  16. License Suspension and Revocation
  17. A person who operates a motor vehicle and accumulates three (3) points on their driver's license shall have their license suspended for a duration of forty-eight (48) hours.
  18.  
  19. If a person operates a motor vehicle and accumulates five (5) points on their driver's license, their vehicle shall be impounded, and their license will be revoked. ((After revocation, a new license cannot be obtained for 48 hours.))

  21. Points on a driver's license will expire every two (2) weeks, or they will be automatically removed upon license revocation.

  23. Officer Discretion
  24. Any peace officer with probable cause to make a vehicle stop or otherwise detain another person under the Louisiana Vehicle Code, as listed below, may use their discretion when issuing an infraction or points on the license of the person operating the vehicle, except when the vehicle operator is acting in an unsafe manner.

  28. DIVISION 1....... VEHICLE REGISTRATION AND TITLE CERTIFICATES

  30. Violation of Vehicle Registration
  31. (a) A person who operates, moves, or leaves a vehicle standing on a public road that has not been registered within the State of Louisiana shall be issued an infraction of $280 and may have their vehicle impounded at the officer's discretion.
  32. (b) A person who operates a motor vehicle without a valid license plate visibly displayed while on a public roadway shall be issued an infraction of $240 and may have their vehicle impounded at the officer's discretion.

  37. DIVISION 2....... DRIVER'S LICENSE

  39. Operating without a Valid License
  40. (a) A person who operates, moves, or otherwise uses a vehicle on any public road without being in possession of an active and valid driver's license issued by the state is in violation of the law, punishable by a sentence of 30 minutes, and may have their vehicle impounded at the officer's discretion.

  42. (b) A person who operates, moves, or otherwise uses a vehicle on any public road with an expired driver's license shall be issued an infraction of $250.

  44. Driving with a Suspended License
  45. A person who operates, moves, or otherwise uses a vehicle on any public road with a suspended, but otherwise valid, driver's license issued by the state shall be issued an infraction of $300 and have their driver's license revoked.

  47. Violation of Learner's Permit Requirements
  48. (a) A person who is between the ages of 16 and 18 and has not successfully completed an automobile driver education course approved by the state, and who operates, moves, or otherwise uses a vehicle on any public road without a valid learner's permit, shall be issued an infraction of $200 and have their learner's permit revoked.

(b) A person who is between the ages of 16 and 18 and has successfully completed an automobile driver education course approved by the state, and who operates, moves, or otherwise uses a vehicle on any public road without being accompanied by an adult who is 18 years of age or older and holds a valid driver's license, shall be issued an infraction of $130 and have their learner's permit revoked.

  61.  
  62. A person who drives, moves, or otherwise uses a vehicle on any public road without valid motor insurance shall be issued an infraction of $200 and may have their vehicle impounded at the officer's discretion.

  72. DIVISION 4....... ROADWAY REGULATIONS

  74. Speed Limit Violation
  75. (a) Any individual operating a motor vehicle on a roadway within a business district or residential area at a speed exceeding 40 MPH shall receive a citation of $120 and have one point added to their driver's license.
  76.  
  77. (b) Any individual operating a motor vehicle on a roadway outside a business district or residential area at a speed exceeding 65 MPH shall receive a citation of $150 and have one point added to their driver's license.
  78.  
  79. (c) Any individual operating a motor vehicle on a public highway at a speed exceeding 90 MPH shall receive a citation of $175 and have two points added to their driver's license.

  81. (d) Any individual operating a motor vehicle at a speed that is unreasonable considering weather conditions, visibility, and traffic on any public roadway shall receive a citation of $200 and have two points added to their driver's license.

  83. Failure to Yield Right-of-Way
  84. Any individual operating a motor vehicle who fails to yield or give right-of-way to another driver at an intersection shall receive a citation of $235.
  85.  
  86. The first vehicle arriving at an intersection has the right-of-way. Additionally, any vehicle already within an intersection has the right-of-way.

