd. may review the undertaking condition of policy renewal and insurance premium, or reject policy renewal if the company considers the concerned insurance policy to be unprofitable.
  208. Policy renewal notices will not be dispatched for short-term insurance policies.
  209.  
  210. VII. Contract Termination, Grace period, etc
  211. 1. Insurance policy will be terminated in the case installment payments is in arrears beyond the grace period (two months from the due date).
  212. 2. If the premium is paid later than eight days following the termination date, renewal application will be void and the concerned policy will be considered as a new policy.
  213. 3. Acceptance of policy renewal with all or part of the following conditions based on the status of insurance claim, benefit reimbursements or content of revisions upon policy renewal.

  220. VIII. Protection Mechanism
  221. We are Small Amount and Short Term Insurance Company. It is not a contract to provide financial aid or coverage of the policyholders protection corporation based on the Insurance Business Law in the event of bankruptcy.

  223. IX. Others
  224. 1. The company has been registered by the Office of the Prime Minister as a Small Amount and Short Term Insurance Company intended for non-Japanese residents visiting or residing in Japan according with Insurance Business Law. The company conducts operations in accordance with all Japanese Laws and our General Insurance Terms and Conditions.
  225. 2. All business operations relating to insurance services shall be conducted in accordance with the insurance conditions written in Japanese. All documentations translated into other languages are for reference purpose only. These terms and conditions will be constantly reviewed and are subject to change. All Revisions are applicable upon renewal of the insurance policy.
  226. 3. The premium is not an object for tax deductions and allowances.
  227. 4. One policyholder can purchase insurance up to 100 insured persons.
  228. 5. Overlapping insurance policies is not permitted.
  229. 6. The company insurance maximum benefits limit for policy undertaking is 10 million JPY per person in total. And the insurance period of our insurance is regulated as 1 year based on the 5th clause of Article 1 of the Insurance Business Law Order for Enforcement, and maximum benefits limit of our company is determined as follows based on the 6th clause of Article 1 of the same law: 3 million JPY for the life insurance (excluding death due to injury), 800,000 JPY for the health insurance, 6 million JPY for disability insurance due to injury, and 6 million JPY for the life insurance (death due to injury). However, by use of the interim measure in additional of Article 3 and 1st clause of additional Article 16 of the amended Insurance Business Law; the maximum benefits limit of our company until March 31st, 2013 is determined as follows: 5 million JPY for the life insurance (excluding death due to injury), 2 million JPY for the health insurance, 10 million JPY for disability insurance due to injury, and 10 million JPY for the life insurance (death due to injury).
  230. 7. Increase in premiums during the covered period
  231. If the total amount of benefit reimbursement wields significant impact on the computational foundation of the insurance, and VIVA VIDA Co., Ltd. determines that the company management will run into severe difficulties, VIVA VIDA Co., Ltd. shall require to increase premiums and/or to reduce maximum limit of benefits during the covered period.
  232. 8. Benefit reduction during the covered period
  233. If the total amount of benefit reimbursement wields significant impact on the computational foundation of the insurance, and VIVA VIDA Co., Ltd. determines that the company management will run into severe difficulties, VIVA VIDA Co., Ltd. shall require a reduction of the payable benefits during the covered period.
  234. 9. New service to provide solutions to product/service related problems
  235. On our desire to provide and offer high-quality service to our valued clients, a customer service center operated by the Small Amount and Short Term Insurance Institute of Japan will be available to accommodate complaints from the clients.

  258. Adopting agent and handling of group contract, we may provide agents and groups with customer’s personal information for the execution of the purposes described in (1) above.

  274. I.Features of our plan
  275. Our insurance plan is for non-Japanese visiting or residing in Japan which covers life, specified disability, and medical treatment. Upon illness or injury, specified disability or death caused by illness or injury within Japan, the company will reimburse the coverage.

  277. II. Coverage
  278. (1) Payable Benefits
  279. The summary of major payable benefits is as follows. Please confirm the details in the General Insurance Terms and Conditions
  280. 1. Life Insurance
  281. A) Injury Death
  282. Benefits will be paid when the insured person dies inside Japan within 180 days from physical injuries inflicted by cause of unforeseen accidents inside Japan, which occurred within the covered period.
  283. B) Common Death
  284. Benefits will be paid when the insured person dies inside Japan from incidents inside Japan caused by reasons other than what is mentioned in A) above, within the period covered and 8 days after the effective date of the new policy.
  285. 2. Specified Disability Benefits
  286. Benefits will be paid when the insured person is stricken with a specified disability within 180 days from the physical injury(s) inflicted by unforeseen accidents which occurred inside Japan within the period covered.
  287. 3. Medical Benefits
  288. Payments to a medical institution needed for the physician’s diagnosis or treatment of the policyholder (or the insured) will be reimbursed for the symptoms occurring inside Japan within the period covered based on the point system for the medical cost (one point of the medical service fee points will be converted to 10 (ten) JPY).
  289. The maximum limit for reimbursement is two million JPY (one million JPY for the short term plan and a new member age of 56 years old and above) in total for a policy year.
  290. ① Coverage for each illness or injury is limited up to 180 days from the first day of medical consultation or the physical injury(s) inflicted by accidents.
  291. ② In the event of a recurrence of an illness after treatment or a period in excess of 3 weeks between treatments, VIVA VIDA Co., Ltd. will have the right to determine whether such illness shall be covered and the extent of coverage based on the continuity of the illness based on the medical diagnosis of the physician.
  292. ③ Medical expenses include charges for the first and subsequent consultations and related charges for tests, treatment, prescriptions, and hospitalization (limited to items eligible to be covered by the regulation of the public medical insurance system). Price differences in bed rental expenses, meal expenses, and miscellaneous personal expenses are excluded.
  293. ④ One point of the medical service fee points for rehabilitation fees will be converted to 5 (five) JPY to be eligible for benefit reimbursements.
  294. ⑤ One point of the medical service fee points for the treatment of inguinal hernia with onset time after 120 days of inception will be converted to 5 (five) JPY to be eligible for benefit reimbursements.
  295. ⑥ All fees of 10,000 JPY and over in total for a particular injury or illness will be covered by our medical benefit.
  296. ⑦ In case the insured person joins Japanese Health Insurance or Social Insurance Schemes, personal expense public healthcare insurance deductions applied accordingly if relevant, and the balance shall be eligible for benefit reimbursements.

  298. (2) Unpayable Benefits
  299. As for unpayable benefits, please refer clause V. in “Information Calling for Attention”.

  303. 2. In addition to the documents mentioned in III.1.(above), other documentation may be required for the claim of benefits.
  304. 3. In case the claim is reimbursable, we make payment within 20 working days from the date all the necessary documentation is obtained.
  305. 4. Unpaid premiums are subject to claim by VIVA VIDA Co., Ltd. upon benefit reimbursement.
  306. 5. Up to two people may be designated as life insurance beneficiaries. However, in principle family members up to two degrees of kinship are eligible.

  364. VIII. Cancellation Return
  365. (1) Policyholder has the right to cancel any forthcoming insurance policy.
  366. (2) If policyholder wishes to cancel an insurance policy, policyholder should submit the cancellation documentation designated by VIVA VIDA Medical Life Co., Ltd. In such case, the cancellation date shall be the date when VIVA VIDA Medical Life Co., Ltd. receives the cancellation documentation and will refund the premiums based on the percentage table below. However, the premiums paid within the month of such cancellation will not be refunded.

  460. Confirmation of Information Calling for Attention

  462. This “Information Calling for Attention” is an explanation of the important clauses which especially require your attention. Please ensure to read this for confirming and understanding the content when you apply for the insurance. Also, please store this stipulation together with the insurance policy certificate in a safe place. This documentation does not cover all the necessary items for the insurance policy. For details, please confirm with “General Insurance Terms and Conditions”. If you have any questions, please do not hesitate to contact us.

  464. I. Cooling Off (withdrawal of application)
  465. The applicant can withdraw or cancel the application if it is within eight days of completion of processing of application. VIVA VIDA Co. Ltd. will refund the paid amount. Please send a request in writing for withdrawal or cancellation within eight days of completion of processing of application.

  467. II. Obligation to Disclose
  468. (1) Obligation to disclose means in the event when the applicant or customer makes a contract, he/she is obliged to disclose the personal information accurately without omission. It is necessary to send personal information only if there are revisions in the previous year content.

  470. 1. Age
  471. 2. Policyholder of any life and/or health insurance
  472. 3. History of illness accompanied with operation and hospitalization
  473. 4. Requested or obtained any benefits from health insurance
  474. 5. Present health situation
  475. 6. History of chronic illness (if ever)
  476. 7. Occupation
  477. (3) When a policyholder or insured person with the intent or serious fault of negligence is found to have made a false or misleading statement within the application form, the application will be rejected and benefits will not be reimbursed; and the contract will be cancelled. In such case, the paid premium would not be refunded.

  479. III. Obligation to Inform
  480. (1) Obligation to inform means
  481. In case of any revisions in the application form and contract detail after making the contract, the policyholder is required to inform VIVA VIDA Co. Ltd. Premiums may not be refunded if the policyholder fails to notify.
  482. (2) Notification when the following occurs
  483. 1. Revisions of policyholder or insured person’s residential or contact address
  484. 2. Revisions of policyholder or insured person’s name
  485. 3. Revisions of insured person’s passport number
  486. 4. Revisions in insurance beneficiary
  487. 5. Occupation (in case corresponding occupation is specified in No.8 of the Statement of Health Condition)

  489. IV. Starting Period of Coverage
  490. 1. Inception shall start at midnight of the day following that on which VIVA VIDA Co., Ltd. received premium payment. When the effective date is designated and premium payment has been done, inception shall start at midnight on the designated commencement date.
  491. 2. The termination of the period covered shall be at noon on the insurance termination date described in the insurance policy.

  493. V. Exclusions of Coverage
  494. Aside from the escape clauses written below, if there is cancellation due to an obstruction of the obligations to disclose, a serious reason, or termination due to unpayable premium installments, he/she will not be eligible to receive benefits. Please verify the details of the General Insurance Terms and Conditions.
  495. (1) Medical Benefit Exclusions
  496. 1. Traffic accidents, accidents during commuting or work, and accidents or illness caused by work.
  497. 2. Treatment of expresses subjective symptoms with no objective observations.
  498. (2) General Exclusions
  499. 1. Dental care or treatment
  500. 2. Pregnancy, childbirth, and/or complications relating thereof (Sterilization operation, miscarriage, abortion, and etc.).
  501. 3. Emotional disorders, mental deficiency, personality abnormality, alcohol dependency, chemical dependency and any other mental disorders, brain disorders and related illness.
  502. 4. Injuries or injury deaths caused by incidents where insured person was under the influence of alcohol. Acute alcoholic intoxication.
  503. 5. All plastic surgeries, dialysis, hepatitis, cirrhosis, organ transplant, varicosity, and all treatments relating to body hair.
  504. 6. Astigmatism, nearsightedness, farsightedness, other vision correction treatments, and illness, injury, or death caused by such treatments.
  505. 7. Poor circulation, menstrual pains, irregular menstruation, constipation, anemia, allergies and pollen allergies.
  506. 8. Menopausal disorders, presbyopia, cataracts, glaucoma, hypacusia, tinnitus, incontinence, osteoporosis, muscular fragility, osteoarthritis, geroderma conditions, and any other ailments diagnosed by the physician as related to advanced age for 40 years old and above.
  507. 9. Traffic accidents and other accidents onboard motor vehicles including snowmobiles, motorboats (including jet bikes), go-carts, and other vehicles of the same sort.
  508. 10. Accident by high-risk sports(during diving, bungee jumping, bobsled, luge, snowboarding, American football, soccer, futsal, rugby, basketball, mountain climbing, motor racing, boxing, judo, karate, martial arts and other professional sports).

  510. VI. Renewal
  511. 2 months prior to the insurance policy termination date, VIVA VIDA Co., Ltd. will dispatch the policy renewal and premium payment documentations (Notification of Renewal) to the policyholder.
  512. If there is no request from the policyholder receiving the Notification of Renewal, automatically this is regarded as policy renewal with the same condition of the previous inception year and the renewal is accepted after receiving the premium payment.
  513. If revisions are to be made, items shall be specified and informed to VIVA VIDA Co., Ltd.
  514. VIVA VIDA Co., Ltd. may review the undertaking condition of policy renewal and insurance premium, or reject policy renewal if the company considers the concerned insurance policy to be unprofitable.
  515. Policy renewal notices will not be dispatched for short-term insurance policies.

  517. VII. Contract Termination, Grace period, etc
  518. 1. Insurance policy will be terminated in the case installment payment is in arrears beyond the grace period (two months from the due date).
  519. 2. If the premium is paid later than eight days following the termination date, renewal application will be void and the concerned policy will be considered as a new policy.
  520. 3. Acceptance of policy renewal with all or part of the following conditions based on the status of insurance claim, benefit reimbursements or content of revisions upon policy renewal.

  523. VIII. Protection Mechanism
  524. We are Small Amount and Short Term Insurance Company. It is not a contract to provide financial aid or coverage of the policyholders protection corporation based on the Insurance Business Law in the event of bankruptcy.

  526. IX. Others
  527. 1. The company has been registered by the Office of the Prime Minister as a Small Amount and Short Term Insurance Company intended for non-Japanese residents visiting or residing in Japan according with Insurance Business Law. The company conducts operations in accordance with all Japanese Laws and our General Insurance Terms and Conditions.
  528. 2. All business operations relating to insurance services shall be conducted in accordance with the insurance conditions written in Japanese. All documentations translated into other languages are for reference purpose only. These terms and conditions will be constantly reviewed and are subject to change. All Revisions are applicable upon renewal of the insurance policy.
  529. 3. The premium is not an object for tax deductions and allowances.
  530. 4. One policyholder can purchase insurance up to 100 insured persons.
  531. 5. Overlapping insurance policies is not permitted.
  532. 6. The company insurance maximum benefits limit for policy undertaking is 10 million JPY per person in total. And the insurance period of our insurance is regulated as 1 year based on the 5th clause of Article 1 of the Insurance Business Law Order for Enforcement, and maximum benefits limit of our company is determined as follows based on the 6th clause of Article 1 of the same law: 3 million JPY for the life insurance (excluding death due to injury), 800,000 JPY for the health insurance, 6 million JPY for disability insurance due to injury, and 6 million JPY for the life insurance (death due to injury). However, by use of the interim measure in additional of Article 3 and 1st clause of additional Article 16 of the amended Insurance Business Law; the maximum benefits limit of our company until March 31st, 2013 is determined as follows: 5 million JPY for the life insurance (excluding death due to injury), 2 million JPY for the health insurance, 10 million JPY for disability insurance due to injury, and 10 million JPY for the life insurance (death due to injury).
  533. 7. Increase in premiums during the covered period

If the total amount of benefit reimbursement wields significant impact on the computational foundation of the insurance, and VIVA VIDA Co., Ltd. determines that the company management will run into severe difficulties, VIVA VIDA Co., Ltd. shall require to increase premiums and/or to reduce maximum limit of benefits during the covered period.
  535. 8. Benefit reduction during the covered period

If the total amount of benefit reimbursement wields significant impact on the computational foundation of the insurance, and VIVA VIDA Co., Ltd. determines that the company management will run into severe difficulties, VIVA VIDA Co., Ltd. shall require a reduction of the payable benefits during the covered period.
  537. 9. New service to provide solutions to product/service related problems
  538. On our desire to provide and offer high-quality service to our valued clients, a customer service center operated by the Small Amount and Short Term Insurance Institute of Japan will be available to accommodate complaints from the clients.

  561. Adopting agent and handling of group contract, we may provide agents and groups with customer’s personal information for the execution of the purposes described in (1) above.