  88. Disregarding Emergency Vehicles
  89. Any individual operating a motor vehicle who fails to yield the right-of-way and immediately move to the right-hand side of the road, clear of any intersection, for any emergency vehicle with active sirens and displaying red or blue lights shall receive a citation of $490.
  90.  
  91. Ignoring Traffic Control Devices
  92. Any individual operating a motor vehicle who disregards any sign, signal, or other traffic control device, including stop signs, traffic lights, pedestrian crosswalks indicated by solid white lines at an intersection, and instructions from a peace officer or construction worker, shall receive a citation of $240.

  94. Illegal Parking
  95. Any individual who stops, parks, or leaves their vehicle standing, whether attended or unattended, in any of the following places shall receive a citation of $95:
  96.  
  97. Blocking an intersection, alleyway, crosswalk, or any public roadway, impeding traffic flow.
  98. Obstructing more than two-thirds of a sidewalk or pedestrian path.
  99. Parking against the direction of traffic flow.
  100. On any median.
  101. Inside a tunnel.
  102. Adjacent to or obstructing any fire hydrant.
  103. On railroad tracks or within the potential range of a collision with a railroad car.
  104. Within the immediate ambulatory parking or bay area of a hospital or clinic.
  105. In front of or obstructing a private driveway or an entrance/exit to a private road or path.
  106. Parking regulations on private property are subject to the policies set by property owners or authorized property managers, as long as they do not obstruct public roads or sidewalks. State agencies, such as the Louisiana State Police (LSP) and others, may establish parking rules for the facilities they manage.

  108. Excessive Vehicular Noise
  109. Any individual whose vehicle emits excessive noise causing a public nuisance shall receive a citation of $100.
  110.  
  111. Examples include modifications that increase the noise pollution of a vehicle or the excessive use of a vehicle horn or siren without justifiable purpose.

  113. Unauthorized Use of Hydraulics
  114. Any individual operating a motor vehicle on any public roadway who uses hydraulic equipment while in motion shall receive a citation of $100.
  115.  
  116. Unsafe Bicycle Operation
  117. An individual who uses a bicycle or any other self-propelled vehicle in a manner that obstructs traffic, incites disorder, creates a hazard, or demonstrates the potential for harm shall receive a citation of $200.

  119. Jaywalking
  120. Any individual who crosses between adjacent intersections controlled by traffic control signal devices or by peace officers at any place on the roadway, except in a crosswalk, shall receive a citation of $195.

  122. Engaging in Speed Contests
  123. An individual who participates in a motor vehicle speed contest on any public roadway shall receive a citation of $550.

  125. In this context, a motor vehicle speed contest includes racing against another vehicle, a clock, or any other timing device.

  129. DIVISION 5....... VEHICLE EQUIPMENT

  131. Window Tint Violation
  132. Any individual who operates a motor vehicle with obstructive material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows shall receive a citation of $195.

  136. Driving Without Headlights
  137. An individual operating a motor vehicle during darkness without using headlights shall receive a citation of $230.
  138.  
  139. Operating an Unsafe Vehicle
  140. Any individual driving a motor vehicle with any of the following on any public road shall receive a citation of $240:

  142. (a) Flat or missing tire.

  144. (b) One or both taillights damaged or not functioning.

  146. (c) Missing any door, hood, or trunk lid.

  148. (d) Driving with any door, hood, or trunk in an open position.

  152. DIVISION 6....... VEHICLE SAFETY REGULATIONS
  153.  
  154. Failure to Wear a Helmet
  155. A driver and any passenger operating or riding on a motorcycle or motorized bicycle without a safety helmet shall receive a citation of $250.
  156.  
  157. Unsafe Riding and Towing
  158. Any individual operating a vehicle capable of towing or carrying another vehicle who fails to do so in a safe manner, such as but not limited to speeding with a load, failing to yield where required, allowing a passenger to ride on the trailer or in the vehicle being towed or carried, or if the vehicle or operation is otherwise unsafe on the road, shall receive a citation of $240.

  160. Reckless Operation of Machinery / Off-Road Vehicles
  161. Any individual who operates any machinery or off-road vehicle, such as the following, on any public road shall receive a citation of $140:
